Dear Trustees, I live across the street from the above property, and I am very dismayed by this application. Here are my objections: 1.The proposed structure is within 17 feet of wetlands,on the north side. ( ( own the dock north adjacent and when there is an extra high or storm tide the water comes up to the entrance and top of my Book) 2.The oesspool are not 100 feet from the wetlands. 3.The structure and the cesspools will be in the flood plain unsatisfactory to the LWRP. 4.This is actually the construction of a second home on the property. What is going to be the actual use of this structure? While we may need to institute greater protection with new requirements,there is no reason to not enforce the ones we have now.The sad thing is that by over developing individual properties,the quality of the entire community is lowered. As a citizen of this community,I care about this. please do your best to protect our community and neighborhoods so that future generations will have a beautiful place to live. Southold Town Laws prohibit the proposed development. The application is being processed by segmenting it into steps, some of which which would be legal, if they were not part of an illegal plan. 1) The first step is to apply to the Trustees for a wetland permit. 2) The second step will be to apply to the Building Department for a building permit. 3) The third step will be to apply to the Zoning Board of Appeals for a special exception to put an accessory apartment into the "storage" building. 4) The fourth step will be to apply to the Building Department for a rental permit for the apartment. Thus there will be 4 applications to agencies of the Town of Southold. The responsibility for coordinating these applications rests in each board and in the Town Board. use the term "rests" primarily because the authority of the Town Board is not being exercised. A request for the Town Board to look into the instant application was answered by statements that it is none of their business. In fact, the Town Board is responsible for guiding the other Town Officials and Boards. The Town Board should respect the independent authority and discretion of other Town officials and Boards, but should not be oblivious to how it is being exercised. Secondarily, both of the Boards which will apply discretion to review and decide whether or not to approve the applications have authority to consider the related applications. And the Building Department, which will have administrative authority to review the applications for building and for the rental permit also has authority which it is not exercising to consider the related applications. The standards to be applied by the Trustees for a wetland permit are set forth in the Code of Laws of the Town of Southold §275-12 titled: "Standards for issuance of permit" as follows: The Trustees may adopt a resolution directing the issuance of a permit to perform operations applied for only if it determines that such operations will not substantially: A. Adversely affect the wetlands of the Town. B. Cause damage from erosion, turbidity or siltation. C. Cause saltwater intrusion into the fresh water resources of the Town. D. Adversely affect fish, shellfish or other beneficial marine organisms, aquatic wildlife and vegetation or the natural habitat thereof. E. Increase the danger of flood and storm-tide damage. - ;-- r.. F. Adversely anavigation on tidal waters or the tida;J v of the tidal waters of the Town. G--Change-tfie ;.;urse of any channel or the natural movement or flow of any waters. H. Adversely affe�t the aesthetic value of the wetland and adjacent areas. _v 4'b41"o."In 5081 Ttie'applicationito the Trustees for a wetland permit states that it is for construction of a THREE CAR GARAGE W/A ONE BEDROOM ACCESSORY APARTMENT OVER. TWO DRYWELLS AND AN I/A OWTS SEPTIC SYSTEM (Innovative and Alternative On-Site Wastewater Treatment System). The Trustees sent a request for Verification of Building Department Requirements to the Building Department. The Building Department replied that a building permit and a ZBA for the Accessory Apartment would be required. The Building Department wrote "location of garage okay" although the location is currently under review and does not yet have approval by the Trustees. In the Trustees field report completed in the field on 8.6.2019 by Nick Krupski states: "Structure is located within 15' of wetlands. Septic is also located w/in 15720' of wetlands. Not an appropriate place of a structure (lowest location on property). Should be moved to other corner of property as far away from wetland as possible." The application clearly expressly states the building is intended to be used as a residence. The suggestion that it can be moved to another part of the property is based on the false pretense that it will be used for storage. Southold Town should not be circumventing it's own laws. The standards to be applied by the Zoning Board of Appeals for a permit for an accessory apartment in an accessory building are set forth in the Code of Laws of the Town of Southold §280-13. B. titled: "Uses permitted by special exception by the Board of Appeals." as follows: ... (13) One accessory apartment in a lawfully existing detached accessory garage, barn or storage building, subject to the following requirements: ... (i) Occupancy of resident structures on the premises shall be subject to the issuance of an annual rental permit in accordance with § 280-13D and the following requirements: [1] The owner of the premises shall occupy either the existing single-family dwelling unit or the accessory apartment in the detached accessory structure as the owner's principal residence. The other dwelling unit shall be leased for year-round occupancy evidenced by a written lease for a term of one or more years to: [a] A family member; or [b] A resident who is currently on the Southold Town Affordable Housing Registry and eligible for placement. [2] Rents charged to a resident on the Affordable Housing Registry shall not exceed the rent established by the Town Board annually pursuant to § 280-30F of this Code. [3] No accessory apartment shall be occupied by more than the number of persons permitted to occupy the dwelling unit under Section 404 of the Property Maintenance Code of the New York State Uniform Fire Prevention and Building Code. [4] An accessory apartment shall only be occupied or otherwise utilized in accordance with the certificate of occupancy issued for the dwelling unit. 0) The Chief Building Inspector, Zoning Inspector, and Town personnel who are engaged in the enforcement of the provisions of this chapter are authorized to make or cause to be made inspections to determine compliance, "`i this chapter and are authorized to a upon any property for the purpose of said inspections. (k) No special exception shall be granted unless the Zoning Board of Appeals, in addition to the considerations, determinations and findings required in §§ 280-142 and 280-143, specifically finds and determines the following: [1] That the granting of the special exception will not adversely impact the privacy and use and enjoyment of any adjoining parcel. [2] That the granting of the special exception will not adversely impact the character of the neighborhood in which it is located. [3] That the cumulative effect of approving the present application along with previously approved applications will not have a cumulative adverse impact on the surrounding neighborhood. [4] That the cumulative effect of approving the present application along with previously approved applications will not have a cumulative adverse impact on the school district in which the property is located. [5] That sufficient off-street parking exists on the subject property to accommodate the proposed accessory apartment. [6] Whether adequate buffer yards and screening can and will be provided to protect adjacent properties from possible detrimental impacts of the proposed use. As stated above in §280-13. B. (13), currently Southold Town law requires the "detached accessory garage" to be "existing" in the instant application it is not. Therefore this application should be returned with a note that the use requested is not permitted. And this requirement is not even proposed to be changed, yet! PS: While land use regulations do not vary according to the owner, an application for development must be authorized by a legitimate owner. The Trustees should not make any decision on the instant application until the legal existence and authority of the applicant is confirmed. B01r r•i ins"!"'; — I am-very dismayed by this application as it represents yet another weekend/summer resident exacting as much as possible from a single family residential zoned lot.The subject lot is 50,370 square feet however,21,101 square feet of which is comprised of wetlands. The existing home is only 24 feet from the wetland boundary, and the proposed structure is located within 19 feet of the wetland boundary. The application seeks to construct a 22 x 35 two story,three car garage with a one bedroom accessory apartment above. Here are my objections:First,the proposed structure is too close to the wetlands to wit: within fifteen feet of the wetlands. As you are aware Town Code section 275-3(D)(1)(a) sets forth the required setbacks for residential structures from wetlands. Specifically,residences must be set back a minimum of 100 feet from the wetland boundary; driveways 50 feet; sanitary cesspools 100 feet, septic tank 75 feet,accessory swimming pools 50 feet,gardening and landscaping 50 feet and placement of C&D material, 100 feet. To allow this proposed development to be sited within 19 feet of a wetland boundary sets a dangerous precedent for this Board and belies the entire purpose of Chapter 275—to protect our wetlands and as a result, our surface water and as a result our entire way of life. The purpose of the setbacks required in Chapter 275 are to provide a buffer from the natural impacts of construction, septic systems, fertilized vegetation and just daily living from not only negatively impacting, but destroying our wetlands. This is why this Board has made considerable efforts over the years to require natural wetland vegetated buffers between the proposed structure/construction and the wetlands. The buffers instilled by this Board provide protection to the wetlands by acting not only as physical buffers to the wetlands but as filtration systems to the surface waters,ensuring that should any undesirable runoff head toward the water,the natural wetland vegetated buffers will filter that unwanted runoff before it impacts our surface waters. This is exactly the purpose of the Board of Trustees,to ensure protection of the wetlands by establishing setbacks and then buffers to protect those setbacks. To allow'-'t` construction of structure that will add density to this extremely constricted site(40%is' wetlands!)within 19 feet of the wetlands when the code requires that even landscaping must be 50 feet away would be a true failure, on all of our parts should it happen.The application proposes to excavate and fill 10,314 square feet of property and proposes two S foot drywells. The application proposes a two story, 35 x 22 square foot,three car garage with a one bedroom apartment above. To that end, it is a certainty that constructing drywells, excavating 10,314 square feet of property, clearing and installing a new septic system, and constructing an additional structure that will add density to this site within 19 feet of the wetlands will(i) negatively impact the wetland in violation of Town Code section 275-12(A); (ii)cause damage from erosion,turbidity or siltation violating Town Code §275-12(B); adversely affect fish, shellfish or other beneficial marine organisms, aquatic wildlife and vegetation or the natural habitat thereof violating Town Code §275-12(D); (iv)increase the danger of flood and storm-tide damage violating Town Code §275-12(E); (v)otherwise adversely affect the health, safety and general welfare of the people of the Town violating Town Code §275- 12(I); and(vi)adversely affect the aesthetic value of the wetland and adjacent areas violating Town Code §275-12(J).Therefore,the application fails to meet the standards that this Board is charged with applying and must be denied. NOV 1 2 2019 Moreover,the cesspools are not located 100 feet from the wetlands as Town setbacks-require J The proposed low nitrogen septic system will similarly be placed too clo a to the wql;. benefit same.Additionally, low nitrogen septic systems typically require re-grading ander retaining walls and fill to be brought in to a property to raise the system to ensure it will be operable.As outlined above,allowing cesspools or septic systems within a close proximity of these wetlands would result in their deterioration and negatively impact our surface waters as a result. This proposed structure and the cesspools will be in the flood plain which is inconsistent with the policies set forth in our LWRP.Indeed the Town's own consistency review indicates that the proposed application is not consistent with the LWRP. Town Code section 275-3 sets forth the purpose for enacting legislation to protect our wetlands stating "The Town Board of the Town of Southold finds that rapid growth,the spread of development and increasing demands upon natural resources are encroaching upon or eliminating many of its wetlands and patent lands,which, if preserved and maintained in an undisturbed and natural condition, constitute important physical, social,aesthetic, recreational and economic assets to existing and future residents of the Town of Southold." If ever there was an application before this Board to deny in the face of overdevelopment, it is this one. These wetlands have already been impacted by the existing development on this subject property.Adding density and construction of a structure within 19 feet of the wetland boundary belies the intent of Chapter,275 and the purpose of this Board. Accessory apartments are permitted under Town Code and require owner occupancy of either the main residence or the apartment. The Code states,"Occupancy of resident structures on the premises shall be subject to the issuance of an annual rental permit in accordance with § 280-13D and the following requirements: W The owner of the premises shall occupy either the existing single-family dwelling unit or the accessory apartment in the detached accessory structure as the owner's principal residence." Simply put,this applicant cannot comply with this requirement.As a neighboring property owner that has lived in this community for 40 years, I must submit to this Board that the existing house is not the full time residence of the applicants. Indeed the applicants are only here during the summer and/or weekends and have not made this house their domicile or full time residence. I believe this Board should request indicia of residency from these applicants including,voter registrations, the address listed on their drivers licenses,tax return bills, credit card receipts etc. Unfortunately the applicant is not entitled to construct an accessory apartment since it does not comply with the current code requirements. This is not a situation where a good intentioned neighbor intends to establish affordable housing in our community. This is going to be a new Airbnb introduced to our already taxed seasonal neighborhood. We fully understand that this Board is not permitted to speculate with regard to future code violations,however, it is required to base its determination on submitted evidence before it, even from personal knowledge of the neighbors.As a full time resident I know every other full time neighbor in my neighborhood and these people do not live here. Thus,we respectfully request that you deny the application. This proposal actually represents the construction of a second home on this property.The aplication states that no zoning and a pproval is necessary.I think that has to be incorrect.Accessory structures are not permitted over 1200 squ„ ,;eet in size for lots of 50,000 square fee, he subject application proposes a two story,the _-_)-.ar garage with a proposed footprint of ; ,J square feet-should the structure exceed 1200 sf total, it would require a variance from the Zoning Board.This is just an application to build another house!
