SUFFOLK COUNTY ADMINISTRATIVE CODE: This application was referred as required under the Suffolk County Administrative Code Sections A 14-14 thru A 14-25, and the Suffolk County Department of Planning issued its reply dated September 3, 2019 stating that this application is considered a matter for local determination as there appears to be no significant county-wide or inter-community impact. LWRP DETERMINATION: The relief, permit, or interpretation requested in this application is listed under the Minor Actions exempt list and is not subject to review under Chapter 268. PROPERTY FACTS/DESCRIPTION: The subject property is 30,822 sq. ft. non-conforming, split zoned residential parcel in R-40 and R-80 Zoning Districts. The northerly property line measures 221.42 feet,the easterly property line measures 154.97 feet, the southerly property line measures 85.60 feet and is adjacent to Kraus Road, and the westerly property line measures 144.84 feet. The lot is improved with a single-story wood framed dwelling with an attached garage and existing attached wooden deck in the rear of the residence and an existing shed on the northerly property line as shown on the survey map prepared by Roderick Van Tuyl, LLS, last revised October 20, 1987. BASIS OF APPLICATION: Request for a Variance from Article XXIII, Section 280-124 and the Building Inspector's July 26, 2019,Notice of Disapproval based on an application for a permit to legalize an "as built" deck addition attached to an existing single family dwelling; at, 1) located less than the code required side yard setback of 15 feet; located at 105 Kraus Road,Mattituck,NY. SCTM#1000-122-5-8. RELIEF REQUESTED: The applicant requests a variance to legalize an "as built" deck addition to an existing single-family dwelling. The "as built" construction, on this 30.833 square foot lot in the Residential R-40/R-80 District, is not permitted pursuant to Article XXIII, Section 280-124, which states lots measuring 20,000-39,999 square feet in total size require a minimum side yard setback of 15 feet. The construction has a side setback of 5 feet, 1 inch. Page 2,December 19,2019 #7347,Herwald SCTM No. 1000-122-5-8 ADDITIONAL INFORMATION: Included in the applicant's submittal are comparative variances, Appeal 45356 in 2003 and Appeal #4659 in 1999, both of which demonstrate relief granted to neighboring property owners for non-conforming deck additions. FINDINGS OF FACT/REASONS FOR'BOARD ACTION: The Zoning Board of Appeals held a public hearing on this application on December 5,2019 at which time written and oral evidence were presented. Based upon all testimony, documentation, personal inspection of the property and surrounding neighborhood, and other evidence,the Zoning Board finds the following facts to be true and relevant and makes the following findings: 1. Town Law $267-b(3)(b)(1). Grant of the variance will not produce an undesirable change in the character of the neighborhood or a detriment to nearby properties. The"as built" deck has been existing since the early 1980's. For more than 36 years the deck has been part of the neighborhood. The neighbors have not complained about the location of the deck over the past thirty-six years. The deck is screened from the adjoining neighbor by mature evergreens and cannot be seen from the street 2. Town Law $267-b(3)(b)(2). The benefit sought by the applicant cannot be achieved by some method, feasible for the applicant to pursue, other than an area variance. The applicant wishes to keep the deck in the same location it has been since the early 1980's. The deck was located in this location due to large trees. The deck allowed easy access from the rear of the home without the use of stairs. 3. Town Law §267-b(3)(b)(3). The variance granted herein is mathematically substantial,representing 66%relief from the code. However,the total deck is 272 sq. ft. and only 105 sq. ft. of the deck is on the non-conforming side yard. The majority of the deck meets the setback requirements. Most of the residences in the neighborhood have attached decks and there have been other appeals granted for deck additions in the area. 4. Town Law X267-b(3)(b)(4). No evidence has been submitted to suggest that a variance in this residential community will have an adverse impact on the physical or environmental conditions in the neighborhood. The east side of the property is heavily vegetated with bushes that keep the deck area out of the sight of neighbors. The applicant must comply with Chapter 236 of the Town's Storm Water Management Code. 5. Town Law $267-b(3)(b)(Q. The difficulty has not been self-created. The applicant's father built the house in the 1950's prior to zoning. The addition of the garage in the 1960's met the setback requirements at the time. 6. Town Law X267-b. Grant of the requested relief is the minimum action necessary and adequate minimum action to enable the applicant to enjoy the benefit of a rear yard "as built" deck while preserving and protecting the character of the neighborhood and the health, safety and welfare of the community. RESOLUTION OF THE BOARD: In considering all of the above factors and applying the balancing test under New York Town Law 267-13, motion was offered by Member Acampora, seconded by Member Planamento, and duly carried,to GRANT the variance applied for and shown on the site plan prepared by Stephen Brasgalla, Architect, and dated July 22, 2019. SUBJECT TO THE FOLLOWING CONDITIONS: 1. "As-Built"rear deck shall remain uncovered and unenclosed and open to the sky. Any deviation from the variance(s) granted herein as shown on the architectural drawings, site plan and/or survey cited above, such as alterations, extensions, or demolitions, are not authorized under this application when involving nonconformities under the zoning code. This action does not authorize or condone any current or future use, setback or other feature of the subject property that may violate the Zoning Code, other than such uses, setbacks and other features as are expressly addressed in this action. In the event that an approval is granted subject to conditions, the approval shall not be deemed effective until the required conditions have been met; and failure to comply therewith will render this approval null and void. The Board reserves the right to substitute a similar design that is de minimis in nature for an alteration that does not increase the degree of nonconformity. Pursuant to Chapter 280-146(B) of the Code of the Town of Southold any variance granted by the Board of Appeals shall become null and void where a Certificate of Occupancy has not been procured, and/or a subdivision map has not been filed with the Suffolk County Clerk,within three (3) years from the date such variance was granted. The Board of Appeals may, upon written request prior to the date of expiration, grant an extension not to exceed three (3) consecutive one (1)year terms. There is ample vegetation that physically screens this deck from view. The applicant seeks to construct a 30 foot by 12 foot deck attached to the rear of the existing single-family dwelling, located on a nonconforming 20,642 sq. ft. parcel. The new deck is proposed 33+-feet from the north property line and greater than 21 feet to the easterly side line. The proposed setbacks are similar to setbacks of the houses exosting in the neighboring area. The property's rear lot line is adjacent to a wooded parcel of approximately 1.8 acre in size, that is now, or was formerly owned by Peters, and accessed from Camp Mineola Road, a nearby private road. 2. The benefit sought by the applicant cannot be achieved by some method feasible for the applicant to pursue, other than an area variance. The location of the deck is reasonably placed, centered behind the dwelling and closely aligned to the rear line at the northwest(rear)section of the house. The dwelling is situated closer to the rear line than the front line, which limits the available rear yard area for a deck or other building Purpose. Without a variance,the applicant would be able to build a deck with only 5 foot in depth, which is not large enough for use by the family when entertaining out-of-doors. 3. The relief granted herein is substantial because the requested rear yard setback is a seven (7)ft reduction of the code-required minimum of 40 feet. All other distances are shown by applicant to be in conformity with the code's minimum requirements. 4. The difficulty for the applicant is self-created, since the applicant acquired the house and property in 1999, when the existing rear yard setback was the same as in the current Town Code, and is now proposing to reduce the conforming setback of the house with a new deck addition. 5. There is no evidence that the grant of the relief requested will have an adverse effect or impact on physical or environmental conditions in the neighborhood or district. No changes in the existing grading of this property will be needed in the construction of the proposed deck. There are no wetlands, or environmentally sensitive areas, on the property. 6. The relief offered to the applicant is the minimum action necessary and adequate to enable the applicant to enjoy the benefit of a rear yard deck, while preserving and Protecting the character of the neighborhood and the health, safety and welfare of the community. At that time , a minimum lot area of 12,500 sq . ft, was required , and..a variance was granted for the reduction of the parcel as shown on the Map of Albert Zanowski dated January 29 , 1951 , and referred to as Lot #3 . The Lot referred to as #4 appears to have properly been sold and merged with Eleanor Papish `s. northerly lot , and therefore the conditions of the 1960 variance have been complied with .
