Westhampton, as a Historic Landmark
WHEREAS, on January 14, 2020, a public hearing was held by the Town Board of the Town
of Southampton regarding the proposed designation of the home located at 121 South
Road, Westhampton, known as the Topping-Raynor House and owned by Eleanor and James
Kobel, further identified on the Suffolk County Tax Map as #900-376-2-2 as a historic
landmark; and
WHEREAS, the Town Board of the Town of Southampton, based on the reports and
recommendations submitted by the Town Planning Board and the Landmarks and Historic
Districts Board, hereby makes the determination that the home located at 121 South Road,
Westhampton is an important historic resource; and
WHEREAS, the Town Board also finds that the home located at 121 South Road,
Westhampton, meets the criteria for historic designation as defined by Section 330-321
(Procedure and criteria for designation of landmarks or historic districts) of the Town Code
of the Town of Southampton; now therefore be it
RESOLVED, that the Town Board of the Town of Southampton hereby designates the home
located at 121 South Road, Westhampton as a Town historic landmark subject to the
provisions of Section 330-321 of the Southampton Town Code; and be it further
RESOLVED, that the Town Board directs the Town Clerk to forward notice of the property

Notice of Public Hearing to Consider Amending Various
Provisions of the Southampton Town Code, Including Chapter

RESOLVED, that the Town Board of the Town of Southampton hereby directs that a public
hearing shall be held on Tuesday, February 11, 2020, at 1:00 p.m., at Southampton
Town Hall, 116 Hampton Road, Southampton, New York, to hear any and all persons either
for or against a local law entitled, “A LOCAL LAW amending various provisions of the
Southampton Town Code, including Chapters 330 (Zoning), 292 (Subdivision of Land), and
325 (Wetlands), to require a digital submission of particular applications,” which provides as
follows:

A LOCAL LAW amending various provisions of the Southampton Town Code, including
Chapters 330 (Zoning), 292 (Subdivision of Land), and 325 (Wetlands), to require a digital
submission of particular applications.
BE IT ENACTED by the Town Board of the Town of Southampton as follows:
Section 1. Legislative Intent.
Currently, the Southampton Town Clerk’s Records Management Division maintains
approximately 16,000 cubic feet of Town Departmental records, with approximately 8,000
cubic feet of those records comprised of both archival and active Land Management records
generated out of the building department and its several land-use boards including, but not
limited to, the Zoning Board of Appeals, the Planning Board, and the Conservation Board, in
compliance with the New York State Records Retention Policy. Indeed, many of the Land
Management application submissions include plans, elevations, and surveys, which occupy a
great deal of space in the Town’s Records Management facility – and which is reaching
maximum capacity.
Thus, the purpose of this legislation is to introduce electronic Land Management
application submissions along with the paper application submissions. By doing this, the
Town will ultimately increase storage capacity in the existing Records Management facility,
improve efficiency, and benefit the environment. Thus, the Town Board of the Town of
Southampton, upon the Town Clerk’s recommendation, will now require the submission of
digital copies of applications to the various Town boards and agencies. A digital copy shall
mean a copy that is identical in content to a paper copy, except that it is recorded
electronically, in a read-only digital format, to be submitted on a media determined annually
by the Town Clerk as Records Management Officer. The Town’s website, as well as each
relevant application package, will include the information and submission instructions as
discussed herein to provide direction to applicants as it relates to the submission of these
digital copies.

And while the Town is not yet in a position to accept only digital copies, but is
instead requiring the submission of both a digital copy and a paper copy, requiring a digital
copy now is an important interim step towards creating a permanent comprehensive digital
submission and storage framework for the Town’s records.
Section 2. Amendment.
Subsection A of section 164 (Application procedure) of Town Code Chapter 330 (Zoning), is
hereby amended by deleting the stricken words and adding the underlined words as follows:
§330-164. Application procedure.
A. Applications for any action by the Board of Appeals shall be submitted in the form
required by the Board and filed in its office. A digital copy of said application shall be
submitted in a format determined, and changed as needed, by the Town Clerk.
Section 3. Amendment.
Subsection A of section 183 (Site plan elements) of Town Code Chapter 330 (Zoning), is
hereby amended by deleting the stricken words and adding the underlined words as follows:
§330-183. Site plan elements.
Submission. A complete site plan application shall consist of:
(1) A completed site plan application form.
(2) A site plan review fee.
(3) An environmental assessment form, Part 1, where required by Chapter 157,
Environmental Quality Review, of this Code.
(4) A site plan.
(5) A digital copy of all application materials in a format determined, and changed as
needed, by the Town Clerk.
Section 4. Amendment.
Subsection A of section 183.2 (Administrative site plan elements) of Town Code Chapter
330 (Zoning), is hereby amended by deleting the stricken words and adding the underlined
words as follows:
§330-183.2 Administrative site plan elements.
A. Submission. A complete administrative site plan application shall consist of:
(1) A completed administrative site plan application form.
(2) An administrative site plan review fee.
a. A fee schedule shall be established, and modified from time to time, by
resolution of the Southampton Town Board. A copy of the fee schedule shall
be on file with the Town Clerk's office and the Department of Land
Management.

b. The Town Planning and Development Administrator shall have the authority to
modify or waive the site plan review fee in whole or in part where such
application demonstrates, in the Town Planning and Development
Administrator's judgment, a substantial public benefit. To modify or waive
such fee, the Town Planning and Development Administrator must make a
written determination of its findings and reasoning for modifying or waiving
such fee and file the determination with the Supervisor, members of the Town
Board and the Town Clerk.
(3) An environmental assessment form, Part 1, where required by Chapter 157,
Environmental Quality Review, of this Code.
(4) A site plan.
a. If an applicant is eligible for administrative site plan review pursuant to
§ 330-183.1A(2); (3); (4); (5); or (6), a site plan shall not be required as
part of a submission so long as site conditions have not changed since the
submittal of the most recently approved site plan on file in the Department of
Land Management. If an applicant is eligible for administrative site plan
review pursuant to § 330-183.1A(7), full color elevations of the approved
signage and the proposed signage shall be required. Nothing within this
section shall prevent the Town Planning and Development Administrator from
requiring a site plan for these applications if in its sole discretion it determines
that other information is deemed necessary to determine conformity of the
proposed site plan with the spirit and intent of this chapter.
b. For applications for administrative site plan review pursuant to § 330-
183.1A(1), the applicant shall cause a site plan map at a minimum scale of
one inch equals 40 feet, to be prepared by an architect, landscape architect,
civil engineer or surveyor that shall include the elements included in § 330-
183 of this chapter. The Town Planning and Development Administrator at its
discretion shall have the authority to allow the site plan to omit those
elements not necessary for making a determination on the issuance of an
administrative site plan approval. In addition, nothing within this section shall
prevent the Town Planning and Development Administrator from requiring
additional elements not included in § 330-183 if in its sole discretion it
determines that other information is deemed necessary to determine
conformity of the proposed site plan with the spirit and intent of this chapter.
c. Unless waived by the Town Planning and Development Administrator, plans
for all required improvements must be submitted by a professional engineer
or licensed architect or, if appropriate, a registered landscape architect.
Installation of such improvements must be under the direct supervision of a
registered architect or licensed engineer.
(5) A digital copy of all application materials in a format determined, and changed as
needed, by the Town Clerk.
Section 5. Amendment.
Subsection D of section 185 (Procedure for amendment of Zoning Law and zone
classification) of Town Code Chapter 330 (Zoning), is hereby amended by deleting the
stricken words and adding the underlined words as follows:

§330-185. Procedure for amendment of Zoning Law and zone classification.
D. Any petition for a change in the Zoning Map shall include the following:
(1) The name of the property owner.
(2) A map, accurately drawn to an appropriate scale, showing the proposed zone
district boundary changes, property lines, the calculated areas affected, in acres
or square feet, the street rights-of-way in the immediate vicinity and the lands
and names of owners immediately adjacent to and extending within 500 feet of
all boundaries of the property to be rezoned.
(3) A metes and bounds description of the proposed amendment.
(4) In the case of any petition for a change in the Zoning Map which is subject to
review by the Suffolk County Planning Commission pursuant to §§ 239-l and 239-
m of Article 12-B of the General Municipal Law, the petitioner shall comply with
any and all additional requirements which said Commission may deem necessary.
(5) A disclosure affidavit in the form prescribed by the Town Board.
(6) The name and address of the relevant fire department, ambulance/emergency
medical services agency, and other municipal agencies or districts with
jurisdiction over the subject property.
(7) The name and address of the school district(s) within which the proposed project
lies.
(8) A digital copy of all application materials in a format determined, and changed as
needed, by the Town Clerk.
Section 6. Amendment.
Subdivision A of subsection 7 (Application for permits) of Town Code Chapter 325
(Wetlands), is hereby amended by deleting the stricken words and adding the underlined
words as follows:
§325-7. Application for permits.
(A) The Conservation Board shall provide an application form setting forth the
information
and documentation required to be submitted by an applicant for a wetlands permit. A
digital copy of all application materials shall be submitted in a format determined,
and changed as needed, by the Town Clerk. A full environmental assessment form
pursuant to the State Environmental Quality Review Act (SEQRA) shall accompany
each application considered to be a Type I or unlisted action pursuant to SEQRA.
Applications shall be submitted to the Conservation Board, unless the Planning Board
is the approving authority for any such application, in which case the application
shall be submitted to such Board. No application shall be considered complete until
the approving authority has made a determination that the application is a Type II
action or has made a negative declaration pursuant to SEQRA or, where a positive
declaration has been made, until the approving authority accepts a draft
environmental impact statement as complete for review, the report of the Chief

Environmental Analyst under § 325-8 has been received and the required fee under
§ 325-13 has been paid.
Section 7. Amendment.
Subdivision (B)(1) of subsection 9 (Application for building or demolition permit) of Town
Code Chapter 123 (Building Construction), is hereby amended by striking the deleting words
and adding the underlined words as follows:
§123-9. Application for building or demolition permit.
B. Building permit application form; submission.
(1) Application for a building permit shall be made to the Building Inspector on forms
provided by the Building Division and shall contain the following information:
a. A description of the land on which the proposed work is to be done.
b. A statement of the use or occupancy of all parts of the land and of the
building(s) or structure(s).
c. The valuation of the proposed work.
d. The full name and address of the owner and of the applicant and the
names and addresses of their responsible officers, if any of them are
corporations.
e. A brief description of the nature of the proposed work.
f. A duplicate set of plans and specifications as set forth in Subsection C of
this section.
g. Such other information as may reasonably be required by the Building
Inspector to establish compliance of the proposed work with the
requirements of the applicable building laws, ordinances and regulations.
h. A digital copy of all application materials shall be submitted in a format
determined, and changed as needed, by the Town Clerk.
Section 8. Amendment.
Subdivision (E)(1) of subsection 9 (Application for building or demolition permit) of Town
Code Chapter 123 (Building Construction), is hereby amended by striking the deleting words
and adding the underlined words as follows:
§123-9. Application for building or demolition permit.
E. Demolition permit application form; submission.
(1) Application for a demolition permit shall be made to the Building Inspector on
forms provided by the Building Division and shall contain at least the following
information:
a. A description of the land on which the proposed work is to be done.

e. Where a whole structure demolition is proposed, a certified copy of the
most recent deed recorded in the Suffolk County Clerk's office and a hold
harmless form. (The application and the hold harmless form shall be
signed by all owners listed.)
f. Such other information as may reasonably be required by the Building
Inspector to establish compliance of the proposed work with the
requirements of the applicable building laws, ordinances and regulations.
g. A digital copy of all application materials shall be submitted in a format
determined, and changed as needed, by the Town Clerk.
Section 9. Amendment.
Subsection 4 (Pre-application procedures) of Town Code Chapter 292 (Subdivision of Land)
is hereby amended by deleting the stricken words and adding the underlined words as
follows:
§292-4. Pre-application procedures.
A. The subdivider shall familiarize himself with these subdivision regulations and the
Zoning Law. These are available at the office of the Town Clerk.
B. The subdivider shall make a preapplication to the office of the Planning Board, as
detailed in Article IV. A digital copy of all application materials shall be submitted in
a format determined, and changed as needed, by the Town Clerk.
C. The Planning Board shall hold a public hearing on the preapplication. Said public
hearing shall be noticed in accordance with the procedures of this chapter and
§§ 277 and 278 of the Town Law.
D. The Planning Board shall issue a report to the subdivider as provided for in Article IV.
Section 10. Amendment.
Subdivision A of subsection 5 (Major review procedures) of Town Code Chapter 292
(Subdivision of Land), is hereby amended by deleting the stricken words and adding the
underlined words as follows:
§292-5. Major Review Procedures.
A. The subdivider shall submit a preliminary plat, together with supporting material,
including topographic map and road and drainage profiles, to the office of the
Planning Board (10 paper prints are required). In addition, a digital copy of all
application materials shall be submitted in a format determined, and changed as

needed, by the Town Clerk. The subdivider shall pay a review fee as specified in
§ 292-29B(1).
Section 11. Amendment.
Subdivision B of subsection 6 (Minor review procedures) of Town Code Chapter 292
(Subdivision of Land), is hereby amended by deleting the stricken words and adding the
underlined words as follows:
§292-6. Minor Review Procedures.
B. The subdivider shall submit a final plat in the form of all final plats, together with
supporting materials, to the office of the Planning Board. In addition, a digital copy
of all application materials shall be submitted in a format determined, and changed
as needed, by the Town Clerk. The subdivider shall pay an application fee as
specified in § 292-30.
Section 12. Amendment.
Subdivision B of subsection 6.1 (Conservation opportunities subdivision review procedures)
of Town Code Chapter 292 (Subdivision of Land), is hereby amended by deleting the
stricken words and adding the underlined words as follows:
§292-6.1. Conservation opportunities subdivision review procedures.
B. The subdivider shall submit a final plat in the form of all final plats, together with
supporting materials, to the office of the Planning Board. In addition, a digital copy of all
application materials shall be submitted in a format determined, and changed as
needed, by the Town Clerk. The Conservation Opportunities Plan shall be in accordance
with the provisions of Article IX (Final Plat for Minor Review) except as otherwise set
forth herein.
Section 13. Amendment.
Subdivision A of subsection 8 (Submission) of Town Code Chapter 292 (Subdivision of
Land), is hereby amended by deleting the stricken words and adding the underlined words
as follows:
§292-8. Submission.
A. Any owner of land shall, prior to subdividing or resubdividing land, shall submit to
the office of the Planning Board at least six copies of a preapplication of the proposed
subdivision, which shall use the standards set forth in Article X as a guide. In
addition, a digital copy of all application materials shall be submitted in a format
determined, and changed as needed, by the Town Clerk.
(1) In order to assist the Planning Board in determining whether a planned
residential development is appropriate for the site, the preapplication shall
include at least one alternate cluster plan which complies with the provisions of
§ 292-11 and Chapter 247 of the Town Code.
(2) Transfers of property shall be reviewed as a preapplication, where a resolution
waiving further subdivision review may be adopted by the Planning Board if it
finds that such transfer complies with this definition and is consistent with the
intent and purposes of these regulations.

Section 14. Amendment.
Subdivision G of subsection 39 (Preservation and protection of natural environment) of
Town Code Chapter 292 (Subdivision of Land), is hereby enacted by adding the underlined
words as follows:
§292-39. Preservation and protection of natural environment.
G. In addition, a digital copy of all application materials shall be submitted in a format
determined, and changed as needed, by the Town Clerk.
Section 15. Authority.
These amendments are authorized and enacted pursuant to Municipal Home Rule Law
§§10(1)(ii)(a)(11), (12), and §10(1)(ii)(d)(3).
Section 16. Severability.
If any section or subsection, paragraph, clause, phrase, or provision of this law shall be
adjudged invalid or held unconstitutional by any court of competent jurisdiction, any
judgment made thereby shall not affect the validity of this law as a whole, or any part
thereof other than the part or provision so adjudged to be invalid or unconstitutional.
Section 17. Effective Date.
This local law shall take effect upon filing with the Secretary of State pursuant to Municipal
Home Rule Law.
AND BE IT FURTHER RESOLVED, that the Town Board of the Town of Southampton hereby
directs the Town Clerk to forward a copy of the proposed local law to the Southampton
Town Planning Board as well as the Suffolk County Planning Commission for their review
and recommendations; and be it further

Notice of Public Hearing:
NOTICE OF PUBLIC HEARING
TAKE NOTICE, that the Town Board of the Town of Southampton hereby directs that a
public hearing shall be held on February 11, 2020, at 1:00 p.m., at Southampton Town
Hall, 116 Hampton Road, Southampton, New York, to hear any and all persons either for or
against a local law entitled, “A LOCAL LAW amending various provisions of the Southampton
Town Code, including Chapters 330 (Zoning), 292 (Subdivision of Land), and 325
(Wetlands), to require a digital submission of particular applications.”
Summary of Proposed Law
In an effort to increase the Town Clerk’s storage capacity, improve efficiency and
effectiveness, and to benefit the environment, the Town Board of the Town of Southampton,
upon the Town Clerk’s recommendation, seeks to require the submission of digital copies of
applications to the various Town boards and agencies. A digital copy shall mean a copy that
is identical in content to a paper copy, except that it is recorded electronically, in a read-
only .pdf format, to be submitted on a CD-ROM, DVD, or USB flash drive with each
application.
While the Town is not yet in a position to accept only digital copies, and is instead requiring
the submission of both a digital copy and a paper copy, requiring a digital copy now is an

important interim step towards creating a permanent comprehensive digital submission and
storage framework for the Town’s records.
Copies of the proposed law, sponsored by Councilman Bouvier, are on file in the Town

Accept and File Notice of Completion of the Final Supplemental
Generic Environmental Impact Statement (FSGEIS) related to the
Amendment to Chapter 330 adding Article XXXII, Sections 330-
421 through 330-439 as the Form-Based Zoning Overlay District
entitled 'Hampton Bays Downtown Overlay District' (HBDOD)
WHEREAS, the Town Board as Lead Agency for the original GEIS has determined that this is
a Type I Action and as such a Supplemental GEIS is needed and appropriate to update the
data from the previous GEIS based on today's conditions, to include an additional level of
detail such as a hypothetical build-out scenario in order to test the parameters of the
proposed Overlay District that will be expressed within the Form-Based Zoning Regulations
as well as indicate thresholds and conditions where a site-specific EIS may be required; and
WHEREAS, by Resolution No. 2018-944 dated September 25, 2018, the Town Board
initiated the Positive Declaration/Supplemental GEIS process and re-established themselves
as Lead Agency and by Resolution No. 2018-354 retained the Planning Consulting Firm
Nelson, Pope & Voorhis LLC to prepare the Supplemental GEIS that assesses the impact of
adopting the new zoning; and
WHEREAS, by Resolution 2019-596 dated May 14, 2019 the Town Board deemed the
Supplemental Draft Generic Environmental Impact Statement Adequate for public review
and commenced public hearings on the subject zone change; and
WHEREAS, a Final Supplemental Generic Environmental Impact Statement (FSGEIS) has
been prepared by the Town's consultants which contains responses to the comments
received on the draft version (DSGEIS); and
WHEREAS, upon review of the Final SGEIS the Town Board, as Lead Agency, finds that said
document adequately responds to comments and will facilitate the preparation of findings
related to the adoption of the form-based code; now therefore
BE IT RESOLVED, that the Final Supplemental Generic Environmental Impact Statement
(SFGEIS) is hereby deemed complete, and Land Management is directed to prepare and file
A Notice of Completion of Final Supplemental Generic Environmental Impact Statement
(FSGEIS) for Publication in the Environmental Notice Bulletin (ENB) as prescribed in SEQRA
(6 NYCRR) Section §617.12; and
BE IT FURTHER RESOLVED, that the Town Clerk is hereby directed to forward this resolution
to the involved and interested agencies as described in Resolution 2019-596 noting that
these agencies may access the Town's website for the complete document. An additional
hard copy of the document shall be kept on file in the Town Clerk's annex in Hampton Bays
and provided to the Hampton Bays Public Library.
Copies of the Final Supplemental Generic Environmental Impact Statement (FSGEIS) are on
file in the Town Clerk’s Office, Monday through Friday, from 8:30 a.m. to 4:00 p.m., and on
the Southampton Town Website http://www.southamptontownny.gov
