April 15, 2019 Re: LWRP Coastal Consistency Review for GLEN & JOANNE MIDDLETON SCTM# 1000-53-4-17 Bulkhead Permits by Gary on behalf of GLEN & JOANNE MIDDLETON requests a Wetland Permit to replace existing 24"x61.5' section of a wave break in same place with an 18" increase in elevation, supported by (24) 10" diameter pressure treated timber pilings; replace existing inland 24"x17.5' lower concrete section of wave break in same place and to be constructed at the same proposed elevation as the new seaward section, supported by (8) 10" diameter pressure treated timber pilings. Located: 2405 Bay Shore Road, Greenport. SCTM# 1000-53-4-17 The proposed action has been reviewed to Chapter 268, Waterfront Consistency Review of the Town of Southold Town Code and the Local Waterfront Revitalization Program (LWRP) Policy Standards. Based upon the information provided on the LWRP Consistency Assessment Form submitted to this department, as well as the records available to me, the proposed action is recommended as INCONSISTENT with the LWRP. 1. The structure is a groin and does not meet§ 275-11. Construction and operation standards of the Southold Town Code. 2. The applicant has not shown that the public access along the foreshore will remain unimpeded by the "wave break" Pursuant to Chapter 268, the Board of Trustees shall consider this recommendation in preparing its written determination regarding the consistency of the proposed action. Replacement of existing inland 24" X 17.5' lower concrete section of the wave break in same place at the same elevation as the seaward section. Please forward all mail to: 57 Hewlett Ct Babylon,NY 11702. Proposed is replacement of existing 24"x61.5' section of a wave break in same place with an 18" increase in elevation for flood control, supported by(24)10"x20'pressure treated timber pilings driven to refusal. Also proposed is replacement of existing inland 24"x17.5'lower con- crete section of the wave break in same place at the same elevation as the seaward section,sup- ported by(8)10"x20 pressure treated timber pilings driven to refusal. Thus the 17.5'section height is proposed to match the adjacent 61.5'section. All equipment&materials will be trucked to project site via upland source by a licensed and in- sured contractor. This project is to replace antiquated wave break for flood control and property erosion. Please note, both wave break sections are existing before August 20, 1977 and visible on the NYSDEC Tidal Wetland maps.In addition, the Town of Southold doesn't allow pressure treated timber sheathing.Typically with this type of project we'd propose CCA timber with 3"spacing, however all untreated alternatives would quickly rot away. Thus corrugated vinyl sheathing is recommended. Please note the existing wave break as before mention was installed prior to 1977 and the existing T&G sheathing is not spaced. This project is minor in nature and offers no community concern. This project is located on Pipes Cove, in Suffolk County,Town of Southold.
