WORK SESSION

9:30 A.M. - Unsafe Buildincj Hearincj - Bernard Dubin, property at North Road and
Soundview Avehue, Southold, postponed to November 26th as owner has begun to
make corrections to the unsafe situation.
9:35 A.M. - Board audited outstanding vouchers.
10:00 A.M. Director of Program Evaluation James McMahon met with the Town Board
to bring them up to date on his meeting with FEMA representatives concerning the
damage to Town beaches and parking lots caused by the October 31st storm. He
will begin work on the DEC permits to build new restrooms at the Town Beach to
replace the ones destroyed by the storm. Mr. McMahon requested the Town Board
to adopt a resolution authorizing him to submit applications to the DEC and Corps
of Army Engineers to dredge Goldsmith's Inlet (see resolution no. 24).
10:25 A.M. - For Discussion Items: (1) Appo'intment of a member to the Board of
Assessment Review place back on November 26th agenda when Supervisor Harris
will be present. (2) Letter from Attorney Marie Ongioni concerning the application
pending before the Board of Appeals by NYNEX Cellular Phone to site a monopole.
The site is adjacent to the landfill property and the Town must approve the "fall
down" area. When Town Attorney Arnoff arrived he advised the Board he was
under the impression Supervisor Harris had met with NYNEX representatives
concerning this, so the Board will wait for Supervisor Harris' input on the matter.
(3) Proposed "Local Law in Relation to Landmark Preservation Commission"-see
resolution no. 25. (4) Southold Town incurred fines under the New York State
Labor Law for failing to having a written Hazard Communication program on record
and implemented at affected Town iob sites. This was discussed further during
Executive Session with the Town Attorneys and resolution no. 29 was' placed on the
agenda. (5) Amend an October 22, 1991 resolution to refund a $500.00 bid deposit
to John T. Montecalvo, Inc. with respect to a bid for furnishing and placing Asphalt
Concrete (see resolution no. 26). (6) Notification of a Solid Waste Management &
Materials Policy Conference in New York City on January 29, 39, 31, 1992 (see
resolution no. 27).

it was Resolved that the Town Board enter into Executive Session. Vote of the

with the Town Board to discuss the qualifications of recreation program
instructors.---The Board also met with retired Police Sergeant Theodore Beebe to
discuss his agreement with the Town to receive compensation for his accumulated
unused vacation days and sick days over a three year period.---Also discussed was
litigation and contract negotiations.

A Regular Meeting of the Southold Town Board was held on Tuesday, November
-12, 1991, at the Southold Town Hall, Main Road, Southold, New York. Deputy
Supervisor Penny opened the meeting at 4:00 P.M., with the Pledge of Allegiance
to the Flag.

Fund Whole Town bills in the amount of $82,701.86; General Fund Part Town bills
in the amount of $49,050.09; Nutrition Fund bills in the amount of $690.36; Adult

DEPUTY SUPERVISOR: We have a public hearing on the consideration of increase
and improvement of facilities of Southold Wastewater District at 4:30 P.M.
1. 4:00 P.M. "In the Matter of the Increase and Improvement of Facilities of
Southold Wastewater Disposal District in the Town of Southold in the County of
Suffolk, New York.
V. RESOLUTIONS.
DEPUTY SUPERVISOR PENNY: At this time, we have a policy for anybody in the
audience, that would like to address the Town Board on any resolutions, that are
before us this afternoon. If they would like five minutes to do so, that's five minutes
per person, would they please step forward at this time. (No response.) Before
we go into resolutions, the Town Clerk has just reminded me to mention to everybody
that the Supervisor is out of town. He's on vacation, and will be home tonight.
He's down in the sunny Bahamas. I hope he's enjoying the weather down there
a little better, than we are up here. Councilman Tom Wickham is doing some
consulting work, and he is in, I believe, India, for the next three weeks, and
then he'll be back. We'll proceed with resolutions. Resolution #1, allocating $100.00
- to The Landfill Questionnaire Fund is held until November 26, 1991.
2.-Moved by Councilwoman Latson, seconded by Justice Edwards, it was
RESOLVED that the Town Board of the Town of Southold hereby appoints Eddie
Smith as a subsitute Driver for any of the programs using the Town vans, effective
immediately, at no cost to the Town, his salary is paid by the Suffolk County
Department of Social Services.

3.-Moved by Councilwoman Oliva, seco'nded by Councilwoman Latson, it was
RESOLVED that the Town Board of the Town of Southold hereby authorizes the
Town clerk to place a display advertisement in the Real Estate Sections of The
Suffolk Times and The Long Island Traveler-Watchmen for a three (3) week period,
November 7, 14, 21, 1991, advertising that the Town is accepting applications for
the Southold Villas Affordable Housing Program, provided the applicants meet the
requirements set forth in the Town's Affordable Housing Code; application deadline
is 4:00 p.m., Friday, December 20, 1991.

WHEREAS, there has been presented to the Town Board of the Town of Southold-'
a proposed Local Law entitled, "A Local .Law in Relation to Recycled Cardboard";
now, therefore, be it
RESOLVED that the Town Board hereby sets 4:30 p.m., Tuesday, November 26,
1991, Southold Town Hall, Main Road, Southold, New York, as time and place for
a public hearing on the aforesaid proposed Local law which reads as follows:
A Local Law in Relation to Recycled Cardboarcl
BE IT ENACTED, by the Town Board of the Town of Southold as follows:
I. (]~apter 48 (Garbage, Rubbish and Refuse) of the Code of the Town of
Southold is hereby amended as follows:
1. Section 48-1 (Definitions) is hereby amended by adding thereto
the following:
CARDBOARD - Shall be a recyclable and shall mean clean, dry
corruc~ated cardboard, flattened and stacked.
2. Section 48-3(A)(1)(b) is hereby amended to read as follows:
(b) No Cardboard, as defined herein, shall be deposited at any
Town of Southold disposal area unless such cardboard is
separated from any and all solid waste, trash, rubbish,
vegetative yard waste, cans~glass, plastic, metal or
paper. Such cardboard is to be deposited only at
designated areas within suc town disposal areas.
(c) No Glass, as defined herein, shall be deposited at any
Town of Southold disposal area unless such glass is
separated from any and all solid waste, trash, rubbish,
vegetative yard waste, cans, cardboard, metal or paper.
Such glass is to be deposited only at designated areas
within such town disposal area and in the area designated
for- the particular color of glass (i.e., clear, amber or
green).
(d) No Plastic, as defined herein, shall be deposited at any
Town of Southold disposal area unless such plastic is
separated from any and all solid waste, trash, rubbish,
vegetative yard waste, cans, cardboard, glass or paper.
Such plastic is to be deposited only at designated areas
within such town disposal area or transfer station.
(e) No newspaper, as defined herein, shall be deposited at any
Town of Southolc~disposal area unless such newspaper is
separated from any and all solid waste, trash, rubbish,
vegetative yard waste, cans, cardboard, glass or plastic.
Such newspaper is to be deposited only at designated areas
within such town disposal area.
II. This Local Law shall take effect upon its filing with the Secretary of State.

a proposed Local law entitled, "A Localv Law in Relation to Commercial Recyclincj";
now, therefore, be it
RESOLVED that the Town Board hereby sets 4:32 p.m., Tuesday, November 26,
1991, Southold Town Hall, Main Road, Southold, New York, as time and place for
a public hearing on the aforesaid proposed Local law which reads as follows:
A Local Law in Relation to Commercial Recycling
BE IT ENACTED, by the Town Board of the Town of $outhold as follows:
I. Chapter 48 (Garbage, Rubbish and Refuse) of the Code of the Town of
Southold is hereby amended as follows:
1. Section 48-1 (Definitions) is hereby amended by adding thereto
the following:
Residential Self Haulers - Those residents who transport their
refuse and~or recylables for deposit at the Town of Southold
refuse disposal area.
Commercial Self Haulers - Those businesses, trades or other
commercial enterprises which transport the refuse and/or
rec¥clables generated in the operation of their business, trade
or commercial enterprise for deposit at the Town of Southold
refuse disposal area.

2.Section 48-3IA)(1) ITown refuse disposal area) is hereby
amended to read as follows:
1. Residential self-haulers and Commercial self-haulers.
3. Section 48-3(A) is hereby amended by adding thereto the
following:
a-- The owners or occupants of all commercial
establishments within the town which utilize
collection services provided by persons licensed to
collect refuse pursuant to the provisions of this
chapter shall place recyclables in separate, ri.gid
containers at curbside for collection on such day or
days as the licensee serving such business shall
desicjnate.
I~-- It shall be unlawful for any commercial establishment
to place out for collection any container in which
refuse is mixed witch recyclables.
c-- It shall be unlawful for any commercial establishment
to place out for collection any container in which one
type of recyclable is mixed with any other type or
types of recyclables.
d.. It shall be unlawful for any private commercial refi~se
hauler/carter to collect refuse from any commercial
establishment which is mixed with recyclables or
thereafter to commincjle different types of recyclables
or to mix recyclables with refuse.
e. Recyclables collected by private commercial refuse
haulers/carters and transported to the
landfill~;/collection center shall be deposited in areas
designated by appropriate landfill personnel.
II. This Local Law shall take effect upon its filing with the Secretary of State.

6.-Moved by Councilwoman Oliva, seconded by Justice Edwards, it was
RESOLVED that the application of Robert Graeb, lessee of the single family house
trailer in the Estate of Samuel G. Brown, which permits expired January 15, 1991,
and July 15, 1991, for trailer located on the west side of Tuthill Road, Cutchogue,
be and hereby are granted for a six (6) month period.
6.-Vote of the Town Board: Ayes: Councilwoman Latson, Councilwoman Oliva,
Councilman Penny, Justice Edwards.

7.-Moved by Councilwoman Latson, seconded by Councilwoman Oliva, it was
RESOLVED that the Town Board of the Town of Southold hereby authorizes an
exten§ion to December 1, 1991 for outstanding medical bills of Joan Richter, retired
employee, whereas the office of Dr. Steven J.N. Chierchie failed to submit the
required bills on Mrs. Richter's behalf to Lawrence Healthcare until after the end
of the plan year.

9.-Moved by Councilwoman Oliva, seconded by Justice Edwards, it was
RESOLVED that the Town Board of the Town of Southold hereby accepts the pr0~osal
of E. F. Kaldor, C.P.A., P.C. to conduct an audit of the books and records of
the Town of Southold and its grant pro, rams for the year ended December 31,
1991, at a total fee of $16,500.00 ($14,500.00 for Town of Southold; $2,000.00 for
Community Development Program).

RESOLVED that the Town Board of the Town of Southold hereby sets 4:30 P.M.,
Tuesday, December 10, 1991, Southold Town Hall, 'Main Road, Southold, New York,
as time and place for a public hearing to obtain Citizen's Views on local needs to
be met with 1992 Federal Community Development Block Grant Funds.

RESOLVED that the Town Board of the Town of $outhold hereby accepts the bid
of Chemical Pollution Control, Inc., at the following prices, for the removal and
disposal of Household Hazardous Waste from the Southold Town Collectio~n Center,
for a period of one (1) year, effective January 1, 1992 through December 31, 1992:

12.-Moved by Councilwoman Latson, seconded by Councilwoman Oliva, it was
RESOLVED that the Town Board of the Town of Southold ehreby accepts the bid
of Oxford Tire Supply, Inc. for the removal of any size tire, on a rim or Off, from
the $outhold Town Landfill Site, at a cost to the Town of $850.00 per trailer load,
for the period of one (1) year, effective January 1, 1992 through December 31, 1992.

13.-Moved by Councilman Penny, seconded by Councilwoman Oliva, it was
I~ESOLVED that the Town Board of the Town of $outhold hereby accepts the bid
of B.P. Wreckers, Ltd. in the amount of $18.98 per ton to be paid by the Town
for the removal of all Scrap Newspaper depostied at the Southold Town Landfill
Site, Cutchogue for a one (1) year period, effective January 1, 1992 through
December 31, 1992, all in accordance with the bid specifications; and be it further
RESOLVED that Supervisor Scott L. Harris be and _.l~e hereby is authorized and
directed to execute an agreement between the Town and B.P. Wreckers, Ltd. for
the removal of the Scrap Newspapers.

WHEREAS, the Town Board of the Town of Southold (herein
called "Town Board" and "Town", respectively), in'the County of
Suffolk, New York, on behalf of Southold Watewater Disposal
District, in the Town (herei~ called "District"), has requested
Cameron Engineering, P.C., engineers duly licensed by the State
of New York (herein called "Engineers"), to prepare a preliminary
map, plan and report for the increase and improvement of
facilities of the District, consisting of the construction of
improvements to the Scavenger Waste Treatment Facility, including
but no~ be limited to, removal of the existing bar rack and grit
screw, installation of a mechanical bar screen, construction of
an extension of the building, installation of the new grit
removal system, modification of the influent channel and'
headworks building, installation of floor plates over the
influent channel, extension of odor control piping in the
headworks building, modification and relocation of the odor
control piping in the equalization tank, installation of a sound-
proof door between the office area and blower room, installation
of an air compressor, electrical work, relocation of existing
plumbing, and other miscellaneous work, and also including
buildings, land or rights in land, original furnishings,
equipment, machinery and apparatus required therefor, at a costi
to the District not to exceed $225,000; and
WHEREAS, the Engineers completed such map and plan and
estimate of cost and filed.same with the Town Board, the Town
Board thereafter adopted an order describing in general terms the
proposed increase and improvement of the facilities, specifying
the estimated cost thereof, and stating that the Town Board would
meet to hear all persons interested in said increase and
improvement of facilities on November 12, 1991 at 4:30 P.M.
(Prevailing Time)at the Town Hall, 53095 Main Road, Southold,
New York, in the Town; and
WHEREAS, copies of such Order, certified by the Town
Clerk, were duly published and posted pursuant to the provisions
of Article 12 of the Town Law; and
WHEREAS, such public hearing was duly held by the Town
Board on this 12th day of November, 1991 at ~:30 P.M. (Prevailing

of a mechanical bar screen, construction of an extension of the
building, installation of the new grit removal system,
modification of the influent channel and headworks building,
installation of floor plates over the influent channel, extension
of odor control piping in the headworks building, modification
and relocation of the odor control piping in the equalization

tank, installation of a sound-proof door between the office area
and blower room, installation of an air compressor, electrical
work, relocation of existing plumbing, and other miscellaneous
work, and also including buildings, land or rights in land,
original furnishings, equipment, machinery and apparatus required
therefor, all in accordance with the map, plan and report
prepared by Cameron Engineering, P.C., engineers duly licensed by
the State of New York, on file in the office of the Town Clerk
and previously approved. The estimated maximum cos~ of said
specific object or purpose, including preliminary.costs~and costs
incidental thereto and the financing thereof, is $225,000 and
said amount is hereby appropriated therefor. The plan of
financing includes the expenditure of $155,000 from the Southold
Watewater Disposal District Repair Reserve Fund heretofore
established by said District and $20,000 from the 1992 Operating
Budget of the District to finance a portion of such
appropriation, and the issuance of $50,000 serial bonds of the
Town to finance the balance of said appropriation, and the
assessment, levy and collection of special assessments upon the
several lots and parcels of land within the District which the
Town Board shall deem especially benefited by said facilities so
much upon and from as shall be in just proportion to the amount
of benefit which the improvement shall confer upon the same, to
pay the principal of and inte'rest on said bonds.
Section 2. Serial bonds of the Town are hereby
authorized to be issued in the principal amount of $50,000,
pursuant to the provisions of the Local Finance Law, constituting
Chapter 33-a of the Consolidated Laws of the State of New York
(herein called "Law"), to finance said appropriation.
Section 3. The following additional matters are hereby
determined and stated:
(a) The period of probable usefulness of said specific
object or purpose for which said $50,000 serial-bonds authorized
by this resolution are to be issued, within the limitations of
Section 11.00 a. 4 of the Law, is forty (40) years.
(b) Funds in the aggregate amount of $175,000 will be
expended to finance a portion of the amount apppropriated
pursuant to this resolution, said $175,000 funds will consist of
$155,000 to be expended from the Southold Wastewater Disposal
District Repair Reserve Fund heretofore established by said
District and $20,000 to be expended from the 1992'Operating
Budget of said District.
(c) current funds are not required by the Law to be
provided prior to the issuance of the bonds authorized by this
resolution or any bond anticipation notes in anticipation of the
sale of such bonds, pursuant to the provisions of Section 107.00
d. 3(1) of the Law.
(d) The proposed maturity of the bonds authorized by
this resolution will exceed five (5) years.
Section 4. Each of the bonds authorized by this
resolution and any bond anticipation notes issued in anticipation
of said bonds, shall contain the recital of validity prescribed
by Section 52.00 of the Law and said bonds and any notes issued '
in anticipation said bonds, shall be general obligations of the
Town payable as to both principal and interest by a general tax
upon all the taxable real property within the Town without
limitation as to rate or amount. The faith and credit of the
Town are hereby irrevocably pledged to the punctual payment of
the principal of and interest on said bonds and any notes issued
in anticipation of the sale of said bonds and provision shall be
made annually in the budget of the Town by appropriation for (a)
the amortization and redemption of the bonds and any notes issued
in anticipation thereof to mature in such year and (b) the
payment of interest to be due and payable in such year.
Section 5. Subject to the provisions of this resolution
and of the Law, and pursuant to the provisions of Section 30.00
relative to the authorization of the issuance of bond
anticipation notes, and of Section 50.00 and Sections 56.00 to
60.00 of the Law, the powers and duties of the Town Board

relative to authorizing bond anticipation notes and prescribing
their terms, form and contents and as to the sale and issuance of
the bonds herein authorized and of any bond anticipation notes
issued in anticipation of said bonds, and the renewals of said
Notes, are hereby delegated to the Supervisor, the chief fiscal
officer of the Town.
Section 6. The validity of the bonds authorized by this
resolution and of any notes issued in anticipation of said bonds,
may be contested only if:
(a) such obligations are authorized for an object or
purpose for which the Town is not authorized to expend money,
or
(b) the provisions of law which'should be complied with
at the date of the publication of such resolution are not
substantially complied with,
and an action, suit or pro6eeding contesting such validity, is
commenced within twenty days after the date of such publication,
or
(c) such obligations are authorized in violation of the
provisions of the constitution.
Section 7. This resolution shall take effect
immediately.

RESOLVED BY THE TOWN BOARD OF THE TOWN OF SOUTHOLD, lN THE
COUNTY OF SUFFOLK, NEW YORK, AS FOLLOWS:
Section 1. The Town Clerk is hereby directed to publish the foregoing bond
resolution, in full, in the "THE SUFFOLK TIMES" a newspaper published in
Mattituck, New York, and in "THE LONG ISLAND TRAVELER-WATCHMAN", a
newspaper published in Southold, New York, two newspapers having a general
circulation in said Town, which newspapers are hereby designated as the official
newspapers of the Town for such publication, together with the Town Clerk's
statutory notice in the form prescribed by Section 81.00 of the Local Finance Law
of the State of New York.
Section 2. This resolution shall take effect immediately.
