SETTING OF THE NEXT PLANNING BOARD MEETING
Vice-Chairman Rich: Good afternoon and welcome to the October 7, 2019 Planning
Board meeting. The first order of business is for the Board to set Monday, November 4,
2019 at 6:00 p.m. at the Southold Town Hall, Main Road, Southold, as the time and
place for the next regular Planning Board Meeting.

Extension of Time to Render Preliminary Plat Determinations/ Re-issue Final Plat
Determination:
Vice-Chairman Rich : Colton Acres Standard Subdivision —This Standard
Subdivision proposes to subdivide 4.24 acres into three 1.2-acre lots in the R-40 Zoning
District. This parcel is\located +/- 275' west of Gillette Drive in East Marion.
Pierce Rafferty:
WHEREAS, this Standard Subdivision proposes to subdivide 4.24 acres into three 1.2-
acre lots in the R-40 Zoning District, located on the south side of SR25 +/- 275' west of
Gillette Drive in East Marion; and
WHEREAS, the Southold Town Planning Board, pursuant to the Southold Town Code,
has 62 days to render a Preliminary Plat Determination after the Preliminary Plat Public
Hearing is closed; and
WHEREAS, on August 5, 2019, the Preliminary Plat Public Hearing was held and
closed; and
WHEREAS, Southold Town Planning Board and the applicant have mutually agreed to
extend the timeframe to render a Preliminary Plat Determination from October 7, 2019
to January 7, 2020; therefore be it
RESOLVED, that the timeframe to render a Preliminary Plat Determination for the
Colton Acres Standard Subdivision is hereby mutually extended from October 7,
2019 to January 7, 2020.

Vice-Chairman Rich: Liebert Standard Subdivision —This proposal is for the
standard subdivision of a 2.43-acre vacant lot into two 1.2-acre lots in the R-40 Zoning
District. This parcel is located on the east side of Hortons Lane, +/- 100' southeast of
the intersection with Jennings Road, in Southold.
Martin Sidor:
WHEREAS, this proposal is for the standard subdivision of a 2.43-acre vacant lot into
two lots, where Lot 1 equals 54,134 sq. ft. and Lot 2 equals 54,134 sq. ft. in the R-40
Zoning District; and
WHEREAS, the Southold Town Planning Board, pursuant to the Southold Town Code,
has 62 days to render a Preliminary Plat Determination after the Preliminary Plat Public
Hearing is closed; and
WHEREAS, on August 5, 2019, the Preliminary Plat Public Hearing was held and
closed; and
WHEREAS, Southold Town Planning Board and the applicant have mutually agreed to

Vice-Chairman Rich: RCC Sacred Heart—This proposal is for a standard subdivision
of 35.5 acres into two lots for the purpose of separating an existing cemetery from an
agricultural area, where Lot 1 = 24.65 acres of agricultural land, and Lot 2 = 10.86 acres
and contains the cemetery of the Roman Catholic Church of the Sacred Heart. In
addition, two lot lines of the adjacent parcel belonging to the Roman Catholic Church of
Our Lady of Ostrabama, SCTM#1000-96-5-12.2 (Lot 3), will be relocated to allow Lot 1
direct access to Depot Lane; the size of Lot 3 will remain at 7.17 acres. The property is
located in the AC Zoning District at 3450 Depot Lane, Cutchogue. SCTM#1000-96-5-
12.2 & 12.3.

WHEREAS,this proposal is for the standard subdivision of 35.5 acres (SCTM#1000-
96.-5-12.3) into two lots for the purpose of separating an existing cemetery from an
agricultural area. Proposed Lot 1 is 24.65 acres of agricultural land in contract for the
sale of Development Rights with Southold Town and proposed Lot 2 is 10.86 acres and
contains the cemetery of the Roman Catholic Church of the Sacred Heart. In addition,
two lot lines of the adjacent parcel belonging to the Roman Catholic Church of Our
Lady of Ostrabama, SCTM#1000-96-5-12.2 (Lot 3), will be relocated to allow Lot 1
direct access to Depot Lane. The size of Lot 3 will remain at 7.17 acres after the lot

WHEREAS, on January 8, 2018, the Southold Town Planning Board granted
Conditional Final Plat Approval upon the map entitled "Final Plat for Standard
Subdivision RCC Sacred Heart" prepared by John C. Ehlers, Land Surveyor, dated
November 10, 2017, with conditions; and
WHEREAS, the Planning Department coordinated with Land Preservation to correct a
discrepancy in the metes and bounds for the proposed right-of-way; and
WHEREAS, on February 21, 2018, the applicant provided a corrected Final,Plat and
mylars; and
WHEREAS, a lot line modification is proposed as a part of this application to provide
access to proposed Lot 1; and
WHEREAS, to allow the applicant to accomplish the condition in the original Conditional
Final Plat Approval to close on the sale of development rights to the Town on Lot 1, the
lot line modification needed to be completed; and
WHEREAS, to complete the lot line modification, the applicant needed to file the deeds
for the lot line changes with the Suffolk County Clerk's Office; and
WHEREAS, on September 10, 2018, the Planning Board granted an approval
resolution specifically for the Lot Line Modifications with the adjacent church, extended
the Conditional Final Plat Approval from July 8, 2018, to January 8, 2019, and added

the condition that the lot line modification be filed with the Suffolk County Clerk's Office
prior to Final Plat Approval being issued on the subdivision map; and
WHEREAS, on December 26, 2018, the applicant submitted a request by email for an
additional 6-month extension of the Conditional Final Plat Approval set to expire on
January 8, 2019, due to difficulty obtaining a revised survey to complete the remaining
conditions; and
WHEREAS, on January 14, 2019, the Planning Board granted an extension of the
Conditional Final Plat Approval with the following conditions;
1. Close on the sale of development rights with the Town of Southold.
2. File the covenants and restrictions, as approved by the Planning Board, with
the Suffolk County Clerk's Office.
WHEREAS, on April 8, 2019, Planning Board found that all conditions had been met,
and granted a Final Plat Approval upon the application; and
WHEREAS, on May 22, 2019, the subdivision map was rejected for filing by the Suffolk
County Clerk's Office, and the applicant was required to revise the near distance tie line
to be measured from Suffolk County Route 48 instead of the Long Island Railroad; and
WHEREAS, to be eligible to file with the Suffolk County Clerk's Office, the revised
subdivision map had to be re-stamped by the Southold Town Planning Board; and
WHEREAS, on October 7, 2019, the Planning Board reviewed the revised subdivision
map and found that there were no substantive changes from the subdivision map
approved previously; be it therefore
RESOLVED, that the Southold Town Planning Board hereby re-issues Final Plat
Approval upon the map entitled, "Final Plat for Standard Subdivision RCC Sacred
Heart", prepared by John C Ehlers, Land Surveyor, dated November 9, 2017 and last
revised June 13, 2019, and authorizes the Chairman to endorse the map.

SITE PLANS
Amended Determination:
Vice-Chairman Rich: Captain Reds Marine Sales Site Plan —This site plan is for the
proposed construction of a 3,680 sq. ft. metal building (ZBA file 7014) for storage (no
basement) where there exists a 1 -story 1,168 sq. ft. office building for boat sales,
storage, parking and display with 8 parking stalls on a General Business (B) and R-40
split zoned parcel totaling 1.6 acres. The property is located at 9605 Route 25
Mattituck. SCTM#1000-122-6-12. This resolution is to amend the site plan approval
granted on July 8, 2019.
Pierce Rafferty:
WHEREAS, this resolution and the amended conditions herein effectively replace the
conditional approval resolution dated July 8, 2019; and
WHEREAS, this site plan is for the proposed construction of a 3,680 sq. ft. metal

WHEREAS, on November 13, 2014, Michael Hughes,, owner, submitted a Site Plan
Application for review; and
WHEREAS, on November 17, 2014, the Planning Board found the application
incomplete for review and notified the applicant of information required to be submitted;
and
WHEREAS, a revised Notice of Disapproval was issued by the Building Department on
September 30, 2016; and
WHEREAS, the applicant obtained variance relief from the Zoning Board of Appeals on
April 28, 2017 and July 21, 2017 for a side yard setback and boat parking in the R-40
Zoning District; and
WHEREAS, on February 9, 2018, Karen Hoeg, authorized agent, submitted materials
for review; and
WHEREAS, on May 18, 2018, Karen Hoeg, authorized agent, submitted materials and
revised site plans for review; and
WHEREAS, on June 4, 2018, the Planning Board found the application incomplete for
review and notified the applicant of information required to be submitted; and

WHEREAS, on November 16, 2018, Karen Hoeg, authorized agent, submitted
materials and plans for review; and
WHEREAS, on December 3, 2018, the Planning Board found the application
incomplete for review and notified the applicant of information required to be submitted;
and
WHEREAS, on December 21, 2018, Karen Hoeg, authorized agent, submitted
materials and plans for review; and
WHEREAS, on January 24, 2019, Karen Hoeg, authorized agent, submitted materials
and plans for review; and ,
WHEREAS, on February 11, 2019, the Planning Board accepted the application as-
complete
s-complete for review; and
WHEREAS, on February 11, 2019, the Southold Town Planning Board, pursuant to
State Environmental Quality Review Act (SEQRA) 6 NYCRR, Part 617, determined that
the proposed action is an Unlisted Action as it does not meet any of the thresholds of a
Type I Action, nor does it meet any of the criteria on the Type II list of actions; and
WHEREAS, on March 1, 2019, the Planning Board, pursuant to Southold Town Code
§280-131 C., distributed the application to the required agencies for their comments;
and -
WHEREAS, the action is exempt from Suffolk County Planning Commission (SCPC)
review; and
WHEREAS, on March 1, 2019, the Southold Town Code Enforcement officer verified
that there were no open violations or`the subject parcel;
WHEREAS, on March 11, 2019, a Public Hearing was held and left open because it
was not properly noticed; and
WHEREAS, on March 14, 2019, the Architectural Review Committee reviewed the
proposed project and approved it as submitted; and
WHEREAS, on March 27, 2019, the Mattituck Fire District determined there was
adequate fire protection for the site; and
WHEREAS, on April 3, 2019, the Southold Town Fire Inspector reviewed and
determined that there was adequate fire protection and emergency access for the site;
and
WHEREAS, on April 8, 2019, a Public Hearing was continued and closed; and

WHEREAS, on April 29, 2019, the Southold Town Engineer reviewed the proposed
project and provided certain recommendations that were incorporated into the site plan
to ensure all drainage meets the minimum requirements of Chapter 236 for Storm
Water Management; and
WHEREAS, on April 29, 2019, the Town of Southold Local Waterfront Revitalization
Program Coordinator reviewed the proposed project and determined the project to be
consistent with Southold Town LWRP policies; and
WHEREAS, on May 6, 2019, the Southold Town Planning Board, as Lead Agency
pursuant to SEQRA, made a determination of non-significance for the proposed action
and granted a Negative Declaration; and
WHEREAS, on May 6, 2019, the Planning Board conducted a referral review and
required revised site plans and additional information; and
WHEREAS, on May 28, 2019, the Southold Town Chief Building Inspector reviewed
and certified the proposed Boat Sales as a permitted use in the General Business (B)
Zoning District pursuant,to ZBA file 7014 & SE4681; and
WHEREAS, on June 17, 2019, Karen Hoeg, authorized agent, submitted final site plans
and additional information as required; and
WHEREAS, on July 8, 2019, the Southold Town Planning Board determined that all
applicable requirements of the Site Plan Regulations, Article XXIV, §280 — Site Plan
Approval of the Town of Southold,, have been met; therefore be it
RESOLVED, that this resolution and the amended conditions herein effectively replace
the conditional approval resolution dated July 8, 2019.
Condition to be met prior to the issuance of a Building Permit:
1. All existing exterior signage circled on sheet 1 and 2 shall be removed from
the site;
Condition to be met prior to the issuance of a Certificate of Occupancy:
2. All exterior light fixtures proposed to remain on the property shall be made
compliant with Chapter 172 of the Southold Town Code or removed from
the site pursuant to the Planning Board letter dated October 4, 2019;
On-going Site Plan conditions:
3. This site plan is pursuant to ZBA file #7014 including eight (8) conditions;

4. This site plan is for an office building for boat sales, a metal storage
building, parking and display only;
5. The natural landscaped area in the rear of the parcel and along the east &
west property lines in the R-40 zone, shall be maintained as a natural
landscaped and/or vegetated buffer area as shown on the site plan;
6. The applicant must install 6 foot high solid fencing (stockade or similar)
along the entire perimeter of the property's code permitted side and rear
yards. No gates to adjacent properties are permitted. This fence is required
both as a condition of the ZBA (decision #7014) and to satisfy the transition
buffer requirement in Town Code;
7. No storage of boats, boat trailers, vehicles or equipment shall be permitted
in the easterly 15 foot side yard setback for the proposed storage building
granted herein. The 15 feet side yard setback must remain open and
unobstructed at all times;
8. No boats, trailers or other items are permitted to be displayed in the front
of the building, except in designated display areas as shown on the site
plan.
