Town Hall Conference Room A meeting of the Southold Town Conservation Advisory Council was held on December 4, 2019 in the Town Hall Conference Room. Present were: Peter Young, Chairman John Stein, Member Peter Meeker, Member James Abbott, Member Caroline Burghardt, Member Carol Brown, Member Lauren Standish, Committee Secretary Absent: James Dinizio, Town Board Liaison CALL TO ORDER The meeting was called to order at 4:30PM by Chairman Peter Young. PLEDGE OF ALLEGIANCE CHAIRMAN'S ANNOUNCEMENTS Chairman Peter Young distributed copies of"Shoreline Stabilization Techniques" to each, of the members. CLIMATE SMART COMMUNITES PROGRAM Several of the committee members attended a Climate Smart Communities meeting in Riverhead, which was hosted by Mark Lowrey from the NYSDEC. 2 The CAC has been invited by Supervisor Russell to attend the Department Head meeting on Mon., December 9th at 10AM to be introduced and present them with a brief overview of the program and the process moving forward. The CAC will then schedule appointments with each of the department heads. REPORTS Caroline Burghardt attended the Board of Trustees meeting-held on Wed., November 13tH The application made on behalf of the Gardiner's Bay Homeowners Assoc. was approved by the Board of Trustees. This application was Not Supported by the CAC. Carol Brown will be drafting a final update of the environmental contact list for distribution. Peter Meeker suggested the CAC consider combining this list with Mark Haubner's list. LWRP Update: Peter Young and John Stein will continue working on a checklist with Mark Terry. END OF YEAR REPORT Peter Meeker asked the CAC members for an end of year report for 2019 accomplishments and 2020 goals. The following was compiled: Accomplishments: Climate Smart Communities Pledge. Reduced the amount of redundancies of property reviews. Agreed to assist with LWRP coordinated reviews. Agreed to assist with Red-Knot Monitoring. Attended group meetings. Participated in water-sampling with Trustee Bredemeyer. Creation of a conservation directory. Improvement in group attendance and participation. Goals: Continue to recruit new members. Obtain a Bronze Level Certification for the town through the CSS. Continue working as the task force for the CSS. APPROVAL OF MINUTES Moved by Caroline John Stein, seconded by Carol Brown, to Approve the Minutes of November 6, 2019. DISCUSSION AND RECOMMENDATION OF WETLAND PERMIT & COASTAL EROSION PERMIT APPLICATIONS Moved by John Stein, seconded by Carol Brown, it was i 3 RESOLVED to SUPPORT the application of MICHAEL SMITH & THERESA SMITH for the installation of an in-ground pool 12'X 30' with on-grade patio around the pool and 4' high fence enclosure, and drywells for discharge. Located: 1405 Terry Lane, Orient. SCTM#14-3-2 Inspected by' John Stein, Carol Brown, Peter Meeker The CAC Supports the application using best management practices. Vote of Council: Ayes: All Motion Carried Moved by Carol Brown, seconded by John Stein, it was RESOLVED to SUPPORT the application of JOHN B. HENRY REVOCABLE TRUST to replace an existing cesspool with a new I/A sewage disposal system. SCDHS is considering this project a best fit sanitary upgrade only. Located: 2360 Village Lane, Orient. SCTM#26-1-15.1 Inspected by: John Stein, Carol Brown, Peter Meeker The CAC Supports the application using best management practices. Vote of Council: Ayes: All Motion Carried Moved by Carol Brown, seconded by John Stein, it was RESOLVED to NOT SUPPORT the application of ANTHONY TARTAGLIA & JAMES HOWELL for the installation of a 130 If. rock revetment at toe of existing bluff to protect property against additional storm erosion. Existing 4'X 13' steps to beach will be replaced in same location and one additional set of 4'X 3' steps to beach north of existing. Located: 55255 North Rd., Greenport. SCTM#44-1-9 Inspected by: John Stein, Carol Brown, Peter Meeker The CAC does Not Support the application. The proposed plan is insufficient to stabilize the property and the applicant should consider a better engineered plan. Any stairs to the beach should have retractable stairs at the base. Vote of Council: Ayes: All Motion Carried Moved by Peter Meeker, seconded by John Stein, it was RESOLVED to SUPPORT the application of MATTHEW STANTON to install 30 If.'of rip- rap bank stabilization at entry to existing dock. Located: 2725 Wells Ave., Southold. SCTM#70-4-16 Inspected by: John Stein, Carol Brown, Peter Meeker 4 J The CAC Supports the application and recommends the applicant contact Cornell Cooperative Ext. for bluff stabilization plantings. Vote of Council: Ayes: All Motion Carried Moved by Carol Brown, seconded by Peter Meeker, it was RESOLVED to SUPPORT the application of ROGERS TRUST to construct-a second-floor addition to existing two-story single-family dwelling. No additional bedrooms proposed, two additional bathrooms and new balcony proposed. Proposed addition approx. 3,000 sf., total square footage 6,010 sf. upon completion, with attached garage. Located: 420 Schooner Dr., Southold. SCTM#71-2-9 Inspected by: John Stein, Carol Brown, Peter Meeker The CAC Supports the application, however, there is a concern with the adequacy of the existing sanitary system. Gutters, leaders and drywells should be installed to contain the stormwater run-off. Vote of Council: Ayes: All Motion Carried Moved by James Abbott, seconded by Caroline Burghardt, it was RESOLVED to SUPPORT the application of MARY ANN HOWKINS for a one-story dwelling with attached garage, replace existing deck with wood deck, remove existing stone patio, and abandon existing sanitary system. Install walkway with 2' stone pavers and 20' existing cellar entrance. On north side of dwelling, outdoor shower enclosure, generator and air conditioning units on 3'X 5' concrete pads. Continue walkway with 2' stone pavers and install new sanitary system. Renovate house with new cedar shingles, new windows and doors and new roof shingles. Remove existing asphalt circular driveway and install a gravel driveway with 20' parking area. Install a silt fence during construction and gutters, leaders and drywells.' , ` Located: 3245 Wells Rd., Southold. SCTM#86-2-7 Inspected by: James Abbott, Peter Young, Caroline Burghardt The CAC Supports the application and recommends an I/A septic system, and the designation of a non-disturbance buffer between the top of the bank and the limit of tidal wetlands. Vote of Council: Ayes: All Motion Carried Moved by Caroline Burghardt, seconded by James Abbott, it was 5 RESOLVED to SUPPORT the application of DARCY GAZZA to remove existing 1275 sf. house and replace with a new house in same location and of same approx. footprint on the existing foundation. New dwelling to include a 14.1 sf. addition on landward side of house as well as an 80 sf. addition and 388 sf. deck on seaward side of the dwelling. Located: 1500 Beebe Drive, Cutchogue. SCTM#103-3-4 Inspected by: James Abbott, Peter Young, Caroline Burghardt The CAC Supports the application and recommends an I/A septic system, and the buffer should be designated on the plan as a non-disturbance buffer. Vote of Council: Ayes: All Motion Carried Moved by Caroline Burghardt, seconded by James Abbott, it was RESOLVED to NOT SUPPORT the application of JEFFREY R. LEMLER & ANCA LEMLER for a new sand beach area, approx. 25'X 70', using approx. 50 cy. of sand; a border of landscaping boulders set to separate the current existing beach area from the proposed beach area, using 50 If. of stones; general cosmetic landscape improvements using native vegetation with existing trees to remain; new gravel path from the beach area to the house using gravel; and areas with wood chips are proposed along the property lot line and around planting areas. No structures need to be erected on site for this work. Sand will be deposited with a small bobcat. All materials and plants'will be locally sourced at a local landscaping installer who will execute and supervise all proposed work. Located: 320 Broadwaters Rd., Cutchogue. There is a concern with the compliance of the chain-link fence and the potential negative impacts the placement of sand could have on the ecosystem. Vote of Council: Ayes: All Motion Carried Moved BY Caroline Burghardt, seconded by James Abbott, it was RESOLVED to SUPPORT the application of SILVIA CAMPS & DAVID HERMER to replace two existing retaining walls perpendicular to the top of bluff with cement retaining walls; replace wood platform and existing beach access with retractable stairs to beach; and repair or replace, as needed, lower 32' railroad ties adjacent to lower platform. Located: 3675 Nassau Point Rd., Cutchogue. SCTM#1 11-9-4.2 Inspected by: James Abbott, Peter Young, Caroline Burghardt Vote of Council: Ayes: All Motion Carried 6 Moved by Caroline Burghardt, seconded by John Stein, it was RESOLVED to SUPPORT the application of WILLIAM & KAREN GOYDAN to remove existing floating docks, and construct a new fixed timber dock, with water and electricity, consisting of a 4'X 78' elevated catwalk, using open-grate decking; a TX 14' hinged ramp; and a 6'X 20' floating dock secured by two (2) 8" dia. pilings. Located: 1645 Marratooka Rd., Mattituck. SCTM#123-3-1 Inspected by: James Abbott, Peter Young, Caroline Burghardt The CAC Supports the application using best management practices, the installation of gutters, leaders and drywells, and a non-disturbance area landward of the shoreline. Vote of Council: Ayes: All Motion Carried Moved by Caroline Burghardt, seconded by John Stein, it was RESOLVED to SUPPORT the application of JANE SEETH IRRVECABLE TRUST, DOUGLAS SEETH REVECABLE LIVING TRUST for the removal and replacement of existing 160 If. timber bulkhead with new vinyl bulkhead in same location as existing and raised height of 12" above existing top cap elevation and an 8 If. bulkhead return on north section. Remove and dispose of existing wood deck landward of bulkhead on southern end of property. Remove and replace existing 6'X 8' fixed dock on northern end of property in same location as existing which is part of an existing property ROW, remove existing fixed dock adjacent to residence and replace with 8'X 15' fixed dock in slightly southerly location. All decking and top caps to be untreated timber or composite material. A 5' wide non-turf buffer provided landward of proposed bulkhead. Located: 175 Mesrobian Dr., Laurel. SCTM#145-4-13 Inspected by: James Abbott, Peter Young, Caroline Burghardt The CAC Supports the application with a 10' vegetated non-turf buffer and the roof run-off is addressed. Vote of Council: Ayes: All Motion Carried Moved by Caroline Burghardt, seconded by John Stein, it was RESOLVED to SUPPORT the application of 65 SOUNDVIEW LLC for proposed 100' stone armoring along face of existing bulkhead with 1-2 ton armor stones. Silt fencing to be used during construction and filter fabric to be used at base of stones. Located: 65 Soundview Ave., Mattituck. SCTM#99-3-2 Inspected by: James Abbott, Peter Young, Caroline Burghardt The CAC Supports the application and recommends aggressive measures be taken to stabilize the slope, which may include a retreat from the crest of the bluff. Vote of Council: Ayes: All Motion Carried RECOMMENDATIONS-APPLICATIONS TO AMEND WETLAND & COASTAL EROSION PERMIT APPLICATIONS Moved by John Stein, seconded by Carol Brown, it was RESOLVED to NOT SUPPORT the application of CLAUDIO PURITA to Amend Wetland Permit# 9276 and Coastal Erosion Permit#9276C to allow the "as-built" installation of a 1.5 to 3 ton rock armoring in front of the bulkhead; two concrete retaining walls and revised stairway and walkway down bluff; gravel splash zone just landward of the bulkhead; seasonal aluminum platform and stairs leading from the bulkhead to the beach and revegetation of the bluff. Located: 19995 SoundviewAve., Southold. SCTM#51-4-6 Inspected by: John Stein, Carol Brown, Peter Meeker The CAC does Not Support the application due to two (2) previous failures. Consideration to move the house further landward is recommended. Vote of Council: Ayes: All Motion Carried Moved by Carol Brown,,seconded by John Stein, it was RESOLVED to NOT SUPPORT the application of STUART THORN to Amend Wetland Permit#7429 and Coastal Erosion Permit#7429C to allow construction of a 12' rock revetment in space between west end of existing bulkhead and proposed rock revetment on adjacent neighbor's property. Located: 19375 Soundview Ave., Southold. SCTM#51-1-20.1 Inspected by: John Stein, Carol Brown, Peter Meeker The CAC does Not Support the application due to the two (2) previous failures. Vote of Council: Ayes: All Motion Carried Carol Brown will attend the next regular meeting of the Board of Trustees scheduled for Wed., December 11, 2019 at 5:30PM. The next meeting of the Conservation Advisory Council will be held on January 8, 2020 at 4:30PM in the Town Hall Conference Room.
