SUFFOLK COUNTY ADMINISTRATIVE CODE: This application was referred as required under the Suffolk County Administrative Code Sections A 14-14 to 23, and the Suffolk County Department of Planning issued its reply dated August 13, 2019 stating that this application is considered a matter for local determination as there appears to be no significant county-wide or inter-community impact. LWRP DETERMINATION: This application was referred for review under Chapter 268, Waterfront Consistency review of the Town of Southold Town Code and the Local Waterfront Revitalization Program (LWRP) Policy Standards. The LWRP Coordinator issued a recommendation dated November 20, 2019. Based upon the information provided on the LWRP Consistency Assessment Form submitted to this department, as well as the records available to us, it is our recommendation that the proposed action is INCONSISTENT with LWRP policy standards and therefore is INCONSISTENT with the LWRP. Policy 1. Foster a pattern of development in the Town of Southold that enhances community character, preserves open space, makes efficient use of infrastructure, makes beneficial use of coastal location, and minimizes adverse effect of development. The proposed action is located within the Residential 40 low density zoning district. The purpose of the zoning district is: The purpose of the Low-Density Residential R-40 District is to provide areas for residential development where existing neighborhood characteristics, water supply and environmental conditions permit full development densities of approximately one dwelling per acre and where open space and agricultural preservation are not predominate objectives. Page 2,January 2,2020 #7344, Streeter SCTM No. 1000-64-1-14.5 & 14.6 The proposed action cannot achieve approximately one dwelling per acre. The applicant is requesting relief for 43.3% of the 40,000 square feet lot area requirement. If approved, the action would set precedent and reinforce a traditional land use pattern of the Town of Southold that is not supported. The proposed action does not meet this policy. Policy 5. Protect and improve water quality and supply in the Town of Southold. The purpose of this policy is to protect the quality and quantity of water in the Town of Southold. Quality considerations include both point source and non-point source pollution management so that existing and potential sources of groundwater contamination are either removed or reduced significantly. The increase of residential density in the Town Creek watershed would contribute nutrient loads and VOC's through sanitary waste disposal and potential use of herbicides and pesticides through property management that are capable of degrading groundwater quality. The increase in groundwater use and sustainable supply to serve the population is also a concern. Residential density above that is allowed by zoning, results in greater use of potable water for irrigation and filling of pools (if installed) causing strain on the potable water supply in the peak use periods(summer months). Policy 6.3 Protect and restore tidal and freshwater wetlands. Wetlands within the Town of Southold are critical natural resources that provide benefits including: open space, habitat for fish and wildlife, water quality enhancement, flooding and erosion protection, scenic value, and opportunities for environmental education. Wetlands and their benefits are also dependent upon the condition of adjacent lands which directly positively or negatively impact the systems. Development in watersheds and in close proximity to creeks has resulted in loss and impairments to the wetlands and their functions cumulatively impacting the Town of Southold's ecosystem. The action would increase residential density within the Town Creek watershed. The increase in residential density within close proximity to marine, surface waters results in increased nutrient loading and pesticide and herbicide inputs that would contribute to the degradation of surface water quality over time. TOWN OF SOUTHOLD, PLANNING BOARD: This application was referred to the Planning Board for review and comments. In a memorandum dated November 22, 2019, the Planning Board recommended denying the application based upon the potential for cumulative adverse impacts to traffic, water quality and water quantity. This recommendation is due to the precedent this would set of granting large area variances for small lots that could affect neighborhoods in at least 18 other areas in the Town, from Laurel to East Marion. Setting this precedent is not consistent with the Town's Comprehensive Plan. The Planning Board notes the subject parcel includes a 20' right of way traveling over a flag and across the entire parcel. The area of the right of way must be deducted from the total to determine the lot area upon which a variance is requested for a subdivision. Town Code ¢280-4 Definitions defines Lot Area as follows: Page 3,January 2,2020 #7344, Streeter SCTM No. 1000-64-1-14.5 & 14.6 The area of a lot taken at its perimeter, exclusive of any portion within a public or private street right-of-way. Based on the surveys submitted,the total lot area minus the right of way area for each lot is estimated as: • Proposed Lot North (SCTM: 64-1-14.5) Total Lot Area=22,637 square feet Right of Way Area=2,490+/- square feet Lot Area Proposed=20,147+/- square feet Area Variance=50% • Proposed Lot South (SCTM: 64-1-14.6) Total Lot Area=41,735 square feet Right of Way Area=6,180+/-square feet Lot Area Proposed=35,555 +/-square feet Area Variance= 11% As shown by the calculations above, both proposed parcels would require an area variance, with the northern lot requiring a substantial variance. Proposed Lot North would not meet the lot depth required in the bulk schedule, and neither proposed lot would meet lot width. Timeline: 1971 Subdivision via Planning Board created the two subject tax parcels (Lots 3 & 4 in the Latson Minor Subdivision). 1973 Minimum lot size was increased to 40,000 square feet 1983 Subject parcels merged when the Town enacted the merger law 1996 Landowner Latson acknowledge Lots 3,4 & 5 merged 1996 Letter from Town Planning acknowledging the merged lots 1996 Map showing lot numbers recognized by the Suffolk County Department of Health Services 2014 Current owner purchased the property as merged via a single deed Moreover, the Planning Board indicates that the access to the subject property is over a 20' private right of way from Youngs Avenue known as Town Creek Lane. A subdivision to add more lots to this right of way would not be allowed due to its insufficient width. Town Code §161 Highway Specification requires a minimum right-of-way width of 50' to access five lots or more. Minimum width requirements exist for public safety reason including emergency access, the nature of which has changed over time as emergency equipment has evolved and become larger. Subdividing the subject property would create a total of seven lots that use Town Creek Lane for access. The proposed subdivision would also create adverse impacts from pollution to nearby Town Creek, only about 380 feet away. Nitrogen from an additional septic system and lawn fertilizer, and pesticides and herbicides from landscape maintenance will quickly infiltrate to Town Creek and the bay. Similar to the old filed maps referenced in our memo from July 20, 2019 regarding ZBA File #'s 7289 & 7294, the earliest Planning Board subdivisions were created without much consideration for environmental impacts, and well before the State Environmental Quality Review Act was enacted, and subdivision review from the Suffolk Country Department of Health Services occurred. Page 4, January 2,2020 #7344, Streeter SCTM No. 1000-64-1-14.5 & 14.6 The Town's Comprehensive Plan, which currently consists of several plans including the Local Waterfront Revitalization Plan as well as the Town Code, identifies that Residential-40 Zoning District as having a minimum lot size of 40,000 square feet. Many parcels in the subject neighborhood are pre-existing, non-conforming with regard to the lot dimensions and setbacks in the Town Code. Applying a zoning distract with a larger minimum was intentional on the part of the legislative body of the Town, and has been common practice to reduce the impact that come from overly dense development over time. This is the main goal of the merger law that requires that undersize parcels merge when held in the same ownership. Granting substantial area variances to unmerge lots using the rationale that the other lots in the neighborhood are small would undermine the zoning in all the areas where there are smaller lots. There are likely a larger number of merged lots in the Town. If the precedent is set by granting this variance, the concern is that the more applications will come in to divide properties using substantial variances, resulting in an increase in the future buildout. Furthermore, an increase in the Town's future buildout will have adverse effects on the Town over time. The adverse effects would include an increase in traffic, and a strain on the water supply, as well as increasing the pollution of our drinking water and bays and creeks by adding more septic systems." The ZBA acknowledges that much of the Planning Board's comments are logically directed toward Town wide impacts to increased residential density, while the Board of Appeals must address standards specifically related to the merits of each individual area variance application within the context of a site-specific neighborhood. However, the Planning Board's comments regarding the 20-foot width of the private right of way from Youngs Avenue, known as Town Creek Lane, to the subject properties and the other lots in the subject subdivision are most pertinent. The Planning Board notes that the proposed subdivision would add an additional lot to the existing subdivision and-adding more lots to this right of way would not be allowed due to its insufficient width. This code was confirmed by the Town Fire Marshall, James Easton, in an a mail dated December 11, 2019 which was sent to the applicant's attorney for comments (see below). TOWN OF SOUTHOLD, FIRE MARSHAL: At the request of the Zoning Board of Appeals for comments, the Town of Southold Fire Marshal has reviewed the above-referenced application and offered a written response, dated December 11, 2019 indicating: "Town Code states that a ROW in an R district serving 5 or more lots must be 50' in width." PROPERTY FACTS/DESCRIPTION: The subject non-conforming, 22,637 square feet (after subtraction of the right of way area, 20,147 square feet buildable), .52 acre irregular-shaped parcel, known as Lot 3 (SCTM: 1000-64- 1-14.5) located in the R-40 Zoning District measures north 9.56 feet and dog-legging 36.32 feet and finally 79.18 feet along a residentially developed lot to the west then runs east 183.39 feet, establishing a northern property line along a second residentially developed lot, then runs south 124 feet along two residentially developed lots to the. east, then runs west 168.86 feet along a fifth residentially developed lot to the south, known as Lot #4 (SCTM: 1000-64-1-14.6), also owned by the applicant and subject of this area variance. A 20 feet wide right-of-way, known as "Town Creek Lane"runs along the western lot line of Lot#3 and continues south to the adjacent lot. Lot #4 is a non-conforming, 41,735 square feet (after subtraction of the right of way area, 35,555 square feet buildable), .96 acre irregular-shaped parcel located in the R-40 Zoning District and measures 168.86 feet along a northern lot line shared with the adjacent undeveloped lot also owned by the applicant, then runs south 60 feet and then east 85.60 feet along a residentially developed lot to the east, then south 168.19 feet along a second residentially developed lot to the southeast,then runs west 95.74 feet along a third residentially developed lot to the south, then runs north 52.33 feet and then west 169.61 feet, then south 53.17 feet and 179.20 feet along a fourth Page 5, January 2,2020 #7344, Streeter SCTM No. 1000-64-1-14.5 & 14.6 residentially developed lot, then 24.27 feet west along the tie line at Town Creek,then north 164.14 feet and 52.19 feet and finally 93.28 feet along a fifth residentially developed lot. A 20 feet wide right-of-way, known as "Town Creek Lane"runs along the western lot line of Lot#4 and continues north to the adjacent lot. Lot#3 is unimproved however, there is an existing stone drive and parking area, substantial fencing and gates and a frame shed measuring 10.3 feet by 12.3 feet. Lot 44 is improved with a 1-story frame house, wood deck, screen porch, generator, air handlers, fencing, gates, a stone drive and parking area, as illustrated on surveys prepared by John C. Ehlers Land Surveyor, and dated April 19, 2019. BASIS OF APPLICATION: Request for Variances from Article IV, Section 280-18 and the Building Inspector's May 10, 2019, Notice of Disapproval based on an application for a subdivision to re-create two previously legal lots merged by Town Law; at, 1) proposed lot will be less than the code required minimum lot area of 40,000 sq. ft.; 2) proposed lot will be less than the code required minimum lot width of 150 feet; 3) proposed lot will be less than the code required lot depth of 175 feet; located at 400 & 650 Town Creek Lane, (Adj. to Town Creek) Southold,NY. SCTM No. 1000-64-1-14.5 & 14.6. RELIEF REQUESTED: The applicant requests variances to reestablish Lot #3 (SCTM: 1000-64-1-14.5) as a legally separate and independent, non-conforming building lot with a lot area measuring 22,637 square feet (20, 147 square feet buildable)where the code requires a minimum lot area of 40,000 square feet, a lot width of 124 feet where the code requires a minimum width of 150 feet and a lot depth of 168.86 where the code requires a minimum lot depth of 175 feet. ADDITIONAL INFORMATION: Lot #3 and Lot #4 were legally subdivided in 1971 with Planning Board approval. While owned by the creator of the subdivision, the lots were merged in 1983 when the merger law was enacted and the then owner, in writing acknowledged the merger to the Planning Board as part of a letter dated 1996 in order to allow lots #1 & #2 to be developed. The subject, merged lots, have been transferred three times since the creation of the initial subdivision and as such would not qualify for a Waiver of Merger application. Covenants and Restrictions are recorded on Lot #4 limiting the use of the eastern, rectangular, portion of the lot maintaining `open space' for the benefit of the neighbor to the south, Lot #5 of the original subdivision (SCTM: 1000-64-1-14.7). The subject parcel transferred to the current owner by single deed. The following Certificates of Occupancy are recorded and presumably apply to the combined, merged, lots: Z690 Issued June 28, 1960 for a single-family dwelling(cottage) Z30844 Issued April 6, 2005 for a deck addition to an existing cottage Z30872 Issued April 20, 2005 for alterations to an existing one family dwelling(cottage) Two immediate neighbors spoke in favor of this application and all owners of the right of way, known as Town Harbor Lane, were present at the public hearing. The applicant and the applicant's attorney verbally indicated their willingness to create Covenants and Restrictions on Lot #3, if relief is granted to reestablish the building lot, including, but not limited to restricting the overall size of the house to 1,500 square feet including all floors, decking, porches and accessory structures and to also place similar Covenants and Restrictions on Lot #4 maintaining the existing cottages size to New York State's Building Code for minimum standards for a single family residence. The applicant stated that proposed C & R's were offered in order to maintain the small scale of the neighborhood and to limit development. Furthermore, the applicant and the neighbors who spoke at the hearing, indicated that they do not want to change the nature of the right of way and see their road `suburbanized'. At the conclusion of the public hearing the applicant was asked to provide a document clarifying all Covenants and Restrictions proposed on both lots to the ZBA. In a letter dated December 9, 2019, the applicant's attorney reiterated their arguments for granting relief and did not clearly indicate the proposed Covenants and Restrictions as requested. By unanimous vote, the Board reopened the hearing on December 5, 2019 in order to request comments by the Town of Southold Fire Marshal relative to the application. Comments from this Official were received December 11, 2019 and were forwarded to the applicant for comment. t Page 6,January 2,2020 #7344, Streeter SCTM No. 1000-64-1-14.5 & 14.6 FINDINGS OF FACT/REASONS FOR BOARD ACTION: The Zoning Board of Appeals held a public hearing on this application on December 5,2019 at which time written and oral evidence were presented. Based upon all testimony, documentation, personal inspection of the property and surrounding neighborhood, and other evidence,the Zoning Board finds the following facts to be true and relevant and makes the following findings: 1. Town Law 4267-b(3)(b)(1). Grant of the variances will produce an undesirable change in the character of the neighborhood or a detriment to nearby properties. As a result of the 1971 Latson subdivision, a 20 feet wide right of way, known as Town Harbor Lane, currently exists allowing access to six residences. By recreating a previously merged lot a seventh residence will require access via this modest, unpaved road and in order to achieve access the road, per Town Code, will need to be widened to a minimum of 50 feet with the full cooperation of all of the owners of the right of way. In so doing, the very nature of this quiet, small scale enclave will be forever altered. Additionally, in widening the roadway to accommodate the re-subdivision of Lot#3, various setbacks for several area homes will be altered detrimentally creating the potential need for additional variance relief. Furthermore, the lot calculations for buildable area are negatively impacted by the widening of the right of way, to accommodate code,thereby further reducing the proposed building lot area of Lot#3. 2. Town Law §267-b(3)(b)(2). The benefit sought by the applicant cannot be achieved by some method, feasible for the applicant to pursue, other than an area variance. As a result of the merger law enacted in 1983, the subject parcel was merged with the lot to the south. In order to re-subdivide this parcel, an area variance is required. 3. Town Law &267-b(3)(b)(3). The variances granted herein are mathematically substantial, representing 50% relief from the code relative to lot size area for Lot#3 and 11% relief from the code relative to lot size area for Lot #4 and 17.3% relief from the code for lot width of Lot 43 and 3.5% relief from the code for lot depth of Lot #3. While Lot 93 previously existed as part of a Planning Board approved subdivision, the lot has since been merged with an adjacent lot to the south and while the newly calculated lot area and setbacks establish a new lot similar in nature to the majority in the immediate area, because of the lack of a 50 feet wide access road, the potential for relief is restricted. 4. Town Law §267-b(3)(b)(4). Evidence has been submitted to suggest that a variance in this residential community will have an adverse impact on the physical or environmental conditions in the neighborhood. According to the Town LWRP Coordinator, "the action would increase residential density within the Town Creek watershed. The increase in residential density within close proximity to marine, surface waters results in increased nutrient loading and pesticide and herbicide inputs that would contribute to the degradation of surface water quality over time." 5. Town Law &267-b(3)(b)(5). The difficulty has been self-created. The applicant purchased the parcel after the Zoning Code was in effect and it is presumed that the applicant had actual or constructive knowledge of the limitations on the use of the parcel under the Zoning Code in effect prior to or at the time of purchase. 6. Town Law 4267-b. Grant of the requested relief is not the minimum action necessary and adequate to enable the applicant to enjoy the benefit of a subdivision while preserving and protecting the character of the neighborhood and the health, safety and welfare of the community. Policy 1. Foster a pattern of development in the Town of Southold that enhances community character,preserves open space, makes efficient use of infrastructure, makes beneficial use of a coastal location, and minimizes adverse effects of development. The proposed action is located with the Residential 40 low density zoning district. The purpose of the zoning district is: The purpose of the'Low-Density Residential R-40 District is to provide areas for residential development where existing neighborhood characteristics, water supply and environmental conditions permit full development densities of approximately one dwelling per acre and where open space and agricultural preservation are not predominate objectives. The proposed action cannot achieve approximately one dwelling per acre. The applicant is requesting relief for 43.3% of the 40,000 sq. ft. lot area requirement. If approved,the action would set precedent and reinforce a traditional land use pattern of the Town of Southold that is not supported. The proposed action does not meet his policy. Policy S Protect and improve water quality and supply in the Town of Southold. The purpose of this policy is to protect the quality and quantity of water in the Town of Southold. Quality considerations include both point source and non-point source pollution management so that existing and potential sources of groundwater contamination are either removed or reduced significantly. The increase of residential density in the Town Creek watershed would contribute nutrient loads and VOC's through sanitary waste disposal and the potential use of herbicides and pesticides through property management that are capable of degrading groundwater quality. The increase in groundwater use and sustainable supply to serve the population is also a concern. Residential density above that is allowed by zoning, results in greater use of potable water for irrigation and filling of pools(if installed)causing strain on the potable water supply in the peak use periods(summer months). Policy 6.3 Protect and restore tidal and freshwater wetlands. Wetlands within the Town of Southold are critical natural resources that provide benefits including: open space,habitat for fish and wildlife,water quality enhancement,flooding and erosion protection, scenic value, and opportunities for environmental education. Wetlands and their benefits are also dependent upon the condition of adjacent lands which directly positively or negatively impact the systems. Development in watersheds and in close proximity to creeks has resulted in loss and impairments to the wetlands and their functions cumulatively impacting the Town of Southold's ecosystem. The action would increase residential density within the Town Creek watershed. The increase in residential density within close proximity to marine, surface waters results in increased nutrient loading and pesticide and herbicide inputs that would contribute to the degradation of surface water quality over time. Wilcenski, Chairman Members of the Planning Board Date: November 22, 2019 Re: Request for Comments for Streeter Lot Area Variance SCTM#1000-64.-1-14.5& 14.6 ZBA #: 7344 The Planning Board has reviewed your request for comments regarding the above- referenced file, and recommends denying the applications based on the lack of adequate access and the potential for cumulative adverse impacts to traffic, water quality and water quantity. This recommendation is due to the precedent this would set of granting large area variances for small lots that could affect neighborhoods in at least 18 other areas in the Town, from Laurel to East Marion. Setting this precedent isnot consistent with the Town's Comprehensive Plan. The subject parcel includes a 20' right of way traveling over a flag and across the entire parcel. The area of the right of way must be deducted from the total to determine the lot area upon which a variance is requested for a subdivision. Town Code U80-4 Definitions defines Lot Area as follows: The area of a lot taken at its perimeter, exclusive of any portion within a public or private street right-of-way. Southold Town Planning Boaju Page 12 Jovember 22, 2019 Based on the surveys submitted, the total lot area minus the riqht of way area for each lot is estimated below: • Proposed Lot North (64-1-14.5) Total Lot Area = 22,637 sq. ft. Right of Way Area = 2,490+1- sq. ft. Lot Area Proposed = 20,147+/- sq. ft. o Area Variance = 50% • Proposed Lot South (64-1-14.6) Total Lot Area = 41,735 sq. ft. Right of Way Area = 6,180+/- sq. ft. Lot Area Proposed = 35,555+/- sq. ft. o Area Variance = 11% As shown by the calculations above, both proposed parcels would require an area variance, with the northern lot requiring a substantial variance. Proposed Lot North would not meet the lot depth required in the bulk schedule, and neither proposed lot would meet lot width. Timeline 1971 -- Subdivision via Planning Board created the two subject tax parcels (Lots 3 &4 in the Latson Minor Subdivision —see attached). 1973 -- Minimum lot size was increased to 40,000 sq. ft. 1995 -- Subject parcels merged when the Town enacted the merger law. 1996 -- Landowner Latson acknowledges Lots 3, 4 & 5 merged (see attached letter). (Later Lot 5 was able to be separated because it met the minimum lot size) 1996 -- Letter from Town Planning acknowledging the merged lots (see attached). 1996 — Map showing lot numbers recognized by the Suffolk County Department of Health Services (see attached). 2014 Current owner purchased the property as merged via a single deed The access to the subject property is over a 20' private right of way from Youngs Avenue known as Town Creek Lane. A subdivision to add more lots to this right of way would not be allowed due to its insufficient width. Town Code §161 Highway Specifications requires a minimum right-of-way width of 50' to access five lots or more. Southold Town Planning Boal u` Page 13 -.1ovember 22, 2019 Minimum width requirements exist for public safety reasons including emergency access, the nature of which has changed over time as emergency equipment has evolved and become larger. Subdividing the subject property would create a total of seven lots that use Town Creek Lane for access. The proposed subdivision would also create adverse impacts from pollution to nearby Town Creek, only about 380 feet away. Nitrogen from the additional septic system and lawn fertilizer, and pesticides and herbicides from landscape maintenance will quickly infiltrate to Town Creek and the bay. Similar to the old filed maps referenced in our memo from July 20, 2019 regarding ZBA File#s 7289 & 7294, the earliest Planning Board subdivisions were created without much consideration for environmental impacts, and well before the State Environmental Quality Review Act was enacted, and subdivision review from the Suffolk County Department of Health Services occurred. The Town's Comprehensive Plan, which currently consists of several plans including the Local Waterfront Revitalization Plan as well as the Town Code, identifies the Residential-40 Zoning District as having a minimum lot size of 40,000 square feet. Many parcels in the subject neighborhood are pre-existing, non-conforming with regard to the lot dimensions and setbacks in the Town Code. Applying a zoning district with a larger minimum lot size was intentional on the part of the legislative body of the Town, and has been common practice to reduce the impacts that come from overly dense development over time. This is the main goal of the merger law that requires that undersize parcels merge when held in the same ownership. Granting substantial area variances to unmerge lots using the rationale that the other lots in the neighborhood are small would undermine the zoning in all the areas where there are smaller lots. There are likely a larger number of merged lots in the Town. If the precedent is set by granting this variance, the concern is that more applications will come in to divide properties using substantial variances, resulting in an increase in the future buildout. And an increase in the Town's future buildout will have adverse effects on the Town over time. The adverse effects would include an increase in traffic, and a strain on the water supply, as well as increasing the pollution of our drinking water and bays and creeks by adding more septic systems. (1) An undesirable change will not be produced in the CHARACTER of the neighborhood or a detriment to nearby properties if granted,because: The applicant's two parcels are lot 3 and lot 4 on the Helen M. Latson subdivision approved by the Southold Town Planning Board May 13, 1971. Mrs. Latson continued to keep the title of the lots in her name after up-zoning. In 1996,Lots 1 & 2 of the subdivision were merged in order to be developed by the owner to meet the Health Department standards at the time (40,000 sq.ft. without public water); Lot 5 was improved with a single family home and was more than one acre, therefore it was conforming. Lot 4 (applicant's improved property is over one acre with the flag). The only remaining property is lot 3 which would have remained merged until an owner pursued an area variance for the parcel. The applicant has a very small cottage on lot 4, she would like to construct another small home on the separate parcel. She does not want to have this parcel over-developed and would impose a Covenant & Restriction limiting the size of the house on the vacant lot, Tax Map # 1000-64-1- 14.5. At the time Latson developed the parcels the subdivision of 4 acres would have allowed 8 homes. Latson subdivision in 1971 only applied for a 5 lot subdivision. Thereafter, the Latson family and their purchasers limited the development of the subdivision to only 4 homes. Lots 1 & 2 were merged. The proposed area variance would enable the applicant to develop the vacant lot, as it had always been planned. The subdivision map shows two cottages on lot 4. (2) The benefit sought by the applicant CANNOT be achieved by some method feasible for the applicant to pursue,other than an area variance,because: The applicant wants to keep the property underdeveloped. Two small homes (cottages), one on each parcel,will maintain the character of the parcels as this owner intends. (3) The amount of relief requested is not substantial because: The area variance is substantial due to the one acre zoning requirement. However, the surrounding parcels along Youngs Avenue are between 10,000 sq.ft. and 20,000 square feet in size, therefore the subject lot is significantly larger than the Youngs Avenue parcels. The lots on Maple Lane(to the east)are a little larger than the Latson lots(@33,000 sq.ft.). (4) The variance will NOT have an adverse effect or impact on the physical or environmental conditions in the neighborhood or district because: The applicant is willing to limit the size of a home on the parcel beause she wishes to maintain the character of her two parcels. The above referenced subdivision was granted Final Approval by the Southold Town Planning Board on May 13, 1971 —39 years ago., At the time this above referenced subdivision was granted final approval by the Town of Southold, the New York State Environmental Quality Review Act, 6 NYCRR Part 617(SEQRA)did not exist. SEQRA was not enacted until 1976. A previous letter(see attached)from the Town of Southold Planning Department was sent to the applicant due to Suffolk County Department of Health Services (SCDHS) requests for SEQRA on the above referenced subdivision on September 17, 1996. As previously stated in the fetter from the Southold Town Planning Department dated September 17, 1996, no SEQRA review was conducted by the Town of Southold at the time of approval for the above referenced subdivision as this subdivision was grarited f=inal Approval by the Southold Town Planning Board in 1971, five (5)years prior to the existence and enactment of SEQRA. Also, by this letter my client wishes to confirm her wish to file C&R's which restrict the size of homes on both lots. The Planning Board's recommendation to deny the requested variance due to 1. lack of adequate access 2. potential cumulative adverse impacts to traffic and water quality 3. precedent to other areas are not supported by the record. The applicant's two parcels are lot 3 and lot 4 on the Helen M. Latson subdivision approved by the Southold Town Planning Board May 13, 1971. Mrs. Latson subdivided @4 acres into 5 lots. In 1996, Lots 1 & 2 of the subdivision were merged in order to meet the Health Department standards at the time (40,000 sq.ft. without public water); Lot 5 was improved with a single family home and was more than one acre, therefore it was conforming under the lot area regulations at the time. Therefore, out of the 5 lots approved, if the area variance is granted, only 4 lots would be developed. 1. Access: The access is existing and at the hearing all the applicable fee owners of the access (private road) were present. Each owner described their applicable ownership and acknowledging that a portion of the common road is owned by the applicant. The northerly portion (@500 feet) of the road is owned by the northerly lots (combined lot 1 and 2), The applicant is the owner of approximately 200 feet of the north-south road, and the owner of Lot#5 on the Latson subdivision owns the east-west 500 feet up to the Town owned portion which includes the park. There are two separate access points which connect to the public road (Young's Avenue). All the Latson lots have mutual easements for access and for utilities. This easement was memorialized by Stanton in order to secure public water. All the owners cooperate and maintain the road. Furthermore, in response to the Planning Board's comments the common road was designed to serve not only the 5 Latson Lots of which only 3 are developed, this application being the 4th lot, but also two existing lots along Town Creek Lane. The westerly portion of Town Creek Lane is owned by the Town of Southold. Southold Town Highway Department has not improved their portion of the road to conform to their own Highway Specifications. The neighbors cooperate among themselves to keep the road in good condition for emergency access and the road conforms to the minimum requirements for emergency vehicles. Based on the comments made at the public hearing, the neighbors would not want to see their road "suburbanized". The proposed lot appears on a Planning Board approved subdivision map; therefore, it is not a new lot and the Highway Specifications do not apply. Moreover, Town Code section § 240-57 provides waiver from subdivision review by the Planning Board for the following:(1) A resubdivision of nonconforming lots shown on a subdivision map approved by the Planning Board afte(April 9, 1957, and filed in the office of the Suffolk County Clerk or the Town Clerk, but not held in single-and-separate ownership. However, the reestablishment of the right to build on said lots shall require variance relief from the Zoning Board of Appeals. This lot would meet the criteria of Town Code 240-57. 2. Cumulative Impact mitigated: The potential cumulative adverse impacts to traffic and water quality caused by a large house which could'be built, as of right, on one combined parcel significantly exceeds the impact that the proposed restricted home sizes might cause on smaller lots. At the hearing the applicant confirmed what she had offered in her written submission to "limit the size of a dwelling on the proposed parcel to 1,500 sq.ft. of living space". At the hearing the applicant further offered the following Covenants in perpetuity: She further wishes to maintain the existing character of her two parcels. Applicant would restrict (in perpetuity) Tax Lot 14.6 that a dwelling size would be limited to a minimum habitable/living space permitted under the New York State Building Code. Her existing home is only 825 sq.ft. (2 bedrooms & 1 bath). Presently, the New York State Building Code (and Southold Town Code for "Dwelling") requires a minimum of 850 sq.ft. of living space. The above conditions, recorded in perpetuity, mitigates the Planning Board concerns. These conditions create a significantly greater limit of development on two properties then the development of one larger property. One large house containing an unlimited number of bedrooms would result in greater cumulative impact then the proposed. There was unanimous support from the adjoining neighbors for the area variances with Covenants. The Covenants limit the house size on both parcels. The Covenants are consistent with the prior development plan imposed on Tax Lot 14.6 by Stanton. The easterly side of lot 14.6 has a private agreement which keeps the area landscaped for the benefit of the owner of Lot#5. There has been a self-imposed community character which the applicant seeks to maintain. The applicant wishes to keep the homes architecturally and aesthetically small and nonintrusive. The proposed perpetual covenants will preserve the goals expressed in the comprehensive plans which also happen to coincide with the applicant's vision for her property. 3. Precedent: This application is unique in that the proposed lot was formerly approved by the Planning Board. Once the variance is granted this application will include an application to re-subdivide the lot. This lot continues to be recognized by a separate tax lot. During the Town's various studies (as referenced by the Planning Board's letter), the Town based their"conclusions and recommendations" using existing lots shown by the separate tax map number. The proposed subdivision lot was counted as part of the overall community density. These studies did not prepare single and separate searches of each vacant lot, this lot was counted and recognized as one of the many pre-existing nonconforming lots for "future build-out". The Streeter deeds identifies two parcels by tax map numbers and as separate parcels (parcel 1 and parcel 2). The County of Suffolk continues to recognize the existence of the two separate parcels. The deeds did not "combine" the two parcels and the Health Department continues to recognize these two parcels. If the Zoning Board grants the requested variances, once the Planning Board application is granted, there is no further action to be taken by any board or agency. In conclusion, this application is unique, The applicant (Ms. Streeter) is also unique in her desire to greatly limit the marketability of both properties. The re- subdivision of this property may not be in the client's financial best interest due to the proposed restrictions; however, the proposed subdivision will benefit the immediate neighborhood and the community.
