SUFFOLK COUNTY ADMINISTRATIVE CODE: This application was referred as required under the Suffolk County Administrative Code Sections A 14-14 to 23, and the Suffolk County Department of Planning issued its reply dated May 2, 2016 stating that this application is considered a matter for local determination as there appears to be no significant county-wide or inter-community impact. LWRP DETERMINATION: The relief, permit, or interpretation requested in this application is listed under the Minor Actions exempt list and is not subject to review under Chapter 268. TOWN OF SOUTHOLD HISTORIC PRESERVATION COMMISSION: The application was referred to the Commission for its review pursuant to Section 170-8 (A) of the Southold Town Code. A decision to approve the request for a Certificate of Appropriateness dated May 17, 2016 was received by the ZBA on June 7, 2016. PROPERTY FACTS/DESCRIPTION: The subject parcel is a 20,414 square feet non-conforming lot in an R-40 Zoning District. It fronts King Street for 117.78 feet; the western property line is 178.24 feet, the eastern property line measures 167.44 feet and the rear property line measures 118.82 feet. The parcel is improved with a pre- existing one and one half story frame dwelling, a pre-existing two car garage with attached frame shed and a one story frame cottage, all as shown on the survey/site plan, sheet SD.01, dated April 1, 2016, prepared by Kevin Perry,R.A. with survey data taken from a survey, prepared by Kenneth Woychuck, L.S. dated September 28,2015. Existing lot coverage is 14.47% as calculated by Kevin Perry, R.A. in his correspondence dated June 6, 2016. This parcel is within the Historic Landmark District and subject to the Historic Preservation Commission. BASIS OF APPLICATION: Request for Variances from Article XXIII Section 280-124 and Article III Section 280-15 and the Building Inspector's March 15,2016 Notice of Disapproval based on an application for building permit to additions and alterations to existing single family dwelling and construct in-ground swimming pool, at; 1) less than the code required front yard setback of 40 feet, 2)lot coverage at more than the code permitted maximum of 20%, 3)following proposed construction existing accessory garage/shed will be located in other than the code required rear yard, located at: 400 King Street Orient,NY. SCTM#1000-26-2-14 R Page 2,June 16,2016 #6961, Campbell SCTM No. 1000-26-2-14 RELIEF REQUESTED: The applicant requests variances to: 1) construct additions and alterations to the existing dwelling having an 8+/- foot front yard setback where the code requires a 40 foot minimum front yard setback, 2) construct additions, alterations and accessory structure (in-ground swimming pool) having a total lot coverage of 26.4% where the code permits a maximum of 20%, and 3) due to proposed construction, place pre-existing accessory structure(garage with attached shed) in a side yard location where the code requires a rear yard location, all as shown on the Site Plan/Survey, sheet SD.01 and architectural drawings sheets SD.02, SD.03, SD.04, SD.05 and SD.06 all dated April 1, 2016 and prepared by Kevin Perry,R.A. AMENDED APPLICATION: During the hearing, the applicant was asked to bring the plan into more conformity with the Town Code. The applicant, on June 6, 2016, submitted a plan decreasing the lot coverage to 23.87%, and bringing the plan into more conformity with the codes with respect to the original request for 26.37% total lot coverage. ADDITIONAL INFORMATION: The applicant submitted a list of variances granted, in the area, for lot coverage greater than 20% as evidence that may mitigate the substantiality of the requested proposed and amended lot coverage.Below is an analysis by the Board. Appeal 44881 for 170 Orchard St. in 2000 was granted a lot coverage variance of 34.4%. This lot is 8460 square feet. The existing lot coverage was 32.15%. This is a small lot, approximately 2/5 the size of the applicant's lot which has an institutional building(former Orient firehouse)that has been converted to a dwelling use and to use it as a comparison for lot coverage is not justified because of the lot size differential between them and the previous use of the existing structure. Appeal 44890 for 2495 King St. in 2000 requested a lot coverage variance of 22.3% and was granted a lot coverage variance of 21%. This lot is 11,812 square feet and its existing lot coverage was 7.6%. This is a small lot, less than 3/5 the size of the applicant's lot and was granted alternative relief for maximum lot coverage of 21%. This Appeal, compared to the others in this analysis, is the closest resemblance to what the applicant proposes. Appeal #5436 for 2360 Village Lane in 2004 was granted a lot coverage variance of 23.2%. This lot is only 4500 square feet and its existing lot coverage was 21.25%. It is not uncommon for lots of this small size to require a lot coverage variance. This is a small lot, less than 1/4 the size of the applicant's lot and to use it as a comparison for lot coverage is not justified because of the lot size differential between them. Appeal #5847 for 230 Vincent St. in 2005 was granted a 21.7% lot coverage variance. This lot is 10,044 square feet. This is a small lot, less than 1/2 the size of the applicant's lot and to use it as a comparison for lot coverage is not justified because of the lot size differential between them. Appeal #6130 for 145 King St. in 2008 was granted a lot coverage variance of 28.25%. This lot is 6732 square feet and its existing lot coverage was 27.4%. It is not uncommon for lots of this small size to require a lot coverage variance. This is a small lot, less than 1/3 the size of the applicant's lot and to use it as a comparison for lot coverage is not justified because of the lot size differential between them. Appeal #6720 for 560 Village Lane in 2014 was granted a lot coverage variance of 23.4%. This lot is 12,569 square feet and its pre-existing lot coverage was 23.5%. This is a small lot, approximately 3/5 the size of the applicant's lot, with pre-existing non-conforming lot coverage of 23.5% and the lot coverage variance granted was a reduction in lot coverage, all of which does not justify this Appeal to be used as a comparison for excessive lot coverage. Page 3,June 16,2016 #6961, Campbell SCTM No. 1000-26-2-14 There exists a section of the applicant's rear yard fencing in the southwest corner of this parcel that protrudes onto the adjoining property. The applicant proposes to relocate this fencing onto this property. The adjoining property to the west is in opposition to the requested variance. FINDINGS OF FACT/REASONS FOR BOARD ACTION: The Zoning Board of Appeals held a public hearing on this application on June 2,2016, at which time written and oral evidence were presented. Based upon all testimony, documentation, personal inspection of the property and surrounding neighborhood, and other evidence,the Zoning Board finds the following facts to be true and relevant and makes the following findings: 1. Town Law &267-b(3)(b)(1). Grant of the variance for a front yard setback of 8+/- feet will not produce an undesirable change in the character of the neighborhood or a detriment to nearby properties. The pre-existing dwelling has a 2.3 foot front yard setback and the proposed additions and alterations in the front yard will be setback further from the front property line and will be similar in style as to what exists today. Grant of a variance for a side yard location of the pre-existing two car garage with attached shed, due to the proposed construction, will not produce an undesirable change in the character of the neighborhood or a detriment to nearby properties. The two car garage with attached shed is pre-existing and is historically characteristic of the neighborhood. Grant of a variance for 23.87% lot coverage as noted in the Amended Application will produce an undesirable change in the character of the neighborhood or a detriment to nearby properties. Excessive lot coverage on locally medium sized parcels, such as the applicant's, will change the historical character of this neighborhood and set an undesirable change with excessive lot coverage. 2. Town Law X267-b(3)(b)(2). The benefit sought by the applicant cannot be achieved by some method, feasible for the applicant to pursue, other than an area variance for a front yard setback. The majority of the dwelling exists in its pre-existing non-conforming front yard location and any proposed additions and alterations will require a front yard setback variance. The benefit sought by the applicant cannot be achieved by some method, feasible for the applicant to pursue, other than an area variance for a side yard location of the pre-existing two-car garage with attached shed. The two-car garage with attached shed, with respect to the pre-existing dwelling, pre-exists narrowly in a conforming rear yard location. Any additions or alterations to the pre-existing dwelling in the rear yard will place the two-car garage with attached in a non-conforming side yard location. To relocate these long standing historical structures would not be feasible. The benefit sought by the applicant can be achieved by some method, feasible for the applicant to pursue, other than an area variance for lot coverage greater than 20%. The existing total lot coverage is 14.47% and a plan to increase the existing lot coverage to conform to the code is feasible. 3. Town Law §267-b(3)(b)(3). The variance granted herein for a front yard setback is mathematically substantial, representing 80% relief from the code. However, the pre-existing front yard setback is 2.3 feet and the proposed front yard setback is 8+/-feet, bringing the parcel into more conformity with the code. The variance granted herein for a side yard location of the pre-existing two car garage with attached shed is mathematically substantial, representing 100% relief from the code. However, this structure is pre-existing, narrowly in a rear yard location with respect to the pre-existing dwelling, and any additions and alterations such that are proposed will unavoidably place this accessory structure in a side yard location. The variance granted herein for alternative relief of 22% maximum lot coverage is not substantial, representing 10%relief from the code. 4. Town Law §267-b(3)(b)(4) No evidence has been submitted to suggest that a variance in this residential community will have an adverse impact on the physical or environmental conditions in the neighborhood. The applicant must comply with Chapter 236 of the Town's Storm Water Management Code. S. Town Law $267-b(3)(b)(5). The difficulty has been self-created. The applicant purchased the parcel after the Zoning Code was in effect and it is presumed that the applicant had actual or constructive knowledge of the limitations on the use of the parcel under the Zoning Code in effect prior to or at the time of purchase. 6. Town Law §267-b. Grant of the requested relief for a front yard setback of 8+/-feet and the location of the pre- existing two car garage with attached shed in a side yard location is the minimum action necessary and adequate to enable the applicant to enjoy the benefit of additions and alterations to the pre-existing dwelling, while preserving and protecting the character of the neighborhood and the health, safety and welfare of the community. Grant of alternative relief for maximum lot coverage of 22% is the minimum action necessary and adequate to enable the applicant to enjoy the benefit of improvements to this parcel while preserving and protecting the character of the neighborhood and the health,safety and welfare of the community. RESOLUTION OF THE BOARD: In considering all of the above factors and applying the balancing test under New York Town Law 267-B, motion was offered by Member Schneider, seconded by Member Weisman (Chairperson), and duly carried,to GRANT the variance for an 8+/-foot front yard setback and a side yard location of the pre-existing two car garage with attached shed as applied for, and shown on the survey/site plan, sheet SD.01, dated April 1, 2016, prepared by Kevin Perry,R.A. DENY the variance as applied for of lot coverage of 26.37% in the original application and DENY the variance as applied for of lot coverage of 23.87% in the Amended application, and GRANT ALTERNATIVE RELIEF for 22% maximum lot coverage. SUBJECT TO THE FOLLOWING CONDITIONS: - 1. Installation of a de watering dry well large enough to accommodate the discharge of pool water. 2. All pool equipment must be placed in a sound proof structure. 3. Any and all fencing that encroaches upon adjoining properties shall be removed and/or relocated to the applicant's property before a building permit is issued. That the above conditions be written into the Building Inspector's Certificate of Occupancy, when issued. This action does not authorize or condone any current or future use, setback or other feature of the subject property that may violate the Zoning Code, other than such uses, setbacks and other features as are expressly addressed in this action. The Board reserves the right to substitute a similar design that is de minimis in nature for an alteration that does not increase the degree of nonconformity. Before applying for a building permit, the applicant or agent must submit to the Board of Appeals for approval and filing, two sets of the final:site plan, including recalculation of lot coverage conforming to the alternative relief granted herein.
