SOUTHOLD TOWN BOARD
NOVEMBER 26. 1991
EXECUTIVE SESSION
Present: Supervisor Scott L. Harris, Justice Raymond W. Edwards, Councilman

9:35 A.M. - On motion of Justice Edwards, seconded by Councilwoman Oliva, it was
Resolved that the Town Board enter into Executive Session. Vote of the Board:
Ayes: Supervisor Harris, Justice Edwards, Councilwoman Oliva.---The Town Board
met with Insurance Consultant William F. Mullen, Jr. and Accountant John Cushman
to discuss the 1992 Insurance Proposals. The Board chose the lowest bidder, Val
Stype & Sons, Inc. as the Town's 1992 Insurance Broker (see resolution no. 29).
The Board also placed resolution no. 28 on the agenda to amend a July 2, 1991
resolution concerning the Town's General Liability Insurance.---Following this
discussion the Town Attorney reviewed pending lawsuits with the Board, and then
met with Recreation Supervisor Kenneth Reeves to discuss personnel.
10:30 A.M. The Board met with Police Chief Droskoski and Chief Public Safety
Dispatcher John Raynor. Mr. Raynor explained to the Town Board the need to
install a Telecommun cations Device for the Deaf, a requirement, effective January
26, 1992 under the American's with Disabilities Act. This device can be inserted
in the existing module without modification for a cost of approximately $1,485.00 for
the equipment and $500.00 for installation by NYNEX.---Chief Droskoski informed
the Board of the requirement to have a police in place with respect to immunization
shots for the police officers and bay constables. The Hepatitis-B Serum costs approx-
imately $100.00 per person, and the shots can probably be given at the hospital at
no cost. Town Attorney Arnoff will have a resolution for the December 10th meeting
putting the policy in place.
11:05 A.M. - Mrs. Sandra Scott met with the Town Board to request permission to
place a single family house traile~ ~or a farmworker/caretaker and wife on her
property on the north side of Route 25, Cutchogue. The Board agreed to a six
month permit (see resolution no. 31).
11:15 A.M. - Planning Board member Mark McDonald met with the Board to discuss
th~ removal of topsoil from a parcel of property on the corner of CR 48 and Cox
Lane, Cutchogue. The owner of prope~rty, Donald Grim, was also present in the
audience. This matter is the Subject of For Discussion Item (1) in a memorandum
from the Planning Board. It was noted that last month the topsoil was scraped and
piled to one side, and it appears to the Planning Board this is a violation of the
Town Code. Mr. Grim stated he h~d scraped the property to remove weeds and
debris which blows onto the property from the landfill, and before he was stopped,
he was planning to have it plowed and seeded. Mr. McDonald said he would make
an inspection of the property. The Board would also request Principal Building
Inspector Lessard to make an inspectiqn. Mr. Grim advised the Board he would
submit a letter to them stating his intent. He had planned to remove the weeds and
debris to his property, let it dry out, sift the remaining soil and place it back on
the property. ---Mr. Grim reviewed With the Board For Discussion Item (8)
concerning the lack of an expiration date on his wife's Recycling and Salvage Facility

Permit. The Board felt it would be appropriate to add an additional condition to
deem the permit a perrfianent use on the subject premises (see resolution no. 32).
EXECUTIVE SESSION
11:45 A.M. On motion of Councilwoman Oliva, seconded by Supervisor Harris, it
was Resolved that the Town Board enter into Executive Session. Vote of the Board:
Ayes: Supervisor Harris, Justice Edwards, Councilwoman Oliva.--The Board
discussed a recent scrap newspaper bid, which they felt should be withdrawnasit
calls for the Town to pay the contractor. Supervisor Harris has information from
the Town of East Hampton whereby they are paid for the scrap newspaper.
Furthermore, it is not necessary to go to bid when it is a recycled item. (See resolu-
tion no. 37).
11:55 A.M. For Discussion Items: (1) Soil ex-cavation at CR 48 and Cox Lane,
Cutchogue, which was discussed with Mark McDonald and Donald Grim at 11:15 A.M.
(2) Letter from the Greenport-Southold Chamber of Commerce requesting permission
to use the Town property at Route 25, west Greenport, where the Tourist
Information Booth is located, for a Spring Craft Show in May, 1992 (see resolution
no. 33). (3) Acceptance of the Hydrogeologic Investigation conducted at the
Landfill (see resolution no. 34), (~) Appointment of a member to the Southold Town
Board of Assessment Review was held for the -December 10th meeting. (5)
Appointment of instructors for the 1992 Winter Recreation Programs (see resolution
no. 30). This was also a subject of discussion with Recreation Supervisor Reeves
at the earlier Executive Session. (6) Another matter discussed with Mr. Reeves was
a contribution by the Town to the roller skating program at the Greenport Legion
this winter sponsored by Greenport School. Mr. Reeves was asked to contact the
other school districts to see if they would be willing to contribute to the program.
Mr. Reeves also met with a representative of the Greenport Legion to discuss using
their facility for recreation programs. He will look into insurance coverage for such
a use. (7) Memorandum from Assistant Town Attorney Kiernan concerning a
judgment the Town has obtained against Barr Vineyards, Inc. for failure to pay
$437.76 in landfill fees since November, 1990. Mr. Kiernan will investigate ways
to recoup this money. (8) Expiration date on the Grim Recycling and Salvage
Facility Permit - discussed with Mr. Grim at 11:15 A.M. (see resolution no. 32).

Town Attorney Arnoff, Assistant Town Attorney Kiernan, Town Clerk Terry.--The
Board discussed possible purchase of property, contracts, and litigation. They placed
resolutions 35, 36 .and 37 on the agenda.

A Recjular Meeting of the Southold Town Board was held on Tuesday, November
26, 1991, at the Southold Town Hall, Main Road, $outhold, New York. Supervisor
Harris opened the meeting at 4:00 P.M., with the Pledge of Allegiance to the Flag.

SUPERVISOR HARRIS: I would like to welcome everybody to our Town Board
meeting. At this time, I need a motion to audit the bills of November 26, 1991.
There are two bills that are being held, that are being pulled out of the audit,
which are The Clam Farm Inc for $1,500.00, and Smith, Finkelstein, Lundberg,
Isler & Yakaboski for $3,577.84.
Moved by Justice Edwards, seconded by Councilwoman Oliva, it was
RESOLVED that the following audidted bills be and hereby ordered paid: General
Fund Whole Town bills in the amount of $90,680.03; General Fund Part Town bills
in the amount of $24,081.59; Nutrition Fund bills in the amount of $1,259.58; Adult
Day Care bills in the amount of $300.63; Home Aid Program bills in the amount
of $31.20; SNAP Program bills in the amount of $741.43; EISEP Program bills in

SUPERVISOR HARRIS: I would abstain, because I was not here for that meeting,
however, I will vote in favor of it, because I read the minutes, and had been
assured that it's accurate by various members of the Board that had been here.

1. New York State Department of Environmental Conservation, Notice of
Complete Application by Frances P. Rauch to subdivide a 5.2 acre parcel into
two lots and construct a single family dwelling with associated septic system on
1.91 acre parcel. The 3.24 acre parcel has an existing residence with acces~sory
structures. Project site is on Hay Harbor north of Equestrian Avenue, Fishers
Island, N.Y. Comments in writing no later than December 13, 1991.
2. New York State Department of Environmental Conservation, Notice ,of
Complete Application of Mark and Lisa Davis to construct a single family dwelling

the public's well-being, that we have three public hearings today, which will be
starting at 4:30 P.M.

SUPERVISOR HARRIS: We have approximately thirty-seven resolutions, that we'll
be enacting upon. Before we start moving on those resolutions, are there any
members of the audience that would like to address this Board on any one of those
resolutions, that we'lL act on in just a few minutes? (No response.) If not, I will
proceed, and Ruth, why don't you start?

RESOLVED that the Town Board of the Town of Southold hereby accepts the bid
of Arshamomaclue Dairy Farm, Inc. for providing the Southold Town Nutrition
Center, Greenport, with 1/2 pints of Homogenized Pasteurized Milk for calendar
year 1992, at a cost of $.21 per 1/2 pint,-all in accordance with the bid specifi-
cations.

5.-Moved by Councilwoman Oliva, seconded by Justice- Edwards, it was
RESOLVED that the Town Board of the Town of Southold hereby accepts the
proposal of Hoppy's Cleaners, Inc. for cleaning the uniforms of the members of
the Southold Town Police Department for the period from January 1, 1992 through
December 31, 1992, at the following prices, all in accordance with the bid specifi-
cations: Uniform Trousers - $.65, Uniform Long Sleeve Shirts - $.17, Uniform
Jackets - $.70, Eisenhower Jackets - $.54, Outer Jackets - $1.24, No Charge
for: Jacket Liners, Uniform Sweaters, Neckties, and Hats; and be it further
RESOLVED that Supervisor Scott L. Harris be and he hereby is authorized and
.directed to enter into an agreement between the Town and Hoppy's Cleaners, Inc.
for the aforesaid proposal.

6.-Moved by Supervisor Harris, seconded by Councilman Penny, it was
RESOLVED that the Town Board of the Town of Southold hereby allocates $100.00
to The Landfill Questionnaire Fund for a complete data evaluation and report project
that will sort the information obtained by the Town of Washington's recent landfill
questionnaire, and organize it so that the data can be logically presented to public
policy and decision makers.
SUPERVISOR HARRIS: It also backs up a letter, which comes from the Town
of Washington for a questionnaire that's going to be used in conjunction with the
Association of Towns. Apparently, it's going to be used to help and change,
and redirect some landfill legislation as previously been enacted. That's what
this request is for.
COUNCILWOMAN OLIVA: I'd like to see a report.

7.-Moved by Justice Edwards, seconded by The Entire Town Board, it was
RESOLVED that the Town Board of the T.own of Southold hereby accepts, with
rec. tret, the resignation of Theresa Reilly, part-time Clerk Typist for the Board
of Appeals, effective December 13, 1991, and extends to Mrs. Reilly their sincere
appreciation for her dedication to her position since July 26, 1988.

SUPERVISOR HARRIS: On behalf of the Town Board, we'd like to extend our
thanks to Theresa for a job well-done over many years, that she served this Town
faithfully.
8.-Moved Councilwoman Oliva, seconded by Supervisor Harris, it was
RESOLVED that the Town Board of the Town df Southold hereby authorizes and
directs the Town Clerk to advertise for resumes for a year-round, part-time
Clerk Stenographer to the Board of Appeals, at a salary of $7.25 per hour.

RESOLVED that the Town Board of the Town of Southold hereby cgrants permission
to Assessors Robert I. Scott, Jr., Scott A. Russell and Darline J. Duff), to attend
a seminar on Assessment Adminstration at Port Jefferson, New York, on Friday,
December 6, 1991, and the use of a Town vehicle for travel, and necessary expenses
for registration and lunch shall be a legal expense against the Assessor's 1991
Budget.

10.-Moved by Justice Edwards, seconded by Councilwoman Oliva, it was
RESOLVED that the Town Board of the Town of Southold hereby authorizes Receiver
of Taxes George R. Sullivan, Data Control Supervisor Jeanne Ruland, and part-
time Tax Receiver Clerk Margaret Coulter to attend a Tax Collection Software
demonstration at the Town of Greenburg, New York, on Friday, November 22,
1991, with the use of a Town vehicle for travel, and meal expenses shall be a
legal charge against the Receiver of Taxes' 1991 Budget.
SUPERVISOR HARRIS: I would just like to further note that the group traveled
up there last Friday, and they were very much impressed with this tax collection
system, that they viewed for the Receiver of Taxes to hook into the State Assess-
ment Roll Levy Modular, which is called the Alarm System, to help further computerize
the tax bills, so we can do them locally, rather than have them done at Newburg,
New York, that has been the past practice, so they are still looking at tax collection --
system, that would be compatible to what the Town is using for the assessment
system, and as they pursue these endeavors they will be taking trips like this
throughout the State to make sure what they receive will be for the best interests
of the taxpayers of this town.

11.-Moved by Councilman Penny, seconded by Justice Edwards, it was
RESOLVED that the Town Board of the Town of Southold hereby authorizes and
directs Supervisor Scott L. Harris to execute New York State Applications for
1992 Funding for the Southold Town Recreation Department and Southold Town
Juvenile Aide Bureau; 1992 Town of Southold State aid eligibility is $32,011.00.

12.-Moved by Councilwoman Oliva, seconded by Councilman Penny, it was
RESOLVED that the application of Bruce M. Vitale for renewal of his sincgle family
watchman house trailer permit, for trailer located at 7280 Sound Avenue, Mattituck,
which permit expired on November 22, 1991, be and hereby is cjranted for a six
(6) month period.

RESOLVED that the Town Board of the Town of Southold hereby accepts the bid
of Agway Energy Products, Riverhead, for supplying the Town with Heatin9 Fuel
Oil for Calendar Year 1992, at a rack price which will be plus $.0750 per gallon
over the Long Island Tank Car Consumer Rack Price, as posted daily in the Journal
of Commerce under the Northville Industries Corporation list.

of Acjway Energy Products, Riverhead, for supplying the Town with Gasoline for
Calendar Year 1992, at a price that will be plus $.0595 per gallon over the Long
Island Tank Car Consumer Rack Price, as posted daily in the Journal of Commerce
under the Northville Industries Corporation list.

RESOLVED that the Town Board of the Town of Southold hereby amends their
resolution no. 13, adopted on September 24, 1991, extending to November l, 1991
for outstanding medical bills of the late Marion A. Regent, former Town employee,
whereas the bills have been submitted in accordance with the Town's~health plan
requirements, but Medicare is still processing them .... to extend to December
31, 1991 for receipt of the outstanding medical bills of the late Marion A. Regent.

RESOLVED that the Town Board of the Town of Southold hereby authorizes and
directs Supervisor Scott L. Harris to execute an acceptance of the award of
$425t000 in grant funds from the New York State Affordable Housing CorporatiO~i,
under the Affordable Home Ownership Development Program to the Town of Southold
for the project known as Southold Villas' Program, subject to the terms and condi-
tions of the award as set forth in the letter from New York State Affordable

SUPERVISOR HARRIS: I'd like to comment, that we're very fortunate. We were
in heavy competition with many other townships throughout the State of New York
to receive this grant from the New York State Affordable Housing Corporation
to enhance affordable housing in Southold Town, and I'm proud as a Supervisor
of this Town, as the Board members are here, that Southold has been chosen
by New York State, and that we have been awarded this grant, which will amount
to be $25,000.00 per house in Southold Villas,once that project gets underway,
reduction, so it is a great enhancement to affordable housing in Southold Town.

SUPERVISOR HARRIS: This next resolution, ladies and gentlemen, is a historic
resolution that we are recinding, although the resolution that we'll be enacting
certainly is not trend setting, but it is historic in that we're going to rescind
a resolution from April 5, 1864, and the reason why we have to rescind this is
the Town of Southold has vigorously endeavored to obtain back the Andros Patent,
a document that belongs to the people of the Town of Southold, from the Brooklyn
Museum, and unfortunately our endeavors have failed up to d~te to retrieve that
document. We are now proceeding on the next track, which is rescinding a resolu-
tion, which authorized to the Andros Patent to be presented to the Long Island
Historical Society for preservation back in 1864. By rescinding this resolution,
it's hoped that we will now send a message to the Brooklyn Museum, that resolution
is no longer in effect, and that the Town of Southold is once again pursuing,
and is very serious about obtaining back a historical document, that belongs to
the people of Southold Town. Toni Booth, our Town Historian, has assured us
that this documentwillbepreserved at least as well as the Brooklyn Museum is
preserving it, if not better, and certainly under her care we know that will happen.
I just wanted to tell you about this resolution before we enact it, why we were
doing it.

WHEREAS, on April 5, 1864 the Town of Southold by formal resolution placed the
document now known as the Andros Patent with the Long Island Historical Society
for preservation, the precise language of the resolution being:
"Notice that the parchment on which the Charter of the Town is
written be presented to the Long Island Historical Society for
preservation (emphasis supplied) also the Confirmation Deed both
having first been re-recorded on the new Town Record." and,
WHEREAS, it has been determined that the placement of these documents with
the Long Island Historical Society was for their preservation during the Civil
War, and
WHEREAS, it has been determined that the war between the States, also referred
to as the Civil War, has ended, and
WHEREAS, the 'Town is now in a position to maintain and preserve its own
records, and
WHEREAS, the Brooklyn Historical Society is the successor in interest to the Long
Island Historical Society, now, therefore, be it
RESOLVED, that the Town of Southold hereby rescinds in all aspects its resolution
referred to above dated April 5, 1864 and directs the Supervisor of the Town
of Southold to take all steps necessary to secure the return of the Andros Patent
and the Confirmatory Deed presently in the custody of the Brooklyn Historical
Society ....

TOWN ATTORNEY ARNOFF: I think we owe a vote of thanks to Toni Booth, who
was the one who found, be advertently, she claims inadvertently, but I think
we owe her a vote of thanks for having found the resolution, which placed l~he
patent with the Historic Society for Preservation. She was going through sdme
old documents, found it, and brought it to our attention. It's nice to have an
historian who's interested enough to follow through like that.
SUPERVISOR HARRIS: It's a point well taken, and so noted by this Town Board,
and it will be a permanent part, certainly, of the record of this meeting, that
Town Historian Toni Booth should be recognized for her 'efforts in the accord.

AGREEMENT TO SPEND TOWN HIGHWAY FUNDS
RESOLVED that pursuant to the provisions of Section 284 of the Highway Law,
the Town Board of the Town of Southold agrees that moneys levied and collected
for the repair and improvement of highways, and received from the State for
the repair and improvement of highways, shall be expended as follows: General
Repairs. The sum of $1,886,000.00 may be expended for general repairs upon
189.03 miles of Town highways, including sluices, culverts and bridges having
a span of less than five feet and boardwalks or the renewals thereof. No
moneys set aside for such improvements shall be expended, nor shall any work
be undertaken on such improvements, until the County Superintendent approves
the plans, specifications and estima:tes for such construction. This agreement
shall take effect when it is approved by the County Superintendent of Highways.

that provides for the closure of the existing Town landfill in Cutchogue; and

landfill site; and
WHEREAS, the State requires that a hydrogeologic investigation be conducted as
part of a Part 360 Landfill Permit Application for both closure of the existing
landfill and construction of a new landfill; and
WHEREAS, the Town has directed its solid waste consultant to conduct such an
investigation; and
WHEREAS, this investigation in the form of a report has been completed by the
Town's consultant and reviewed by the Town Board;
BE IT NOW RESOLVED, that the Town Board hereby accepts the investigation
and its findings, conclusions and recommendations; and
BE IT FURTHER RESOLVED, that the Town Supervisor file this investigation report
with the appropriate offices of the ,New York State Department of Environmental
Conservation.

SUPERVISOR HARRIS: The Town is pursuing acquisition of this property, possibly
in the future, and the last appraisal obviously was done two years ago, which
makes it an outdated appraisal, (tape change) In order to pursue this property
under Open Space Bond resolution, which was enacted by the people in 1987,
November, we have to first get assurances from alt agencies, EPA, DEC, and the
like, that there's a clean bill of health on this property, but besides from that
fact, we have to also know what the property is worth in order for us pursue
acquistition of this property, if the Town Board so desires in the future. So,
that is what this resolution does. It does an update for us.

corrucjated cardboard, flattened and stacked.
2. Section 48-3(A) (1) (b) is hereby amended to read as follows:
(b) No Cardboard as defined herein, shall be deposited at any
Town of Southold disposal area unless such cardboard is
separated from any and all solid waste, trash, rubbish,
vec. tetative yard waste, cans, ~tlass, plastic, metal or
paper. Such cardboard is to be deposited only at
desic~nated areas within such town disposal area.
(c) No Glass, as defined herein, shall be deposited at any
Town of Southold disposal area unless such glass is
separated from any and all solid waste, trash, rubbish,
vegetative yard waste, cans, cardboard, metal or paper.
Such glass is to be deposited only at designated areas
within such town disposal area and in the area designated
for the particular color of glass (i.e., clear, amber or
green).
(d) No Plastic, as defined herein, shall be deposited at any
Town of Southold disposal area unless such plastic is
separated from any and all solid waste, trash, rubbish,
vegetative yard waste, cans, cardboard, glass or paper. _.
Such plastic is to be deposited only at designated areas
within such town disposal area or transfer station.
(e) No newspaper, as defined herein, shall be deposited at any
Town of Southold disposal area unless such newspaper is
separated from any and all solid waste; trash, rubbish,
vegetative yard waste, cans, cardboard, glass or plastic.
Such newspaper is to be deposited only at designated areas
within such town disposal area.
II. This Local Law shall effect upon its filing with the Secretary of State.

Commercial Self Haulers - Those businesses, trades or other
commercial enterprises which transport the refuse and/or
recyclabies generated in the opereation of their business, trade
or commercial enterprise for deoosit at the Town of Southold
refuse disposal area.
2. Section 48-3[A)(1) (Town refuse disposal area) is hereby amended
to read as follows:
1. Residential self-haulers and Commercial self-haulers.
3. Section 48-3(A) is hereby amended by adding thereto the following:
3. Private commercial refuse haulers/carters.
a. The owners or occupants of all commercial
- establishments within the town which utilize
collection services provided by persons licensed to
collect refuse pursuant to the provisions of this
chapter shall place recyclables in separate, rigid
containers at curbside for collection on such day or
days as the licensee serving such business shall
design ate.
It shall be unlawful for any commercial establishment
to place out for collection an,/ container in which
refuse is mixed with recyclables.

SUPERVISOR HARRIS: ResolUtion No. 41, would the Board like to authorize the
'Fown Clerk to advertise for two additional members of the Landmark Preservation,
now that you have adopted that Local Law?
41.-Moved by Councilman Penny, seconded by Councilwoman Oliva, it was
RESOLVED that the Town Board of the Town of Southold hereby authorizes and
directs the Town Clerk to advertise for resumes for two (2) new members of the
Southold Town Landmark Preservation Commission with special emphasis on a lawyer
and publicist.
