Based upon the information provided on the LWRP Consistency Assessment Form submitted to this department, as well as the records available to me, it is my recommendation that the proposed action is INCONSISTENT with the below Policy Standards and therefore is INCONSISTENT with the LWRP 4.1 Minimize losses of human life and structures from flooding and erosion hazards. The following management measures to minimize losses of human life and structures from flooding and erosion hazards are suggested.- A. uggested.A. Minimize potential loss and damage by locating development and structures away from flooding and erosion hazards. 3. Move existing development and structures as far away from flooding and erosion hazards as practical. Maintaining existing development and structures in hazard areas may be warranted for: a. structures which functionally requires a location on the coast or in coastal waters. The single family dwelling does not require a location on the coast. b. water-dependent uses which cannot avoid exposure to hazards. The existing single family dwelling is not a water dependent use and the proposed action does further expose the structure to hazards. In 2013 the same property was issued a Wetland Permit to repair damage caused by tropical Storm Sandy. C. sites where relocation of an existing structure is not practical. There is ability to relocate the single family dwelling further landward on the parcel. It is recommended that the Board set back the structure to the greatest extent practicable. In the event the action is approved, it is recommended that the Board require the installation of a I/A OWTS due to the close proximity to surface waters. Pursuant to Chapter 268, the Board of Trustees shall consider this recommendation in preparing its written determination regarding the consistency of the proposed action. FINDINGS OF-FACT/•REASONS EOR BOARD ACTION: The,Zoning Board of Appeals held a public hearing on,this application on April 11,2019 at which time written and oral evidence were presented. As a result of a narrow, non-conforming building lot measuring 60 feet wide at the roadside and tapering to 50.94 feet wide at the waterside, any structure replacing the existing residence that is wider than approximately 16 feet will require relief. 3.
