SUFFOLK COUNTY ADMINISTRATIVE CODE: This application was not required to be referred to the Suffolk County Department of Planning under the Suffolk County Administrative Code Sections A 14-14 to 23. LWRP DETERMINATION: The relief, permit, or interpretation requested in this application is listed under the Minor Actions exempt list and is not subject to review under Chapter 268. TOWN OF SOUTHOLD OFFICE OF ENGINEER: This application was referred for an evaluation and recommendation to the Office of the Engineer. In their letter dated October 16,2019,the Engineer stated that there are no other concerns about the structure due to the current conditions of the adjacent structures, beyond what the Building Department has already addressed. However, the site has never received a formal stormwater review under Chapter 236 prior to construction. The engineer would recommend that the applicant submit a plan indicating any and all drainage systems that have been installed on the site. PROPERTY FACTSMESCRIPTION: The subject property is a 130, 532 sq. ft. parcel located in an R-40 Zoning District. The property is located approximately 400 ft. north of Peconic Bay Boulevard on a private Right of Way. The property has a frontage of 229.23 ft. along the right of way, which then turns west 396.22 ft. before turning south 397.29 ft. It then measures 489.30 ft. towards the east and the right of way frontage. The residence is located close to the east side of the property along the right of way. The parcel is improved with a single-family two-story dwelling shown on the survey by Nathan Taft Corwin,Land Surveyor, last revised May 8, 2019. BASIS OF APPLICATION: Request for a Variance from Article IV, Section 280-14 and the Building Inspector's May 17, 2019, Notice of Disapproval based on an application for a permit to legalize an "as built" second story on an existing single family dwelling; at, 1) less than the code required front yard setback of 60 feet; located at 7213 Great Peconic Bay Blvd., Laurel,NY. SCTM No. 1000-126-10-1.2. RELIEF REQUESTED: The applicant requests a variance to legalize an"as-built" second story addition having a front yard setback of 15.2 feet to the foundation (14.4 feet to the roof overhang)where the bulk schedule requires a front yard setback of no less than 60 feet Page 2,November 21, 2019 #7330,Kermanshachi SCTM No. 1000-126-10-1.2 ADDITIONAL INFORMATION: As per written submission and oral testimony by the applicant's agent, a variance was granted (# 5986, dated February 8, 2007) for an as-built addition of a two story attached garage with only unheated attic storage space on the second floor, with a setback of 14 feet,4 inches from the easterly property line along the Right of Way. Sometime after this, instead of building what was granted, the owner added dormers to the second floor of the garage and converted it to habitable space. A Certificate of Occupancy # 40299 was issued on April 5, 2019 for an "as-built" garage addition. An inspection report dated April 15, 2019 noted the existence of the second-floor additions to the attached garage. FINDINGS OF FACT/REASONS FOR BOARD ACTION: The Zoning Board of Appeals held a public hearing on this application on November 7, 2019 at which time written and oral evidence were presented. Based upon all testimony, documentation, personal inspection of the property and surrounding neighborhood, and other evidence,the Zoning Board finds the following facts to be true and relevant and makes the following findings: 1. Town Law X267-b(3)(b)(1). Grant of the variance will not produce an undesirable change in the character of the neighborhood or a detriment to nearby properties. The applicant's property has frontage along a private Right of Way, which extends approx. 400 feet north of Peconic Bay Boulevard. The existing 14'-4" setback to the garage roof overhang(15. 2 feet to the foundation) is greater than the five-foot setback of the adjacent house to the south, and also greater than the three-foot setback of the next house to the so4th. The existing structure legally exists under past Certificates of Occupancy, and the second-floor alterations to the attached garage do not extend past the lines of the existing house, the first-floor setback lines, or the roof lines. 2. Town Law 4267-b(3)(b)(2). The benefit sought by the applicant cannot be achieved by some method, feasible for the applicant to pursue, other than an area variance. The existing attached garage and roof structure above already legally exist under past Certificates of Occupancy and with the benefit of variance relief for a front yard setback. However, the applicant ignored the ZBA condition of approval limiting the second floor of the garage to unheated attic storage space by adding a dormer for head room and converting the attic to habitable space. Any work to this area of the house that was not granted by prior variance relief from the zoning code will require additional relief. 3. Town Law §267-b(3)(b)(3). The variance granted herein is mathematically substantial, representing approximately 74.6 % relief from the code. However, the as-built second floor alterations to the legally existing attached garage do not increase or change the degree of non-conformance of the previously approved front yard seback. 4. Town Law X267-b(3)(b)(4). No evidence has been submitted to suggest that a variance in this residential community will have an adverse impact on the physical or environmental conditions in the neighborhood. The applicant must comply with Chapter 236 of the Town's Storm Water Management Code. 5. Town Law §267-b(3)(b)(5). The difficulty has been self-created. The applicant purchased the parcel after the Zoning Code was in effect and it is presumed that the applicant had actual or constructive knowledge of the limitations on the use of the parcel under the Zoning Code in effect prior to or at the time of purchase. 6. Town Law §267-b. Grant of the requested relief is the minimum action necessary and adequate to enable the applicant to enjoy the benefit of a second story bedroom while preserving and protecting the character of the neighborhood and the health, safety and welfare of the community. Page 3,November 21, 2019 #7330,Kermanshachi SCTM No. 1000-126-10-1.2 RESOLUTION OF THE BOARD: In considering all of the above factors and applying the balancing test under New York Town Law 267-13, motion was offered by Member Lehnert, seconded by Member Acampora, and duly carried,to GRANT the variance as applied for, and shown on the Plans prepared by Sid Schlomann, R.A., dated May 13, 2019, and the survey prepared by Nathan Taft Corwin, III, Land Surveyor, and dated May 8, 2019. SUBJECT TO THE FOLLOWING CONDITIONS: 1. The applicant shall submit drawings by a licensed design professional showing compliance with Chapter 236,Stormwater Management Code to be approved by the Building Department. 2. Building Department shall grant Certificate of Occupancy only after compliance with Chapter 236, Stormwater Management Code. 3. This approval shall not be deemed effective until the required conditions have been met; and failure to comply therewith will render this approval null and void That the above conditions be written into the Building Inspector's Certificate of Occupancy, when issued. Any deviation from the survey, site plan and/or architectural drawings cited in this decision will result in delays and/or a possible denial by the Building Department of a building permit, and may require a new application and public hearing before the Zoning Board of Appeals. Any deviation from the variance(s) granted herein as shown on the architectural drawings, site plan and/or survey cited above, such as alterations, extensions, or demolitions, are not authorized under this application when involving nonconformities under the zoning code. This action does not authorize or condone any current or future use, setback or other feature of the subject property that may violate the Zoning Code, other than such uses, setbacks and other features as are expressly addressed in this action. In the event that an approval is granted subject to conditions, the approval shall not be deemed effective until the required conditions have been met; and failure to comply therewith will render this approval null and void. The Board reserves the right to substitute a similar design that is de minimis in nature for an alteration that does not increase the degree of nonconformity. Pursuant to Chapter 280-146(B) of the Code of the Town of Southold any variance granted by the Board of Appeals shall become null and void where a Certificate of Occupancy has not been procured, and/or a subdivision map has not been filed with the Suffolk County Clerk,within three (3)years from the date such variance was granted. The Board of Appeals may, upon written request prior to the date of expiration, grant an extension not to exceed three (3) consecutive one (1)year terms. The property Site Plan has been prepared by the office of Nathan Taft Corwin, Land Surveying P.C. last dated 5/8/2019. The disapproval prepared by the Building Department indicates the creation of an "As-Built" second floor addition to an existing single family residence where the front yard setback does not meet Bulk Schedule requirements. At this time and due to the current conditions of the adjacent properties I see no other concerns beyond what the Building Department has already addressed. (Note: This is not an approval for any other agency or department having jurisdiction.) According to my files, this site has never received a formal stormwater review under Chapter 236 prior to construction. Therefore, at this time I would recommend that the applicant should submit a plan indicating any and all drainage systems that have been installed on the site. This plan should be certified by a Design Professional and must meet the minimum requirements of Chapter 236 for Stormwater Management Any upgrades required to meet those minimum standards should be installed prior to submission of the drainage plan. The plans prepared by Donald Jewell, Architect only included the first floor (garage). The Zoning - Board had granted a variance for the setback to the existing garage (14'4") with the area above the garage shown as "unheated attic storage" with a large triangular window for the existing space above the garage. Note: The ZBA granted 14' 4" due to the roof overhang (eves around the house),the actual foundation was at 151". These setbacks have not changed. The owner mistakenly believed that the building permit could be amended. The applicant completed a second floor dormer designed to be stepped back from the street side window, the second floor dormer over the garage is facing the side yard (South). The work was done and a building permit for the second floor alteration/addition was filed. Upon review by the building department, the second floor alteration/additions could not be issued because the original 2007 variance had not contemplated the second floor alterations/addition which were constructed. A new application for the "as built" second floor alteration/addition over the existing garage is herein made. No change is produced to the character of the neighborhood or detriment to nearby properties. The second floor over the existing garage has the full dormer facing the rear yard. From the front of the house the second floor does not appear changed from the original un-finished garage. The History of the property is that the existing structure on the property was converted to a single family dwelling by Perini sometime after 1977. Perini had doubled the size of the original structure and made improvements to the house prior selling the house to Kermanshahchi. These improvements made by Perini were shown on the plans submitted to the Town for the garage but the building department only issued a building permit for the "garage". This was discovered when the title company searched the building department records. The applicants were in contract to sell the house and building permits for the interior spaces had to be obtained. The applicants had the drawings prepared for the interior which included the second floor of the garage. The house has been encroaching onto the front yard since the structure was first constructed. The second floor over the garage did not change the ZBA approved setback, the roof line first changes @ 15' back,thereafter a dormer was added facing the side yard. . (2) The benefit sought by the applicant CANNOT be achieved by some method feasible for the applicant to pursue,other than an area variance,because: The existing house and garage location have not changed. The second floor dormer addition to the second floor does not increase the front yard non-conformity. The garage remains a garage on the first floor and the roof line of the garage from the street side is maintained. The dormer is added to the side. (3) The amount of relief requested is not substantial because: The Zoning Board granted the variance for the existing location of the garage and the second floor was constructed within the existing roof frame. A dormer was added to meet the NYS Building Code for the habitable space. However, the street view maintains the one story roof line with a side dormer stepped back 15'from the front elevation. Based upon all testimony, documentation, personal inspection of the property,and other evidence,the Zoning Board finds the following facts to be true and relevant: AREA VARIANCE RELIEF REQUESTED: The applicants request a variance to allow the addition of an attached garage with a setback of 14'4"from the easterly front lot line along a private road. REASONS FOR BOARD ACTION: On the basis of testimony presented, materials submitted and personal inspections,the Board makes the following findings: 1. Grant of the variance will not produce an undesirable change in the character of the neighborhood or a detriment to nearby properties. The applicant's property has frontage along a private right-of-way, and the right-of-way extends at least 400 feet north of Peconic Bay Boulevard. The 14'4" setback is greater than the five-foot setback of the adjacent house to the south (now or formerly of Benedict) and also greater than the three-foot setback of the next house now or formerly of Denston (south of Benedict). 2. The benefit sought by the applicant cannot be achieved by some method, feasible for the applicant to pursue, other than an area variance. There is no other practicable location for an attached garage on the property. The applicant's house is pre-existing and the floor plans are laid out. The garage is being located where the carport existed. 3. The variance granted herein is substantial. The difficulty has been self-created insofar as it was the result of efforts of the prior owner to convert a nonconforming structure on this parcel into a dwelling. The original structure had,been the bathhouse of a girls' camp and was transformed by a previous owner. The as-built garage for which a setback reduction is sought was previously a carport. 5. As you are well aware, my clients have trying to obtain a certificate of use from the Village for quite some time in order to sell their property which is currently under contract. To that end, they hired an expeditor to legalize the space above their garage by means of filing for a permit/variance. The permit was recently denied and they have been advised that they need to make major changes to the plans/property in order to get an approval. We have been speaking to our architect about a potential solution, and his suggestion was that we amend our filings to request to expand the opening to the family room off the living room area. We can then rename the center of the home from living room/dining room to solely a living room with an open kitchen. As a result, the current den will become a dining room. We have been advised that the Village of Southold has very specific limitations on the number of dens or family rooms a home can have. As such, our architect is suggesting that we keep the variance filed for the room upstairs,but with the changes mentioned above, so we can find a solution to the variance problem we have been facing for these many months. It goes without saying that the current application, as it stands will never be approved since even if we are able to comply with the village zoning requirements, the health department requirements will never be able to be complied with due to the current positioning of the house on the property. That is why we believe that changing the plans will circumvent the septic problem that will surely arise if we continue on this current path. We ask for a face to face meeting in order to explain the above and answer any potential questions in order to make a final decision on the pending applications.
