fees.

prune invasive vegetation selectively in a 50'x100' area; replant with beach grass at 18" spacing; all
work is 100' or more from mean high water boundary. Located: 860 East Road, Cutchogue.

The proposed action has been reviewed to Chapter 268, Waterfront Consistency Review of the
Town of Southold Town Code and the Local Waterfront Revitalization Program (LWRP) Policy
Standards. Based upon the information provided on the LWRP Consistency Assessment Form
submitted to this department, as well as the records available to me, it is my recommendation that
the proposed action is INCONSISTENT with the LWRP Policy 6, specifically:
6.3 Protect and restore tidal and freshwater wetlands.
D. Provide adequate buffers between wetlands and adjacent or nearby uses and
activities in order to ensure protection of the wetland's character, quality, values,
and functions.
E. Maintain buffers to ensure that adverse effects of adjacent or nearby
development are avoided.-

2 Avoid permanent or unnecessary disturbance within buffer areas.
3. Maintain existing indigenous vegetation within buffer areas.
Photos indicate that the area proposed to be cleared is indicative on a
quality, maritime habitat with high function and value (wildlife habitat, wave
attenuation during storm events, erosion control etc... The parcel is
located within a NYSDEC Significant Coastal Fish and Wildlife Habitat Area.
Figure 1 below shows the extent of the maritime habitat.
The LWRP CCR form indicates the need to clear is to provide "public
views". This is incorrect. Views from public vantage points are not
expected.
The application is deficient in the following areas:
1. The species and types of "invasive" vegetation (trees, shrubs,
groundcover) to be cleared are not identified. What is the
meaning of the term "invasive" as applied here? NYSDEC
maintains a list of invasive species that I have included below.
2. The amount of clearing is not identified. The area is large
equaling 5000 square feet.
3. The method of clearing is not identified.

LWRP policy language recommends the protection of wetland functions and associated
benefits regardless of the availability of compensatory mitigation, especially, areas
designated as Significant Coastal Fish and Wildlife Habitats.
It is recommended to preserve this important maritime habitat that a non-disturbance buffer
is created.
Clearing of NYSDEC unregulated invasive trees, shrubs and groundcover should not be
permitted in this area.
Pursuant to Chapter 268, the Board of Trustees shall consider this recommendation in preparing its
written determination regarding the consistency of the proposed action.

proposed actions that are subject to the Town of Southold Waterfront Consistency Review Law. This
