In your letter you request that the Board revise the minimum rear yard setback allowed for the construction of the dwelling, as conditioned in their decision of January 23, 2020. You explain that the previously proposed second story deck has been eliminated. Furthermore, due to the property not located parallel with the house,the actual setback of the southern portion of the house from the rear yard property line, is not 43.7 feet, pursuant to alternative relief granted, but instead 42.7 feet, Accordingly,you ask that this Board revise their alternative relief to grant 42.7 feet rear yard setback. I reviewed your letter, survey, and the Zoning Board of Appeals determination, dated January 23, 2020; and have determined that your request is de minimus in nature because the change does not significantly increase the degree of non-conformity, and upholds the intent of ZBA Appeal No. 7362. Please submit to our office two signed and stamped surveys and architectural plans (elevations and floor plans) depicting improvements with the aforementioned changes. Due to the fact that the property is not parallel with the house the south end of the house is closer to the rear property line by 1 foot they the second-story portion of the house where the second story deck was eliminated. I believe the intention of the revised relief was to just remove the second story deck that was 4 feet deep. By quick calculation that would bring the relief from 39.73 to 43.7 feet. However, the actual portion of the house that would be closer to the rear yard is 42.76 feet.We kindly ask that the revised relief be changed to allow a setback of 42.7 feet instead of 43.7 feet.This would still eliminate the second story deck and not require us to modify the modular house footprint.We hope that you understand our situation and can revise the determination without the need for an additional public hearing. We tried to discuss this with you prior to the world getting shut down and unfortunately, I was not able to send this email out before the virus took its hold on the east end. SUFFOLK COUNTY ADMINISTRATIVE CODE: This application was not required to be referred to the Suffolk County Department of Planning under the Suffolk County Administrative Code Sections A 14-14 to 23. LWRP DETERMINATION: The relief, permit, or interpretation requested in this application is listed under the Minor Actions exempt list and is not subject to review under Chapter 268. PROPERTY FACTS/DESCRIPTION: The subject property is a nonconforming 20,871 square foot lot in the Residential R-40 Zoning District. The northerly property line measures 129.55 feet, the easterly property line measures 175.00 feet and runs adjacent to a 5 feet wide pedestrian Right of Way to the Long Island Sound owned by the adjacent property owner, the southerly property line measures 111.88 feet and the easterly property lines measures 142.28 feet to the existing driveway to the north of the property and 33.50 feet from the existing driveway to the south of the property totaling 175.78 feet which runs adjacent to Stars Road. The property is improved with a single family dwelling with a front porch, rear patio and a 10.2 ft. by 11.5 ft. shed located in the rear side yard as shown on the survey map prepared by Howard W. Young,LS, and last revised October 4,2019. BASIS OF APPLICATION: Request for Variances from Article XXIII, Sections 280-124 and the Building Inspector's July 31, 2019 Notice of Disapproval based on an application for a permit to demolish an existing dwelling and construct a new single family dwelling located less than the code required front yard setback of 40 feet; 2) located less than the code required rear yard setback of 50 feet; located at 3700 Stars Road, East Marion, NY. SCTM#1000-22-2-16. RELIEF REQUESTED: The applicant requests variances for a building permit to demolish an existing dwelling and construct a new modular single family dwelling and an attached on-site constructed garage. The proposed dwelling includes a wrap-around front porch, measuring 8 feet deep by 37.33 feet long with a return on the south side also measuring 8 feet in depth and a second story rear deck of 19.75 feet by 4 feet. The proposed construction, on this nonconforming 20,871 square foot lot in the Residential R-40 Zoning District, is not permitted pursuant to Page 2,January 23,2020 #7362,Caravanos SCTM No. 1000-22-2-16 Article XXIII, Section 280-124 which states; lots measuring 20,000-39,999 square feet in total size require a front yard setback of 40 feet and a rear yard setback of 50 feet. The survey prepared by Howard W. Young, last revised October 4, 2019 illustrates a proposed front yard setback of 34.58 feet and a rear yard setback of 39.73 feet. ADDITIONAL INFORMATION: No letters of support or against the project have been received by the Zoning Board of Appeals The applicant proposes to remove the old sanitary system and install a new Suffolk County Board of Health approved waste water system and is in the process of obtaining a permit for the existing 10.2 foot by 11.8 foot shed in the rear yard. The applicant has proposed to move the existing driveway from the present location on the southwest of the property adjacent to Stars Road to the northwest location of the property adjacent to Stars Road to better accommodate primary, first floor access from the proposed garage to the residence. The proposed new construction represents 16% lot coverage of the maximum 20% allowed by code. Included in proposed site plan, but not subject of a variance request in the installation of an in-ground pool in a compliant location. The owner and the owner's representative were asked why they could not move the location of the dwelling more southerly to eliminate a variance, and they stated they did not wish to change or amend the location. The applicant provided the following three comparable variances approved for similar relief requested: 1. Lot 1000-22-2-18: a) Appeal #5446, 12/18/03 granted alternative relief of 30 ft. rear yard setback for single family dwelling b) Appeal #5954, 10/05/06'granted variance of 31 ft. rear yard setback for sunroom addition to a single family dwelling c) Appeal#6459, 4/20/11 variance for swimming pool located in the side yard 2. Lot 1000-22-2-19: a) Appeal#2816, 5/14/81 variance to construct a new single family dwelling at having a front yard setback of 35 feet and a rear yard setback of 26 feet. FINDINGS OF FACT/REASONS FOR BOARD ACTION: The Zoning Board of Appeals held a public hearing on this application on January 2,2020 at which time written and oral evidence were presented. Based upon all testimony, documentation, personal inspection of the property and surrounding neighborhood, and other evidence,the Zoning Board finds the following facts to be true and relevant and makes the following findings: 1. Town Law X267-b(3)(b)(1). Grant of alternative relief will not produce an undesirable change in the character of the neighborhood or a detriment to nearby properties. Adjacent to the rear yard is a neglected 5 feet wide Right of Way to the Long Island Sound maintained by the owner of twelve acre waterfront parcel with large open space. Furthermore, the neighborhood is developed with similar setbacks and variances have been approved in the immediate neighborhood. 2. Town Law X267-b(3)(b)(2). The benefit sought by the applicant cannot be achieved by some method, feasible for the applicant to pursue, other than an area variance. The subject lot is narrow at 111.68 ft. in depth. If the code is applied to conform to the front and rear setbacks (40 feet and 50 feet) development potential would allow a house with only 21 ft. in width. 3. Town Law 4267-b(3)(b)(3). The variances granted herein are mathematically substantial, representing 13.5% from the code for the front yard setback and 20.6% relief from the code for rear yard setback. Alternative relief granted for the rear yard setback measuring 43.7 feet will be less substantial at 12.6% relief from the code. Many of the other homes in the neighborhood have front yard setbacks of 35 feet or less. The rear yard is adjacent to a 5 Page 3,January 23,2020 #7362, Caravanos SCTM No. 1000-22-2-16 ft. wide right of way and adjacent to that is a large undeveloped parcel. The applicant indicates an existing landscape block retaining wall adjacent to the rear yard property line will lesson any visual impact. 4. Town Law 4267-b(3)(b)(4). No evidence has been submitted to suggest that a variance in this residential community will have an adverse impact on the physical or environmental conditions in the neighborhood. The applicant must comply with Chapter 236 of the Town's Storm Water Management Code and remove the current sanitary system. 5. Town Law 4267-b(3)(b)(5). The difficulty has been self-created. The applicant purchased the parcel after the Zoning Code was in effect and it is presumed that the applicant had actual or constructive knowledge of the limitations on the use of the parcel under the Zoning Code in effect prior to or at the time of purchase. 6. Town Law &267-b. Grant of alternative relief is the minimum action necessary and adequate to enable the applicant to enjoy the benefit of a new-construction, two-story home with an attached one car garage while preserving and protecting the character of the neighborhood and the health, safety and welfare of the community. RESOLUTION OF THE BOARD: In considering all of the above factors and applying the balancing test under New York Town Law 267-B, motion was offered by Member Acampora , seconded by Member Dantes, and duly carried, to DENY relief as applied for,and GRANT ALTERNATIVE RELIEF as follows: • The front yard setback shall measure 34.6 feet • The rear yard setback shall measure 43.7 feet. SUBJECT TO THE FOLLOWING CONDITIONS: I. The applicant shall submit a revised survey and architectural drawings depicting the alternative relief granted. 2. The applicant shall obtain a certificate of occupancy from the Town of Southold Building Department for the existing shed located in the rear yard 3. Swimming Pool mechanicals shall be placed in a sound deadening enclosure. 4. Drywell for swimming pool de-watering shall be installed. That the above conditions be written into the Building Inspector's Certificate of Occupancy, when issued. Before q pplying for a building permit, the applicant or agent must submit to the Board of Appeals for approval and filing, two sets of the final survey and architectural drawings conforming to the alternative relief granted herein. The ZBA will forward one set of approved, stamped drawings to the Building Department. Failure to follow this procedure may result in the delay or denial of a building permit, and may require a new application and public hearing before the Zoning Board of Appeals. In the event that this is an approval subject to conditions, the approval shall not be deemed effective until such time that the foregoing conditions are met; and failure to comply therewith will render this approval null and void. Pursuant to Chapter 280-146(B) of the Code of the Town of Southold any variance granted by the Board of Appeals shall become null and void where a Certificate of Occupancy has not been procured, and/or a subdivision map has not been filed with the Suffolk County Clerk,within three (3) years from the date such variance was granted. FINDINGS OF FACT The Zoning Board of Appeals held a public hearing on this application on December 18, 2003, at which time written and oral evidence were presented. Based upon all testimony, documentation, personal inspection of the property, and other evidence, the Zoning Board finds the following facts to be true and relevant: AREA VARIANCE RELIEF REQUESTED: Applicant wishes to construct a single-family dwelling with a 35 ft. rear yard at the northerly end of the dwelling, and 23 feet at the southerly 2-story end of the dwelling, at its closest point, as shown on the January 14, 2002 survey, amended October 7, 2003, prepared by Joseph A. Ingegno, L.S. REASONS FOR BOARD ACTION: On the basis of testimony presented, materials submitted and personal inspections, the Board makes the following findings: 1. Grant of the alternative relief will not produce an undesirable change in the character of the neighborhood or a detriment to nearby properties. The proposed two-story house is 69 feet wide by 45 feet in depth, including a front porch, breezeway and attached garage, and the applicant has requested a rear yard setback at 23 fleet, instead of the code required 50 feet. The benefit sought by the applicant cannot be achieved by some method, feasible for the applicant to pursue, other than an area variance. If the dwelling were 50 feet from the rear and 40 ft. from the front yard lines, the depth cf the proposed dwelling would only be 20 feet. The property is 460 sq. ft. larger than a lot of 19,999 sq. ft., which would be allowed a 35-ft. rear yard setback without a variance. 3. The variance granted herein is substantial. Although the size of the property is 20,459 sq.ft., the rear yard setback increases to a minimum 50 ft. rear yard, instead of 35 feet for a lot having less than 20,000 sq. ft. This relief granted is for a 30 ft. rear yard setback, instead of the requested 23 feet. 4. The difficulty was self-created when the dwelling was planned without conforming to the current Town Code requirements. 5. No evidence has been submitted to suggest that a variance in this residential community of nonconforming size lots will have an adverse impact on the physical or environmental conditions in the neighborhood. 6. Grant of the alternative relief is the minimum action necessary and adequate to enable the applicant to enjoy the benefit of a new dwelling with porch and garage, while preserving and protecting the character of the neighborhood and the health, safety and welfare of the community. REASONS FOR BOARD ACTION: On the basis of testimony presented, materials submitted and personal inspections, the Board makes the following findings: 1. Grant of the variance will not produce an undesirable change in the character of the neighborhood or a detriment to nearby properties. The applicant wishes to construct a glass and screen sunroom which will be located at the southeast side of the dwelling in the vicinity of an existing deck. The setback of the new construction is requested at 31 feet from the rear lot line, which is slightly greater than the nonconforming setback of the dwelling that exists. 2. The benefit sought by the applicant cannot be achieved by some method, feasible for the applicant to pursue, other than an area variance because the house has been existing with a 30 ft. rear yard setback since it was built, and an expansion of a nonconforming setback may not be obtained without a variance. 3. The variance granted herein is not substantial. The lot coverage is noted at less than 18.5 percent for all building area, and the sunroom will be a single-story unheated addition replacing an outside step area. 6. Grant of the requested relief is the minimum action necessary and adequate to enable the applicant to enjoy the benefit of a glass and screen enclosed sunroom, while preserving and protecting the character of the neighborhood and the health, safety and welfare of the community.
