Penny IV (9:45 a.m.-12:00 p.m.), Councilwoman Ruth D. Oliva~ Councilwoman Ellen M. Latson, Councilman Thomas H. Wickham, Town Attorney Harvey A. Arnoff, Assistant Town Attorney Matthew G. Kiernan, Town Clerk Judith T. Terry. 9:45 A.M. The Town Board met with Charles Voorhis, Cramer, V0orhis & Associates, Environmental Consultants to the Town Board, to discuss the proposed Findings Statement with respect to the environmental aspect of the chapge of zone petitions of E.M. Kontokosta (Southold Commons)., and Jem Realty~ Co. (Jem Commons). It was determined that the Town Attorney would speak to Howard Pachman, attorney for the applicant of these projects, and request an extension of 'time for preparation of the Findings Statement until after the conclusion of the public hearings on same. Mr. Arnoff contacted Mr. Pachman, he agreed to an extension, and agreed to setting February 4, 1992 for a publid hearing on Jem Commons (see resolution no. 31), and a public hearing on Southold Commons on March 10, 1992 (see resolution no. 32). The Board also agreed to further retain the services of Cramer, Voorhis & Associates to complete the environmental review process on these petitions (see resolution no. 33). EXECUTIVE SESSION 10:25 A.M. On motion of Councilman Wickham, seconded by Councilwoman Oliva, it was Resolved to enter into Executive Session. Vote of the Boa rd: Ayes: Supervisor Harris, Justice Edwards, Councilman Penny, Councilwoman Oliva, Councilwoman Latson, Councilman Wickham. Also present: Town Attorney Arnoff, Assistant Town Attorney Kiernan, Town Clerk Terry, Councilman-Elect Joseph J. Lizewski, and Councilwoman-Elect Alice J. Hussie.---The Board met with John D. Williams and Jeffrey C. Witherspoon to discuss the litigation with respect to the 350th Video. Executive Session (continued) 10:20 A.M. - The Town Board met with Mildred B0yce, President of the North Fo_r_k Animal Welfare League, Inc., and William Cremers, Director of same to discuss the agreement between the League, Village of Greenport, and Town of Southold concerning the dog control services for the Village of Greenport. The Village of Greenport contends the League should enforce their Dog Ordinance by providing. dog control services and house the dogs at the Southold Town Dog Shelter at no cost to the Village. Town Attorney Arnoff does not agree with this theory, and he contends that the Village must enforce their own ordinance, and at a fee the League may, if they wish, provide housing at the shelter. Mr. Arnoff will send a letter to Village Attorney Dan Ross advising him of the Town's position. Executive Session (continued) 12:25 A.M. - The Board discussed the court decision with respect to the Home Occupation amendment to the Zoning Code wherein the Judge determined the Town should have completed a full Environmental Assessment Form. 12:45 P.M. - Recess for lunch. 2:00 P.M.- Work Session reconvened and the Town vouchers. Board audited outstanding EXECUTIVE SESSION 2:45 P.M. On motion of Supervisor Harris, seconded by Councilwoman Oliva, it was Resolved that the Town Board enter into Executive Session. Vote of the Board: Ayes: Supervisor Harris, Justice Edwards, Councilwoman Oliva, Councilwoman Latson, Councilman Wickham. Also present: Town Attorney ~Arnoff, Assistant Town Attorney Kiernan, Town Clerk Terry, Councilwoman-Elect Hussie.---The Board discussed personnel proposed appointment to the Board of Assessment Review. 3:10 P.M. - For Discussion Items: (1) Appointment to the Board of Assessment Review (see 2:45 P.M. executive session). No decision was reached. (2) Report from Recreation Supervisor Kenneth Reeves with respect to the Greenport School roller skating program to be held at the Greenport Legion and possible contribution to same by the Town. In reviewing a letter from Greenport School it was determined that all of the local schools are contributing to the program except Mattituck- Cutchogue and Laurel. Mr. Reeves will be asked to determine why they are not participating. (3) Reviewed resolution no. 29 with respect to reducing the bond estimate for Southold Villas, Phase I if a guarantees are provided with respect' to the completion of all site work (see resolution no. 29 for further details). (4) Council- man Wickham discussed the US/UK Countryside Exchange Report. 3:20 P.M. The Town Board reviewed the resolutions to be voted upon at the 4:00 P.M. Regular Meeting. EXECUTIVE SESSION. 3:55 P.M. - On motion of Supervisor Harris, seconded by Councilwoman Oliva, it was Resolved that the Town Board enter into Executive Session. Scott, Jr., Chairman of the Board of Assessors to further discuss the proposed appointment to the Board of Assessment Revi.ew. 4:00 P.M. - Work Session adjourned. 24O REGULAR MEETING A Regular Meeting of the Southold Town Board was held on Tuesday, December 10, 1991, at the Southold Town Hall, Main Road, Southold, New York. SUPERVISOR HARRIS: Come on up. What we have here is a class project. This is th~ Southold Daisy Troop #1332 of the Southold Girl Scouts. These children have brought their ornaments in to show the Town Board. They're going to decorate the Town tree. They've all made this special little project. Each one spent many, many hours making one, they said, and they certainly are looking forward to hanging them on the tree. I told them that they would be on the tree for many weeks for everybody to admire, and you can come back in yourself, and look at it with your parents if you w.ant, or bring your teachers back here again, to make sure that they're still here. Thank you, and we wish you all a Merry Christmas, and hope Santa brings you everything that you've asked for. IV. RESOLUTIONS. Harris to execute an application to Senate Insurance Company, Schenectady, New York, for Excess (Stop Loss) Insurance with respect to the Town's self-funded Health Care Benefit Plan, for the period ,of January 1, 1992 through December 31, 1992, at a premium cost of $11,916.00; all in accordance with the approval of the Town's Insurance Consultant William F. Harris to execute a Service Agreement between the Town of Southold and Lawrence Healthcare Administrative Services, Inc,, Schenectady, New York, for processing all medical and managed care benefit claims with respect to Southold Town's self-funded Health Care Benefit Plan, at a fee of $8.50 per employee per month for medical, and an additional fee fof $2.25 per employee per month for managed care program, for the period of January 1, 1992'through December 31, 1992, all in accordance with-the approval of the Town's Insurance Consultant William F. Harris to execute an amended agreement between the Town of Southold and Theodore Beebe, retired Police Sergeant, whereby Mr. Beebe will receive compensation for his accumulated unused vacation days and sick days in three payments: The first in the amount of $18,071.70 which was made on or about May 8, 1991, the second in the amount of $18,071.70 on or before January 15, !992, and the third in the amount of $36,143.40 on or before January 15, 1993, all in accordance with the amended agreement as prepared by the Town Attorney. 4.-Vote of the Town Board: Ayes: Councilman Wickham, Councilwoman Latson, Councilwoman Oliva, Councilman Penny, Justice Edwards, Supervisor Harris. This resolution was declared duly ADOPTED. 5.-Moved by Councilman Penny, seconded by Councilwoman Oliva, it was RESOLVED that the Town Board of the Town of Southold hereby authorizes the followin9 1992 Budget modification to the General Fund - Part Town to reinstate the full-time Bay Constable position previously cut fromt he 1992 Budget ($26,200.00),~ and remove two (2) seasonal Bay Constables in the 1992 Budget ($10,000.00): To: B3120.1 Bay Constable, Personal Services $ 16,200.00 From: B1910.4 Unallocated Insurance, Contractual Expenses $ 16,200.00 COUNCILWOMAN LATSON: Can I just comment on this, Scott? The Supervisor informed us that he received some additional funds, from insurance reimbursement, that had enabled the Town Board to reinstate the; third Bay Constable. Part of that criteria is that the Bay Constable will be working with the Town, and the CAC to increase the testing in Town creeks to provide for a data base to, hopefully, get many of the creeks that are now closed,reopened on conditional levels on a year-round basis, based on the rainfall, so that they could be opened not only in the winter months, but in the summer months, and I'm happy to see that we will be able to have a third Bay Constable on, and that he will be utilized in this manner. Thank you. DECEMBER 10, 1991 2 4.3 SUPERVISOR HARRIS: I'm also thankful that due to our request for proposal for insurance for the year '92, there was cost savings realized, and that we were able to reinstate this gentleman. It is very important,as Ellen has stated, that we assist the DEC, because of their budgetary cutbacks they're going to need additional help in testing many of our creeks, that have been closed due to high coliform count, and we know that working with the DEC, and also helping to utilize the Marine Science Learning Center in Cedar Beach in Southold. We ' hope to use that facility in a vein were we can become a test facility, actually a laboratory for testing coliform bacteria within our creeks, that have been closed to try to get them open. Bill Has-back, from the DEC that has been in charge of the shellfish program has assured me that, they will work with us to try to get many of these creeks opened up. A lot of it is not'due to the DEC criteria, but unfortunately due to the FDA, that sets the criteria for which the State of New York has to follow. So, I'm looking forward to working closely with Bill Hasback, Maureen Davison, and other personnel in the DEC, as well as the Town Trustees, the CAC, and ! am going to create a new Shellfish Advisory Committee in 1992 to help expedite these matters, to get these creeks opened up, and those who are closed permanently, or those on a conditional basis, hope- fully on a seasonal basis, if not permanent year round basis. So, Ellen, I'm also pleased that we can get working on this. It's very important, not only to the residents of this township, but also to the baymen of this town, the source of revenue for their livelihood. 5.-Vote of the Town Board: Ayes: Councilman Wickham, Councilwoman Latson, Councilwoman Oliva, Councilman Penny, Justice Edwards, Supervisor Harris. This resolution was declared duly ADOPTED. 6.-Moved by Councilman Wickham, seconded by Councilwoman Olvia, it was RESOLVED that the application of John C. Tuthill for renewal of his single family house trailer permit, for trailer located on the east side of Elijah's Lane, Mattituck, which permit expires on January 19, 1992, be and hereby is 9ranted for a six (6) month period. 6.-Vote of the Town Board: Ayes: Councilman Wickham, Councilwoman Latson, Councilwoman Oliva, Councilman Penny, Justice Edwards, Supervisor Harris. This resolution was declared duly ADOPTED. 8.-Moved by Councilwoman Oliva, seconded by Councilman Penny, it was RESOLVED that the Town Board of the Town of Southold hereby accepts the bid of Muse Heavy Equipment Service, Inc. for repairs to the Dresser 540 Payloader at the Southold Town Landfill, as per the bid specifications, at the bid price of $14,100.00, plus $250.00 for transportation, if required, all in accordance with the recommendation of Commissioner of Public Works Jacobs. 8.-Vote of the Town Board: Ayes: Councilman Wickham, Councilwoman Latson, Councilwoman Oliva, Councilman Penny, Justice Edwards, Supervisor Harris. This resolution was declared duly ADOPTED. 9.-Moved by Supervisor Harris, seconded by CouncilWoman Oliva, it was RESOLVED that the Town Board of the Town of Southold hereby appoints Dorothy E. Pfalzer to the part-time Clerk position in the office of the Receiver of Taxes, for the 1991/92 Tax Collection season, at a salary of $6.36 per hour. 9.-Vote of the Town Board: Ayes: Councilman Wickham, Councilwoman Latson, Councilwoman Oliva, Councilman Penny, Justice Edwards, Supervisor Harris .... This resolution was declared duly ADOPTED. 10.-Moved by Supervisor Harris, seconded by CouncilmEn Wickham, it was RESOLVED that the Town Board of the Town of Southold hereby engages the services of Andrew D. Stype, C.'A.R., at a fee of,$750.00, to conduct an appraisal of the North Fork Bank & Trust Company Mortgage/Computer Center (SCTM #1000-141-4-24), located on the corner of Sound Avenue and Pacific Street, Mattituck, New York. 10.-Vote of the Town Board: Ayes: Councilman Wickham, Councilwoman Latson, Councilwoman Oliva, Councilman Penny, Justice Edwards, Supervisoi* Harris. This resolution was declared duly ADOPTED. DECEMBER 10, 1991 SUPERVISOR HARRIS: This site that is having an appraisal done is a second site, hopefully for the new Southold Town Human Resource Center. This Town has endeavored over the last two years to find a site, that would be long term for the services that we p.rovide to our elderly population in this town, and with the second appraisal it's hoped that when the appraisal comes in, that we can come up with a figure working with the bank, that is sensible to the Town Board, that we can use in the future for a, as I said, as a new facility to engage many of the programs, that Vi McKieghan now runs out of her Nutrition Program down in Greenport out of the Catholic facility down there. 11.-Moved by Councilwoman Olvia, seconded by Councilwoman Latson, it was RESOLVED that the Town Board of the Town of Southold hereby authorizes and directs Supervisor Scott L. Harris to execute an Extensiort Agreement between the New York State Office of Parl~s, Recreation and Historic Preservation and the Town of Southold for the acquisition of the Mattituck !nlet Park property; saida'jreement for the sum of $225,000.00, and is extended to December 31, 1992; form of the agreement has been approved by the Town Attorney. 11.-Vote of the Town Board: Ayes: Councilman Wickham, Councilwoman Latson, Councilwoman Oliva, Councilman Penny, Justice Edwards, Supervis:or Harris. This resolution was declared duly ADOPTED. SUPERVISOR HARRIS: Again, I'd like to .lust explain that this resolution is trying maintain a grant, that we have received in the Town of Southold. This grant could be used towards the purchase of property known as the C~,rey Tank Farm property in Mattituck, provided that a clean_bill of health is issued to the Town from the DEC, EPA, and any other agencies, that are involved with the cleanup of this site. The Town has been looking at this seriously as an open space purchase for the benefit of the residents of the Town of Southold, and those endeavors will continue once we receive that documentation. 12.-Moved by Justice Edwards, seconded by Supervisor Harris, it was RESOLVED that the Town Board of the Town of Southold hereby authorizes and directs Supervisor Scott L. Harris to execute the Order on Consent to the New York State Department of Environmental Conservation in the matter of the violation of Article 25, Title 4 of the NYS-DEC Law (Tidal Wetlands Act) caused by cleaning · and grading adjacent area to a regulated tidal wetland, and installation of lighting. system and reconstruction of a rock revetment on the adjacent area to a regulated tidal wetland without required permit on or before 11/20/90 at Elizabeth Field - Fishers Island Airport; and the payment of a penalty in the amount of $2,000.00 to the NYS-DEC shall accompany the Order of Consent; said payment shall be a full contribution by the engineering time of Calocerinos & Spina ($1,000.00) and the project contractor Falvey Construction Corp. This resolution was declared duly ADOPTED. 13.-Moved by Councilman Penny, seconded by Councilwoman Oliva, it was RESOLVED that the Town Board of the Town of Southold hereby increases the per hour salary of Carolyn Smith, Aide in the Senior Adult Day Care Program, from $4.50 per hour to $5.00 per hour to be in line with the other Aides in the program, effective December 2, 1991. 13.-Vote of the T, own Board: Ayes: Councilman Wickham, Councilwoman Latson, Councilwoman Oliva, Councilman Penny, Justice Edwards, Supervisor Harris. This resolution was declared duly ADOPTED. 37.-Moved by Supervisor Harris, seconded by Councilwoman Oliva, it was RESOLVED by the Town Board of the Town of Southold th~it in light of the recent outbreak of Hepatitis-B, and in response to recent regulations issued by the U.S. Labor Department's Occupational Safety and Health Administration, the Chief of Police is hereby authorized to implement a program to provide voluntary vaccinations to prevent Hepatitis-B to all police officers, at a total cost not to exceed $4,000.00 37.-Vote of the Town Board: Ayes: Councilman Wickham, Councilwoman:Latson, Councilwoman Oliva, Councilman Penny, Justice Edwards, Supervisor Harris. This resolution was declared duly ADOPTED. SUPERVISOR HARRIS: This resolution is required by a new State law. All Police Officers must have the availability to get Hepatitis-B vaccinated. That's the vaccine, in order to comply with the new regulations. They're calied first time..first responsers it's called. Also, the Fire Department who's on the Rescue Squads, also, have to have the same vaccine. It is required, however, of a Officer, or in this case if he turns it down, the Town is still covered. It's his option, whether he would like this vaccine or not, but the Town must provide it by law, so that is what we are doing. The cost to the Town Will be approxi- mately $4,000.00. 38.-Moved by Supervisor Harris, seconded by Councilwoman Oliva, it was RESOLVED that the application of Mary H. Cuipryk (formerly Mary H. This resolution was declared duly ADOPTED. SUPERVISOR HARRIS: Number 39 on your agenda, appointing a member of the Southold Town Board of Assessment Review, is going to be held. At this time, before I go back to the Town Board, for comments. I'd like to go out to the audience. Are there any members of the audience, that would like to address this Board on any matter that they feel may be pertinent at this time? Yes? Will you come forward and state your name, please? BILL KART: My name is Bill Kart. I'm with the football program, l've lived in Greenport for eighteen years. I was born out here. I plan to go to college next year. I play football to further my education to become a Police Officer. The reason I'm here is to talk to you about the Town of Southold donating money towards the Greenport athletic field, and the field can be used for many ithin~ts, such as sporting events, outdoor summer concerts, fund raisers, or anything that needs sufficient outdoor lighting. Two times I have used the lights, as a player and a spectator. I've played on the Greenport-Southold-Mattituck football team for about four years, and the feeling you get when you walk out of the locker room, when there is about fifteen tosevent~enhundred people cheering for you, the feeling is incredible: As a spectator I went to a girl's soccer game, and about fifteen to seventeen hundred people showed up for a game as well. The part I'm trying to get at is that the lights have rejuvenated the towns, you know from Mattituck to Orient, She'lter Island, anyway on the North Fork. It gives people something to do at night, and the local sporting teams play at night. It's not only the sport games, but the whole North Fork benefit from the lights. I hope you consider donating money towards the lights. Anything will be a big help. Thanks. SUPERVISOR HARR'IS: Thank you. We've had other individuals, for your informa- tion, Bill, speak on behalf of this project, and this Board will endeavor to look to see the availability of funding, and as I said ~arlier, to the individual who spoke, we will see if this Town can make available from these funds. The priorities, of course, will have to weighed out. There are a lot of people vy~c~ for this funding, as you would expect. The competition is heavy, such as a game that I'm sure you've been playing at football. We will certainly take this under advisement, and we thank you for your interest in this project, because we understand, and certainly know it's worthwhile endeavor. Thank you for coming. If not, this will be our last Town Board meeting for the year, and I'd certainly like to go to the Town Board members at this time. If they have any remarks they'd like to make, I'll start with Councilwoman Latson. COUNCILWOMAN LATSON: Yes. Thank you, Scott. As~you know this is Ruth, and I, last Town Board meeting serving in the capacity as elected Council- woman in the Town of Southold, and speakin9 for myself the last six years as an elected official, two as a Trustee, and on the Town Board, have been a worth- while endeavor. I think it's important to remember that 9overnment is made up of citizens like myself, who can come from any walk of life who usually express an interest in their local government, and the happening around them. I think I'm a very good example of that, and I would encourage the public-to become involved in the many aspects of 9overnment. The next Town Board certainly has a heavy agenda with the recommendations of the US/UK having arrived, and with the fiscal constraints, that have been placed both on the taxpayer, and on local governments as a whole. I'd like to say it has been a pleasure servin9 you for the past four years in this capacity. I've learned a lot. I've met a lot of interesting people. I have a lot of people to thank, many people, begining with the Town Clerk's Office, and the ladies who work in that office, who make everything available to the Town Board members. The members of the Planning, I think we do have a fine Plannin9 Board. I think they have their work cut out for them in the next several years, and I've enjoyed working with all of them, Mark McDonald, Ritchie Latham, Mr. Ward, Valarie, Melissa, Bob Kassner. Also, I've enjoyed my relationship with Ray Jacobs, the Highway Supertendent, and Ken Reeves as the Director of Recreation in the Town. Jim McMahon, certainly has always been a wealth of information, and with that I wish the next coming Town' Board well in their endeavors, and thank you. SUPERVISOR HARRIS: I would like to wish you, Ellen, a health and happy holiday. Ruth? COUNCILWOMAN OLIVA: Yes. Thank you, Scott. It is a rare priviledge in this country to serve in an elected office. I feel that I have been greatly honored, and I'd like to thank everybody for their support. I'd like to wish everybody a very Merry Christmas, and joyous and healthy New Year for everybody. COUNCILMAN WICKHAM: I'd just like to comment '~briefly. I think everybody knows that there's been some movement on responding to the recommendations of UK/US Stewardship Exchange. We received a report last week, and we also received, I believe, on the same day, Scott, a grant from a foundation to help the town to respond to that. Exactly how we're going to respond is going to have to be developed in an open way with a number of participants in the town, and the different Boards of Town government, and we look forwar(1 to getting cracking on that first thing next year. Thank you. DECEMBER 10, 1991 2-5.3 SUPERVISOR HARRIS: I would like to first take this opportunity to wish Ellen and Ruth the best in all their endeavors. The last two years have had a lot of challanges before us, and we've met those challanges head on, and it's been a pleasure to work with the whole Board, not to mention Ruth and Ellen. We certainly have had our differences, as any Board would have, however, we've tackled tough problems, and we've met them head on, as I said earlier, and that to me is very important. We have stood our ground on many occasions when most people would have been intimidated, this Board has held it's head up high. Elected officials, whether they're on a local level, County, State, or Federal level, are a rare breed. Those who~will sacrifice themselves to put out for the people that represent them, on a constant basis, twenty-four hours a day, don't come freely, and they certainly don't come overpaid. The people in any municipality, especially those elected to Town Board, have had their hands full when it comes to economic times, such as the nation has been facing, not to mention Long Island, the State of New York, and certainly the Town of Southold is not exempted from that. We do have many challenges ahead, but a lot of those challenges have been started through the help of the Town Board over my last two years, l'm looking forward to continuing the good work that this Board has started and has created to see those endeavors come to f.rui'tion. I'd like to wish everyone in the audience,a Happy and Healthy Holiday, and may God bless, and we're looking forward in the next couple of years to again, moving ahead, and making Southold a great place, a gem, as has been said many times, a jewel among many townships in Suffolk County. Three hundred and fifty-one years old, and headed quickly for three hundred and fifty-two, soon to be ending this decade, going into the year 2000. We have macJe many, many programs work. There are many programs, that still need work, however, this Board will always be remembered. It's in history books. This Board has been part of the 350th celebration of the Town of Southold, the great Town of $outhold, the number one oldest town in New York State, and for that I'd like to thank this Board for your participation, and your help, and I certainly am looking forward to also to working with you in years to come, and hope that you will endeavor, and give of yourself, as you have in the past for the betterment of the people of the Town of Southold.
