Oliva, Councilwoman Ellen M. Latson, Councilman Thomas H. Wickham, Town Attorney Harvey A. Arnoff, Assistant Town Attorney Matthew G. Kiernan, Superintendent of Highways Raymond L. Jacobs, Town Clerk Judith T. Terry. 9:45 A.M. - Donald Bracken and Dia~ne Carroll, developers of the. Cedarfields affordable housng project, Greenport, appeared before the Town Board to request that the remaining four unsold houses be exempted from the guidelines for affordable housing to enable them to attract a wider range of potential buyers. The units have been vacant for the past six months and they would like to sell at the same price, but to anyone who can afford to pay, as the costs for holding the vacant units has become a burden to them. They have placed many newspaper ads, End more are coming out this week. The Board advised they would be unwilling to extend a blanket exemption, but would consider each applicant for a house on a case-by-case. basis; 10:30 A.M. - For Discussion Items: (1) Notification from the Building Department that the buildings that have been declared unsafe, and a hearing held, with respect to the Stimpson-Larson premises, R-ocky Point Road, East Marion, have not been removed in accordance with the decision of the Town Board. A demolition permit as applied for on July. 23rd, but has not been returned for a permit. In a discussion with Principal Building Inspector Lessard at 3:30 P.M., it was determined that the permit has been secured, but the buildings have not bee removed. It is now at a point where the Town Attorney must take legal action against the property owners. '(2) Discussion by the Town Attorney with respect to a complaint by Mr. Ted Klos and Mr. Andre Moraillon, neighbors of Arthur Carlson, at Akerly Pond Lane, Southold. Mr. Carlson is presently before the Board of Appeals concerning his seafood business operation at Lower Road. Mr. Klos and Mr. M0raillon (who were in the audience at this time) are concerned that Mr. Carlson's operation will sanctioned throUgh the recent enactment of the Home Occupation Law. Town Attorney Arnoff made it .clear that this is not the case and he will not be able to "boot-strap" hi's operation to the new legislation. The Town Board reaffirmed their. policy and concurred with Town Attorney Arnoff. (3) Proposed Local Law prohibiting parking within 500 feet without a Town parking permit at Sound 'Road, G reenport and Rocky Point Road, East Marion ( see resolution no. 16 ). Superintendent of Highways Jacobs explained the severe problems caused 'by transients in this area and urged the Town Board to proceed with the legislation as soon as possible. (4) Justice Edwards brought to the Board's attention the metal dump on Town property on Fishe'rs Island. Superintendent of Highways Jacobs offered to research the cost to remove the metal from the Island. Justice Edwards~ also brought to the Board's 'attention the need to repair'the chain link fence around the tennis court which was built with Town funds on the Fishers Island School property. The Board'wiil put the necessary funds to replace the fence in the 1992 budget,, and requested the Town Attorney to .work out a lease agreement between the school and the Town to enable the Town to legally make the improvements. (5) Proposed "Local Law in Relation to Hotel or Motel Uses" was placed on. the agenda for a public hearing or~ August 13th (see resolution no. 17). (6) Request from William Zoldessy for a refund of the fee he paid for a beach parking permit, as he does not use Town beaches and would like to purchase a Mattituck Park District permit (see resolution no. 18). The Town Board also put resolution no. 19 on the agenda, ordering that beach parkino permits are no longer refundable under any circumstances. (7) Letter from D;~ Richard A. Hall request the refund of the building permit fee he paid in January, 1990. After speaking to Principal Building Inspector Lessard at 3:30 P.M., the Town Board determined that the fee would not be refunded, and the Town Attorney would respond to Dr. Hall. (8) Creation of the position of Director of Program Evaluation was discussed during Executive S¢C~sion at 11:55 A.M., and resolution no. 21 to create the position and set the sa~l~f was placed on the agenda. The position will be posted in accordance with CSEA requirements. (9) Memorandum from the Conservation Advisory Council advising that due to the dramatic decline in the time spent on wetland applications, they are going to try to produce background papers and possible position papers on (1) comprehensive dredging policy, (2) Swans and what should be done with them, (3) Goose Creek - runoff and bacteria data, (4) Pumpout stations, (5) Cesspool sites and leakage, (6) review of past environmental projects, and (7) carrying capacity of creeks in relation to number of boats. The Town Board expressed their approval for these very important and needed studies. (10) Town Attorney Arnoff brought to the Town Board's attention' the need for a policy with respect to the types of acceptable performance bonds. Recently savings/money market passbooks have been submitted in the name of the developer, which the Town Attorney finds are totally unacceptable. The Board placed resolution no. 20 on the agenda setting the policy that only letters of credit, cash, or a performance bond from a recognized bonding company will be acceptable. (11) Town Attorney Arnoff asked the Board for their feelings with respect to accepting dedication of Hummel Pond and the surrounding land should two subdivision~ be merged and the remainder of the land clustered. The Board agreed, provided:'there will be no problem with drainage from the lots to be built upon. Superintendent of Highways Jacobs and Engineering Inspector Richter will research the layout to make this determination. EXECUTIVE SESSION 11:55~A.M. - On motion of Councilwoman Latson~ seconded by Councilman Wickham, it was Resolved that the Town Board enter .into Executive Session. Also present: Town A.ttorney Arnoff, Assistant Town Attorney Kiernan, Superintendent of Highways Jacobs, Town Clerk Terry. The Board discussed personnel a'nd litigation. 12:50 P.M. - Recess for lunch. 2:00 P.M. - Board audited vouchers. EXECUTIVE SESSION 2:35 P.M. - On motion of Councilman Penny, seconded by Justice Edwards, it was Resolved that the Town Board enter into Executive Session. Vote of the Board: Ayes: Supervisor Harris, Justice Edwards, Councilman Penny, Councilwoman Oliva, Councilwoman Latson, Councilman Wickham. Also pre'sent Town Attorney Arnoff, Assistant Town Attorney Kiernan, Town Clerk Terry. The Board discussed the possible purchase of property and contract negotiations.--At 2:.55 P.M. they met with Mildred Boyce, President, and William Cremers, of ~the~North .Fork Animal. Welfare League, met with the Tdwn Board to conclude negotiations for the renewal of the contract for shelter/enforcement services to the Town see resolution no. 24 authorizing Supervisor to execute the new contract.---At 3:30 P.M. the Board met with Principal Building Inspector Lessard concerning what legal action will be required to enforce the Board's decision on the Stimpson-Larson unsafe premises. 3:55 P.M. - Work Session adjourned. REGULAR MEETING A Regular Meeting of the Southold Town Board was held on Tuesday, July 30, 1991, at the Southold Town Hall, Main Road, Southold, New 'fork. SUPERVISOR HARRIS: At this time we'd like to do a presentation of two awards, one being the promotion of Kevin Lynch to Sergeant, and also we have a meritorious award for Officer Thomas Gralton for his actions some months ago. So at this time, could you come forward, Kevin, and Chief? CHIEF DROSKOSKI: Kevin, congratulations. It givesme pleasure to see a guy rising up two ranks, and now promoted to Sergeant. Congratulations. 3¸2 JULY 30, 1991 SUPERVISOR HARRIS: It was Detective Lynch. Se~rgeant Lynch, on behalf of the Town congratulations. Wear t!~t gold shield with pride, and we know that the Town of Southold is going to be a little safer now, that you're in the new postion of Sergeant. Thank you. Congratulations to you, and your family. At this time, would Officer Gralton come forward. Ladies and gentlemen, Office Tom Gralton sometime ago gave of himself to save another's. He dove into some cold water, and suffered, also, some illness because of that, that for some time, which we're glad to see you've recovered from. I have a proclamation on behalf of the Town Board, and the people of the Town of Southold, that I'd like to read at this time. Moved by Supervisor Harris, seconded by the Entire Town Board, WHEREAS, the sanctity and value of human life is treasured and honored as a basic tenet of American life; and WHEREAS, it is in the highest pursuit and' maintenance of that belief that a person should expend all of his knowledge, ability and efforts toward the goal, even at risk to his own life and welfare; and WHEREAS, on the 16th day of April, Ninetee Hundred and Ninety-One, WHEREAS, POLICE OFFICER THOMAS GRALTON did exemplify the character, ability, knowledge, selflessness, courage and devotion necessary to meet the challenge in that he displayed excellent judgment by diving into the waters of Great Pond, Southold, to institute, without delay, the rescue of a man whose boat had capsized and was calling for help. OFFICER GRALTON went into the frigid pond, swam out to the frightened man, and pulled him back to the safety of the beach, permitting immediate resuscition efforts.to commence, which~ saved the life of the man, Samuel "Ray" White of Greenport. OFFICER GRALTON'S quick action and proper response, and his willingness to enter the water at risk to himself, aided in the successful efforts to save the life of Mr. White, and WHEREAS, POLICE OFFICER THOMAS GRALTON'S acts contributed to the saving of a life and are a tribute to his devotion and skill as a Police Officer of the Town of Southold; now, therefore, be it RESOLVED, that the Town Board of the Town of Southold hereby commends POLICE OFFICER THOMAS GRALTON for his meritorious actions and notes its pride in the q~ality and dedication of his services to the Town of Southold. This resolution was declared duly ADOPTED. SUPERVISOR HARRIS: On behalf of the Town, we're honored to have you among some of the finest, and congratulations again. This exemplifies what the tradition of Southold Town stands for, and certainly what the position of Police Officer, which you hold at this time. At this time, I'd like to present you with this proclamation, and the Chief, Stanley Droskoski also has a proclamation, that he'd like to read at this time. CHIEF DROSKOSKI: I have a brief statement of the actions, that Officer Gralton took on the day the incident occurred. On April 16, 1991, at about 1:58 P.M., Headquarters received a 911 Emergency call reporting that there was overturned boat at Great Pond, and the man was in the water shouting for help. When the call was dispatched Police Officer Thomas Gralton was patrolling in the area, and he immediately responded to the scene. He could see the overturned boat, and the man in the water, in distress. Without hesitation, Officer Gralton went into the water, swam out to the man, pulled him back to the beach, where he was then assisted by members of Southold Fire Department Rescue Squad in getting the victim out of the water. The man, who's life Officer Gralton saved is Samuel Ray White in Greenport. Mr. White was treated at the scene for cold water exposure, and exhaustion, and taken to Eastern Long Island Hospital, and treated. Officer Gralton was also treated at the scene for cold water exposure, and exhaustion, and taken to Eastern Long Island Hospital, also, where he remained for several days. His responsive action at the risk of his own life resulted in the saving of another man's life. Therefore, Officer Gralton is recognized, and commended by virtue of a life- saving bar for his rescue and lifesaving actions. Officer Gralton is certainly a credit to the Department and Southold Town. Officer Gralton, congratulations. I. REPORTS. 1. RESOLUTIONS. None. SUPERVISOR HARRIS: At this time are there any members of the audience, that would like to speak on any resolution that we'll be acting upon in the next few minutes? (No response.) Hearing none, we'll start with the first resolution. 1.-Moved by Supervisor Harris, seconded by Councilman Penny, WHEREAS, there has been presented to the Town Board of the Town of Southold a p~oposed Local Law entitled, "A Local Law in Relation to Parkinc~ Regulations"; now, therefore, be it RESOLVED that the Town Board hereby sets 4:40 P.M., Tuesday, Auc~ust 13, 1991, Southold Town Hall, Main Road, Southold, New York, as time and place for a public hearinc~ on the aforesaid proposed Local Law, which reads as follows, to wit: A Local Law in Relation to Parking Regulations BE IT ENACTED, by the Town Board of the Town of Southold as follows: I. Chapter 92 (Vehicles and Traffic) of the Code of the Town of Southold is hereby amended as follows: 1. Section 92-42 (Parking prohibited during certain hours) is here amended by deleting the following: Between the Name of Street Side Hours of Breakwater Road Both 10:00 p.m. and 7:00 a.m. Location In Mattituck, from Mattituck Park District north boundary line southerly for a distance of 250 feet. 1.-Vote of the Town Board: Ayes: Councilman Wickham, Councilwoman Latson, Councilman Penny, Justice Edwards, Supervisor Harris. Harris to execute Amendment No. 1 to the Grant Agree- ment between the U,S. Department of Transportation, Federal Aviation Administration, and the Town of Southold, for a $2,662.12 increase from $134,244.00 to $136,906.12 under the 1985-86 grant to seal and repair the runways at Elizabeth Field Airport, Fishers Island. 2.-Vote of the Town Board: Ayes: Councilman Wickham, Councilwoman Latson, Councilman Penny, Justice Edwards, Supervisor Harris. This resolution was declared duly ADOPTED. 3.-Moved by Councilman Wickham, seconded by Supervisor Harris, it was RESOLVED, that consent is hereby given to Raymond L. Jacobs, Superintendent of Highways of the Town of Southold, to abandon a portion of New Suffolk Avenue that extends from the northerly line of New Suffolk Avenue, said highway has not been traveled or used as a highway for six and more years prior to the date hereof, and is hereby declared abandoned pursuant to section 205 of the Highway Law as a highway and a public right-of-way. This resolution was declared duly ADOPTED. 4.-Moved by Justice Edwards, seconded by Supervisor Harris, it was RESOLVED that the Town Board of the~ Town of Southold hereby authorizes the reduction of the amount of the Perforrflance Bond for Kay Dee Estates subdivision, located at Leslie Road, Cutchogue, from $56,285.00 to $46,285.00 due to the elimina- tion of a firewell, all in accordance with the recommendation of the Southold TOwn Planning Board and Engineering Inspector Richter. 4.-Vote of the Town Board: Ayes: Councilman Wickham, Councilwoman Latson, Councilman Penny, Justice Edwards, Supervisor Harris. This resolution was declared duly ADOPTED. SUPERVISOR HARRIS: Resolution #5, accepting a Certificate of Deposit as a' Perfor- mance Bond for roads, and improvement in the subdivision of Kay Dee Estates, Cutchogue, has been removed. 6.-Moved by Councilwoman Latson, seconded by Justice Edwards, it was RESOLVED that the Town Board of the Town of Southold hereby authorizes an advance fee check in the amount of s990.50 (47 tickets at $21.00 each, plus $3.50 postage and handling) for the December 11, 1991 family bus-. trip to the Christmas Spectacular at Radio City Music Hall; check made payable to Radio City Music Hall; charge to be made to A7320.4, Joint Youth, Contractual Expenses. 6.-Vote of the Town Board: Ayes: Councilman Wickham, Councilwoman Latson, Councilman Penny, Justice Edwards, Supervisor Harris. This resolution was declared duly ADOPTED. 7.-Moved by Councilman Wickham, seconded by Justice Edwards, it was RESOLVED that the Town Board of the Town of Southold hereby authorizes the closure of Case's Lane, Cutchogue, from 6:00 P.M. to 10:00 P.M., Saturday, August 10, 1991, as a safety precaution during the Douglas Moore Memorial Concert, to be held on the Cutchogue-New Suffolk Historical Council's Cutchogue Village Green, provided the Douglas Moore Memorial Committee secures and files with the Town Clerk a Certificate of LiabilitY/ Insurance for at least One Million Dollars naming the Town of Southodl as an additional insured. 7.-Vote of the Town Board: Ayes: Councilman Wickham, Councilwoman Latson, Councilman Penny, Justice Edwards, Supervisor Harris. This resolution was declared duly ADOPTED. 8.-Moved by Justice Edwards, seconded by Councilman Wickham, it was RESOLVED that the Town Board of the Town of Southold hereby authorizes and directs the Supervisor to execute an Extension Aqreement between the County of Suffolk, Department for the Aging, and the Town of Southold for the EISEP Program, for the period of April 1, 1990 through March 31, 1992, at an extension period cost of $23,498.00, all in accordance with the approval of the Town Attorney. 8.-Vote of the Town Board: Ayes: Councilman Wickham, Councilwoman Latson, Councilman Penny, Justice Edwards, Supervisor Harris. This resolution was declared duly ADOPTED. JULY 30, 1991 COUNCILWOMAN LATSON: Scott, could I just comment on the resolution coming up? I think it would be wise if we amended it, where it says to dredge navigation channel in Wunneweta Lagoon. According to the plan, it's at the entrance of Wunneweta Lagoon. Could we substitute those words? It makes it much clearer. TOWN CLERK -EERRY: I did what the County had suggested. you would like? COUNCILWOMAN LATSON: At the entrance. What are the words 9.-Moved by Councilman Penny, seconded by Justice Edwards, WHEREAS, the Town of Southold has requested the County of Suffolk to dredge a navigation channel at the entrance to Wunneweta Lagoon, Town of Southold; and WHEREAS, the County of Suffolk proposes to do said dredging of Wunneweta Lagoon, in the Town of Southold, at a nominal cost to the Town of Southold; and WHEREAS, in order to accomplish said dredging, plans, specifications, agreements and other documents must be executed on behalf of the Town of Southold; and WHEREAS, this approval shall remain in effect for the period of the required permits (Expiration Date: November 6, 2000); now, therefore, be it RESOLVED that the Supervisor be and he hereby is authorized to execute, on behalf of the Town of Southold, all necessary plans and specifications, spoil area agreements, assurances to the County of Suffolk, license and/or dredging permit applications to Federal and State Agencies and all other documents that may be required to accomplish said dredging work. 9.-Vote of the Town Board: Ayes: Councilman Wickham, Councilwoman Latson, Councilman Penny, Justice Edwards, ~upervisor Harris. This resolution was declared duly ADOPTED. SUPERVISOR HARRIS: We're extremely please anytime we can get the County of Suffolk in to do dredging, projects in the Town of Southold. It's a long arduous task, and with all the demands on the dredge it's good to have them there in, Town waters. · 10.-Moved by Supervisor Harris, seconded by Councilwoman Latson, it was RESOLVED that the Town Board of the Town of Southold hereby authorizes Insurance Consultant William F. Mullen, Jr. to seek proposals for the Town's 1992 ~nsurance Program. 10.-Vote of the Town Board: Ayes: Councilman Wickham, Councilwoman Latson, Councilman Penny, Justice Edwards, Supervisor Harris. He's name is James McMahon, and he has been the Community Development Director. Harris to execute the agreement between the Town of Southold and the North Fork Animal Welfare League, Inc., whereby the North Fork Animal Welfare League, Inc. will provide the Town with dog officer services and for pound or shelter services, for the period of August 1, 1991 through July 31, 1992, for the sum of $130,000.00, to be paid to the League in twelve equal monthly payments; said agreement to be in accordance with the approval of the Town Attorney. 24.-Vote of the Town Board: Ayes: Councilman Wickham, Councilwoman Latson, Councilman Penny, Justice Edwards, Supervisor Harris. JULY 30, 1991 39 SUPERVISOR HARRIS: At this time, are there any members of the audience that would like to discuss any matter with this Board, that they feel may be pertinent or informatiQnalto this body? Would you state your name, please, sir? WILLIAM ZOLDESSY: My name is William Zoldessy, and I live on Bergen Avenue in Mattituck, and I thank you very much for the refund. First I'll say as such the refund is immaterial. What I'm trying to prove is a point. At the beginning of the year I went down to the Hall. I got my beach and garbage permit, and a Southold beach permit. After a few weeks, upon presenting my Mrs. and myself at the Mattituck beach, where I live, I was denied access. I was told to get a Matti~.uck beach permit. Whereas, I found out from the office down the hall when the Mattituck Park Commission was meeting. Presented myself there, and they said a wrongful thing had taken place, because I was not notified at the time, that I would in the future have to get a Mattituck pass, and this wasn't worth two cents to me. That you gave me back my $5.00, I proved my point. In order to further correct this issue, I think I should be given for the rest of the season, authorization to present myself at the Mattituck beach, because up to now I've been illegally, immorally, and unlawfully denied access to the beach. SUPERVISOR HARRIS: Let me just elaborate a little bit on this. We have no prior knowledge of any park district within the Town of Southold, that is charging a fee for the use of that property. This Board is not privy to that, as it's a separate district, separate set of commissioners, that rule, and, also, tax basically the residents of that area. Our permits are for Town facilities, that we issue. We have no prior knowledge to what any district is doing beyond that. We were glad to refund this money because obviously you live in a park district area, and use that facility, not a Town owned facility, so we were glad to refund that money. As far as the further use of that facility up there, that's a park district matter. I assume you're talking about that piece of property, which we have absolutely no control over. There are a set of elected Commissioners, and I would suggest that you talk to them in reference to your request. WILLIAM ZOLDESSY: Thank you very much. Thank you all. You may have seen in the papers last week that the Town of Southold is advertising for volunteers to assist at the Cutchogue Landfill to explain to people the ins and outs, and details of sort, separation of their waste materials, and the recycling program. We are trying to attain the highest percentage possible in pursuit to our Solid Waste Management Plan. We are anxious to acheive very high rates of recycling, so we're looking for volunteers, who would like to help educate and explain the program to the various users of the Cutchogue Landfill, and I'm just mentioning this, so if you know of people who would like to do that through the summer months there is a procedure, and the applications will be received at the Town Clerk's Office.
