Metzger, LLS, last revised November 21,2013. FINDINGS OF FACT/REASONS FOR BOARD ACTION: The Zoning Board of Appeals held a public hearing on this application on January 3, 2018 at which time written and oral evidence were presented. Based upon all testimony, documentation, personal inspection of the property and surrounding neighborhood, and other evidence,the Zoning Board finds the following facts to be true and relevant and makes the following findings: 1. Town Law 4267-b(3)(b)(1). Grant of the variance will not produce an undesirable change in the character of the neighborhood or a detriment to nearby properties. The Lupton Point area consists of approximately 22 described lots which predate zoning, located on a quiet, private street. The subject property has been in existence since prior to zoning with no evidence of adverse impacts. The proposed additions are on the rear(seaward side)of the house and will have no visual impact on the street. 2. Town Law 4267-b(3)(b)(2). The benefit sought by the applicant cannot be achieved by some method, feasible for the applicant to pursue, other than an area variance. The present home has been in existence since prior to zoning and is located within the 75 foot bulkhead setback and the 50 foot rear yard setback. The proposed "as- built" walkout basement extension with enclosed porch and open deck above were built under the existing first floor deck (elevated on the seaward side due to the slop of the property) which was previously granted setback relief of 63.4 feet from the bulkhead where the code requires a minimum of 75 feet. 3. Town Law 4267-b(3)(b)(3). The variance granted herein is mathematically substantial,representing 15% relief from the code for a rear yard setback of 42.8 feet at the closest point where the code requires a minimum of 50 feet. However, the lot is irregularly shaped and the house is cited at an angle to the rear property line so that the setback increases to 63.4 feet from the portion of the rear of the lot that is bulkheaded which was the subject of a prior variance approval. No evidence has been submitted to suggest that a variance in this residential community will have an adverse impact on the physical or environmental conditions in the neighborhood. The applicant must comply with Chapter 236 of the Town's Storm Water Management Code, and comply with the determination made by the LWRP coordinator, and the conditions set by this board. 5. Town Law 4267-b(3)(b)(5). The difficulty has been self-created. The applicant purchased the parcel after the Zoning Code was in effect and it is presumed that the applicant had actual or constructive knowledge of the limitations on the use of the parcel under the Zoning Code in effect prior to or at the time of purchase. 6. Town Law &267-b. Grant of the requested relief is the minimum action necessary and adequate to enable the applicant to enjoy the benefit of an "as-built" basement addition enclosed porch and open deck above while preserving and protecting the character of the neighborhood and the health, safety and welfare of the community. RESOLUTION OF THE BOARD: In considering all of the above factors and applying the balancing test under New York Town Law 267-13, motion was offered by Member Lehnert, seconded by Member Dantes, and duly carried, to GRANT the variance as applied for, and shown on the plans (site plan, elevations, floor plans) prepared by Angela Mangels,Architect,dated July 25,2018. In considering this application, the Board has reviewed the code requirements set forth pursuant to Article III, Section 280-13(B)(13) to establish an Accessory Apartment in an Accessory Structure and finds that the applicant complies with the requirements for the reasons noted below: 1. The Accessory Apartment unit will be located on the second floor of the accessory garage with an area of 630 square feet of livable floor area in conformity as proposed,as described and shown on the floor plan by Angela Mangels, Architect dated July 25, 2018 and signed by Angela Mangels, R.A., and as confirmed by the Building Inspector in a memorandum titled"Verification of Livable Floor Area"dated November 26,2018 and received by the Board of Appeals on November 26, 2018. 2. The dwelling unit complies with the definition of same in §280-4 of the code and complies with the code requirements as defined in Section 280-13(B)(13) of the Zoning Code. The owner confirms that the accessory apartment shall not contain less than 450 sq. feet nor will the accessory apartment exceed 750 square feet of livable floor area, all on one floor with only one full bathroom. 3. The applicant herein, owns and resides at the property and will continue to occupy the single-family dwelling as a principal residence in conformance with the code requirements as set forth in Article 11I, Section 280-13(B)(13)0, 1-4), and as documented by driver's license, NYS tax return, utility bills, and notarized affidavit. The proposed tenant is the owner's mother,Muriel Doka, as documented by an affidavit signed by the owner and a rental agreement. 5. The owners' plans comply with the on-site parking requirements and provide for a total of three (3) parking spaces, two for the principal use and one for the Accessory Apartment, utilizing the existing driveway areas, as shown on the site plan and building plans (floor plan and elevations) prepared by Angela Mangels,Architect,dated July 25, 2018. 6. Only one accessory apartment will be on the subject property and no Bed and Breakfast facility, as authorized by Section 280-13(B)(14) hereof shall be permitted in or on premises for which an accessory apartment is authorized or exists. 7. This conversion is/shall be subject to a building permit, inspection by the Building Inspector, and annual renewal of the Certificate of Occupancy. REASONS FOR BOARD ACTION DESCRIBED BELOW: Based upon all testimony, documentation, personal inspection of the property and surrounding neighborhood, and other evidence, the Zoning Board finds the following facts to be true and relevant: 1) The Accessory Apartment, as applied for, is reasonable in relation to the District in which is located, adjacent use districts, and nearby adjacent residential uses. 2) This Accessory Apartment shall be in conjunction with the owner's residence in the Accessory structure, and as proposed will not prevent the orderly and reasonable use of districts and adjacent properties. 3) No evidence has been submitted to show that the safety, health, welfare, comfort, convenience, order of the Town would be adversely affected. 4)The special exception is authorized under the Zoning Code through the Zoning Board of Appeals as noted herein, and issuance of a Certificate of Occupancy from the Building Inspector is required by code before an Accessory Apartment may be occupied.
