Opening:
The Agricultural Advisory Committee meeting was called to order at 7:00 pm on November 20, 2019 in
the Southold Town Hall conference room.
Next Meeting(s):
The next regular AAC meeting will be Wednesday, December 4, 2019 at 7:00 pm in the Southold
Town Hall Conference room.

Town Engineer, Michael Collins is the invited guest for the December 4 meeting.
Points to be covered with Michael Collins:
Michael Collins opinion on the 2018 Water consumption in the Town of Southold report by
Glynis Berry.
Michael Collins opinion on water quality in the Town of Southold and the assumptions made
about the contribution of nitrogen by Agriculture.
Where is the Town of Southold with regard to water testing?
Septic systems
Cultivated acres vs. Sod acres.
Attempt to organize a meeting with Land Preservation before the year end.
Minutes and Administration:
Minutes of October 9, 2019 to be submitted by Chris Baiz for review at a subsequent AAC meeting.
Motion made by Tom Stevenson to accept the corrected meeting minutes of November 6, 2019,
seconded by Mark VanBourgondien. All in favor, motion passed.
Review Proposed Acquisition of Development Rights:
No new proposed Acquisitions presented to the committee for review.
Discussion on DRS agricultural land parcels and the restrictive easements on past parcels
preserved.
Discussion on a sunset clause to restrictive language in easements.
Easements are unnecessarily lengthy and should mirror chapter 70 of the Town Code.
Discussion on Amending past easements.
Discussion on basis for the extinguishing of easements on land that may be permanently
under water in the future.
Can development rights be sold under different classifications?

Proposed Agricultural Revisions to Town Code:
Review of the draft of Chapter 70 of the Town Code with suggested changes:
70-3
Add Mariculture and Aquaculture crops.
Add wording for on-farm direct marketing.
Structures and equipment for any agricultural purposes and incidental uses such
as an Agricultural business office, bathroom facilities, dining hall for farm workers,
etc. to support the farm operation.
Development Right-change to: The permanent legal interest or right to prohibit or
restrict the use of land for the purpose of residential subdivision & development.
Structure-change to: Anything requiring a building permit from the Town shall be
considered a structure.

B. Added language-The seller (Grantor) may, and should, provide its own
appraisal.

A. (End of paragraph A) except as may be amended to the benefit of Agriculture in
the future. Provided such amendment is more restrictive (Ref. 280-4 Ag
Definitions).
B. (End of paragraph B) alienation of the development rights only. (with language
that follows development rights stricken.
Strike out C. \[2\] and the agricultural economy in general.
Strike out C. \[3\] and replace with: Permits for structures for agricultural use on
lands in which DRS have been acquired by the Town shall be reviewed and
granted by the Town Building Dept.
Add Farmstead Area requirement into Chapter 70.

Review of New York State Department of Agriculture and Markets Model Agricultural
Conservation Easement.

Discussion if Town law supersedes New York State Ag & Markets.
Discussion about the Town of Southold presenting Ag & Markets easement language as more
restrictive than the Town. However, when in reviewing the document, the reverse was found.
Discussion on restoring equality to DRS and Non DRS lands with regard to Agriculture in the
Town Code.
Contact John Risnica of Ag & Markets to clarify some points.
Review Applications for structures related to Agriculture on parcels with Town /County owned
development rights.
No new applications submitted regarding structures for committee review.
