Project Description: Remove and replace (in-place) approximately 100 If of existing
timber bulkhead with vinyl bulkhead; remove and replace (in-place) existing 3' x+A 8'
steps to beach; backfill with approximately 25 cy of clean sand fill to be trucked in from
an approved upland source;,maintain existing covenanted 10' wide non-turf buffer
adjacent to bulkhead; and replant approximately 5'wide sloped area between non-turf
buffer and edge of lawn with native vegetation. '
Findings: The project meets all the requirements for issuance of an Administrative
Permit set forth in Chapter 275 of the Southold Town Code. The issuance of an
Administrative Permit allows for the operations as indicated on the site plan submitted by
En-Consultants, last dated on November 13, 2019 and stamped approved on November
13, 2019.
Special Conditions: None.
Inspections: Final Inspection.
If the proposed activities do not meet the requirements for issuance of an Administrative
Permit set forth in Chapter 275 of the Southold Town Code, a Wetland Permit will be
required.
This is not a determination from any other agency.

Block 01, Lot 21 which is more particularly bounded and described as set forth in
Schedule "A" annexed hereto, hereinafter referred to as the Property;
WHEREAS, the Property is situated on lands within the jurisdiction of the
Board of Trustees of the Town of Southold (hereinafter the `Trustees") pursuant
to Chapter 275 of the Town Code of the Town of Southold or its successor, and
various activities conducted upon the property may thus be subject to the
regulation and approval of the Trustees prior to being conducted;
WHEREAS, the DECLARANT(S) therefore made application to the Trustees for a
permit pursuant to the Wetlands Law of the Town of Southold to undertake certain
regulated activities; and

WHEREAS, as a condition of the granting of a Wetlands Permit to undertake
such regulated activities, the Trustees required a ten foot "non-turf buffer"
adjacent to and landward of the bulkhead.
NOW, THEREFORE, the DECLARANT(S) do/does hereby covenant and agree as ,
follows:
1) Upon the substantial completion of the aforementioned permitted
activities there shall be established and subsequently maintained a ten
foot, non-turf buffer adjacent to the bulkhead, "non-turf buffer" as
defined by Chapter 275 of the Town Code; and as depicted on survey/site
Plan last dated 01/0212007 and stamped approved on 1012012006; and
2) These covenants shall run with the land and shall be binding on the
DECLARANT(S), his/her/their heirs, assigns, purchasers, or successors in
interest and may only be modified after a public hearing and upon
resolution of the Trustees.

pursuant to code (i.e., sand, plantings, etc.), conditioned upon the revegetation of the sloped area. I will email you the

Town of Southold Town Code and the Local Waterfront Revitalization Program (LWRP) Policy
Standards. Based upon the information provided on the LWRP Consistency Assessment Form
submitted to this department, as well as the records available to me, it is my recommendation that
the proposed action is CONSISTENT with the LWRP policies.
It is recommended that the non-turf buffer is vegetated to further Policy 6.
Pursuant to Chapter 268, the Board of Trustees shall consider this recommendation in preparing its
written determination regarding the consistency of the proposed action.

The project seeks to replace an existing timber bulkhead situated between two adjoining bulkheads to the east and west
with a vinyl bulkhead in the same location to maintain the property's historical method of protection against erosion and
flooding. The existing,developed site has been improved with and supported and protected from flooding and erosion by
a bulkhead since prior to 1977,and there is no viable non-structural alternative means of maintaining and protecting the
upland portion of the property in its current location. Without replacement and maintenance of the bulkhead,the subject
and adjacent properties would be exposed to severe erosion,flooding,and damage to the residential structures located
thereon. The project will thus effectively maintain the existing conditions along this bulkheaded shoreline without any
change in or significant adverse impact on the adjacent unvegetated beach or tidal waters. The project will provide the
ecological benefits associated with replacing a treated timber bulkhead with untreated vinyl sheathing and maintaining the
existing,covenanted, 10'wide non-turf buffer landward of the bulkhead.

A. INSTRUCTIONS
1. All applicants for permits* including Town of Southold agencies, shall complete this CCAF for
proposed actions that are subject to the Town of Southold Waterfront Consistency Review Law. This
assessment is intended to supplement other information used by a Town of Southold agency in
making a determination of consistency. *Except minor exempt actions including Building Permits
and other ministerial permits not located within the Coastal Erosion Hazard Area.
2. Before answering the questions in Section C, the preparer of this form should review the exempt
minor action list, policies and explanations of each policy contained in the Town of Southold Local
Waterfront Revitalization Program. A proposed action will be evaluated as to its si nim
beneficial and adverse effects upon the coastal area (which includes all of Southold Town).

The project seeks to replace an existing timber bulkhead situated between two adjoining bulkheads to the east and west with a vinyl
bulkhead in the same location to maintain the property's historical method of protection agaipst erosion and flooding. The existing,
developed site has been improved with and supported and protected from flooding and erosion by a bulkhead since prior to 1977,and
there is no viable non-structural alternative means of maintaining and protecting the upland portion of the property in its current
location. Without replacement and maintenance of the bulkhead,the subject and adjacent properties would be exposed to severe
erosion,flooding,and damage to the residential structures located thereon.

Please find enclosed an application for a Administrative Wetlands Permit to remove and replace
(in-place) approximately 100 if of existing timber bulkhead and 3' x 8' steps off the bulkhead to
the beach; and revegetate/maintain an existing, 15' wide naturally vegetated area adjacent to the
reconstructed bulkhead, including an existing covenanted 10' wide non-turf buffer.
We are requesting an Administrative Wetlands Permit because the existing bulkheading is
permitted pursuant to Trustees Permit No. 5481; and Section 275-5 (B)(2)(i) allows for
consideration for administrative review "the construction of a permitted bulkhead, as per§275-
11, which is to replace an existing functional bulkhead, subject to the following: [That the .
new bulkhead is constructed substantially similar to the design and measurement of the existing
bulkhead; [21 new bulkhead is in the same location as the existing bulkhead; and j�Any
such operations shall require the addition of a nonturf pervious buffer area. "
