SUPERVISOR RUSSELL: Please rise and join in the Pledge. Thank you. I would invite
anyone that would like to address the Town Board on any of the agenda items to please feel free?
Bob Hanlon, Orient
BOB HANLON: Item number 900, I would like to praise the town on doing that. It's a step in
the right direction to preserve Plum Island and associated properties. As I have indicated in the
past, the town's efforts at zoning Plum Island in anticipation of sale is a very good move and
will, while it doesn't resolve the issues it's a step in the right direction and will help (inaudible)
move us to take care of that property, so I thank you for putting this on the agenda for public
hearing.
SUPERVISOR RUSSELL: Thank you. Who else would like to address the Town Board?
Louise Harrison
LOUISE HARRISON: Good evening. I am Louise Harrison from Save the Sound and I too
would like to praise the town for the proposed Marine III zone code amendment. We will be
supporting it and we hope y ou get a good turnout at the public hearing in favor of it as well. We
think that this is a key piece in protecting Plum Island and also should go a long way to
protecting our most delicate far eastern end of the town in Orient and Orient Point. So thank
you.
SUPERVISOR RUSSELL: I want to thank you actually because it was with the scoping and the
various scenarios that your group and others, all these groups that you're bringing together, this
was disseminated from a lot of that discussion. You know, sometimes you can't think of

everything and you guys were very helpful in helping identify the next step in ensuring that you
meet your goals.
MS. HARRISON: Well, thank you for saying so but it's a real big group effort. The town is a
key player.

RESOLVED that the normal tip fees for brush disposal at the Cutchogue Compost Facility shall
be waived for residential vehicles, and reduced to $30/ton for commercial vehicles, for the period
October 17 -November 30, 2019; and be it further
RESOLVED that for the purposes of this resolution, residential vehicles shall be defined as any
vehicle with a resident disposal permit issued by the Town Clerk of the Town of Southold
carrying less than one ton of debris (including trailers), or for vehicles without a permit, any
vehicle carrying less than one ton (including trailers); and that commercial vehicles shall be
defined as any vehicle with a commercial disposal permit issued by the Town Clerk of the Town
of Southold, or for vehicles without a permit, any vehicle with a carrying capacity of one ton or
greater; and be it further
RESOLVED that the tip fee waiver/reduction described herein shall not apply to stumps of any
type; and that it applies to the charge for the weight of the debris ONLY, and not to single entry
fees for vehicles without permits, which will still be charged as appropriate.

COUNCILWOMAN DOHERTY: There has been some confusion because we opened the
landfill early for the free brush because of the storm, so anybody can drop off their brush at the
landfill between now and November 30th. Commercial rates are reduced until November 30th
as well. And the Highway Department as we just read, starts their cleanup at your residence on
November 18th. So it's two different programs and people were becoming confused.

in connection with the Marine III (MIII) District"
BE IT ENACTED by the Town Board of the Town of Southold as follows:
I Purpose.
The federal government, which currently owns Plum Island, has announced its intention to close
the research facility on Plum Island and eventually sell the island. Previously, when the Federal
Government made the aforementioned announcement, the Town Board of the Town of Southold
took steps to amend the Town's Zoning Map in preparation for the Plum Island being privately
owned. The purpose of the Marine III (MIII) District is to provide a waterfront location in the
portion of the Town located on Long Island for ferry service to and from Plum Island.
II. Article XXXV Marine III Zone District (MIII)
280-205 Use regulations.
In the MIII District, no building or premises shall be used and no building or part of a building
shall be erected or altered which is arranged, intended or designed to be used, in whole or in part
for any uses except the following (one use per 320,000 square feet of land above mean high
water, unless otherwise specified):
A. Permitted uses. The following uses are permitted uses and are subject to site plan
ap rop val by the Planning Board:
(1) Ferry terminals for ferry service to and from Plum Island only.
B. Accessory uses. The following uses are permitted as accessory uses and/or structures:
(1) Ticket offices, waiting areas, snack bar
(2) Off-street parking or loading areas.
(3) Offices for executive and administrative uses.
(4) Storage sheds and tool sheds.
(5) On-site storage and repair facilities directly related to the operation of the primary
permitted use
(6) Museum
(7) Any other customary structures or uses which are customarily incidental to the
principal use, except those prohibited by this chapter.

District unless the same conforms to the Bulk Schedule and Parking and Loading Schedules•

If any clause, sentence, paragraph, section, or part of this Local Law shall be adjudged by any
court of competent jurisdiction to be invalid, the judgment shall not affect the validity of this law

IV. EFFECTIVE DATE

SUPERVISOR RUSSELL: That concludes the agenda. Who would like to address the Town
Board on any issue?
Peter Harris, Greenport
PETER HARRIS: Good evening, Peter Harris, Greenport. I am here tonight to inquire how
much funding is going to be budgeted for sidewalk replacement for the budget year 2020.
SUPERVISOR RUSSELL: There's actually a capital project for$500,000 for 2020.
MR. HARRIS: Okay. So that brings me to my next question. What is going to be done to
address hazardous condition of the sidewalk in the balmy location in Greenport? Main Street
between Bridge and Washington Avenue north up to the junction of Route 48 and Route 25?
Knapp Place, Sterling Place, Bailey Avenue, Champlin Place and Atlantic Avenue. A couple of
weeks ago, a highway department crew showed up in my neighborhood. They trimmed over-
hanging bushes, they moved two trees, ground tree routes, poured three new sidewalk panels at
three different locations. I want to thank them, however the repair work completed is just the tip
of the iceberg of what really needs to take place. I recently read in the Suffolk Times, you Scott,
you just answered my question but also, also isn't there $250,000 earmarked for Fishers Island?
SUPERVISOR RUSSELL: Yes.
MR. HARRIS: Recently, one of my elderly neighbors two doors down from me tripped and fell
on Sterling Place in front of house 509. She had to be transported by Greenport Fire Department
Rescue Squad to Eastern Long Island Hospital. And speaking of the Greenport Fire Department,
I have a letter and copies that were approved by the Greenport Fire council regarding the poor
conditions of the area sidewalks in Greenport. I will read the letter and then I will bring it up and
hand it to you, Scott. The letter was addressed to Scott Russell, Supervisor of Southold Town,
`re: sidewalks in dangerous conditions and disrepair. This letter is to bring to your attention as
well as the attention of the other five others that comprise the voting party of the Southold Town
Board of a dangerous condition. As you are well aware that members that belong to all fire
departments throughout the entire township serve as volunteers. The service is done 24/7, 365
days a year whether it be a fire or a medical emergency. It is important that the means of getting
to a business or to a person's residence be made safe by having the existing sidewalk system be
level and in good condition It has been brought to the attention of the Greenport Fire Department
fire council that this is not the case in the following areas of Greenport, Main Street between

Bridge Street and the intersection of Route 25/CR 48, Knapp Place, Champlin Place, Bailey
Avenue, Sterling Place. The sidewalks in these areas are over 70 years old and are lifted, broken
and uneven. The Greenport Fire Department answers many calls under the cover of darkness of
night, making it very easy for a first responder to injury oneself by tripping and falling on a
defective town-owned sidewalk. Not to mention that the resulting injuries could lead to a lawsuit
against the Town of Southold. We are respectfully requesting that action be taken by the Town
Board to be proactive in making the sidewalk system in the east/west fire protection district,
served by the Greenport Fire Department a safe means of passage by all who use it.
Respectfully, James Kalin, Secretary/Treasurer.' Besides the sidewalks, all of the corners need
to have handicap ramps installed to comply with the federal Americans with Disabilities Act. It
is a shame that people have to choose to walk in the street because of the poor conditions of our
70 plus year old sidewalks. It's not just the residents but the area is used every day by
employees of ELIH when they are on their breaks. The gals like to come out and they walk and
they use the neighborhood every day. As well as residents from Peconic Landing who are out
seeking exercise. That takes care of that. The next item that I would like to speak about, I
happened to be watching, turned on channel 22 one morning and I happened to catch a segment
of the Town Board work session and it had to do with a request of purchasing additional
equipment for the use of doing drainage work. And I very tentatively sat there listening to Jamie
Richter and Michael Collins, they seemed like they were doing all the talking, highly respected
engineers from my time working for the Town of Southold. My main question on the issue was
a statement saying that the highway four-wheel drive rubber tire excavator digging bucket is
sometimes too large for doing the trenching work and that a different machine needed to be
purchased to accomplish that task. I don't understand why you, why they don't purchase a
couple of narrower buckets that could be interchangeable on the end of the excavator boom to
accomplish their needs without having to spend an excessive amount of funding to have the right
tool to do the right job. You know, the lifter for the rings, I actually, if I had ran for a fourth
term, that was on my go to list to purchase a lifter to set the rings in place and make it a more
safe condition to work in, totally behind that 100 percent. But again, you know, the, somebody
had used the phrase the right tool for the right job. You have got a machine that digs the hole,
you can change out and put a narrower bucket when you want to lay in pipe, why do you need to
go and buy a whole machine when you can do it with interchangeable buckets? But that's just
somebody that was in the business for years. My last comment and I am going to make this,
having been a former superintendent for the Town of Southold, Raymond L. Jacobs, former
superintendent of highways for the Town of Southold, Ray C. Dean former superintendent of
highways for the Town of Southold, all three of us had worked in the business our entire life
working on highways. Mr. Dean had worked for the State Department of Transportation before
he was elected, Mr. Jacobs was an employee of the Town of Southold, became Deputy and then
he became superintendent when Ray Dean decided to retire. I was a former employee of the
New York State Department of Transportation and decided to run for public office upon
Raymond Jacobs contacting me to tell me he wasn't going to be seeking re-election. I can speak
for myself because I can speak for Ray Jacobs and I can speak for Raymond Dean because as a
high school student I worked for Mr. Dean during the summers and all three of us took the job
very seriously as far as knowing the job and being at the job on a daily basis, seven, eight hours
minimum during the day, stayed after hours if we were out on the road and there were things that
needed to be caught up on. I can't say that's the same for your current superintendent and I think

there's some people sitting up on that dais'know what I am talking about. I just happened to be
walking in and when you got to salary scale, $111,916, if you don't believe what I am saying
that the person that is currently holding that office, he is not there half the time. You are paying
a full-time salary for a part-time employee and if you don't believe me, talk to the people that
work in that department. They'will tell you, talk to people who have retired because they got
tired of not being listened to because they knew what they were talking about. You have a
person run for office, good for him. He ran, he was elected but he didn't bring any knowledge
about highway work when he took the job and he wouldn't listen to anybody. I will never forget
the first day the man walked into the office when I was still there and I said to him, I am glad
you are here because we need to sit down. I want to have a nice smooth transition, we need to go
over. I don't need to go over anything, I know it all. And here we are, almost five years later
and I am telling you, he is not there half the time and it's not, as a taxpayer, no less a former
superintendent, 1 gave my all and so did the two other people that I named. We served the
people. This gentleman is not-serving the people. And some people might say, well, he's an
elected official, what can we do? Right there, that salary has to be approved by every one of you
people sitting up there: Hold that over his head, you want that salary? You show up and go to
work. I would not expect any less from any one of you people sitting up here and it just, it just
grinds me when I go by there and he's not there and it's not because he's out on the job. I am
telling you and there's people that know exactly what I am saying. So, I am just going to say,
you know what? Talk to the guy, you want that kind of money, we are not talking a person that's
put in charge of checking on the beaches, summertime for $15,000-$17,000., we are talking
$111,000 almost $112,000 and the person ain't coming to work. I just, I don't know what else to
say and it's not sour grapes because I (inaudible), I retired. So it's not sour grapes that I lost an
election to somebody, this is, I lived and sweated that job,just like Ray did. Both Ray's. And to
be the person in charge of a multi-million dollar operation, certainly not in my opinion taking it
serious. So, with that, thank you so much for your time.
SUPERVISOR RUSSELL: Thanks, Pete. I just want to address, at least from the sidewalk
perspective, the idea is to set up a capital project, you know, sidewalks are very expensive but we
are going to ask the same thing we did as roads; go out and evaluate the worst first. Focus on
those first and we are going to have to fund it probably over a few years, so that's...
MR. HARRIS: If I can just say something, Scott. When they do, I know how it was done when
I was there on Fishers Island, Louisa, this year, did they go piecemeal or did they replace-an
entire-section of sidewalk in one...

MR. HARRIS: 2019, there was no, the money that was appropriated for sidewalk work was
never done?
JUSTICE EVANS: Not to date yet.

SUPERVISOR RUSSELL: It was carried over. We were waiting for the utility company to
move infrastructure, they took a very long time and we missed the season on it. So what we
anticipate doing I believe it's next spring.
JUSTICE EVANS: When it's done, my understanding is they are trying to do long stretches.
All the sidewalks on Fishers Island are in terrible shape.
MR. HARRIS: Welcome to the club, my dear.
JUSTICE EVANS: The most traveled ones that are in the worst shape, they won't get them all.
MR. HARRIS: Well, I just know from when I was superintendent, it was always we didn't do
piecemeal, we did stretches.
JUSTICE EVANS: And that's the plan.

MR. HARRIS: That's what I am looking for. I am not looking for a panel here, a panel there
because that is not solving the problem where I live and out on Main Street. The amount of foot
traffic that we have, during the summer season, it's a, having been a superintendent, having went
to numerous examinations before trial because someone had fell and someone got injured and as
soon as we were notified we went, we fixed the problem and the thing that saved this town was
the fact that there had never been a problem, the town was never notified of an existing problem
in that location. Not that the town was trying to get out of it but with all the miles of sidewalk
that you have in the town, you are not going to know where every single one is. I will tell you,
in my particular location, I went out personally, I went out with a measuring wheel, a pad and I
am writing this stuff down. I took it serious. In one of the locations I had written on my pad, 509
Sterling Place is exactly where my neighbor, she happened to be going to visit someone on
Champlin Place and on her way home, she tripped on a raised hem, so I just, I had to share that.
SUPERVISOR RUSSELL: I will tell you one thing, not only where you out there with a
measuring wheel, you were out there with a ruler to make sure they were putting the asphalt on
the road that they bid.
MR. HARRIS: Mr. Supervisor, I am not looking for a pat on the back from nobody but one
thing, if Pete Harris has something to say, he says what he has to say.

SUPERVISOR RUSSELL: And that's why I appreciate working with you for as long as I did.
one of the things I would suspect, I am certainly no expert but probably from a mobilization
perspective, you would have to saturate an area one at a tune rather than here, here, here. Just
from a mobilization you can probably do more sidewalks for less money if you did and any
contractor that will bid is going to want to see it that way. Who else would like to address the
Town Board? (No response)
