Tel.(631)765-1809•Fax(631)765-9064 J/� Southold Town Clerk FINDINGS, DELIBERATIONS AND DETERMINATION MEETING OF JANUARY 23, 2020 ZBA FILE#7356 NAME OF APPLICANT: Robert and Stephanie Swing PROPERTY LOCATION: 1745 Bay Shore Road, Greenport,NY SCTM No. 1000-53-4-7 SEQRA DETERMINATION: The Zoning Board of Appeals has visited the property under consideration in this application and determines that this review falls under the Type II category of the State's List of Actions, without further steps under SEQRA. SUFFOLK COUNTY ADMINISTRATIVE CODE: This application was referred as required under the Suffolk County Administrative Code Sections A 14-14 to 23, and the Suffolk County Department of Planning issued its reply dated October 8, 2019 stating that this application is considered a matter for local determination as there appears to be no significant county-wide or inter-community impact. LWRP DETERMINATION: This application was referred for review under Chapter 268, Waterfront Consistency review of the Town of Southold Town Code and the Local Waterfront Revitalization Program (LWRP) Policy Standards. The LWRP Coordinator issued a recommendation dated December 12, 2019. Based upon the information provided on the LWRP Consistency Assessment Form submitted to this department, as well as the records available to us, it is our recommendation that the proposed action is INCONSISTENT with LWRP policy standards and therefore is INCONSISTENT with the LWRP. Policy 1: Foster a pattern of development in the Town of Southold that enhances community character, preserves open space, makes efficient use of infrastructure, makes beneficial use of a coastal location, and minimizes adverse effects of development. The proposed location of the pool does not minimize the adverse effects of development by proposing the pool partially located in the side yard with a setback of 10 feet to a tidal wetland and increasing lot coverage to 21.9 percent over the maximum allowable lot coverage of 20 percent. The proposal is not supported and does not meet this policy. It is recommended that the pool is redesigned and relocated to meet this policy. Policy 4: Minimize loss of life, structures, natural resources from flooding and erosion. Chapter 275 Wetlands and Shorelines administered by the Town Board of Trustees requires a setback of 50' from tidal wetland to a pool and related structures. The proposed pool is located 10' from the wetland (bulkhead) and within the AE FEMA flood zone. The base flood elevation was not provided on the survey.... This policy does not support the construction of structures (pools) within areas subject to the risk of flooding and potential loss. Policy 4.1A recommends that to minimize potential loss and damage, structures should be located as far from flooding hazards as possible. This proposed action does not meet this policy. Page 2,January 23,2020 #7356, Swing SCTM No. 1000-53-4-7 Policy 6.2: Protect and restore Significant Coastal Fish and Wildlife Habitat. Pipes Cove is a significant coastal fish and wildlife habitat. These habitats have experienced human disturbance resulting from adverse effects of adjacent land uses. This parcel is within the designation. Policy 6.3: Protect and restore tidal and freshwater wetlands. Development in watersheds and in close proximity to wetlands has resulted in loss and impairments to wetlands and their functions; cumulatively impacting the Town of Southold's ecosystem. PROPERTY FACTS/DESCRIPTION: The subject property is a non-conforming 23,055 square foot water front parcel located in an R-40 Zoning District. The parcel measures 110.20 feet fronting Pipes Cove along the northerly property line with a landward concrete seawall running parallel , The parcel measures 100 feet fronting Bay Shore Road along the southerly property line, measures 207.41 feet along the westerly property line and measures 253.70 feet along the easterly property line. The parcel is improved with a two story frame house and garage, a framed screened porch, a roof over wood porch, and a wood walk. All is shown on a survey prepared by Nathan Taft Corwin,LLS, last revised September 18, 2019. BASIS OF APPLICATION: Request for Variances from Article III, Section 280-15; Article XXIII, Section 280- 124; and the Building Inspector's September 19, 2019 Notice of Disapproval based on an application for a permit to construct an accessory swimming pool and to legalize an"as built" second story deck addition to an existing single family dwelling at, 1) swimming pool located in other than the code permitted rear yard; 2)more than the code permitted maximum lot coverage of 20%; located at 1745 Bay Shore Road, (Adj.to Pipe's Cove) Greenport, NY. SCTM# 1000-53-4-7. RELIEF REQUESTED: The applicant requests variances to construct a swimming pool that is partially located in the side yard where town code requires swimming pools be located in a rear yard location or a front yard location if the parcel borders wetlands or a body of water. The construction of the proposed swimming pool will result in buildable lot coverage of 21.9%where the code permitted maximum lot coverage is 20% of buildable area. ADDITIONAL INFORMATION: During the site inspection board members saw a shed located in the front yard of the property. The shed is not located on the applicant's survey and the lot coverage calculations do not include the shed which is currently located on the property. The Board discussed with the applicant the LWRP's recommendation that the action is INCONSISTENT the LWRP Policy, and informed the applicant that they are prevented from granting a variance unless steps were taken to mitigate negative impacts caused by the proposed location of the swimming pool in a flood zone. Furthermore, on January 15, 2020 the applicant provided the Board with copy of Southold Town Trustee and New York State Department of Environmental Conservation (NYSDEC) applications for proposed work. The NYSDEC response, included and dated May 23, 2019 indicates the applicant requires a NYSDEC variance. No evidence to support compliance with the NYSDEC request was included. FINDINGS OF FACT/REASONS FOR BOARD ACTION: The Zoning Board of Appeals held a public hearing on this application on January 2, 2020 at which time written and oral evidence were presented. Based upon all testimony, documentation, personal inspection of the property and surrounding neighborhood, and other evidence,the Zoning Board finds the following facts to be true and relevant and makes the following findings: 1. Town Law 4267-b(3)(b)(1). Grant of the variance will produce an undesirable change in the character of the neighborhood or a detriment to nearby properties. The Bay Shore Road neighborhood consists of single family, waterfront and upland residences located on lots developed over many years, with most lot sizes not conforming to current zoning requirements. Area properties are developed with houses are of varying size, style and age, Page 3,January 23,2020 #7356, Swing SCTM No. 1000-53-4-7 including many older homes which have been substantially renovated or altered. While accessory structures are common to the neighborhood, few properties, especially along the waterfront, are developed with swimming pools as a result of the neighborhood's sensitive environmental setting along the Peconic Bay. Despite less than code conforming lot sizes, excessive lot coverage is not common to this residential neighborhood. 2. Town Law X267-b(3)(b)(2). The benefit sought by the applicant can be achieved by some method feasible for the applicant to pursue, other than an area variance. The applicant could build the swimming pool in a code conforming location or build a smaller swimming pool within the maximum code permitted 20% lot coverage. 3. Town Law 4267-b(3)(b)(3). The variance herein would be mathematically substantial, representing 100% relief from the code for the non-conforming side yard location and 5% relief from the code for non-conforming lot coverage.. 4. Town Law X267-b(3)(b)(4), Evidence has been submitted in the LWRP report to suggest that the subject variance for the swimming pool will have an adverse impact on the physical or environmental conditions in this neighborhood. The proposed location of the pool and increased lot coverage is close to an environmentally sensitive area surrounding pipes cove and this action is not supported by the LWRP. 5. Town Law X267-b(3)(b)(5). The difficulty has been self-created. The applicant purchased the parcel after the Zoning Code was in effect and it is presumed that the applicant had actual or constructive knowledge of the limitations on the use of the parcel under the Zoning Code in effect prior to or at the time of purchase. 6. Town Law 4267-b. Grant of the requested relief is not the minimum action necessary and adequate to enable the applicant to enjoy the benefit of a swimming pool while preserving and protecting the character of the neighborhood and the health, safety and welfare of the community. The proposed swimming pool can be relocated in order to avoid aforementioned potential adverse environmental impacts. Wetlands and their benefits are also dependent upon the condition of adjacent lands which directly positively or negatively impact the systems. Development in watersheds and in close proximity to wetlands has resulted in loss and impairments to the wetlands and their functions; cumulatively impacting the Town of Southold's ecosystem. Setbacks are required to help mitigate the direct and indirect adverse impacts from development. The proposed action does not meet this policy. It is recommended that the pool is relocated to achieve the greatest setback from the tidal wetland as possible. Pursuant to Chapter 268 the Southold Town Zoning Board of Appeals shall consider this recommendation in preparing its written determination regarding the consistency of the proposed action.
