SUFFOLK COUNTY ADMINISTRATIVE CODE: This application was referred as required under the Suffolk County Administrative Code Sections A 14-14 to 23, and the Suffolk County Department of Planning issued its reply dated October 15, 2019 stating that this application is considered a matter for local determination as there appears to be no significant county-wide or inter-community impact. LWRP DETERMINATION: The relief, permit, or interpretation requested in this application is listed under the Minor Actions exempt list and is not subject to review under Chapter 268. PROPERTY FACTS/DESCRIPTION: The subject property is a non-conforming 7,700 square foot parcel located in an R-40 Zoning District. The parcel measures 50.00 feet along the westerly property line fronting Old Shipyard Road, measures 140.00 feet along the northerly property line, measures 60.00 feet along the easterly property line and , and measures 140.35 feet along the southerly property line. The parcel is improved with a two-story frame house. All is shown on a survey prepared by John T.Metzger, LLS, last revised August 13,2019. BASIS OF APPLICATION: Request for Variances from Sections 280- 124 and the building inspector's August 13, 2019 Notice of Disapproval based on an application for a permit to demolish an existing dwelling and construct a new single family dwelling at 1) located less than the code required rear yard setback of 50 feet, 2)more than the code permitted maximum lot coverage of 20% located at 1605 Old Shipyard Lane, Southold,NY. RELIEF REQUESTED: The applicant requests a variance to build an 11 ft. x 18 ft. deck in the rear yard that will result in a rear yard setback of 23.8 feet where code requires a minimum rear yard setback of 50 feet and lot coverage of 23.6% where code allows a maximum lot coverage of 20%. ADDITIONAL INFORMATION: The applicant has the benefit of a ZBA Decision No. 6234 dated January 22, 2009 which granted alternative relief for a main floor rear deck to be no larger than 10 ft. by 8 ft., as a condition of approval, with a rear yard setback of 27 feet where code requires a minimum 35 foot rear yard setback, and a lot coverage, of 24.3% that was confirmed by a survey prepared by John Metzger, L.S., last revised July 6, 2010, where code permits a maximum lot coverage of 20%. This current variance application proposes to eliminate the Page 2,December 19,2019 #7355, 1605 OSYL,LLC SCTM No. 1000-64-5-30 addition of the front porch previously approved in the 2009 decision and to reduce lot coverage to 23.6% which will result in a lesser non-conforming variance. The applicant also received an approval for a de minimus change to the rear deck approved in ZBA No. 6234 on June 24, 2019 which allowed deck stairs to protrude 3 feet into the approved rear yard setback of 27 feet for a stair setback of 24 feet. The adjacent neighbor who appeared at the public hearing voiced no objection to a raised ground level deck in the rear yard. FINDINGS OF FACT/REASONS FOR BOARD ACTION: The Zoning Board of Appeals held a public hearing on this application on December 5, 2019 at which time written and oral evidence were presented. Based upon all testimony, documentation, personal inspection of the property and surrounding neighborhood, and other evidence,the Zoning Board finds the following facts to be true and relevant and makes the following findings: 1. Town Law X267-b(3)(b)(1). Grant of the variance will not produce an undesirable change in the character of the neighborhood or a detriment to nearby properties. The neighborhood consists of single family homes on similar sized lots. The proposed non-conforming lot coverage is smaller than what was previously approved and the non-conforming rear yard setback is for a deck which will remain open to the sky and will have a limited impact on the neighbors since an existing 6 foot high fence encloses the applicant's rear yad and maintains visual privacy from the adjacent neighbor's properties . The proposed rear deck will not be visible to the street 2. Town Law &267-b(3)(b)(2). The benefit sought by the applicant cannot be achieved by some method, feasible for the applicant to pursue, other than an area variance. The applicant's home has a non-conforming lot coverage which was approved by the ZBA in a prior decision and which the applicant proposes to reduce in order to build a rear yard deck that is larger than what was originally approved in ZBA No. 6234 The existing home is setback 35 feet from the property line and any proposed rear yard deck will require the benefit of an area variance. 3. Town Law &267-b(3)(b)(3). The variance(s) granted herein for a 23.8-foot rear yard setback is mathematically substantial, representing 53% relief from the code. The variance granted for a 23.6% lot coverage is substantial representing 18% relief from the code. However, the deck shall remain open to the sky and is not visible to adjoining properties or the street and the proposed lot coverage is less non-conforming than what was previously granted. 4. Town Law 4267-b(3)(b)(4). No evidence has been submitted to suggest that a variance in this residential community will have an adverse impact on the physical or environmental conditions in the neighborhood. The applicant must comply with Chapter 236 of the Town's Storm Water Management Code. 5. Town Law §267-b(3)(b)(5). The difficulty has been self-created. The applicant purchased the parcel after the Zoning Code was in effect and it is presumed that the applicant had actual or constructive knowledge of the limitations on the use of the parcel under the Zoning Code in effect prior to or at the time of purchase. 6. Town Law §267-b. Grant of the requested relief is the minimum action necessary and adequate to enable the applicant to enjoy the benefit of a rear yard deck while preserving and protecting the character of the neighborhood and the health, safety and welfare of the community. RESOLUTION OF THE BOARD: In considering all of the above factors and applying the balancing test under New York Town Law 267-B, motion was offered by Member Weisman (Chairperson), seconded by Member Planamento, and duly carried,to Page 3,December 19,2019 #7355, 1605 OSYL,LLC SCTM No. 1000-64-5-30 GRANT the variances as applied for, as shown on the survey prepared by John T. Metzger, LLS, last revised August 13, 2019, and on the Architectural Plan prepared by Mark Kevin Schwartz,Architect, dated June 13, 2019. SUBJECT TO THE FOLLOWING CONDITIONS: 1. The variance alternative relief granted in ZBA decision 6234 is hereby amended to reflect a maximum lot coverage of 23.6%, 2. The rear deck must remain uncovered and open to the sky; and the front porch shall not be enclosed. 3. The required stairs to grade must be located to the side of open deck so that it does not protrude into the side yard or rear yard beyond the 23.6-foot rear yard setback. That the above conditions be written into the Building Inspector's Certificate of Occupancy, when issued. Any deviation from the survey, site plan and/or architectural drawings cited in this decision will result in delays and/or a possible denial by the Building Department of a building permit, and may require a new application and public hearing before the Zoning Board of Appeals. Any deviation from the variance(s)granted herein as shown on the architectural drawings, site plan and/or survey cited above, such as alterations, extensions, or demolitions, are not authorized under this application when involving nonconformities under the zoning code. This action does not authorize or condone any current or future use, setback or other feature of the subject property that may violate the Zoning Code, other than such uses, setbacks and other features as are expressly addressed in this action. In the event that an approval is granted subject to conditions, the approval shall not be deemed effective until the required conditions have been met, and failure to comply therewith will render this approval null and void. The Board reserves the right to substitute a similar design that is de minimis in nature for an alteration that does not increase the degree of nonconformity. Pursuant to Chapter 280-146(B) of the Code of the Town of Southold any variance granted by the Board of Appeals shall become null and void where a Certificate of Occupancy has not been procured, and/or a subdivision map has not been filed with the Suffolk County Clerk,within three (3)years from the date such variance was granted. The Board of Appeals may, upon written request prior to the date of expiration, grant an extension not to exceed three (3) consecutive one (1)year terms. Reasons for the Board Action: "The addition of a slightly shallower front porch will reduce the proposed lot coverage" A smaller rear yard deck....... "reducing the proposed excessive lot coverage. Resolution of the Board: 3. Although the decision limits the deck size,that limitation was predicated on primarily reducing the overall coverage coupled with Maintaining a 27ft. rear yard setback. However,the Board then amended the decision by allowing the staircase to protrude an additional 3 ft. Into the rear yard setback. The primary intent of this application is to further reduce the overall coverage from 25.3%to 23.6 %,which was the goal of the Board in the original decision. These proposed rear yard additions will create a nonconforming rear yard setback of 27 feet for the proposed deck and porch and a rear yard setback of 19 feet for the proposed stairs. Collectively, the proposed additions will increase the lot coverage to 25.3%. ADDITIONAL INFORMATION: The applicant's home is a two-story modular construction on a crawl space that currently meets the code's maximum lot coverage of 20% and has a 35 ft. conforming rear yard setback. Because the dwelling had to be built to FEMA standards, the finished first floor had to be much higher in elevation than others in the neighborhood and therefore it appears much taller and larger than other homes in the immediate vicinity which are typically modest one- story ranch or bungalow style. The rear of the house was built with sliding doors on both floors in anticipation of proposed rear deck additions. The House currently does not have a Certificate of Occupancy. At the public hearing on January 8, 2009 written and oral testimony was given by neighbors who voiced their concerns over the applicant's dwelling changing the character of the neighborhood by virtue of it's unusually large appearance on a small lot and objected to increasing the lot coverage beyond what is allowed by code. They also voiced concerns over the loss of privacy in their own rear yards that the applicant's proposed elevated first floor and second story rear yard decks would cause. REASONS FOR BOARD ACTION: On the basis of testimony presented, materials submitted and personal inspections,the Board makes the following findings: 1. Town Law §267-b(3)(b)(3)(1). Grant of alternative relief will not produce an undesirable change in the character of the neighborhood or a detriment to nearby properties. The addition of a slightly shallower front porch will reduce the proposed 25.3% lot coverage and improve the appearance of the house from the street. Alternative relief cannot be achieved by w'k tfied;d Of Appeals feasible for the applicant to pursue, other than an area variance because the house currently has a code compliant lot coverage and rear yard setback so any proposed addition will require a variance. . 3. Town Law 4267-b(3)(b)(3). The variances as proposed are substantial in that the lot coverage of 25.3% represents a 26.5%variance beyond the code limits of 20% and the proposed rear yard setback of 27 feet is a 22.85% variance beyond the code required minimum of 35 feet. 4. Town Law §267-b(3)(b)(5). The difficulty hag been self-created insofar as the applicant could have chosen to build a smaller house in anticipation of his desire to have a front porch and two rear decks. 5. Town Law §267-b(3)W(4). No evidence has been submitted to suggest that a variance in this residential community will have an adverse impact on the physical or environmental conditions in the neighborhood. The house has been built to FEMA.standards and will adhere to the Town's drainage codes. 6. Town Law §267-b. Grant of alternative relief is the minimum action necessary and adequate to enable the applicant to enjoy the benefit of a front porch and rear deck while preserving and protecting the character of the neighborhood and the health, safety and welfare of the community. RESOLUTION OF THE BOARD: In considering all of the above factors and applying the balancing test under New York Town Law 267-B, motion was offered by Member Weisman, seconded by Member Oliva, and duly carried, to DENY the Variances as applied for, and to GRANT ALTERNATIVE RELIEF as noted below and subject to the following Conditions= 1. The proposed covered front porch shall be reduced from 8 ft.x 27.6 ft.to 6 ft x 27.6 feet. and 2.
