A Special Meeting of the SOUTHOLD TOWN ZONING BOARD OF APPEALS was held at the Southold Town Hall Annex, Second Floor Conference Room, 54375 Main Road at Youngs Avenue, Southold on Thursday, October 24, 2019 commencing at 5:00 P.M. Present were: Leslie Kanes Weisman, Chairperson Eric Dantes, Vice Chair Nick Planamento, Member Patricia Acampora, Member Robert Lehnert Kim E. Fuentes, Board Assistant Call to Order at 5:1OP.M. by Chairperson Weisman. EXECUTIVE SESSION: 5:10 P.M. Motion was offered by Chairperson Weisman, seconded by Member Dantes to enter into Executive Session. Vote of the Board: Ayes: Members Weisman, Dantes, Acampora, Planamento and Lehnert. This Resolution was duly adopted (5-0). a) Attorney advice b) Litigation 5:24 P.M. Motion was offered by Chairperson Weisman, seconded by Member Dantes to exit Executive Session. Vote of the Board: Ayes: Members Weisman, Dantes, Planamento, Acampora and Lehnert. This Resolution was duly adopted (5-0). Page 2—Minutes Special Meeting held October 24,2019 Southold Town Zoning Board of Appeals WORK SESSION: a) Requests from Board Members for future agenda items. b) Address concerns relating to the upcoming November 7, 2019 Meeting: The Enclaves Hotel & Restaurant Special Exception Application and Draft Environmental Impact Statement Public Hearings. c) Proposal from Noise Consultant to review DEIS of the Enclaves Hotel &Restaurant. There is no consensus at this time in favor of retaining an acoustics specialist pursuant to our consultant's (Carrie O'Farrell of Nelson Pope &Voorhis) recommendation and to agree to a service contract. The members will review the portion of the DEIS document (Exhibit J) that addresses noise impacts and prepare questions for the public hearing relating to their concerns. d) De Minimus Approval Request of Daley, #7099, for the demolition of the single family residence located at 1350 Paradise Point Road, Southold. The variance was originally approved as additions and alterations. Members reviewed and approved a draft letter to be mailed to the applicant's representatives. As part to the ZBA response, the applicant is required to make calculations demonstrating that the demolition that took place had not exceeded 50% of the market value of the original dwelling. POSSIBLE RESOLUTION TO CLOSE THE FOLLOWING HEARINGS: RICHARD AND SIOBHAN HANS #7320 —(Adjourned from October 10, 2019) Request for a Variance from Article III, Section 280-15 and the Building Inspector's April 2, 2019,Notice of Disapproval based on an application for a permit to legalize "as built" additions and alterations to an existing accessory garage; at, 1) less than the code required side yard setback of 10 feet; located at 2125 Pine Tree Road, (Adj. to Little Creek) Cutchogue, NY. SCTM No. 1000-98-1-13. BOARD RESOLUTION: A motion was offered by Chairperson Weisman, seconded by Member Planamento to CLOSE the hearing. Vote of the Board: Ayes: All. This Resolution was duly adopted (5-0). r RICHARD AND SIOBHAN HANS #7321 —(Adjourned from October 10, 2019) Request for an interpretation pursuant to Article III, Section 280-13(C); and the Building Inspector's April 2, 2019 Notice of Disapproval based on an application for a permit to legalize "as built" additions and alterations to an existing accessory garage, at; 1) as to whether "as-built" construction of finished space in an existing accessory garage is permitted accessory use; at: 2125 Pine Tree Road, (Adj. to Little Creek) Cutchogue, NY. SCTM No. 1000-98-1-13. BOARD RESOLUTION: A motion was offered by Chairperson Weisman, seconded by Member Acampora to CLOSE the Hearing. Vote of the Board: Ayes: All. This Resolution was duly adopted (5-0). Page 3—Minutes Special Meeting held October 24,2019 Southold Town Zoning Board of Appeals BRION LEWIS #7325 — (Adjourned from October 10, 2019) Request for Variances from Article III, Section 280-15; Article XXII, Section 280-116A(1); Article XXIII, Section 280- 124; and the Building Inspector's May 1, 2019, Amended May 31, 2019 Notice of Disapproval based on an application for a permit to construct additions and alterations to an "as built" accessory building, legalize an "as built" accessory garden shed and an accessory deck, and construct additions and alteration to an existing single family dwelling; at, 1) -accessory building located less than the code required front yard setback of 50 feet; 2) accessory building located less than the code required side yard setback of 15 feet; 3) "as built" accessory garden shed located less than the code required side yard setback of 15 feet; 4) "as built" accessory deck located less than the code required 100 feet from the top of the bluff; 5) single family dwelling located less than the required side yard setback of 20 feet; 6) single family dwelling located less than the required 100 feet from the top of the bluff; located at 62615 County Road 48, (Adj. to Long Island Sound) Greenport, NY, SCTM No. 1000-40- 1-8. BOARD RESOLUTION: A motion was offered by Chairperson Weisman, seconded by Member Lehnert to CLOSE the hearing. Vote of the Board: Ayes: All. This Resolution was duly adopted (5-0). DELIBERATIONS/POSSIBLE DECISIONS/RESOLUTIONS: The Board continued with agenda items, and commenced deliberations on the following application. Resolutions was duly adopted (5-0). RESOLUTIONS: RESOLUTION ADOPTED: Motion was offered by Chairperson Weisman, seconded by Member Acampora to authorize advertising of hearings for Regular Meeting to be held on November 7, 2019 which Regular Meeting will commence at 8:30 A.M., Town Meeting Hall, 53095 Main Road, Southold. Vote of the Board: Ayes: Members Weisman, Dantes, Planamento, Acampora and Lehnert. This Resolution was duly adopted (5-0). RESOLUTION ADOPTED: Motion was offered by Member Weisman, seconded by Member Acampora to approve minutes from October 10, 2019, Regular Meeting. Vote of the Board: Ayes: Members Weisman, Dantes, Planamento, Acampora and Lehnert. This Resolution was duly adopted (5-0).
