BOUNDARY LINE AGREEMENT
This Agreement,made the day of October,2019,between 13405 Main Road LLC,residing
at 13405 Main Road, Mattituck (hereinafter referred to as "Owner"), and Konstantinos Hazoglou,
residing at 165 Wickham Avenue,Mattituck,NY 11952(hereinafter referred to as"Adjoining Owner");
WHEREAS,the Owner is the owner in fee simple of certain real property known as and by 13405 Main
Road,Mattituck,New York designated as,district 1000,Section 140,Block 03,Lot 034 on the Tax Map
for the County of Suffolk,State of New York and as more particularly described on Schedule A attached
hereto and made part hereof(hereinafter"Premises A");and
WHEREAS, the Adjoining Owner is the owner in fee simple of certain real property known as and by
165 Wickham Avenue,Mattituck,New York designated as District 1000,Section 140,Block 03,Lot 033
on the Tax Map for the County of Suffolk, State of New York and as more particularly described on
Schedule B attached hereto and made part hereof(hereinafter"Premises B");and
WHEREAS, a survey of Premises A has been prepared by Vincent M. Teutonico of Big Apple Land
Surveyors, dated October 7, 2019 (hereinafter the "Survey"), a copy of which is attached as Exhibit I
and
WHEREAS,Premises A and Premises B, as above described, share a boundary line which divides Lot
034(Premises A)from Lot 033 (Premises B)as shown on the attached Survey(hereinafter referred to as
the"Boundary Line");and
WHEREAS, the attached Survey shows the Plastic Fence on Premises A which is not on the shared
Boundary Line and lies up to 4 feet south of such shared Boundary Line(hereinafter referred to
as the"Fence");and
WHEREAS, the parties desire to fix and definitely establish the boundary line between the two parcels
mentioned above respectively owned by them and to resolve any question concerning their respective
rights concerning the Boundary Line without resort to litigation;and
NOW, THEREFORE, in consideration of the mutual promises and conveyances herein contained, and
other good and valuable consideration, the receipt of which is hereby mutually acknowledged, the
parties hereto for themselves and their heirs, legal representatives,successors and assigns,covenant and
agree as follows:
That irrespective of the placement of the Fence between Premises A and Premises B, the common
boundary line between the parcels shall be deemed the northerly boundary of the property owned by the
Owner and the southerly boundary of the property owned by the Adjoining Owner is established as
being described as follows:
A line beginning at the point where the division line between Premises A and Premises B intersects with the westerly side of
Wickham Avenue, as shown on the aforementioned survey, said point of beginning being North 20 degrees 21'20" West,
134.94 feet from the corner formed by the northerly side of Main Road and westerly side of Wickham Avenue; thence
continuing westerly North 76 degrees 00'10"East, 138.54 feet along the division line between Premises A and Premises B,
as shown on said survey,
That the Adjoining Owner waives and otherwise disclaims any claim of title, right of possession,
ownership, and interest in and to any land lying to the south of the Boundary Line'so established,
including but not limited to that portion of Premises A which is not fenced in(i.e.the strip of land which
lies between the Fence and the Boundary Line,which varies in width from 3 feet to 4 feet)and;
That the Adjoining Owner makes no claim of possession or title, under color of title, or in adverse
possession,or otherwise in and to the portion of Premises A which lies south of the Boundary Line and;
The.,parties further agree and acknowledge that any use by the Adjoining Owner, their heirs, legal
representatives, successors and assigns, of any portion of Premises A lying north of the Fence, is
permissive and not hostile to or with any claim of right against the Owner, their heirs, legal
representatives,successors and assigns.
The parties further agree and acknowledge that the Owner is responsible for paying for the costs of
moving and/or removing the Fence, provided, however, that such moving and/or removal is at the
Owner's sole discretion and the Adjoining Owner has no right to cause the Owner to remove or relocate
the Fence.
IT IS MUTUALLY AGREED AND COVENANTED that this agreement shall run with the land and
inure to the benefit of and be binding upon the parties hereto and their respective heirs, legal
representatives,successors,grantees and assigns of Owner and Adjoining Owner.

BEGINNING at a granite monument set at the intersection of the westerly side of Wickham Avenue
with the northerly side of Main Road (N.Y.S. Route 25);
RUNNING thence along said northerly side of Main Road, South 77 degrees 53' 40" West 124.81 feet
to a concrete monument and land now or formerly of North Fork Liquor Corp.;
