SUFFOLK COUNTY ADMINISTRATIVE CODE: This application was not required to be referred to the Suffolk County Department of Planning under the Suffolk County Administrative Code Sections A 14-14 to 23. LWRP DETERMINATION: The relief, permit, or interpretation requested in this application is listed under the Minor Actions exempt list and is not subject to review under Chapter 268. PROPERTY FACTS/DESCRIPTION: The subject property is a nonconforming 20,127 square feet lot located in the Residential R-40 Zoning District. The northerly property line measures 138.82 feet, the easterly property line measures 150.28 feet, the southerly property measures 129.55 feet and the westerly property line measures 150.00 feet and runs adjacent to Hickory Road. The property is improved with a single story wooden dwelling with an attached garage as shown on the survey prepared by Nathan Taft Corwin, III, LS, and dated August 27, 2019. BASIS OF APPLICATION: Request for a Variance from Article XXIII, Sections 280-124 and the Building Inspector's July 20, 2019,Notice of Disapproval based on an application for a permit to construct an addition to an existing single family dwelling; at, 1) located less than the code required rear yard setback of 50 feet; located at 670 Hickory Road, Southold,NY. SCTM#1000-54-6-7 RELIEF REQUESTED: The applicant requests a variance to construct a deck addition to a single family dwelling The proposed construction on this nonconforming 20,127 square feet lot in the Residential R-40 Zoning District, is not permitted pursuant to Article XXIII Section 280-124 which states; lots measuring 20,000-39,999 square feet in total size require a minimum rear yard setback of 50 feet. The proposed construction has a rear yard setback of 40.9 feet as shown on the survey map submitted by Nathan Taft Corwin, III, LS, and dated August 27, 2019 and the Proposed Alteration Plot Plan submitted by John Sbaglia,Architect, dated July 21, 2019. Page 2, January 23, 2020 #7358, Blazek SCTM No. 1000-54-6-7 ADDITIONAL INFORMATION: During the hearing, the applicant was asked to bring the plan into more conformity with the code by reducing the deck originally proposed at 14 ft. by 22 ft. to 12 ft. by 22 ft. reducing the setback to 42.9 feet rather than the 40.9 feet requested. The applicant would then need to be granted alternative relief conditioned by submission of a new survey map and site plan. FINDINGS OF FACT/REASONS FOR BOARD ACTION: The Zoning Board of Appeals held a public hearing on this application on January 2, 2020 at which time written and oral evidence were presented. Based upon all testimony, documentation, personal inspection of the property and surrounding neighborhood, and other evidence,the Zoning Board finds the following facts to be true and relevant and makes the following findings: 1. Town Law X267-b(3)(b)(1). Grant of the alternative relief will not produce an undesirable change in the character of the neighborhood or a detriment to nearby properties. The home has been remodeled and updated and adds a more positive look to the neighborhood. As this is an older community, many of the homes have been updated and renovated. The applicant wishes to eliminate the existing stairs to a sliding door and have a walk out deck in its place. The addition of a rear deck would allow for more outdoor use at the rear of the home. The deck will pose no obstruction to any of the neighbors as it cannot be seen from the road and there is a natural buffer from the neighbors to the rear of the home. 2. Town Law 4267-b(3)(b)(2). The benefit sought by the applicant cannot be achieved by some method, feasible for the applicant to pursue, other than an area variance. As a result of the original subdivision and placement of the existing residence, there is a narrow rear yard which will not allow the applicant to have a useable deck in order to meet the 50 rear yard setback. 3. Town Law X267-b(3)(b)(3). The alternative relief granted herein is mathematically substantial, representing 14.2% relief from the code. However, the location of the home and the proposed deck cannot be located other than the rear yard. The residence neighboring the rear is not close to the property line and will not be impacted by the proposed deck. 4. Town Law X267-b(3)(b)(4). No evidence has been submitted to suggest that a variance in this residential community will have an adverse impact on the physical or environmental conditions in the neighborhood. The applicant must comply with Chapter 236 of the Town's Storm Water Management Code. 5. Town Law §267-b(3)(b)(5). The difficulty has been self-created. The applicant purchased the parcel after the Zoning Code was in effect and it is presumed that the applicant had actual or constructive knowledge of the limitations on the use of the parcel under the Zoning Code in effect prior to or at the time of purchase. 6. Town Law 4267-b. Grant of alternative relief is the minimum action necessary and adequate to enable the applicant to enjoy the benefit of a rear deck while preserving and protecting the character of the neighborhood and the health, safety and welfare of the community. RESOLUTION OF THE BOARD: In considering all of the above factors and applying the balancing test under New York Town Law 267-B, motion was offered by Member Acampora, seconded by Member Dantes, and duly carried, to Page 3, January 23, 2020 #7358, Blazek SCTM No. 1000-54-6-7 DENY as applied for, and GRANT ALTERNATIVE RELIEF for a rear yard setback of 42.9 feet by reducing the proposed deck from 14 ft. in depth to 12 ft. in depth. SUBJECT TO THE FOLLOWING CONDITIONS: 1. The applicant shall submit a revised survey or site plan depicting the alternative relief granted. 2. The wooden rear deck shall not be enclosed or covered and shall remain open to the sky. That the above conditions be written into the Building Inspector's Certificate of Occupancy, when issued. Before applying for a building permit, the applicant or agent must submit to the Board of Appeals for approval and filing, two sets of the final site plan or survey, a conforming to the alternative relief granted herein. The ZBA will forward one set of approved, stamped drawings to the Building Department. Failure to follow this procedure may result in the delay or denial of a building permit, and may require a new application andpublic hearing before the Zoning Board of Appeals. In the event that this is an approval subject to conditions, the approval shall not be deemed effective until such time that the foregoing conditions are met; and failure to comply therewith will render this approval null and void. Pursuant to Chapter 280-146(B) of the Code of the Town of Southold any variance granted by the Board of Appeals shall become null and void where a Certificate of Occupancy has not been procured, and/or a subdivision map has not been filed with the Suffolk County Clerk,within three (3)years from the date such variance was granted. The Board of Appeals may, upon written request prior to the date of expiration, grant an extension not to exceed three (3) consecutive one (1)year terms.
