EASEMENT AGREEMENT

THIS INDENTURE made this $ day of C4-6�1e-� , 2019, by and
between Kevin Lucas Commare and Terrie Jensen Commare, 456 Chateau Grimaldi,
Mandeville, LA 70471 (hereinafter referred to as "Grantors"), and Henry Frederick Sharman and
Lucille F. Sharman, 495 Poplar Street, Laguna Beach, CA 92651 (hereinafter referred to as
"Grantees").
WHEREAS, Grantor owns certain lands situate at 395 Stephensons Road, Orient, New
York, 11957 Suffolk County Tax Map No. 1000-017.00-01.00-009.001, more fully described in
Schedule "A" annexed hereto and made a part hereof("Grantors' Property"); and
WHEREAS, Grantees own certain improved lands situate at 283 Stephensons Road,
Orient, New York, 11957, Suffolk County Tax Map No. 1000-017.00-01.00-009.002, more fully
described in Schedule `B" annexed hereto and made a part hereof(Grantees' Property"); and
WHEREAS, Grantors, for good and valuable consideration, are desirous of conveying an
Easement to Grantees over a portion of Grantors' Property so that Grantees can access Grantees'
Property from Stephensons Road.
WITNESSETH:
1. Grantors do hereby grant, transfer, bargain, sell and convey unto Grantees, their
heirs, successors and assigns, in perpetuity, an Easement, over and upon a portion of the eastern
side of Grantors' Property depicted on the Survey for Sharman Family Trust prepared by
Howard W. Young, L.S. dated August 30, 2019, attached hereto as Schedule "C" ("Easement
Area"), The Easement Area is more particularly described in Schedule "D" attached hereto.
2. The nature, character and extent of the Easement hereby granted is as follows:
A. Grantees shall have the right, subject to the rights of the Grantors, its heir,
heirs, successors and assigns as more fully set forth herein, to traverse said Easement
Area from Grantees' property to Stephenson Road.
B. Said access shall be limited to pedestrian and vehicular traffic.
C. The location of the Easement Area depicted in Schedule "C" and
described in Schedule "D" shall not be changed without the consent of both parties and
their respective representatives.
D. Any and all costs associated with the use of said Easement shall be borne
solely by the Grantees, and furthermore, the Grantees, in conjunction with use of the
Easement by the Grantees, agree to provide the Grantors with proof of liability insurance
provided for by the Grantees, naming the Grantors, their heirs, successors and assigns as
the case may be, as an additional insured thereon as the Grantors' interests may appear.
E. Grantees also agree to indemnify, save and hold Grantor harmless against
any and all claims for property damage and/or personal injury arising out of the use and
enjoyment of said Easement by the Grantees, their heirs, successors and assigns, invitees
and trespassers to the extent not covered by insurance. Grantors, their successors and/or
assigns, shall notify the Grantees by certified mail, return receipt requested, of a change
in ownership in order to facilitate changes in the endorsement.
3. This Agreement shall inure to the benefit of, and bind, the parties, their heirs,
successors, legal representatives and/or assigns, and shall run with the land in perpetuity.
