Located: 815 Rosenburg Road, East Marion. SCTM# 1000-21-1-25.1 (Formerly Lot 1.3) The proposed action has been reviewed to Chapter 268, Waterfront Consistency Review of the Town of Southold Town Code and the Local Waterfront Revitalization Program (LWRP) Policy Standards. Based upon the information provided on the LWRP Consistency Assessment Form submitted to this department, as well as the records available to me, it is my recommendation that the action is INCONSISTENT with the below listed Policy Standard and therefore is INCONSISTENT with LWRP. 6.3. Protect and restore tidal and freshwater wetlands. A. Comply with statutory and regulatory requirements of the Southold Town Board of Trustees laws and regulations for all Andros Patent and other lands under their jurisdiction 1. Comply with Trustee regulations and recommendations as set forth in Trustee permit conditions. According to Town records, the structures were constructed without obtaining Board of Trustee review or regulatory permits. The installation of a vegetated buffer is recommended landward of the top of bluff to further Policies 4and 6. A report prepared by Suffolk County Water Soil and Water Conservation Service District (2019) included within the ZBA record identifies concerns regarding storm water affecting the integrity of the bluff. Pursuant to Chapter 268, the Board of Trustees shall consider this recommendation in preparing its written determination regarding the consistency of the proposed action.
