SUFFOLK COUNTY ADMINISTRATIVE CODE: This application was referred as required under the Suffolk County Administrative Code Sections A 14-14 to 23, and the Suffolk County Department of Planning issued its reply dated July 2, 2019 stating that this application is considered a matter for local determination as there appears to be no significant county-wide or inter-community impact. LWRP DETERMINATION: This application was referred for review under Chapter 268, Waterfront Consistency review of the Town of Southold Town Code and the Local Waterfront Revitalization Program (LWRP) Policy Standards. The LWRP Coordinator issued a recommendation dated November 4, 2019. Based upon the information provided on the LWRP Consistency Assessment Form as well as the records available, it is recommended that the proposed action is EXEMPT from LWRP Review. PROPERTY FACTS/DESCRIPTION: The subject property is a non-conforming 20,480.20 sq. ft. parcel, 17,727.20 sq. ft. of which is buildable since 7.44% is in a wetland, located in the R-40 Zoning District. The northerly property line fronting Pipes Creek measures 95.00 feet along the shore line, the westerly property line measures 205.00 feet, the southerly property line, fronting Bayshore Road measures 100.00 feet and the easterly property line measures 218.00 feet. The parcel is improved with a two-story frame single family dwelling with an attached wood deck, as shown on the survey prepared by Francis C. Watson, L.S. last revised January 4,2019. BASIS OF APPLICATION: Request for a Variance from Article XXIII, Section 280-124 and the Building Inspector's June 11, 2019, Notice of Disapproval based on an application for a permit to reconstruct a deck attached to an existing single family dwelling; at, 1) less than the code required side yard setback of 15 feet; located at 605 Bay Shore Road, (Adj.to Pipes Creek)Greenport,NY. SCTM No. 1000-53-3-8. RELIEF REQUESTED: The applicant requests a variance to replace an existing wood deck and construct a new wood deck attached to the rear of the single-family dwelling, maintaining the same nonconforming side yard setback of 12.5 feet where a minimum of 15 feet is required according to Town Code. Page 2,November 21,2019 #7331,Osdoby SCTM No. 1000-53-3-8 ADDITIONAL INFORMATION: The applicant is also proposing an in-ground swimming pool in the rear yard that will be conforming to the Town Code,but will require Southold Town Board of Trustees approval FINDINGS OF FACT/REASONS FOR BOARD ACTION: The Zoning Board of Appeals held a public hearing on this application on November 7, 2019 at which time written and oral evidence were presented. Based upon all testimony, documentation, personal inspection of the property and surrounding neighborhood, and other evidence,the Zoning Board finds the following facts to be true and relevant and makes the following findings: 1. Town Law X267-W)(b M. Grant of the variance will not produce an undesirable change in the character of the neighborhood or a detriment to nearby properties. The subject proposed deck will replace an existing 12 feet x 19 feet attached wood deck with a slightly larger 14 feet by 27 feet attached wood deck, which will not be visible from the road because the attached proposed deck in the rear yard will maintain the same side yard setback as the applicant's dwelling. Neither will the proposed deck be visible to adjacent properties which contain undeveloped wooded buffers. 2. Town Law X267-b(30)(2). The benefit sought by the applicant cannot be achieved by some method, feasible for the applicant to pursue, other than an area variance because if the applicant were to construct an attached deck on the rear of their house with a conforming 15 foot side yard setback, the deck would not line up with the exterior door and deck stairs and the railings would block the existing exterior windows. . 3. Town Law §267-b(3)(b)(3). The variance granted herein is mathematically substantial, representing 16.6% relief from the code. However, as indicated, the existing deck will be replaced by a new deck that will maintain the same existing non-confirming side yard as the dwelling and original deck, which historically has had no adverse impacts on the neighborhood 4. Town Law §267-b(3)(b)(4). No evidence has been submitted to suggest that a variance in this residential community will have an adverse impact on the physical or environmental conditions in the neighborhood. The proposed deck is located at considerable distance from wetlands and the applicant must comply with Chapter 236 of the Town's Storm Water Management Code. 5. Town Law 4267-b(3)(b)(5). The difficulty has been self-created. There is no history of variance relief for the as built deck in the Town's records and the Certificate of Occupancy No. Z7168 dated August 9, 1976 for the private one family dwelling does not list an attached deck. Moreover, the applicant purchased the parcel after the Zoning Code was in effect and it is presumed that the applicant had actual or constructive knowledge of the limitations on the use of the parcel under the Zoning Code in effect prior to or at the time of purchase 6. Town Law §267-b. Grant is the minimum action necessary and adequate to enable the applicant to enjoy the benefit of an attached rear yard deck while preserving and protecting the character of the neighborhood and the health, safety and welfare of the community. RESOLUTION OF THE BOARD: In considering all of the above factors and applying the balancing test under New York Town Law 267-B, motion was offered by Member Planamento, seconded by Member Weisman (Chairperson), and duly carried,to GRANT the variance as applied for, and shown on the survey prepared by Francis C. Watson, L.S., last revised January 4, 2019 and building plans (Sheet nos. A-1 &A-2) prepared by Joseph Fischetti, P.E., dated February 16, 2018. That the above conditions be written into the Building Inspector's Certificate of Occupancy, when issued. Any deviation from the survey, site plan and/or architectural drawings cited in this decision will result in delays and/or a possible denial by the Building Department of a building permit, and may require a new application and public hearing before the Zoning Board of Appeals. Any deviation from the variances) granted herein as shown on the architectural drawings, site plan and/or survey cited above, such as alterations, extensions, or demolitions, are not authorized under this application when involving nonconformities under the zoning code. This action does not authorize or condone any current or future use, setback or other feature of the subject property that may violate the Zoning Code, other than such uses, setbacks and other features as are expressly addressed in this action. In the event that an approval is granted subject to conditions, the approval shall not be deemed effective until the required conditions have been met; and failure to comply therewith will render this approval null and void. The Board reserves the right to substitute a similar design that is de minimus in nature for an alteration that does not increase the degree of nonconformity. Pursuant to Chapter 280-146(B) of the Code of the Town of Southold any variance granted by the Board of Appeals shall become null and void where a Certificate of Occupancy has not been procured, and/or a subdivision map has not been filed with the Suffolk County Clerk,within three (3)years from the date such variance was granted. The Board of Appeals may, upon written request prior to the date of expiration, grant an extension not to exceed three (3) consecutive one (1) year terms. In your letter,you have requested that the condition, "that the deck remain open to the sky"be rescinded in the variance approval,#7331, dated November 21, 2019. This request is not de minimus, but rather a request to amend the Board's decision by lifting a condition of approval for variance relief. I reviewed your letter and the Zoning Board of Appeals determinations No. 7331 as well as the hearing transcript of November 7, 2020. In the hearing testimony, it was understood that the proposed deck would be in the same form as the old deck, and that the applicant wished to maintain the functionality of the deck and keep the status quo. It is the Building Department's assessment that the construction of a porch would also require a building permit,and that therefore, a Notice of Disapproval would issue if the structure did not meet required setbacks. Should your client wish to pursue replacing the deck with an enclosed porch, at a future date,you will need additional variance relief with a new application and a public hearing. Osdoby(ZBA Decision#7331) Zoning Board Of Appeals Situate: 605 Bay Shore Road, Greenport SUM#1000-53-3-8 Dear Members of the Board, On November 26,2019,Steven and Jaci Osdoby obtained a zoning variance authorizing the replacement of an attached deck.The decision contains a condition that the deck shall remain open to the sky.The imposition of the condition took the property owners by surprise as no discussion relating to the restriction took place during the hearing. Having now resided on the property during the warmer months of the year,the property owners have experienced an overabundance of mosquitoes. This has severely restricted their ability to enjoy the deck and the outside.They would also like their new baby grandchildren to be able to enjoy the outside without fear of a mosquito attack. Please note that the property is adjacent to a tidal marsh and the back of the house and deck face northeast placing it in the lee of the prevailing winds out of the southwest. Therefore,the property owner has considered erecting a screen porch on top of a portion of the deck to address the mosquito infestation. Request is hereby made for a de minimis amendment of the decision removing the condition that the deck shall remain open to the sky as to allow for the eventual construction of the screen porch on top of a portion of the approved deck.The footprint as approved by your Board would remain unchanged.
