A regular meeting of the Southold~Town Board of Appeals was held at the Town Clerk's Office, $outhold, New York, on Thursday, December 4, 1958, 1958, at 7:30 P.M. There were present: Messrs. Robert W. Gillispie, Jr., Chairman, Robert Bergen, Herbert Rosenberg and Charles Gregonis, Jr. Also present: Mr. Howard M. Terry, Building Inspector. PUBLIC HEARING: Appeal No. 122, Application of ALEXANDER BLASCHAK, for a variance in accordance with the Zoning Ordinance Article iV, Section 400, for permit to use for residential purposes pmoperty located on the east side of New Suffolk Lane, Cutchogue, N.Y. Fee Paid~$15.00. Chairman opened the hearing by reading application for the variance, notice of disapproval issued to applicant by the Building Inspector and legal notice of hearing with affidavit attesting to its publication in the official newspaper. Howard Terry showed a sketch of the property and Chairman: "Is there anyone present who wishes to described same. speak for this application?" Mr. Howard Terry showed a sketch of the property and described same. Mr. & Mrs. Blaschak spoke and stated that they wished to use the upstairs for residential purposes, on a building now used as a garage and for storage purposes. Mr. Blaschak stated that the property was bounded on the North by Overrun; South by Hutton; east by Billard and West by New Suffolk Ave. Mrs. Blaschak stated that they did not intend to transfer the property. .Resolution offered by Mr. Rosenberg, seconded by Mr. Bergen, WHEREAS, the application of ALEXANDER BLASCHAK, having been considered at Public Hearing No. 122, on December 4, 1958, and the Board finding that strict application of the Ordinance would produce undue hardship because the building meets all the requirements for residential purposes except the north side line. The situation is unique because it is a larger lot than the neighboring lots and is the only one not used for residential purposes. The public convenience and welfare and justice.~will be sub- stantially served, and the legally established or permitted use of neighborhood ~K?perty and adjac~n~ use districts would not be substantially or permaued~/m~ured and the spmrzt of the ordinance would be observed. BE IT RESOLVED that the application be granted with the condition that the two foot (2') side yard on the north side presently existing on this building may not be construed as permissable in the event the present building is altered.
