Penny IV, Councilwoman Ruth D. Oliva, Councilwoman .~ Ellen M. Latson, Councilman Thomas H. Wickham. Also present: Town Attorney Harvey A. Arnoff, Assistant Town Attorney Matthew G. Kiernan, Superintendent of Highways Raymond L. Jacobs, Town Clerk Judith T. Terry. For Discussion Items: (1) Request froh~ the Fishers Island Seniors Hotline for a $3,000 allocation in the 1992 Budget - will be considered during the budget preparation. (2) Memorandum from-the Board of Appeals transmitting a request from an applicant, Gustave J. Wade, for documented proof of the appraised value upon which the 2% SEQRA limitation was based as it pertained to his application. The suggested responding to Mr. Wade by (a) providing him with a copy of the Town's appraisal of his property; (b) a current appraisal, by the applicant upon which the fee would be based; (c) a agreement to limit the SEQRA fee based upon a copy of Mr. Wade's appraisal prepared in 1989 or 1990. The Board agreed any one of the suggestions would be acceptable. (3) Appointment of Frederick Ross as Chairman of the Southold Town Land Preservation Committee (see resolution no. 18). (4) Memorandum from the Town Attorney concerning certain deeds to the North Fork Housing Alliance for affordable housing parcels. Town Attorney will research further and discuss this again on August 27th. (5) Memorandum from the Town Attorney with respect to releasing the covenant and restriction-with respect to access to Route 25 on~ the North Fork Housing Alliance affordable housing parcel on Rachel's Road, Mattituck Board agreed - see resolution no. 19). The affordable parcel at Liberty Lane and Colonial Road, Southold was discussed. Applicant would like a proposed driveway parcel released to her. Board cannot release an outright deed, but after an appraisal (resolution 20) could sell the 20 ft. by 100 ft. parcel to the property owner if she is agreeable. (6) Application of Mary Mulcahy Jackson for the volunteer position under the Recycling Education Program (see resolution 20). . (7) Discussion by Councilwoman Oliva to set up a task force to study-the transcript to be produced as a result of the US/UK Countryside Exchange results. ~ Supervisor Harris suggested this be addressed, by the North Fork Planning Conference. Councilman Wickham said that group is already studying the recommendations, and feels the Town Board should delegate a member to be a part of that group at the outset. Justice Edwards suggested inviting a the' US/UK member from Vermont to meet with the Board. Supervisor Harris will set up a meeting for the evening of September 10th to begin a group discussion. (8) Proposed Local Law to restrict parking at Youngs Road, Orient - see resolution no. 22 setting 8:00 P.M., Tuesday, August 27th for a public hearing. (9) Discussed waiving building, permit renewal fee for the Mattituck Youth Activities project - i Board agreed- see resolution no. 23). (10) Proposed resolution to engage the services of Oxford Tire of Connecticut to remove the accumulation of scrap tires from the Landfill and continue the service until December 31st. New York Tire Recycling Co. who had the contract has gone out of business and cannot fulfill their agreement (see resolution no. 24). (11) Proposed Local Law in Relation_ to Impoundment of Dogs - Board set 8:02 P.M., Tuesday, August 27th for a public hearing (see resolution no. 25). (12) Proposed resolution by Councilwoman Latson to request the DEC to delay the opening of the 1991 NYS 'Scallop Season until October 7th to provide for the recovery of the Peconic Bay Scallop from the devastating effects of the Brown Tide Algae Blook (see resolution no. 26). (14) AUGUST 13, 1991 Presentation by Councilman Wickham of the recommendations of the solid Waste Management Task Force with respect to public education on recycling: (1) Commercial/institutional establishments should be required to recycling their waste in the same categories as those required of residential users; each load of commercial waste brought to the landfill, either by carters or directly by businesses, should be inspected for separation of recyclable products from the remaining waste, and those loads not suitably separated should be turned back and not accepted at the landfill; there should be more public education before implementing mandatory ru~es for the commercial sector, starting with discussions with carters. 11:15 A.M. - Short recess. EXECUTIVE SESSION 11:45 A.M. - On motion of Councilman Penny, seconded by Councilwoman Oliva, it was Resolved that the Town Board enter into Executive Session. Also present: Town Attorney Arnoff, Assistant Town Attorney Kiernan, Superintendent of Highways Jacobs, Town Clerk Terry. The Board discussed numerous litigation matters.---At 12:020 P.M. Police Chief Droskoski met with the Board to discuss contract negotiations. 12:55 P.M. - Recess for lunch. 3:15 P.M. - The Town Board audited bills. Regular Meeting. 3:59 P.M. - Work Session adjourned. 58 REGULAR MEETING A Regular Meetinc~ of the Southold Town Board was held on Tuesday, August 13, 1991, at the $outhold Town Hall, Main Road, Southold, New York, Supervisor Harris opened the meeting at 4:00 P.M., with the Pledge of Alleginace to the Flag. We'll start off with some brief business before we get into a proclamation, that we'll be pre- senting in reference to the Adopt-A-Mile-Marker Week. We need a motion to approve the audit of the bills of August 13, 1991. Moved by Councilman Wickham, seconded by Justice Edwards, it was RESOLVED that the following audited bills be and hereby ordered paid: General Fund Whole Town bills in the amount~iof $61,740.23; General Fund Part Town bills in the amount of $45,468.88; Nutrition Fund bills in the amount of $2,701.14; Home Aide Program bills in the amount of $162.00; SNAP Program bills in the amount of $3,823.29; EISEP Program bills in the amount of $204.74; Highway Fund Whole Town bills in the $11,652.66; Hydrogeolic Landfill Study bills in the amount of $15,833.40; Computer Capital Account bills in the amount of $73.04; Employee Health Benefit Plan bills in the amount of $47,188.67; Fishers Island Ferry District bills in the amount of $60,489.76; Fishers Island Sewer District bills in the amount of $195.18; Fishers Island Ferry District Agency & Trust bills in the amount of $417.17; Highway Fund Part Town bills in the amount of $8,989.11. SUPERVISOR HARRIS: I need a motion to approve the next Board meeting of August 27, 1991, at 7:30 P.M. Moved by Councilwoman Oliva, seconded by Councilwoman Latson, it was RESOLVED that the next regularly scheduled meeting of the $outhold Town Board will be held at 7:30 P.M., on August 27, 1991, at the Southold Town Hall, Main Road, Southold, New York. Vote of the Town Board: Ayes: Councilman Wickham, Councilwoman Latson, Councilwoman Oliva, Councilman Penny, Justice Edwards, Supervisor Harris. This resolution was declared duly ADOPTED. SUPERVISOR HARRIS: At this time, we have a proclamation, which I would like to present. This special proclamation is proclaiming August 11th through August 17, 1991, as Adopt-A-Mile-Marker Week, and before I present this proclamation to Harry Fagan, who was the originator and devisor of the plan for the preserva- tion program. There are a number of individuals here, who have adopted a mile marker since this program began a number of months ago, and at this time, Harry if you would come up front. I'd like to read the proclamation to you first, and then we will go into those individuals who graciously volunteered their services, adopting a mile marker. Moved by Supervisor Harris, seconded by The Entire Town Board, WHEREAS, in 1755, Postmaster Benjamin Franklin placed thirty stone mile-markers along the Main Road from Riverhead to Orient for the purpose of determining how much to charge, per mile, for mail; and WHEREAS, twenty-one of the original markers remain in place in Southold Town, and each is inscribed with a number and the letters, SCH, which inscription was intended by Benjamin Franklin to convey the mileage from a certain spot to the Suffolk' County House in Riverhead; and WHEREAS, Southold Town resident, Harry Fagan, devised a plan for a marker preservation program, a plan to enlist the help of service organizations and civic- minded residents throughout Southold Town to "adopt" the markers and maintain them and their site; and AUGUST 13, 1991 59 WHEREAS, through the efforts of Harry Fagan, there are now comitted volunteers for the care and maintenance of each of the twenty-one markers; now, therefore, be it RESOLVED that in recognition of the many hours of dedication and patience by Harry Fagan, the Town Board wishes to pay special tribute to Mr. Fagan and the public spirited organizations and residents by proclaiming August 11 - 17, 1991 as ADOPT~A-MILE-MARKER WEEK in the Town of $outhoid; and be it further RESOLVED, that the Town Board of the Town fo Southold hereby extends their sincere gratitude for the caring and concern which has been displayed for the preservation of these historic mile markers which have been in place for over 236 years in the Town of Southold. Number 24 has been adopted by the East Marion Community Church. Number 25, Mr. Doug Rogers has adopted that mile marker. Number 26, Mr. Ed Latham has adopted that one. Of course, as I said Ralph Williams is here, and we're talking about Jessie and Hector Pemberton, and Elinor Williams. Mile. Marker number 29 Southold Rotary Club, and Number 30, Cross Sound Ferry Corporation has adopted. HARRY FAGAN: I owe a debt of gratitude to Bob Long for all of the historical information, that he was able to furnish me with, which got me started. Also, to Sparky Coyle, who stimulated my interest over two years ago by giving me a list of about fifty years old, and he said he was 19 years old. I don't know whether to believe that or not. SUPERVISOR HARRIS: Ladies and Gentlemen, I'm pleasedto present most of the people, the new parents of the Southold Town Adopt-A-Mile-Marker that are located within Southold Town, twenty-one of them, and hopefully three of those markers someday will be retreived, and I'm sure we will have parents for them immediately. There is a waiting list, I understand from Harry of people who wanted to adopt a mile marker, but unfortunately it was first come, and first serve, so at some point I'm sure that these three markers will be recovered at which time we will certainly have an adoption for them. SUPERVISOR HARRIS: At this time, before we entertain motions on resolutions that we'll be enacting in the next few minutes, are there any members of the audience, that would like to address us on any one these resolutions coming forward? (No response.) At this time, the first resolution of the afternoon, excepting a reduced Letter of Credit as bond for roads and improvement in minor subdivision Charles Simmons. ' 1.-Moved by Superwsor Harris, seconded by Councilman Penny, it was RESOLVED that the Town Board of the Town of Southold hereby accepts the reduced Letter of Credit in the amount of $181,941.00, posted by Charles P. Simmons and A. E. Nicholas as a bond for roads and improvements in the minor Subdivision of Charles Simmons, located at Mattituck, all in accordance with the Town Board's resolution of July 2, 1991 accepting this reduction as recommended by the Southold Town Planning Board and Engineering Inspector Richter. 1.-Vote of the Town Board: Ayes: Councilman Wickham, Councilwoman Latson, Councilwoman Oliva, Councilman Penny, Justice Edwards, Supervisor Harris. This resolution was declared duly ADOPTED. 2.-Moved by Justice Edwards, seconded by Councilwoman Latson, it was RESOLVED that the Town Board of the Town of $outhold hereby authorizes an advance fee check in the amount of $60.00 as a deposit for the October 31, 1991 senior trip to West Point Military Academy; said charge to be made to A7620.4, Adult Recreation, Contractual Expenses; check made payable to West Point Tours, Inc. 2.-Vote of the Town Board: Ayes: Councilman Wickham, Councilwoman Latson, Councilwoman Oliva, Councilman Penny, Justice Edwards, Supervisor Harris. This resolution was declared duly ADOPTED. 3.-Moved by Councilwoman Latson, seconded by Councilwoman Oliva, it was RESOLVED that the application of Eugene Vanden Bosch, Northeast Nurseries, for renewal of his watchman/caretaker trailer permit, for trailer located on the south side of County Road 48, Cutchogue, which permit expired on August 8, 1991, be and hereby is cjranted for a six (6) 'month period. 3.-Vote of the Town Board: Ayes: Councilman Wickham, Councilwoman Latson, Councilwoman Oliva, Councilman Penny, Justice Edwards, Supervisor Harris. This resolution was declared duly ADOPTED. 4.-Moved by Councilwoman Oliva, seconded by Councilwoman Latson, it was RESOLVED that the Town Board of the Town of Southold hereby authorizes an extension of the 90-day submission date for Jacqueline Kelsey with respect to outstanding medical bills, whereas the bills were submitted with the Town's health plan requirements, but Medicare is still processing the claims. 4.-Vote of the Town Board: Ayes: Councilman Wickham, Councilwoman Latson, Councilwoman Oliva, Councilman Penny, Justice Edwards, Supervisor Harris. This resolution was declared duly ADOPTED. 5.-Moved by Councilman Penny, seconded by Councilwoman Latson, it was RESOLVED that the Town Board of the Town of Southold hereby appoints James C. McMahon provisionally to the postion of Director of Program Evaluation, effective August 14, 1991, at a salary of $42,690.00 per annum. 5.-Vote of the Town Board: Ayes: Councilman Wickham, Councilwoman Latson, Councilwoman Oliva, Councilman Penny, Justice Edwards, Supervisor Harris. This resolution was declared duly ADOPTED. 6.-Moved by Councilwoman Oliva, seconded by Councilman Wickham, it was RESOLVED that the Town Board of the Town of Southold hereby authorizes an extension of the 90-day submission date for John Bakowski with respect to out- standing medical bills, whereas the bills were submitted in accordance with the Town's health plan requirements, but Medicare is still processing the claims. 6.-Vote of the Town Board: Ayes: Councilman Wickham, Councilwoman Latson, Councilwoman Oliva, Councilman Penny, Justice Edwards, Supervisor Harris.' McBride for renewal of his farm worker house trailer permit, for trailer located on the north side of Oregon Road, Cutchogue, New York which permit expired on August 9, 1991, be and hereby is c~ranted for a six (6) month period. 7.-Vote of the Town Board: Ayes: Councilman Wickham, Councilwoman Latson, Councilwoman Oliva, Councilman Penny, Justice Edwards, Supervisor Harris. This resolution was declared duly ADOPTED. 8.-Moved by Councilman Penny, seconded by Councilwoman Oliva, it was RESOLVED that the Town Board of the Town of Southold hereby authorizes and directs Supervisor Scott L. Harris to execute Change Order No. 1 with respect to the Bulkhead Reconstruction at Klipp Park, Greenport, which change order is to approve resheeting and deadmen system for 19 additional linear feet, at a cost of $2,000.00, all in accordance with the approval of Town Engineering Inspector James A. Richter. 8.-Vote of the Town Board: Ayes: Councilman Wickham, Councilwoman Latson, Councilwoman Oliva, Councilman Penny, Justice Edwards, Supervisor Harris. This resolution was declared duly ADOPTED. 2 AUGUST 13, 1991 9.-Moved by Councilwoman Latson, seconded by Councilwoman Oliva, it was RESOLVED that the Town Board of the Town of Southold hereby engages the services of Andrew O. Stype to conduct an appraisal on behalf of the Land Preser- vation Committee, at a fee of $1,000.00, on the property of Timothy Coffey, Route 25 and Richmond Creek, Peconic, 19 acres, SCTM#1000-75-6-7.3. 9.-Vote of the Town Board: Ayes: Councilman Wickham, Councilwoman Latson, Councilwoman Oliva, Councilman Penny, Justice Edwards, Supervisor Harris. This resolution was declared duly ADOPTED. 10.-Moved by Justice Edwards, seconded by Councilman Wickham, it was RESOLVED that the Town Board of the Town of Southold hereby authorizes the release of the performance bonds of R & L Well Drilling, placed with the Town for the satisfactory performance of their well drilling services at the Southold Town Landfill, all in accordance with the recommendation of Dvirka and Bartilucci~ the Town's Engineers, who have advised that R & L Well Drilling have satisfactorily completed the installation fo the monitoring wells. 10.-Vote of the Town Board: Ayes: Councilman Wickham, Councilwoman Latson, Councilwoman Oliva, Councilman Penny, Justice Edwards, Supervisor Harris. Harris to execute a free, permanent easement from the Town of Southoid to Long Island Lighting Company for the proposed installation of single phase electric facilities at the Highway Department property, Peconic Lane, Peconic, where a Telecommunications Tower and Equipment Building will be installed by Cellular Telephone Company, d/b/a Metro One, all in accordance with the approval of the Town Attorney. 11 .-Vote of the Town Board: Ayes: Councilman Wickham, Councilwoman Latson, Councilwoman Oliva, Councilman Penny, Justice Edwards, Supervisor Harris.
