SUFFOLK COUNTY ADMINISTRATIVE CODE: This application was referred as required under the Suffolk County Administrative Code Sections A 14-14 to 23, and the Suffolk County Department of Planning issued its reply dated March 12, 2019 stating that this application is considered a matter for local determination as there appears to be no significant county-wide or inter-community impact. LWRP DETERMINATION: This application was referred for review under Chapter 268, Waterfront Consistency review of the Town of Southold Town Code and the Local Waterfront Revitalization Program (LWRP) Policy Standards. The LWRP Coordinator issued a recommendation dated November 4, 2019. Based upon the information provided on the LWRP Consistency Assessment Form, as well as the records available, it is recommended that the proposed action is INCONSISTENT with LWRP policy standards and therefore is INCONSISTENT with the LWRP. On July 5, 2019, the LWRP Coordinator made a recommendation of CONSISTENT to the Southold Town Board of Trustees for the action. Upon further review and with the Coastal Erosion Hazard Area shown on the plan, the Coordinator reassessed the action to the policies and have determined that parts of the action are INCONSISTENT with the LWRP. Notably Policy 4: Policy 4. Minimize the loss of life, structures, and natural resources from flooding and erosion. 1. Avoid development other than water-dependent uses in coastal hazard areas. Locate new development which is not water-dependent as far away from coastal hazard areas as practical. The coordinator commented that the proposed CEHA is depicted in different locations on the Young and Young survey and the first story addition and the Frank W. Uellendahl survey. However, with the conditions imposed herein and the removal of the improvements located within the CERA, the Zoning Board of Appeals finds the proposed action to be CONSISTENT with the LWRP Page 2,November 21,2019 #7293,Milano SCTM No. 1000-21-2-9 SUFFOLK COUNTY SOIL AND WATER CONSERVATION DISTRICT: This application was referred to Suffolk County Soil and Water Conservation District (SCS&WCD) for review and comment and the SCS&WCD issued its reply dated May 8, 2019 indicating an inventory, evaluation and site visit occurred on April 16, 2019. Agency comments include: 1. The waterfront residential property located atop a large bluff that leads down to the Long Island Sound is well vegetated with a mix of perennial grasses, trees and shrubs. The toe of the bluff is not supported by a hardened shoreline and shows signs of significant wind and water erosion. The bluff face exceeds the recommended maximum 1:3 ratio, and partly as a result, the bluff condition is poor and unstable in some areas. The bluff s face shows an estimated 80% of vegetated cover, there are several areas of concern that should be addressed to ensure the bluff's long-term protection. Failure to monitor and maintain the angle of repose and adequate vegetation on the bluff will significantly impact the bluff s long-term resilience and will contribute to significant soil loss of the bluff, specifically around and under the staircase. These unstable areas are potentially the result of several factors that may be causing the erosion including the use of woody and invasive species that occupy the bluff face, as well as several wildlife corridors that create gully erosion. In addition, there are a number of spots on the bluff that suffer from soil loss due to runoff from the top of the bluff. To stabilize the bluff, runoff control measures are recommended to capture and convey all stormwater runoff away from the bluff and discard it to the south. It is recommended that the bluff face, top and toe be monitored closely for any changes in vegetation. 2. The current structure (single family dwelling) on the property is located very close to the top of the bluff and may impact the stabilization and health of the bluff that is adjacent to the structure. It was observed that the current structure is overhanging the top of the bluff and as a result poses significant impact to the bluffs stability. 3. The proposed improvements to the site include the construction of an accessory swimming pool located in the side yard with a 25.2 foot setback (Note: the prior site plan depicts a 60 foot setback, while the last revised site plan, stamped by the Southold Town Board of Trustees, depicts a 74 foot setback) from the top of the bluff. This raises a concern as the location of the pool and required construction may cause the bluff to destabilize and fail. Special consideration should be taken to ensure that any runoff from these surfaces are collected and discharged in a designated area away from the top of the bluff. It is critical that runoff be diverted away from the proposed structure during construction and post-construction to ensure the stabilization of the soils surrounding the proposed improvement. 4. Additional considerations include: • All ground disturbance activities have an impact. If soil disturbance is minimized the impacts associated with the activated are significantly decreased. Undisturbed and vegetated areas should be left undisturbed whenever possible. • Protection of existing vegetation is critical to ensuring the long-term stabilization of the property. Protected areas should be clearly identified with bright colored ribbon and/or fencing prior to the commencement of construction. Additionally, stockpile locations, staging areas and access points must be clearly defined to minimize impact. • Any improvement that alters the natural course of drainage will increase the impact of stormwater runoff. Consideration should be taken to minimize the impact of runoff during and after construction. Erosion and sediment control measures should be implemented prior to ground disturbing activities. • All efforts should be taken to vegetate and stabilize disturbed soils as soon as possible. • Construction and the use of heavy equipment may impact the stabilization of soils. Vibrations from machinery as well as soil compaction have adverse impacts. Machinery should not be Page 3,November 21,2019 #7293,Milano SCTM No. 1000-21-2-9 left to idle and only running when in use. The location and storage of such equipment should be limited to protect the stabilization of the bluff and the surrounding soils. SOUTHOLD TOWN BOARD OF TRUSTEES: Because of the close proximity of the proposed residential improvements to the Coastal Erosion Hazard Area, the subject action was first reviewed by the Board of Trustees. Subsequently, the applicant received a Wetland Permit, #9519, on August 14, 2019 to extend the currently existing 913 square feet one and two-story dwelling consisting of the 639 square feet one-story structure located seaward of the 274 square feet two-story structure; the existing 417 square feet garage and 130 square feet covered porch attached to existing two-story dwelling and the existing 366 square feet one-story portion of the dwelling to be demolished and replaced with a 171 square feet addition (seaward) and a two-story addition (landward); the existing dwelling to be renovated by replacing windows, relocated kitchen and bathroom; the 1,097 square feet one-story addition to be located landward of the existing swelling with attached 763 square feet garage and attached 150 square feet greenhouse; proposed balcony cantilevering off proposed north facing living room to be 195 square feet; install an 8'x8' hot tub on the ground and outdoor shower off the master bedroom with a 12'x21' area to be paved with bluestone for the hot tub and outdoor shower; install a proposed 8' high and 12' long privacy wall off master bedroom where hot tub and outdoor shower are to be located; and install a proposed 40'x20' in- ground pool. A Japanese stone garden to be installed where the existing one-story structure will be removed as depicted on the site plan prepared by Frank W.Uellendahl,R.A. PROPERTY FACTS/DESCRIPTION: The subject conforming, 51,765 square feet, 1.180 acre irregular-shaped parcel located in the R-40 Zoning District measures 367.25 feet along a residentially developed lot the east, then runs 195.18 feet along a tie line at the Long Sound, then returns 290.59 feet along a residentially developed lot to the east owned by the applicant and then runs 50.00 feet to a bend in Aquaview Road and continues 90.00 feet further west along Aquaview Road. The parcel is developed with frame garage, a wood-frame one and two-story house with wood decking and stairs, a wood sitting platform, beach stairs and a frame shed as shown on a survey prepared by Howard W. Young, last revised May 3, 2019. BASIS OF APPLICATION: Request for Variances from Article III, Section 280-15; Article IV, Section 280-18; Article XXII, Section 280-116A(1) and the Building Inspector's February 11, 2019, Notice of Disapproval based on an application for a permit to construct additions and alterations to an existing single family dwelling and construct an accessory swimming pool; at, 1) swimming pool located in other than the code required rear yard; 2) additions located less than the code permitted side yard setback of 15 feet; 3) additions located less than the code required 100 feet from the top of the bluff; located at 745 Aquaview Avenue, (Adj. to Long Island Sound) East Marion,NY. SCTM No. 1000-21-2-9. RELIEF REQUESTED: The applicant requests variances to make alterations and additions to an existing single- family residence, consisting of the removal of the existing shed and garage along with the partial removal of the existing, waterside, covered porch and part of the existing cottage roof(total of 911 square feet to be removed) and for the addition of a two-story structure over the existing residence, to add a new, attached, two car garage with unfinished second floor and attached greenhouse, of 150 square feet along with an 8'x8' hot tub for a total of 3,100 square feet of living space with a bluff setback of 25 feet where the code requires a minimum bluff setback of 100 feet and the proposed improvements have a 7.3 feet side yard setback where the code requires a minimum side yard setback of 15 feet. Additionally, the applicant proposes to locate a 20 feet by 40 feet in-ground swimming pool in the side yard where the code requires such improvements to be located in the rear yard or in the case of a waterfront parcel, such improvements may be located in the front yard provided they meet the minimum permitted front yard setback requirement. ADDITIONAL INFORMATION: The Southold Town Building Department issued Certificate of Occupancy #Z-1340 on June 5, 1962 and #Z-3259 for a private one family dwelling. No member of the public spoke in favor of or against this application, however, the heirs of an immediate neighbor to the west submitted a letter of support Page 4,November 21,2019 #7293,Milano SCTM No. 1000-21-2-9 which was received by the Southold Town Zoning Board of Appeals on November 6, 2019. The applicant's agent and architect, when asked if the proposed alterations and additions would constitute a demolition of the existing residence stated `No' and that he had confidence in the application and design to maintain the original foundation and primary floor of the subject property. Furthermore, the agent on behalf of his client indicated their willingness to install an Innovative/Alternative septic system. FINDINGS OF FACT/REASONS FOR BOARD ACTION: The Zoning Board of Appeals held a public hearing on this application on November 7,2019 at which time written and oral evidence were presented. Based upon all testimony, documentation, personal inspection of the property and surrounding neighborhood, and other evidence,the Zoning Board finds the following facts to be true and relevant and makes the following findings: 1. Town Law X267-b(3)(b)(I). Grant of the variances will not produce an undesirable change in the character of the neighborhood or a detriment to nearby properties. The area between Rocky Point Road and Stars Road is developed with a majority of non-conforming lots created prior to zoning and is further developed with a recent conservation subdivision. Most of the developed lots contain houses of varying style, size and age built in the mid- to late 20'h Century. Along the Long Island Sound are road end access points and an association waterfront park for the neighborhoods to the south. Of the approximate 20 waterfront lots on Aquaview Avenue, a neighborhood to itself, the applicant's lot is among the largest at 1.18 acres. Most adjacent waterfront lots, in particular to the east, are very narrow with approximately 50 feet on the Long Island Sound and contribute to a dense building environment. As a benefit of the applicant's lot width of approximately 140 feet on the water there are expansive views to the north and west with sufficient room to accommodate an in-ground pool in the side yard as found in other, area homes. Furthermore, the applicant's proposed alterations are designed to enhance the cottage style still prevalent in this waterfront community. 2. Town Law 4267-b(3)(b)(2). The benefit sought by the applicant cannot be achieved by some method, feasible for the applicant to pursue, other than an.area variance. The existing residential structure, covered by Town of Southold Certificate of Occupancy#Z-1340 was first issued in 1962 and was constructed 7.3 feet off the eastern lot line and substantially less than 100 feet from the top of the bluff. Currently, the existing northern fagade rests on the edge of the bluff. While the applicant proposes to maintain the eastern lot line and the existing fagade, in an effort to make the alterations and additions more in compliance with today's code will remove the northern most portion of the existing house to shift the habitable portion behind the Coastal Erosion Hazard Line while maintaining deck access to the other improvements seaward of the residence. Furthermore, as a result of being less than the required bluff setback of 100 feet, any improvement to the existing residence will require relief from the code. Relative to placing the in-ground swimming pool in the side yard, as a result of the topography with the house laying lower than the road to the south and the proposed attached garage, along with bluff setbacks, it would be impossible to site a swimming pool in a conforming rear or front yard location. 3. Town Law 4267-b(3)(b)(3). The variances granted herein are mathematically substantial, representing 75% relief from the code for the bluff setback, 50% relief from the code for the side yard setback and 100% relief from the code for placing the pool in the side yard. However, the existing house was built with a valid Certificate of Occupancy and the applicant proposes no increase in the non-conformity of the site. Furthermore, as a result of the design of the house, it's not possible to locate the swimming pool, a common accessory structure to a residence, in a conforming location along with the installation of an I/A septic system. 4. Town Law 4267-b(3)(b)(4). No evidence has been submitted to suggest that a variance in this residential community will have an adverse impact on the physical or environmental conditions in the neighborhood. The applicant must comply with Chapter 236 of the Town's Storm Water Management Code. Page 5,November 21,2019 #7293,Milano SCTM No. 1000-21-2-9 5. Town Law &267-b(3)(b)(5). The difficulty has been self-created. The applicant purchased the parcel after the Zoning Code was in effect and it is presumed that the applicant had actual or constructive knowledge of the limitations on the use of the parcel under the Zoning Code in effect prior to or at the time of purchase. 6. Town Law &267-b. Grant of the requested relief is the minimum action necessary and adequate to enable the applicant to enjoy the benefit of alterations and additions to a single family residence consisting of the removal of the existing shed and garage along with the partial removal of the existing, waterside, covered porch and part of the existing cottage roof and for the addition of a two-story structure over the existing residence, to add a new, attached, two car garage with unfinished second floor and attached greenhouse, along with an 8'x8' hot tub and to locate a 20 feet by 40 feet in-ground swimming pool in the side yard while preserving and protecting the character of the neighborhood and the health, safety and welfare of the community. RESOLUTION OF THE BOARD: In considering all of the above factors and applying the balancing test under New York Town Law 267-B, motion was offered by Member Planamento, seconded by Member Weisman (Chairperson), and duly carried,to GRANT the variances as applied for, and as shown on the site plan and floor plan labeled A-100 and A-300 Approved by the Southold Town Board of Trustees, created by Frank W. Uellendahl, Registered Architect and dated June 4, 2019. SUBJECT TO THE FOLLOWING CONDITIONS: 1. Prior to receiving a building permit,the owner(s) of the subject property cited herein must sign a statement acknowledging: a. That the applicant(s) have read this determination and understand the limits of the variance relief granted herein; b. That the applicant(s)will immediately contact the Building Department if a demolition,as defined by Section 280-4 of the Town Code,' occurs during construction,or any construction undertaken in any other way exceeds the scope of the approvals granted herein,or the issued building permit; c.That the applicants are aware that the Zoning Board of Appeals retains jurisdiction until the issuance of the Certificate of Occupancy and has the right, after a public hearing,to modify,suspend or revoke such approvals or any term or condition thereof or to impose thereon one or more new conditions, pursuant to Article XXV, Section 280-141 of the Town Code. 2. The applicant shall install an Innovative and Alternative Septic System approved by Suffolk County Board of Health. 3. Swimming Pool mechanicals shall be placed in a sound deadening enclosure. 4. A drywell for swimming pool de-watering shall be installed. 5. The applicant shall comply with recommendations of the Suffolk County Soil and Water Conservation District,as cited above. 6. This approval shall not be deemed effective until the required conditions have been met; and failure to comply therewith will render this approval null and void. That the above conditions be written into the Building Inspector's Certificate of Occupancy, when issued. 1 Section 280-4 of the Town Code defines "Demolition" as any removal of a structure or portion thereof, where the total cost of the reconstruction of the structure or portion thereof exceeds 50% of the market value of the existing structure before the start of removal. Connie Bunch informed me yesterday that she is ready to type the Certificate of Occupancy. Since the ZBA decision expired on November 21, 2022 she asked me to request an extension. I apologize for having missed the deadline to request an extension prior to the date of expiration. The contractors were not able to complete the proposed construction in a timely manner partially due to pandemic related delivery delays of various building materials and kitchen appliances. One exterior sliding door unit was finally installed in August 2022. Exterior work such as patios,the driveway and the pool fence did not get completed until December of last year,the reason why the owner did not receive the final survey from Young&Young until February of this year. The final Trustees inspection passed in March 2023,without objections.And so did the final inspection by the building inspector. Thank you very much for understanding the difficulties this project went through, however,the owner is relieved and very happy that the job is finished. I conducted an inventory and evaluation of the site on April 16th, 2019 with respect to the proposed property improvements detailed in the Notice of Disapproval letter sent to the applicant on February 11th,2019.The improvements include additions/alterations to the existing single-family dwelling and an accessory in-ground swimming pool.,The Notice of Disapproval cited the following: Article XXII Section 280-116A(1) "All buildings or structures located on lots upon which there exists a bluff landward of the shore or beach shall be set back not fewer than 100 feet from the top of such bluff."'The site plan shows the proposed construction at 25.2 feet from the top of the bluff. In addition,the proposed construction was not permitted pursuant to Chapter 280-Bulk Schedule which requires a minimum side yard setback of 15 feet.The proposed construction has a 7.5 feet side yard setback. Lastly,the accessory swimming pool is not permitted pursuant to Article III,Section 280-15, which states "accessory buildings and structures may be located in the required rear yard, or in case of a waterfront parcel, accessory buildings and structures may be located in the front yard, provided that such buildings and structures meet the front yard principal setback requirements." The swimming pool is located in the side yard. Office Hours:Monday through Thursday 7:30 a.m.to 4:00 p.m. Friday 7:30 a.m.through 3:00 p.m. r I observed the site and respectfully submit the following comments: 1)The waterfront residential property located at 745 Aquaview Avenue in East Marion, NY, is located atop a large bluff that leads down to the Long Island Sound.The property atop of the bluff is well vegetated with a mix of perennial grasses,trees and shrubs.The toe of the bluff is not supported by a hardened shoreline (bulkhead) and shows signs of significant wind and water erosion.The bluff face exceeds the recommended maximum 1:3 ratio, and partly as a result,the bluff condition is poor and unstable in some areas.The face of the bluff is very steep and consists of several areas with vertical faces between the top of the bluff and the toe. Although the bluff's face is shows an estimated 80%of vegetated cover,there are several areas of concern that should be addressed to ensure the bluff's long- term protection. Failure to monitor and maintain the angle of repose and adequate vegetation on the bluff will significantly impact the bluff's long term resilience.As you will see in the photos below,there are several areas of the bluff face that are bare and/or eroding that may contribute to significant soil loss of the bluff,specifically around and under the staircase. I believe that these unstable areas are a result of several factors that may be causing the erosion of the bluff including the use of woody and invasive species that occupy the bluff face,as well as several wildlife corridors that create gully erosion approximately 1-25 feet below the top of the bluff. In addition,there are number of spots on the bluff that suffer from soil loss due to runoff from the top of the bluff.To stabilization the bluff, runoff control measures are recommended to capture and covey all`stormwater runoff away from the bluff and discharged to the south. It is recommended that the bluff face,top and toe be monitored closely for any changes in the vegetation.Additional stabilization mitigation measures may be required if erosion persists.See attached images. 2)The current structure (single family dwelling) on the property is located very close to the top of the bluff and may impact the stabilization and health of the bluff that is adjacent to the structure. It was observed that the current structure is overhanging the top of the bluff and as a result poses significant impact to the bluff's stability. It is important to note the age of the existing structure and that the bluff's size and orientation may have changed greatly since the structure was originally erected. See attached images. 3)The proposed improvements to the site include the construction of an accessory swimming pool located in the side yard with a 25.2 foot setback from the top of the bluff.This raises a concern as the location of pool and required construction may cause the bluff to destabilize and fail. In addition, even though the proposed construction does not drastically increase the amount of impervious area,special consideration should be taken to ensure that any runoff from these surfaces are collected and discharged in a designated area away from the top of the bluff. It is critical that runoff be diverted away from the proposed structure during construction and post-construction to ensure the stabilization of the soils surrounding the proposed improvement. Stormwater runoff,stabilization and soil loss is a significant factor when considering the location of a pool or similar structure. It is recommended that the location of the pool be considered to avoid impacts associated with the proposed construction.See attached images. 7®C i RECEIVE® JUN 0 3 2019 011I1VGaoARD oFAPPEAcs } 1 It is recommended that the proposed accessory swimming pool be located in the side yard or the front yard,with a significant setback from the bluff's top to ensure no additional impacts to the already eroded bluff. 4)Additional considerations: • All ground disturbance activities have an impact. If soil disturbance is minimized the impacts associated with the activated are significantly decreased. Undisturbed and vegetated areas should be left undisturbed whenever possible. • Protection of existing vegetation is critical to ensuring the long-term stabilization of the property. Protected areas should be clearly identified with bright colored ribbon and/or fencing prior to the commencement of construction.Additionally,stockpile locations, staging areas and access points must be clearly defined to minimize impacts. • Any improvement that alters the natural course of drainage (ex: structures, impervious surfaces, conveyances,etc.)will increase the impact of stormwater runoff.Consideration should be taken to minimize the impact of runoff during and after construction.
