business agenda to address the Board on any given topic.

Sanitary Flow Credit - FI Utility Co Acquistion
WHEREAS, on November 6, 2019, the Town of Southold acquired Fee Title to a parcel owned
by Fishers Island Utility Company, Inc.; and
WHEREAS, said property is identified as SCTM #1000-3.-7-3 is located at No # East End
Road, Fishers Island, New York, in the R-120 zoning district; and
WHEREAS, the entire parcel is 5.35 acres as per a survey prepared by CME Associates
Engineering, Land Surveying & Architecture, PLLC, last dated October 4, 2019; and
WHEREAS, said property is located within the Fishers Island School District; and
WHEREAS, the deed recorded as part of the purchase prohibits the use of the property for any
residential, commercial, or industrial uses and prohibits the use of the property for anything other
than preservation of open space and passive recreation; and
WHEREAS, as per Section 117-7 (Determination of Credits to be Deposited) of the Town Code,
the Land Preservation Coordinator provided the Town Board with a calculation of the sanitary
flow credits available for transfer from the above-mentioned parcel prior to the Town Board
public hearing on the purchase; and
WHEREAS, one (1) sanitary flow credit is available to be placed into the Town TDR Bank as a
result of the acquisition of this buildable, non-subdividable property; now, therefore, be it

RESOLVED that the Town Board of the Town of Southold hereby places one (1) sanitary flow
credit into the Town SFC Bank from the Town’s fee title acquisition of the property
formerly owned by Fishers Island Utility Company, Inc. that is located at No # East End
Road, Fishers Island, and identified as SCTM #1000-3.-7-3; and, be it further
RESOLVED that the Town Clerk shall enter this transfer of one (1) sanitary flow credit into the
Sanitary Flow Credit Log; and, be it further
RESOLVED that the Town Clerk shall forward this resolution to the Tax Assessors Office, the
Land Preservation Department, the Special Projects Coordinator and the Planning Department
for inclusion into the Town database and GIS system.

read as follows:
Whereas Mr. Christopher Newell has completed his training and management recommends that
he be promoted to full captain.
Therefore, it is resolved with effect October 10, 2019 to increase Mr. Newell’s Captain (FIFD)
salary to $28.00 per hour and simultaneously Mr. Newell is released from his part-time
Deckhand (FIFD) position.

WHEREAS, the Historic Preservation Commission denied the application of LOUIS
POTTERS AND LENORE BRANCATO dated June 28, 2018, for a Certificate of
Appropriateness for the demolition of 675 Skippers Lane, Orient, NY., pursuant to Section 170-9
(A) of the Southold Town Code, (Criteria for Approval of Demolition or Removal of Historic
Landmarks).
WHEREAS, on May 31, 2019, the Owners of 675 Skippers Lane appealed to the Town Board
requesting a reversal of the Commission’s Denial of the Certificate of Appropriateness pursuant
to Section 170-11(Appeals), or in the alternative requested an approval from the Town Board on
the grounds that prohibition of such demolition will subject the applicant to undue hardship
pursuant to Section 170-10 (Hardship criteria for approval of demolition, removal or alteration
of historic landmarks; and
WHEREAS, the application has been reviewed pursuant to Sections 170-10 and 170-11, of the
Southold Town Code (Landmarks Preservation); now, therefore, be it
RESOLVED that the Town Board of the Town of Southold hereby finds that the appeal of the
Historic Preservation Commission is hereby denied on the ground that the proposed demolition
of the Structure at 675 Skippers Lane does not meet the criteria for approval under Section 170-9
(A) of the Southold Town Code, (Criteria for Approval of Demolition or Removal of Historic
Landmarks) and be it further;
RESOLVED that the Town Board of the Town of Southold hereby finds that the application for
approval on a hardship basis is hereby denied on the ground that the proposed demolition of the
Structure at 675 Skippers Lane does not meet the criteria for approval under Section 170-10 of
the Southold Town Code, (Hardship criteria for approval of demolition, removal or alteration of
historic landmarks) and be it further;

connection with the Marine III (MIII) District” which reads as follows:
LOCAL LAW NO. 2019
A Local Law entitled, “A Local Law in relation to an Amendment to Chapter 280, Zoning,
in connection with the Marine III (MIII) District”
BE IT ENACTED by the Town Board of the Town of Southold as follows:
I Purpose.
The federal government, which currently owns Plum Island, has announced its intention to close
the research facility on Plum Island and eventually sell the island. Previously, when the Federal
Government made the aforementioned announcement, the Town Board of the Town of Southold
took steps to amend the Town’s Zoning Map in preparation for the Plum Island being privately
owned. The purpose of the Marine III (MIII) District is to provide a waterfront location in the
portion of the Town located on Long Island for ferry service to and from Plum Island.
II. Article XXXV Marine III Zone District (MIII)
§ 280-205 Use regulations.
In the MIII District, no building or premises shall be used and no building or part of a building
shall be erected or altered which is arranged, intended or designed to be used, in whole or in part,
for any uses except the following (one use per 320,000 square feet of land above mean high
water, unless otherwise specified):
A. Permitted uses. The following uses are permitted uses and are subject to site plan
approval by the Planning Board:
(1) Ferry terminals for ferry service to and from Plum Island only.
B. Accessory uses. The following uses are permitted as accessory uses and/or structures:
(1) Ticket offices, waiting areas, snack bar
(2) Off-street parking or loading areas.
(3) Offices for executive and administrative uses.
(4) Storage sheds and tool sheds.
(5) On-site storage and repair facilities directly related to the operation of the primary
permitted use
(6) Museum
(7) Any other customary structures or uses which are customarily incidental to the

principal use, except those prohibited by this chapter.
§ 280-206 Bulk, area and parking regulations.
No building shall be used and no building or part thereof shall be erected or altered in the MIII
District unless the same conforms to the Bulk Schedule and Parking and Loading Schedules
incorporated into this chapter by reference, with the same force and effect if such regulations
were set forth herein in full.
III. SEVERABILITY
If any clause, sentence, paragraph, section, or part of this Local Law shall be adjudged by any
court of competent jurisdiction to be invalid, the judgment shall not affect the validity of this law
as a whole or any part thereof other than the part so decided to be unconstitutional or invalid.
IV. EFFECTIVE DATE
This Local Law shall take effect immediately upon filing with the Secretary of State as provided
by law.
