Oliva, Councilwoman' Ellen M. Latson, Councilman Thomas H. Wickham, Assistant Town Attorney Matthew G. Kiernan, Town Clerk Judith T. Terry. 9;45 a.m. - The Board met with Peg Murphy who,reported on the Summer Showcase Concert Series. The total cost for the series was $3,340.00 for seven concerts, which were huge successes. Of the $31,340.00 cost, $1,600.00 was contributed by the Town and majority of the remainder of the money was from donations. Mrs. Murphy asked the town Board if they would consider a $2,000.00 grant in the 1992 Budget, which would ensure eight concerts next summer.- 9:50 'a.m. - Ed Siegmann, representing the senior groups, and Joseph Ristuccia of Tax Pac, appeared before the Town Board to express support for a Human Resources building. The groups feel it should be done now and not put off. He further advised they do not think it should be put to a referendum. 10:00 a.m. - For Discussion- Items: (I) Reappointment of John Sullivan to the Board of Assessment Review was held to Executive Session. (2) Notification .of seminar entitled, "Environmental Issues: Long Island's Future", has been received. Resolution no. '10 was placed orr the agenda granting permission to attend. (3) Jem Commons & Southold Commons - Draft ElS with respect, to these change of zone petitions. The Board would like to meet with their consultant, Cramer & Voorhis, at the next work session on September 10th to discuss the next steps to be taken under the environmental guidelines. 10:30 a.m. - Donald Stanton, member of the Kenney's Beach Civic Association, as well as the Town's Kenny'.s Beach Shoreline Erosion Control Committee, met with the Town Board ko appeal them to take firm action to correct the beach problem. He said this appeal has been presented for the past ten years and nothing has happened. He said he has spoken to Robert Greene of the DEC, who suggested the Town apply directly to remove the spoil stored at Goldsmith's Inlet and transport it to Kenney's Beach. Councilman Penny advised that Superintendent of Highways . Jacobs has made that application' and has had no response. He is currently in the process' of refiling. Mr. Stanton said the Association proposes to the Town Board: (a) activate ~he DEC application to truck the sand to Kenney's Beach; (2) consider application to modify, or alter or remove a poi~tion of the jetty at Goldsmith's Inlet; '(3) apply for technical assistance to, for instance, Sea Grant, or to the DEC themselves. Councilman Penny advised that Town Attorney Arnoff, who is on vacation, has done considerable research into aspects and ramifications with respect to the jetty and will soon submit a written opinion to the Town Board. He asked Mr. Stanton to be patient for a short while longer. 11:20 a.m. - For Discussion Items continued: (4) Application for the part-time Records Management Clerk position with the Town Clerk's Office. Applicant has re- cently graduated from law school, and is certainly qualified_ for the position (see resolution no. 11). (5) Board discussed placing a referendum on the ballot at the general election for a $1,750,000 to acquire development rights in agricultural lands. Bond counsel will be asked to prepare the necessary bond resolution for the AUGUST 27, 1991 September 10th meeting. (6) Supervisor Harris asked the Board extending to September 10th the acceptance, without charge, the Hurricane Bob (see resolution no. 12). to consider debris from 12:05 p.m. meeting. Board reviewed resolutions to' be voted ~pon at the 7:30 p.m. regular EXECUTIVE SESSION '12:10 p.m. On mbtion of Councilman Wickham, seconded by Justice Edwards, it was Resolved that the Town Board enter into Executive Session. REGULAR MEETING A Regular Me~ting of the Southold Town Board was held on Tuesday, August 27, 1991, at the Southold Town Hall, Main Road, Southold, New York. Wickham SUPERVISOR HARRIS: I hope everyone is faring well after the disaster that hit the east end on Monday. I hope that things are coming back to normal a little bit in your lives. At this time it's distinct honor to have a presentation made by our Chief of Police Stanley Droskoski. This will be the first time in the history of Southold Town that a woman detective will actually be made tonight with a badge. At this time, Chief, would you like tO bring up Detective Wilson and we shall proceed. POLICE CHIEF DROSKOSKI: It gives me great pleasure to promote and assign Detective Wilson to her new position. She certainly has earned and deserves the position through her efforts with JAB, and what she's done with the DARE Program. She certainly is our first female Police Officer, our first Detective in Southold Town, and an article I read she says, the position of Chief of Police is not out of reach. Beth, congratulations. The very best to you. AUGUST 27, 1991 71 SUPERVISOR HARRIS: On behalf of the Town Board, and maybe each member may have something to say, but it is a distinct honor to be Supervisor, and this is his history that's being made tonight. Beth has really been above the rest in many things, that she's endeavored to tackle, JAB League being her latest, and she has done such a marvelous job. ] think the kids are already asking her, when do we start, when do we start? The program say no to drugs. You can't say enough about the importance, of course, of drugs awareness in Southold Town, and Kevin, who before her, was head of JAB, and taking over that role Beth has certainly done a tremendous job this year, and I know that she will next year, and being a De~ective just gives you a little bit more prestige-, and certainly a little more respect amongst the children of our community, because when they think of Kojak many times, they think of Detective Kojak, and I'm sure that in your case they're going to say Detective Wilson. When you have that honor of Detective in front of it, it gives some special meaning to an officer, that gives instructions to our youth, and certainly saying no, and being aware of the drug problem that exists in Southold, but on behalf of Southold Town people congratulations and many, many years of luck ahead, and we hope that :lAB funds continue in the State of New York, because we have been cut back this year due to State funding for the JAB, which to me is a disaster to strike in the very essence of drug awareness. I'm sure there are other members, Beth, while you're here maybe would like to say a few words. COUNCILWOMAN LATSON: I'd just like to congratulate you. COUNCILWOMAN OLIVA: Congratulations, Beth. The best of luck, and keep going for the Chief of Police. COUNCILMAN PENNY: Congratulations. Keep up the good work. TOWN CLERK TERRY: I don't know if everybody knows, that's watching us tonight, but JAB is Juvenile Aid Bureau, and you might want to tell them what the DARE Program is, because that's so important, and you're working so hard with the schools on that, aren't you? DETECTIVE WILSON: Yes, I am. DARE is Drug Abuse Resistance Education Program to teach children how to say no to drugs, and teach them self esteem, and a sense of self worth, so that they are very confident in being able to say no to drug abuse, and lead a drug free live, which we are striving for. ASSISTANT TOWN ATTORNEY KIERNAN: And knowing that they always have a friend in the blue. DETECTIVE WILSON: That's right. I already see that coming. The kids are very comfortable in going up to the Police cars, going up and say hi, waving to everyone.' So, just within one year, we've already made a very good start, l'm looking forward to this year. POLICE CHIEF DROSKOSKI: I might want to add, that the position of detective that also assumes the head of our Juvenile Aid Bureau. SUPERVISOR HARRIS: We have one member of our Board tonight is absent. This afternoon he had an emergency meeting called by his family down south, and Council- man Tom Wickham will not be here tonight joining us for a Town Board meeting, and Judge Edwards will be here, hopefully he probably will be a little late, but he will be joining us shortly. Before going to the resolutions, we'll do the audit of bills for August 27, 1991. I need a motion. SUPERVISOR HARRIS: On there any members of the audience, that would like to address this Board on any resolution, that we will be entertaining in the next few minutes? PAUL SZPARA: Paul Szpara. Mattituck. I have two questions. One, I'd like to know, it says, direct Supervisor to execute an agreement with the Family Service League. That's the first one, and tt~e second one is, I'd like to know what the Town is going to do about pick up of brush? SUPERVISOR HARRIS: The second question I'll take after we do resolutions, because that will open up the floor to anybody that wants to address anything to this Board, that may be of importance. To the first one, Fam!ly Service League is, you know, the Town enters into a contract with. It's been our understanding that this contract has not been signed, and certainly when we looked into it, we found out that this, indeed, the contract had not been signed, and so with the Town Clerk's awareness of this, and bringing it to our attention, we are now going to be executing this contract with Family Service League through our Community Development Director, or Program Coodinator, as his new title is, Jim McMahon. PAUL SZPARA: A contract that provides services to the Town of Southold. COUNCILWOMAN LATSON: It went into effect in January, and expires in December, but for some reason it just went through, and was never signed~ but technically it's been in effect. SUPERVISOR HARRIS: It is in effect. The first resolution of the evening, grant permission to Principal Buildinq Inspector Victor Lessard, Senior Building Inspector Curt Horton, and Building Inspector Gary Fish to attend a COde Enforcement Seminar. .-Moved by Supervisor Harris, seconded by Councilman Penny, it was RESOLVED that the Town Board of the Town of Southold hereby c~rants permission to Principal Building Inspector Lessard~ Senior Buildinq Inspector Horton, and Buildinc~ Inspector Fish to attend a Code Enforcement Seminar, sponsored by the Fire Inspectors Association of Suffolk County, on "Above Ground Flammable Liquid Storage", at the Suffolk County Fire Training Academy, Yapank, New YOrk, on Wednesday, September 18, 1991f from 9:00 a.m. to 1:00 p.m., and the use of a Town vehicle for travel, registration fee of $10.00 per person, and lunch expense shall be a legal charge against the Building Department's 1991 Budget. 1.-Vote of the Town Board: Ayes: Councilwoman Latson, Councilwoman Oliva, Councilman Penny, Supervisor Harris. This resolution was declared duly ADOPTED. 2.-Moved by Councilman Penny, seconded by Councilwoman Latson, it was RESOLVED that the Town Board of the Town of Southold hereby requests the Suffolk County Department of Public Works to designate a "No Stopping" zone on the north side of County Route 48, from the extended curb line at the intersection of Cox Neck Road and County Route 48, Mattituck, easterly for a distance of 475 feet; said request is needed as vehicles are currently parking at the curb line on County Route 48 to gain access to the new business complex on that side of the road, rather than parking in the parking areas provided for the complex; said request is in accordance with the recommendation of Police Chief Droskoski and Superintendent of Highways Jacobs. 2.-Vote of the. 3'own Board: Ayes: Councilwoman Latson, Councilwoman Oliva, Councilman Penny, Supervisor Harris. This resolution was declared duly ADOPTED. SUPERVISOR HARRIS: An explanation for this, there is a problem up there with traffic, and it's been impeded apparently because of the curb cut, that has been taken off of County Road 48, and tractor trailers, and the like are actually stopping in the shoulder, impeding people from turning in off of County Road 48 through that one curb cut, which is one way, and because of traffic has been slowing down, actually in the speed lane to make that turn. The Chief of Police, and the Superin- tendent of Highways have requested that we ask the Department of Public Works in SUffolk County to designate and put up signs no stopping in the curb, and that whole area, to curtail any traffic fatalities that may occur. 3.-Moved by Councilwoman Oliva, seconded by Councilman Penny, it was RESOLVED that the application of Martin Sidor for renewal of his farm worker house trailer permit, for trailer located on the south side of Oregon Road, Mattituck, which permit expires on September 23, I991 be and hereby is c~ranted for a six (6) month period. ' 3.-Vote of the Town Board: Ayes: Councilwoman Latson, Councilwoman Oliva, Councilman Penny, Supervisor Harris. This resolution was declared duly ADOPTED. 4.-Moved by Councilwoman Latson, seconded by Councilwoman Oliva, it was RESOLVED by the Town Board of the Town of Southold that James C. McMahon, Director of P~ogram Evaluation, is hereby authorized to execute for and in behalf of the Town of Southold, a public entity established under the laws of the State of New York, an application and to file it in the appropriate State office for the purpose of obtaining certain Federal financial assistance under the Diaster Relief Act (PUblic Law 288, 93rd Congress) or otherwise available from the President's Disaster Relief Fund; and befit further RESOLVED that the Town of Southold, a public entity established under the laws of the State of New York, hereby authorizes James C. McMahon, Director of Program Evaluation, its agent, to provide to the State and to the Federal Emergency Manage- ment AgencY (FEMA) for all matters pertaining to such Federal disaster assistance the required assurances and agreements. 4.-Vote of thel TOwn Board: Ayes: Councilwoman Latson, Councilwoman Oliva, · Councilman Penny~ Supervisor Harris. This resolution was declared duly ADOPTED. ^uous- 1991 SUPERVISOR HARRIS: I may add, if everyone would, please, write to your Con- gressman, George Hockbrueckner,.and to your Senator, Alfonse D'Amato, not to mention the President of the United States', George Bush. Please, urge them to declare this a disaster area on the East End of Suffolk County. It's very important that we have that declaration, because otherwise we never can get reimbursed for the amount of monies, that we've all had to spend to clean up this disaster after hurricane Bob has struck us. The tremendous amount of equipment, and personnel, and overtime has been spended to help in this cleanup, and without the_ Federal government declaring this a disaster area, even though we locally have done it as Supervisors, and the County Executive has done it, declared an emergency, and so has the Governor of the State. Without the Federal government declaring it a disaster area, we can not get reimbursed for funds. They are so badly needed at this time, and we're all working on marginal budgets as it is. Thank you. 5.-Moved by Councilman Penny, seconded by Councilwoman Oliva, it was RESOLVED that the Town Board of the Town of Southold hereby accepts the bid of Eastern Wholesale Fence Co., Inc., Medford, New York, for supplying the Highway Department with 10,000 linear feet (more or less as may be needed), of Snow Fence, at $44.45 per 100 ft. roll, all in accordance with the bid specifications. 5.-Vote of the Town Board: Ayes: Councilwoman Latson, Councilwoman Oliva, Councilman Penny, Supervisor Harris. This resolution was declared duly ADOPTED. 6.-Moved by Supervisor Harris, seconded b~/ Councilman Penny, it was RESOLVED that the Town Board of the Town of Southold hereby authorizes and directs the Town Clerk to advertise for bids for the purchase of 10,000 yards (more or less as may be needed) of soil to be used for covering purposes at the Southold Town Landfill. 6.-Vote of the Town Board: Ayes: Councilwoman Latson, Councilwoman Oliva, Councilman Penny, Supervisor Harris. This resolution was declared duly ADOPTED. 7.-Moved by Councilwoman Oliva, seconded by Supervisor Harris, it was RESOLVED that the Town Board of the Town of Southold hereby accepts Irrevocable Letter of Credit No. 910823, in the amount of $67,560.00, as a bond for roads and improvements in the major subdivision of Orient Park Estates, ali in accordance with the Town Board's resolution of December 27, 1989, approving said amount as recommended by the Southold Town Planning Board and Sidney B. Bowne & Son, Consulting Engineers. 7.-Vote of the Town Board: Ayes: Councilwoman Latson, Councilwoman Oliva, Councilman Penny, Supervisor Harris. This resolution was declared duly ADOPTED. 8.-Moved by Councilwoman Latson, seconded by Councilwoman Oliva, it was RESOLVED that the application of Frank Sawicki for renewal of his farm worker house trailer permit, for trailer located on the north side of Old North Road, Southold, which permit expires on September 23, 1991, be and hereby is granted for a Six (6) month period. ~ 8.-Vote of the Town Board: Ayes: Councilwoman Latson, Councilwoman Oliva, Councilman Penny, Supervisor Harris. This resolution was declared duly ADOPTED. 9.-Moved by Councilman Penny, seconded by Councilwoman Oliva, it was RESOLVED that the Town Board of the Town of Southold hereby authorizes and directs Supervisor Scott L. Harris to execute an agreement between the Family Service League, Inc. and the Town of Southold, whereby the consultant will provide individual and crisis intervention counseling plus alcohol and substance abuse prevention/education services for the Southold Town Youth Services Program at an agreed sum not to exceed $30,396.00, for the term of January 1, 1991 through December 31, 1991, all in accordance with the approval of the Town Attorney. 9.-Vote of the Town Board: Ayes: Councilwoman Latson, Councilwoman Oliva, Councilman Penny, Supervisor Harris. This resolution was declared duly ADOPTED. 10.-Moved by Councilwoman Oliva, seconded by Supervisor Harris, it was RESOLVED that the Town Board of the Town of Southold hereby grants permission to all Town Board Members, Town Attorneys, and Solid Waste Manaqement Task Force Members, to attend a seminar entitled, "Environmental Issues: Long island's Future", on Tuesday, October 1, 1991, from 9:00 a.m. to 2:00 p.m., at the Hunting- ton Hilton, Melville, New York, and the use of a Town vehicle, necessary expenses for travel, and $35.00 registration fee, which includes luncheon, shall be a legal charge against the 1991 Budget. 10.-Vote of the Town Board: Ayes: Councilwoman Latson, Councilwoman Oliva, Councilman Penny, Supervisor Harris. This resolution was declared duly ADOPTED. 11 .-Moved by Councilwoman Latson, seconded by Councilwoman Oliva, it was RESOLVED that the Town Board of the Town of Southold I-3_ereby appoints Russell R. Kassner as a part-time Clerk in the Town Clerk's Office to work on the Records Management and Inventory Planning Program, effective September 3, 1991, 17-1/2 hours per week, at a salary of $6.00 per hour; said salary to be paid from the Records Inventory & Planning Grant received by the Town Clerk's Office. SUPERVISOR HARRIS: It has been brought to my attention, that it should be added paid by a grant. COUNCILWOMAN LATSON: Paid for by a $17,000 gran~t that was received by the Town Clerk's Office for this purpose. 11.-Vote of the Town Board: Ayes: Councilwoman Latson, Councilwoman Oliva, Councilman Penny, Supervisor Harris. This resolution was declared duly ADOPTED. 12.-Moved by Councilman Penny, seconded by Councilwoman Oliva, it was RESOLVED that the Town Board of the Town of Southold hereby authorizes the Southold Town Landfill to accept, without charge, brush, leaves, trees, and stumps from the destruction caused by Hurricane Bob until September 10, 1991. 12.-Vote of the Town f3oard: Ayes: Councilwoman Latson, Councilwoman Oliva, Councilman Penny, Supervisor Harris. This resolution was declared duly ADOPTED. SUPERVISOR HARRIS: Just for a clarification, earlier when Hurricane Bob hit I was on the radio advising the people of Southold Town, that we were going to open the landfill for two weeks at no charge, and it was going to end on September 3rd at five o'clock. However, due to the massive debris, and destruction that has taken place more so than we entailed when we first offered this free entrance into the landfill for two weeks, we've extended it one more week to September 10th, and at that time the Town Board will make a decision, which happens to be a Town Board day, whether we should even extend it for another week after that. I think we'll have a better opportunity to see exactly how much brush has been cleaned. The Highway Department has done an exceptional job, considering that they have twenty-two men for four hundred lane miles of roads in Southold Town to clean up, and they haven't even finished doing any work part of the whole town yet, once around. So it will be months before Highway Department has had an opportunity to clean up the massive debris and destruction that has taken place in Southold. I~d like to add further that the amount of debris received so far at the landfill by the latest figures, as of yesterday, was over two thousand tons, have been brought into the landfill to date, and this is just the beginning of the clean up of the disaster after Hurricane Bob I~as hit. COUNCILWOMAN LATSON: Can I add on a different note, that also partly under the purview of the Highway Department, that we met on last Thursday, and we decided that the bayside beaches in the town could be reopened through Labor Day. So, Gull Pond, Goose Creek, and New Suffolk were opened this Monday, and the beaches will be opened, and beach attendants, and life guards will be there through Labor Day weekend to provide a place to bathefor not only our local residents, but for our summer residents, and our tourists as well. SUPERVISOR HARRIS: Thank you. Councilwoman Latson is Chairman of Parks, Recreation 'and Beaches standing committee. 13.-Moved by Councilwoman Latson, seconded by Councilman Penny, it was RESOLVED that the Town Board of the Town of Southold hereby authorizes and directs the Town; Clerk to advertise for resumes for one (1) member of the Board of Assessment Review. i3.-Vote of the Town Board: Ayes: Councilwoman Latson, Councilwoman Oliva, Councilman Penny, Supervisor Harris. This resolution was declared duly ADOPTED. 14.-Moved by Councilwoman Oliva, seconded by Councilman Penny, it was RESOLVED that the Town Board of the Town of Southold hereby authorizes and directs the Supervisor to execute a grant application to the New York State Office for the Aging for the Recreation Program for the Elderly grant for the period of April 1, 1991 to March 31, 1992. 14.-Vote of the Town Board: Ayes: Councilwoman Latson, Councilwoman Oliva, Councilman Penny, Supervisor Harris. This resolution was declared duty ADOPTED. AUGUST 27, 1991 SUPERVISOR HARRIS: I would just like to take this time. We do have two public hearings tonight, which are scheduled for 8:00 o'clock, and while we do have a few minutes I'd just like to make a few statements to our audience. I'd like to thank, to begin with, with Hurricane Bob Southold Town Highway Department under Ray Jacobs, who did a marvelous lob cleaning up, making access for emergency services to all homes in Southold Town within the first twelve hours after the storm hit. Their Highway crews working until midnight that night, and h~ve been working ever since. So, I'd like to thank them. ] would also like to thank LILCO. They did an exceptional job compared to 1985, when Gloria hit. I think most people had power restored within three days after Hurricane 13ob came throuc3h, and with the amount of crews that they brought in from outside. I'd like to thank them, also, because certainly they made a sacrifice to their families, not being home during that period being here helping us on the East End. Of course, I'd like to continue with all the volunteer fire departments from Orient all the way through Mattituck. They did a tremendous job, opening up their doors to the people, helping them, providing showers. The schools, that opened up their doors for shelters during this time period. All the people from the Telephone Company, who made sure our phones were working. They certainly were, as far as I was concerned, a model utility, because the phones are an ultimate necessity when lights are out,' and there is no electricity. These people at least had security to know that they had phone communication, in case there were problems in their own home. In an emergency medical situation, they could have contact on the outside. So, I'd like to thank them, and of course everyone else, who chipped in, who's been working together towards this common goal of bringing together the pieces of Southold Town after this hurricane and this destruction that it left. I really can't say enough about how everybody has worked together. Suffolk County Department of Emergency Preparedness did a wonderful job. They were in contact with me every hour, as was LILCO. Pat Halpin, the County Executive, did a great, j9b. We were in contact on and off many times, and the first call that came Jn that I had with Pat Halpin, he asked me is there anything I can do for $outhold at this time2 Fishers Island was hit very hard, because it was very close to the eye, much closer than we were on the East End. I asked him to, please, get equipment and personnel over there as soon as possible to help them uncover the massive destruction that took place, the trees and wires over there, and the next day, and this is on Monday, when I talked to the County Executive, on Tuesday there was a crew, a number of people, crews that came down with equipment from Albany, that went right to Fishers Island through New London Ferry to help them with their destruction over there. So, I want to, of course, thank him personally for his intervention and help. Of course, not to end it, I'd like to also thank everyone on Southold Town Police Department, who did a marvelous iob making sure that the people were safe, those who needed evacuation, those who were in trouble with wires after the storm. They were a tremendous asset to this town. So, this destruction, that we've all learned from this storm, we had great coordination, and I hope that next time, if there is~, and hopefully there won't be a next time, but if there is a next time, that we'll have a little bit better understanding of how to deal with the destruction, that can take place from a hurricane in 1990's. I, also at this time would like to go out to the audience, otherwise the Town Board has a few statements to make, to entertain anything that you may have of importance to bring before us. Paul, you had a question before, if you'd like to present that question at this time, and see if we can answer that for you. You asked about the debris along side the road. I think that's been answered. The Highway Depart- ment has gone through part of the town already with clean up. Of course, as the Highway crews go through more and more people clean up debris, and they bring it out to the road, hoping the Highway will come back. With the amount of destruction, that has taken place, and the limited number of personnel the High- way has, there may not be a possibility for them to go back a second time, so the $uperentendent of Highway Ray Jacobs has asked me to ask everyone here, that if you can possible get to the landfill yourself, it would certainly help alleviate the pile up of debris that is taking place right now. He will make all efforts to. try to get back a second time, but it will be months before he can get through one time the entire mass of cleanup that he has in front of him. So, he has asked me to mention that, and I hope that answers your question about the debris, Paul. Are there any people from the audience, that would like to ask us any questions at this time in reference to any subject before we go into our public hearings at 8:00 o'clock? Councilwoman Oliva? AUGUST 27, 1991 COUNCILWOMAN OLIVA: I would just like to make a public statement of thanks for myself, and my neighbor's mother, to the Orient Fire Department, and the Ladies Auxilary. for their gracious hospitality on the day of the hurricane. It was most comforting to my neighbor's mother, who is in her eighties, to be at the Fire House where she felt far more safe and secure, than say in my house, or her house, with trees probably bending in half, and they gave us lunch, and they just treated us so beautifully, and I do want to publically thank them. They are a credit to the community. Thank you. SUPERVISOR HARRIS: Are there any other members of the Board? Councilwoman Latson? COUNCILWOMAN LATSON: I think one of the interesting things about the hurricane, Scott, is that it came on so rapidly. When we went to bed that night it was only moving at twelve miles an hour. We thought it would get here Monday, late Monday afternoon, and when we woke up that morning, it was moving north-west at thirty miles an hour, and it was really blowing quite heavily by 10:30 in the morning, and raining. SUPERVISOR HARRIS: I had a call at 4:00 o'clock in the morning from Emergency Prepa~redness n Suffolk County saying that the storm had been tracked to go across the twin forks at that time by the computer modulethat they have, and they said get everything prepared so we of course went into action, and got everybody called, and got everything prepared, and thank goodness, we're on the west side of the eye when it do come through, and it;didn't come across the twin forks as had been projected, and as everyone knows the eye of the storm actually went over Block Island, and at Iow tide. As Ellen had mentioned if moved at 35 miles an hour, when it did come through, and thank goodness it came at Iow tide otherwise it would have been total destruction, certainly on all the East End towns. Are there any members of the audience, that would like to address this Board on any issues at this time? Councilman Penny? COUNCILMAN PENNY: I think that many of us have a new respect for LILCO after this hurricane. We waited about four days the last time, before we saw any LILCO trucks on the North Fork, and this time they were out almost immediately. I saw trucks from Pennsylvania, from Connecticut, Massachusetts. I mean it was just absolutely amazing. There were groups of trucks just about everywhere you went, where there was a lot of devastation, and also, repeat what Scott said about the many town, state, and local groups, that got out and did the amazing job, that they did of cleanup. I mean it's really outstanding. I'd like to mention at this time, that our first fall meeting of the Legislative Committee will be next Wednesday at 7:30. Our topic on the agenda will be considering the addition of a Home Business Office to our Home Occupation Law. This is something that we started in July, and we haven't done anything on that through the month of August, because it's really tough to get people to come out in the middle of summer, but we're going to start up again, so we hope that we have some participation. Thank you. SUPERVISOR HARRIS: On that, which I failed to mention earlier, certainly the County of Suffolk Department of Public Works, and the State Highway Department has done a tremendous .iob, and still are out there working, and the Chairman of LILCO, Bill Cataco$inc~s~ artd._[, and Joe Janoski, and Pat Halpin met on Monday, and I'd like to thank him personally, because he made a committment to all of us on the East End, that whatever he could do, that money was no expense, whatever it took to get electricity back to all the residents, that he would do that, and he did keep his word, and certainly got the electricity back to many people on the East End. COUNCILWOMAN OLIVA: And you saw how many trucks were in Orient. SUPERVISOR HARRIS: Two hundred and forty-nine crews to be exact, that were sent out to Southold. There were three hundred and eighty thousand people without power after Hurricane Bob came through, most of it on the East End. COUNCILWOMAN LATSON: were without water. They were not only without power, but most of them SUPERVISOR HARRIS: At this time, I'll need a motion to recess for public hearings. Chapter 38 (Dogs) of the Code of the Town of Southold is hereby amended as follows: 1. Section 38-7 (Confinement; redemption; disposition) is hereby amended to read as follows: Any dog impounded under the provisions of this Article shah be confined in accordance with the provisions of the Agriculture and Markets Law of the State of New York and may be redeemed by the owner or harborer thereof upon payment to the Town Clerk or Dog Control Officer of the sums set forth below: (a) Ten dollars for the first impoundment of any docj owned by that person; (b) twenty dollars for the first twenty-four hours or part thereof and five dollars for each additional twenty-four hours or part thereof for the second impoundment, within one year of the first impoundment, of any docj owned by that person; or (c) thirty dollars for the first twenty-four hours or part thereof and five dollars for each additional twenty-four hours or part thereof for the third and subsequent impoundments, within one year of the first impoundment, of any docj owned b~/ that perons. Any dog not so redeemed shall, at the option of the DoD Control Officer, be made available for adoption or be destroyed or given to a recognized society for the care and welfare of dogs. The fee for the adoption of a dog shall be in such amount as may be, from time to time, established by Town Board resolution. The Dog Control Officer may, as a condition to an adoption, require that the dog shall be spayed or neutered within one (1) year after such adoption and may require a deposit of twenty dollars ($20.) to assure that such dog is spayed or neutered within such time.
