SUFFOLK COUNTY ADMINISTRATIVE CODE: This application was referred as required under the Suffolk County Administrative Code Sections A 14-14 to 23, and the Suffolk County Department of Planning issued its reply dated August 13, 2019 stating that this application is considered a matter for local determination as there appears to be no significant county-wide or inter-community impact. LWRP DETERMINATION: The relief, permit, or interpretation requested in this application is listed under the Minor Actions exempt list and is not subject to review under Chapter 268. TOWN OF SOUTHOLD OFFICE OF THE ENGINEER: In a letter dated October 16, 2019 the Town Engineer. responded to a request from the Zoning Board of Appeals to review this application for compliance to the Town Code and more specifically Chapter 236 Stormwater Management. The property Site Plan(survey) last prepared by John Ehlers, LS, lasted revised July 1, 2019. The Town Engineer stated that the"as built"alterations have not been reviewed for compliance with Chapter 236 Stormwater Management, and it is recommended that stormwater management plan be prepared and certified by a design professional that meets the minimum requirement of Chapter 236. PROPERTY FACTS/DESCRIPTION: The subject property is a non-conforming 24,656 square foot parcel located in an R-40 Zoning District. The parcel measures 100.46 feet along the northerly property line fronting Sound Beach Drive, measures 236.71 feet along the westerly property line measures 87.50 feet along the southerly property line and measures 241.75 feet along the easterly property line. The parcel is improved with a one-story frame house, frame decks and a frame shed. The parcel has a steep topography with an elevation of 10 feet at Sound Beach Drive which climbs to an elevation of 90 feet at the top of the bluff. There is no driveway access off Summit Drive. The driveway is accessed from a 15-foot right of way off of Summit Drive, across the lot to the South of the applicant's property. All is shown on a survey by John Ehlers,L.L.S. last revised July 1, 2019. Page 2,December 19,2019 47341,935 Sound Beach SCTM No. 1000-106-1-43 BASIS OF APPLICATION: Request for Variances from Article III, Section 280-15; Article XXIII, Section 280- 124 and the Building Inspector's June 10, 2019, Notice of Disapproval based on an application for a permit to legalize "as built" additions to an existing single family dwelling and legalize an "as built" shed; at, 1) as built construction located less than the code required front yard setback of 40 feet; 2) as built construction located less than the code required side yard setback of 15 feet; 3) as built shed is located in other than the code permitted rear yard; located at 935 Sound Beach Drive,Mattituck,NY. SCTM No. 1000-106-1-43 RELIEF REQUESTED: The applicant requests variances to legalize decks having a front yard setback of 39.2 feet where a minimum of 40 feet is required by code and a side yard setback of 12.9 feet where the code requires a minimum of 15 feet, and to maintain a 10.2 ft. by 12.4 ft. frame shed in a side yard location where code requires an accessory shed to be placed in a rear yard. ADDITIONAL INFORMATION: A stop work order was issued to the applicant on April 3, 2019 for "Construction without first obtaining a Building Permit." FINDINGS OF FACT/REASONS FOR BOARD ACTION: The Zoning Board of Appeals held a public hearing on this application on December 5, 2019 at which time written and oral evidence were presented. Based upon all testimony, documentation, personal inspection of the property and surrounding neighborhood, and other evidence,the Zoning Board finds the following facts to be true and relevant and makes the following findings: 1. Town Law$267-b(3)(b)(1). Grant of the variance(s)will not produce an undesirable change in the character of the neighborhood or a detriment to nearby properties. The neighborhood consists of single-family homes and decks are typical accessories to single family homes. The house has a certificate of occupancy dated July 7, 1976 and is set at the same setback as the as-built decks. The variance for the front yard location is for a setback to the Southern property line which while technically a front yard that borders the neighbor's property and not a public road. Grant of the variance for the non-conforming shed location will not produce an undesirable change in the character of the neighborhood because the house has two front yards therefore the shed's side yard location is the least non-conforming location the shed could be placed. Moreover, neither the subject dwelling or any part of the subject property can be viewed from either Summit Drive or Sound Beach Drive 2. Town Law X267-1b(3)(b)(2). The benefit sought by the applicant for the as-built decks can be achieved by some method, feasible for the applicant to pursue, other than an area variance. The decks could be built with a code conforming side yard setback. However, the house was built under an old version of the code with a different required minimum side yard setback and the decks maintain the side yard setback from the house. The deck's non- conforming front yard setback is because of a 15-foot right of way on the Southern property line. The southern property line does not border a public street and the deck will not be visible from a public road. Due to the parcel having two front yards there is not a code conforming location for the shed therefore the applicant has no choice but to request variance relief in order to have a legal shed. 3. Town Law §267-b(3)(b)(3). The variances granted herein for the deck's side yard setback is mathematically substantial, representing 14% relief from the code. The variance granted herein for the deck's non-conforming front yard setback is not mathematically substantial representing 2% relief from the code. The variance granted herein for the shed is mathematically substantial representing 100% relief from the code. However, the property does not have a code conforming location to place a shed, the deck's side yard setback matches the house's side Page 3, December 19,2019 #7341,935 Sound Beach SCTM No. 1000-106-1-43 yard setback and the deck's non-conforming front yard setback is from the neighboring property line and not from a public or private road. 4. Town Law 4267-b(3)(b)(4). No evidence has been submitted to suggest that a variance in this residential community will have an adverse impact on the physical or environmental conditions in the neighborhood. The applicant must comply with Chapter 236 of the Town's Storm Water Management Code. 5. Town Law X267-b(3)(b)(5). The difficulty has been self-created. The applicant purchased the parcel after the Zoning Code was in effect and it is presumed that the applicant had actual or constructive knowledge of the limitations on the use of the parcel under the Zoning Code in effect prior to or at the time of purchase. 6. Town Law X267-b. Grant of the requested relief is the minimum action necessary and adequate to enable the applicant to enjoy the benefit of two decks and a shed while preserving and protecting the character of the neighborhood and the health, safety and welfare of the community. RESOLUTION OF THE BOARD: In considering all of the above factors and applying the balancing test under New York Town Law 267-B, motion was offered by Member Weisman (Chairperson), seconded by Member Acampora, and duly carried,to GRANT the variances as applied for, and shown on the architectural plans prepared by Jim Deerkoski, Professional Engineer, dated May 13, 2019; and survey prepared by John Ehlers,LLS, last revised July 1, 2019. SUBJECT TO THE FOLLOWING CONDITIONS: 1. "As-Built"front and rear decks shall remain uncovered and unenclosed and open to the sky. 2. As recommended by the Office of the Town Engineer, the applicant shall prepare a stormwater management plan to be certified by a design professional that meets the minimum requirement of Chapter 236. That the above conditions be written into the Building Inspector's Certificate of Occupancy, when issuer. Any deviation from the survey, site plan and/or architectural drawings cited in this decision will result in delays and/or apossible denial by the Building Department of a buildingpermit, and may require a new application and public hearing before the Zoning Board of Appeals. Any deviation from the variance(s) granted herein as shown on the architectural drawings, site plan and/or survey cited above, such as alterations, extensions, or demolitions, are not authorized under this application when involving nonconformities under the zoning code. This action does not authorize or condone any current or future use, setback or other feature of the subject property that may violate the Zoning Code, other than such uses, setbacks and other features as are expressly addressed in this action. In the event that an approval is granted subject to conditions, the approval shall not be deemed effective until the required conditions have been met; and failure to comply therewith will render this approval null and void. The Board reserves the right to substitute a similar design that is de minimis in nature for an alteration that does not increase the degree of nonconformity. Based upon his review of the survey and building plans,the Town Engineer states in his letter, dated January 2, 2020 (copy attached), that the"as built" decks are not considered impervious structures, and therefore, have no requirement under Chapter 236 (Stormwater Management). Accordingly, Condition No. 2 is rescinded. I will confirm this action by resolution of the Members of the Board of Appeals at our next meeting-on January 23, 2020.
