Dear Ms. Moore:
The Southold Town Board of Trustees reviewed the survey prepared by Peconic
Surveyors, P.C., last dated April 2, 2019 and determined that the proposed renovations
to the existing house and deck including new siding and windows, resurfacing of
existing deck on existing floor joists, replace any damaged floor joists and structural
members as necessary, replacing of existing handrails on decks with cable handrail
system and aluminum posts; new outdoor shower enclosure on deck, remove old steps
and construct new stairs to rear yard, resurface upper deck on existing joists, replace
damaged floor joists and structural members as necessary; on east side of house
remove existing ramp and replace with 5' wide stairs and ramp to front yard; new hot
tub on upper deck area, stairs from upper deck to upper deck balcony removed, replace
area of stairs with decking; remove old deck and walkway on east side of house and
replace with 37'x16' patio on grade located on the captioned property are out of the
Wetland jurisdiction under Chapter 275 of the Town Wetland Code and Chapter 1.11 of
the Town Code.
Therefore, in accordance with the current Wetlands Code (Chapter 275) and the
Coastal Erosion Hazard Area (Chapter 111) no permit is required.
Please be advised, however, that no clearing, no removal of vegetation, no cut or
fill of land or removal of sod, no construction, sedimentation, or disturbance of
any kind may take place within 100' landward from the top of the bluff, or seaward

of the tidal and/or freshwater wetlands jurisdictional boundary or seaward of the
coastal erosion hazard area as indicated above, without further application to,
and written authorization from, the Southold Town Board of Trustees pursuant to
Chapter 275 and/or Chapter 111 of the Town Code.
It is your responsibility to ensure that all necessary precautions are taken to prevent any
sedimentation or other alteration or disturbance to the ground surface or vegetation
within Tidal Wetlands jurisdiction and Coastal Erosion Hazard"Area, which may result
from your project. Such precautions may include maintaining adequate work area
between the tidal wetland jurisdictional boundary and the coastal erosion hazard area
and your project or erecting a temporary fence, barrier, or hay bale berm.
This determination is not a determination from any other agency.

The Southold Town Board of Trustees reviewed the survey dated March 19,2002 and
determined that the renovation of part of the ground floor of the existing structure and a second
floor addition above—existing decks shall remain and a new stair wil connect them - to be out
of the Wetland Jurisdiction under Chapter 97 of the Town Wetland Code and Cbapter 37 of the
I OWL Code. Coastal Erosion.
However any activity within 100' of the Wetland line and/or seaward�of the Coastal Erosion
Hazard Line, would require action from this office.

Dear President and Board members:
With reference-to the above property, I am respectfully requesting a letter of no
jurisdiction to the new owner. Enclosed is a record of the letter of no jurisdiction issued
to the prior owner Donald and Jeanne Kurz. In 2002 the Trustees marked the wetlands
for the prior owner and then issued the letter of no jurisdiction for renovations and 2nd
floor addition to the existing structure (copy attached).
The new owners wish to renovate the existing house and deck. We wish to be
assured that no permit is required. The renovation will include the following: new siding
and new windows to the existing house; existing 17' 3 1/2"deck to be resurfaced with
1pe on existing CCA floor joists (replace any damaged floor joists & structural members
as necessary), replace existing handrails on decks with cable handrail system and
aluminum posts; new outdoor shower enclosure on deck; remove old steps and
-construct, new 5A Y4" x 4' 71/8" stairs to rear yard (to meet building code); resurface 10'
2 3/4" x 40'5" upper deck with 1pe decking on existing CCA joists. Replace any
damaged floor joists and structural members as necessary. On east side of house
remove existing ramp and replace with 5' wide stairs and ramp to front yard.
New 7' 10" x 8' 61/4" hot tub on upper deck area; stairs from upper deck to upper
balcony removed, replace area of stairs with decking; Remove old deck and walkway on
east side of house and replace with 37' x 16' patio on grade.
