Re: Egress Windows for Don Tison, 170 Laurel Ave. Southold.
Dear Mr. Fish,
This letter is to confirm that the second level bedroom windows of the renovation
project at 170 Laurel Avenue, Southold meet the New York State Building code
standards related to emergency escape and rescue. The standards are found in Section
1009 of the code.
These standards in 1009.2 & 1009.2.1 require that the net clear opening be 5.7
square feet, the net width not be less then 20 inches and net height be no less then 24
inches. The code in section 1009.4 regarding operational constraints, specifies that
windows shall be operational from the inside of the room without the use of key or tool,
or force greater then that which is required for normal operation. This section permits
bars, grills, grates, or similar devices to be installed over the opening and requires them to
be releasable or removable without key or tool or force greater then that which is required
for normal operation of the escape and rescue opening. The code in this section also
requires-smoke alarms to be installed following Section 907.2.10 when such windows
under this section are installed.
Including the installation of smoke alarms, these windows meet the standards
during normal operations by their function of sliding to the jamb bottom and tilting in,
without the use of tools or keys or force greater then required for normal operation. The
net-opening height is 37.5 inches and 28 inches wide creating a net opened area of 7.29
square feet.

MEETING OF MAY 12, 2005

Property Location: 170 Laurel Avenue, Southold CTM 56-3-4
SEQRA DETERMINATION: The Zoning Board of Appeals has visited the property under
consideration in this application and determines that this review falls under the Type II category of
the State's List of Actions, without an adverse effect on the environment if the project is implemented
as planned.
PROPERTY FACTS/DESCRIPTION: The applicant's 9,540 sq. ft. parcel has 100 feet along Laurel
Lane and is improved with a 1-%2 story frame dwelling with shed as shown on the April 26, 1995
survey prepared by Roderick VanTuyl, P.C.
BASIS OF APPLICATION: Building Department's February 28, 2005 Notice of Disapproval, citing
Section 100-242A in its denial of an application for a building permit to construct an addition, for the
reason that the new construction will increase the degree of nonconforming with a front yard at less
than the code-required 35 feet.
FINDINGS OF FACT
The Zoning Board of Appeals held a public hearing on this application on May 4, 2005 at which time
written and oral evidence were presented. Based upon all testimony, documentation, personal
inspection of the property, and other evidence, the Zoning Board finds the following facts to be true
and relevant:
AREA VARIANCE RELIEF REQUESTED: The applicant wishes to construct additions to the
existing dwelling, the front portion of which is proposed within the 35 ft. restricted front yard setback
area, as shown on the 1/23/05 diagram drawn by John F. Barkiski, P.E. The new 4' deep front
change involves an increased height affecting an existing 74 sq. ft. of floor space, approximately 3.3
feet higher than the lower, front one-story section. Also proposed is an increase in the existing
overall height, increased from 20 ft. 3-1/16th inches to 23 ft 9-3/16th inches to the top of the highest
ridge of the new construction. The setback is shown at a minimum of 31 ft. from the front lot line for
the new, second-level construction roof area.
REASONS FOR BOARD ACTION: On the basis of testimony presented, materials submitted and
personal inspections, the Board makes the following findings:

1. Grant of the variance will not produce an undesirable change in the character of the
neighborhood or a detriment to nearby properties. The applicant's home is the only 1%2 story home
among larger, two-story homes in the neighborhood along Laurel Avenue. The setback is proposed
to be increased to a minimum of 31 feet with the new two-story construction. The existing setback is
27 feet at its closest point from the front lot line, which will remain at an one-story level. ; a

2. The benefit sought by the applicant cannot be achieved by some method, feasible for the
applicant to pursue, other than an area variance. This particular house was built parallel to the front
property line, which places the house on a 30 degree, angle to the side property line. This angled
location leaves little to no room for expansion, and the logical choice is to build up over the existing
first floor area.
3. The variance granted herein is not substantial.
4. The difficulty was self-created when the applicant purchased the lot knowing the tight side and
front yard tolerances.
5. No evidence has been submitted to suggest that a variance in this residential community will
have an adverse impact on the physical or environmental conditions in the neighborhood.
6. Grant of the requested relief is the minimum action necessary and adequate to enable the
applicant to enjoy the benefit of an addition, while preserving and protecting the character of the
neighborhood and the health, safety and welfare of the community.
RESOLUTION OF THE BOARD: In considering all of the above factors and applying the balancing
test under New York Town Law 267-B, motion was offered by Member Orlando, seconded by
Chairwoman Oliva, and duly carried, to
GRANT the variance as applied for, as shown on the 1/23/05 and 2/13/05 elevation and floor
diagrams prepared by John F. Barkiski, P.E., and setbacks shown on the April 26, 1995
survey prepared by Roderick VanTuyl, P.C.
This action does not authorize or condone any current or future use, setback or other feature of the
subject property that may violate the Zoning Code, other than such uses, setbacks and other
features as are expressly addressed in this action.
Vote of the Board: Ayes: Members Oliva (Chairwoman), Orlando, Dinizio, and Simon. Member

Dear Patricia,
Thank you for your time once again this past Friday, it was late afternoon and your
time was greatly appreciated Please find attached our application for a building permit to
complete repairs and alteration of our home at 170 Laurel Avenue.
As we discussed, we are repairing our old home and this has required us to replace the
second floor roof system. The old roof, built during the 1800's was becoming unsound.
The new roof system, designed to comply with current building codes regarding structure
and egress makes our home safe and will also allow us to insulate and vent the structure
which was not possible before.
The new taller roof begins 31 feet from the street line. You noted that there is an
exception in the code that allows for a reduced set back. At that time I believed that we
met all the standards of the required set backs without having to use the exception
standards.
Once,reviewed the survey given to us when we purchased our property, indicated that
the increased roof height on the front of our home did not meet the 35 feet setback from
the street line. It should be noted that our home being only twenty-seven feet from the
street line, measures thirty-six feet to the actual pavement of Laurel Ave. This indicates
that the pavement line of Laurel Avenue is nine feet past our front lot line or street line.
I returned to your offices for a second time and we discussed the actual location of our
roof alteration and its proximity to laurel Avenue. You showed me the exemption
standards that allowed a reduced set back in older neighborhoods. We briefly discussed
how those standards might apply to our situation. Questions arose regarding a rear or
flag lot directly behind ours with its principal building lying within three hundred feet of
our new roof structure. It was not clear at that time the impact if any the flag lot.may have
upon the exemption standards. The standards were within the Southold town code and
found within section 100-230, Exceptions and modifications.

Attached are surveys of our property and of our neighbors flag lot directly behind us
and a Plan of Lower Laurel Ave stamped by a licensed Engineer. The Plan of Lower
Laurel Ave demonstrates our compliance with the standards found within section 100-
230. This section reads as follows:
Section 100-230, Exceptions and modifications.
"A. Established front yard setback. Where property in the vicinity is
improved with principal buildings with front yards of less than that required by
the provisions of this chapter, the front yard setback shall be the average
setback of the existing buildings within three hundred (300) feet of the
proposed building on the same side of the street within the same use district."
Two existing buildings fall within these standards. The first is our home lot, number
4 on the tax map. The survey shows our existing home is twenty-seven feet, (27') from
the street line. The second building is located on lot 3 on the plan. The plan shows that it
measures thirty-two feet from the paved portion of Laurel Ave to the front of the home.
This measure although conservative, proves our alteration meets the town code. Together
an average of twenty-nine feet and six inches becomes the required front setback for any
new construction on our property. This is closer to the street then our alteration is and this
measure would be decreased if we were to use the actual street line for lot 3.
Three properties shown on the Plan of Lower Laurel Ave do not meet the threshold of
the section above and thus are not used in the averaging. First, The Lot Labeled N/F J
Poliwoda and its principal building are beyond the 300' requirement. Second, the lot
Labeled N/F Haesch, lot 5 is excluded from the averaging because the home fronts on the
Main Road. Third, the lot labeled N/F Witzke lot 2.3 fronts on our back yard lot line and
it's own accessway and is excluded as it does not front on laurel Ave.
The Witzke lot is a flag or back lot with access to Laurel Ave via an access way. All
principal buildings within a flag lot must meet the codes required front yard set back.
That front lot line is the front lots, rear property lot line. See Town Code Section 100-
100-235 (B) . That section in part reads as follows:
"The front yard of any lot having access to a street by means of an accessway shall
be the required front yard specified for the district in which the lot is located and
shall be measured from the rear lot line to the front lot."
Therefore,the front yard set back for lot(2.3) is measured from their front lot line and
that line being the same line as our lot (4) and our side neighboring lot 3.) combined rear
lot lines. The code also defines "front lot line" this definition reads as follows: "LOT
LINE, FRONT -- The lot line separating a lot from a street right-of-way; also referred to
as "street line.""The front lot line is also defined as being the Street line.

The fact that the flag lot 2.3 has a defined street line that is not Laurel Ave is
further reinforced by the fact that the accessway is excluded from the lot area. The section
that excludes the accessway is section 100-235 (B). This section in part reads as follows:
Section 100-235 (B) "Residential rear or flag lots and accessways. Any rear lot or
flag lot occupied or to be occupied by a one-family dwelling shall have access
thereto by means of an accessway,having a width of not less than fifteen(15) feet,
serving only such lot. The area of the accessway shall not be included in
determining the area of any lot.
The code section shown above excludes a rear lots accessway from the lot area. The term
Lot area is further defined within the Town codes definition section. The Codes Lot Area
Definition reads as follows: "LOT AREA -- The area of a lot taken at its perimeter,
exclusive of any portion within a public or private street right-of-way."
The code defined "lot area" does not use the term "accessway" as is used in section 100-
235. However it uses the phrase " private street right of way". Therefore, the term
"accessway" as used in the section relating to rear lots, has the same meaning as "private
right of way." A right of way is used to access properties and yard and other
requirements are measured from them. The town code defines Right of way as follows:
RIGHT-OF-WAY LINES --The boundary lines of land used or intended for use as streets,
as shown on deeds,plats or the Master Plan, and from which yard and other requirements
shall be measured.
A private right of way ends at a certain point leading to a rear or flag lot.At that point
a line is formed separating the right of way from the remaining lot area. That line is the
Front lot line. The Town Code definition of Lot Line, Front is as follows: "LOT LINE,
FRONT -- The lot line separating a lot from a street right-of-way; also referred to as
"street line."" The front lot line is also defined as being the Street line. The Town Code
defines Street Line as follows: "STREET LINE -- The dividing line between a lot and a
street." Conclusively, Lot 2.3 does not front on Laurel Ave. Therefore it is not included in
averaging out our required set back for our Property.
In summary, Please accept our application for a building permit and issue a permit to
complete repair and alterations of our property. Our application conforms with the Town
of Southold Code requirements. Specifically, following section 100-230. The average set
back that we must meet is 29'6" ,twenty nine feet and six inches,
