along our many waterways~ or that should be purchased to retain open space, or for
future water supply purposes. The purchases could be either outright purcl~ases or
just the development rights similar to the farmland program. The Farmland Committee
would be willing to assume the extra duties associated with the program. Board agreed
this would be an extremely good program.

a very speciar resolution
and the Town Board wishes

very ~lood friend Council-'
Eddie; will you and Althea
do not get involved in as
far as the Police Department is concerned, but last week I was reviewing some of
the services that are provided and some of the grants we've received that are provided
to the community, and i felt it was very important in relation to not only positive
action of the Police Department, but also a positive action in serving the youth of
our community, so it-gives me a great deal of pleasure to read this 'resolution on
behalf of the Town Board.
Moved by Councilwoman Cochran, seconded by the Entire Town Board,

handed this to me to also present to you, so that's in:addition to the presentation.
And you can guess who gave it to me. Three guesses, Ed.
SUPERVISOR MURPHY: Eddie, why don't you just wait one second. I think our
very capable Chief of Police, Dan Winters, also has a proclamation.
CHIEF WINTERS: Thank you very much, Mr. Supervisor. I too have an award for
Ed, who certainly has given of himself and made the Juvenile~ Aide Bureau what it
was. "Spedal' Order, 87-1, 3 February., ',1.987.. The Following Member of this'Depart-

COUNCILWOMAN COCHRAN:' You wanted to say something?
SERGEANT SIDOR: I just realized that--well, those of you that know me, know
that I have a tendancy to start talking, so---I ~have a captive audience---any how,
I would just like to express my thanks to the present Town Board and some past
members, ex-members of the Town Board that I'm sure are not here tonight, for
their complete support and backing that I received. I feel that I've been successful,
or the programs have been very good, because of the fact that from all t~ese Town
Board members I have gotten their complete backing, never had a problem. They've
always gone along with whatever I've requested. I do appreciate that, and I'd also
FEBRUARY 3, 1987 ~ 4 8 9
like to mention that I'd like to thank the' Chief and the I~ieutenant from our depart-
ment for their trust and their:freedom?th;a~.---~hey gave me in' being able to establish
this; Without that freedom, without the trust, the free-hand that I did get, it would
have been very difficult to set up something when we started off.
SUPERVISOR MURPHY: Ed, thank you. You did a great job. Thank you for your
efforts; and ! know your successor, hopefully will learn from you equally as well.
Come on in Martin; This-is 'Martin Flatley who's going to take over Eddie"s job.
Good luck, Martin; Do as well. Thank you.
Io REPORTS.
SUPERVISOR MURPHY: ~oving on to reports. I would like to ask the Councilmen
if'they have anything report. 'i I'd.like to start off on my right with Councilman
Penny.
COUNCILMAN PENNY: Yes, thank you. On the 21st we had a meeting of the Kenny's
Beach Shoreline ErOsion Control Committee. It was a regularly scheduled monthly
meeting, and this 'is a committ~ee that we've established with members of the DEC and
that State and the County governments, and we're trying to rectify, or work out a
possible solution for a very severe erosion problem on the Sound. This'was a regular
meeting. We discussed the fact that we are addressing 13,000 'feet of shorelini~, and
' the tremendous costs involved with this: It'..becomes quite ~a figure when you figure
that You're going to be somewhere to do a good erosion control project, you.have to
be addressing somewhere between $300 and. :$900 a foot with structures and sand, and
so that is 'why we're applying to the State for funding and hoping to get a lot of these
costs off-set if'anything ever does go through. Just as a point of information, the
Coastal Erosion' Management Zone, the CEHA, the Coastal Erosion Haza'rds Act is going
to be up for review. There is not going to be a local meeting here in the Town Hall.
It wilF be in: Riverhead, and we should get a better clarifii:~tion of the dates in the
future, but it'~ tentatively set for 2:'00 P.M. in the Riverhead Town Hall on the ~19th
of March, and 7:00 P.M. at the County Center on the same day. On the 27th we met,
the Kenny's Beach Committee, and quite a few members from the Town Board, met
with the State representatives of the DEC, Russ Wege, Roman Rocozi; Jay Tanski from
Sea Grant was ~there, and Jean Gilman again: from the DEC, and we actually walked a
good portion of the shoreline between Duck Pond Point and Horton Point, just to give
the DEC people in' Albany. an idea of the ',severity of what we were talking about. They
agreed there was a problem, and that they witl: be asking for funding in the next
budget. Unfortunately this ~won't come into effect until 'next year, but we're still
hopeful that one of our other applications for funding will go through. On the ;~gth
we attended a meetincj of the DEC, it was a public'hearing, and there were about 20
representatives of the DEC here and a lot of people from the public; and it 'was an
open forum meeting,. It was very good. It gave us a chance to ask any questions
directly of the DEC. After the meeting we pigeon-holed some of the members of the
DEC because there's been' pressure on us to ack on the 1~J90' landfill' cut-off, and we're
hopefully going ~to be setting up a meeting with the DEC and with our consultant H2M,
because the DEC is pressuring us to move, move, move, and H2M is 'telling us to hold
back, don't rush, let's make sure we have all our ducks in order. So we fee! like as
a Town Board we're between two different factions here, and so we're going to iron
out these differences hopefully in a meeti:ng in:the very near future. On the 30th
I was down at the Scavenoer Waste Plant. Ir'was a regular routine visi't~ition with
Jim: Monsell and George D~smarais from H2M. We were discussing operating procedures
and setting up a calendar of routine maintenance. On the 2nd, which was last night,
there was another meeting here on the Local Waterfront Revitalization Procjram address-
ing the Coastal Zone Boundary. This was a meeting with the community to discuss
areas of concern of the public; We have funding from the State, about $30,000, I
believe, to prepare this study, and what our consultants, which is Szepatowsld, the
planners, are trying to find out is:they have concerns already from the Town Board
and they want to find out any more concerns of the community that they could address
in this-study, and then they're going to be proceeding with that forthwith. And that's
basically all. Thank you.
SUPERVISOR MURPHY: Jay?
COUNCILMAN SCHONDEBARE: Yes, thank you, Frank. There was a meeting of
the Code Committee, and we discussed an ordinance with regards to the regulation
of outside exhibitions. We discussed the bed and breakfast and accessory apartments.
Evidentially people are trying to have both the bed and breakfast, plus an accessory
apartment all in one family dwelling. We'll-discuss accessory structures that are on
front lines on waterfront property and the need to always go to the ZBA. We're trying
to straighten out that. We'll'discuss a concept of.the architectural review board for
the Town. It has been recommended. There is a--I think Dick Ward proposed one for
our perusal. And we'll'disCuss the Trustees' jurisdiction on Long Island Sound and
some of the questions that we have as to whether or not there, is such jurisdicl~ion.
There will be another meeting of the Code Committee. What i've done is to meet each
Wednesday--the first Wednesday of the month. There's so much work that's been
referred it that it's going to have to be an on-going basis. We have Chief Winters
with his alarm system. He's trying to correct some of the alarms that are tied up to
490
FEBRUARY 3, 1987
the police headquarters, and the false alarms that always go in~ He's recommended
an ordinance to us to have us enact it.: We'll vdiscuss that tomorrow night. Likewise
we'll discuss tomorrow night the Landmark Preservation Law. I guess that people in
the community become familia~ with it. It's quite encompassing and there's going to
be a lot of surprises for some people. This 'was submitted to the Code Committee by
the Landmark Preservation,Commission for our, review. And likewise we hopefully will
straighten out the permit 'process for having an outside fair~ carnival or bazaar. Thank
you, Frank.
SUPERVISOR MURPHY: Thank you, Jay. Paul?
COUNCILMAN STOUTENI3URGH: Well, we left out the very important one, the ~
Plan we all attended here on that snowy night in'which we cancelled our Master
~-~-~ing, of course, I .ho?e:everyone understands it's now February 11th. i also
attended the Erosion Committee in which we walked the beaches and saw ~some of the
problems that George has already spoken about. I attended the Farmland Committee
representing the Town Board there, and they are reviewing three farms to come under
their program. The Latham farm in'Orient, the Orville Terry farm out in'Orient, and
also the new one which has just come in to them, the Environmentais, which is~in~
Cutch0gue, the Jim Cross farm, and they're proceeding to review those farms to come
under their program. I was also at the DEC, the Code Committee, and the Waterfront
Revitalization Program, which you already heard about.
SUPERVISOR MURPHY: 'Thank you,' Paul. Jean?
COUNCILWOMAN COCHRAN: I think most of it-'-! also walked the beaches with Paul
and George. I also attended the DEC meetin9. I also attended the Waterfront Revital-
ization, and yoU've just been given a full report on those areas, so I will pass on to
Judge Edwards.
JUSTICE EDWARDS: I was also at the snowy Master Plan meeting, and the DEC
meeting, and I think the DEC as a group is:now going to come and visit the Town
and find out the problems that the people have. I.can say we on Fishers Island
are. extremely lucky because they've .been coming over there every summer at the
Town Father's Meeting, as long as i've been in-office anyway, and that's close to
five years, so we're lucky to have them come visit :us. Also there was some l~robl.ems
that I brought up. they're going to look into. This:past weekend the Fisl~ers'lsland ~1
Civic,Association had their'winter meeting. They meet four times a year and at thisli ~i!]
~~here were a good 30 people I th nk that came over. These ~e peopil~
that have homes on the Island, are. concerned with the Island. Live down i~!De]awa~?
New York, Boston, Hartford, and 30 of them braved the weathe~- and came d~n for
the meeting to make their desires known. We are also looking] forward to havincl:an
aquifer study don on the Island. We've got some good thoughts on that. ! brought
that up with the Town Board today. We have an economic committee on the Island
~hat's trying to also boost the economy of the Island. We're looking at the downward
enrollment of the school, and there's two things :that's causing that and the biggest
problem is 'the affordable housing. The kid§ on the Island--no way in the world can
they compete with the summer people when it 'comes to buying a house. So we have
similar problems that you have, only on the lsland,.only they're not on that big a
scale. All in' all it'~ been a busy couple of weeks. Thank you, Frank.
SUPERVISOR MURPHY:
busy.
I1. PUBLIC NOTICES.
SUPERVISOR MURPHY:
Thank you, Ray'. As you could see everybody's been quite
I'd.like to move on to the second item, the Public'Notices.
This again'is because of the storm, on our Master Plan. Wednesday, February 11th,
;1987, from 2:00 to 5:00, and 7:00 to 9:00 P.M. at the Southold Senior/Youth Rec Center
in Peconic~ This:a change. We will reconvene our Public"Hearing on the Lo~al Law to
Amend the Southold Town Code and Zoning Map. Postponed from January 22nd.
III. COMMUNICATIONS.
SUPERVISOR MURPHY: There is only one Communication, and it'S (from Paul A.
Caminiti, Esq.) on a traile:r permit request (Salvatore & Jeanne Catapan). Very
interesting reading.
V. RESOLUTIONS
SUPERVISOR MURPHY: I'd like to move on to Resolutions at this 'time and I'd lik~
to make a statement on the policy fo the Town Board that anyone who would like to
address the Town Board on a proposed resolution that is scheduled here may do so
at this :time. There will be, after the meeting, anybody can address the Town Board

any resolutions. So is there anyone on the left would like to address the Town Board
on a proposed resolution today? (No response.) In the middle? (No response.) Over
on the right? (No ,response.) If not we'll move on to the first resolution, and it's a
trailer permit renewal.
FEBRUARY 3, 1987
491
1. Moved by Councilwoman Cochran Councilman Penny, it was
RESOLVED that the application for renewal of his'single
family house trailer permit, for on the south side of private road,
off of the east side of Main Road, Mattitock, New York, which permit expires on
February 9, :1987:, be and hereby is ~tranted for a six (6) month period.
1.-Vote of the Town Board: Ayes: Councilman Penny., CouncilWoman Cochran, Council-
man Schondebare, Councilman Stouten. burgh, Justice Edwards, Supervisor Murphy.
This:resolution was declared duly ADOPTED.
SUPERVISOR MURPHY: Number 2 we're going to hold, waiting for the legal work
to be finished on it-(decisiOn on the petition of John A. Costello for a change of
zone from "M" Light Multiple Residence District to "AHD" Affordable Housing District
on property at Greenport}.---John, to bring up to' date, we're waiting for the
covenants and restrictions to go with that piece of property.
JOHN A. COSTELLO: You're holding this'resolution?
SUPERVISOR MURPHY: Yes. We haven't got the covenants and restrictions yet
on the p~ece of property for the zone change.
MR. COSTELLO: Am I out of order to comment?
COUNCILMAN SCHONDEBARE: Oh, no, go ahead, say what you want.
MR. COSTELLO: The reason I didn't comment when you asked for comments, was
because I thought it was up for a decisi'on. The covenants and restriction's that
were requested from the Town Planning Board on this 'property, they gave me a set-
off on it~ on the property going according to those covenants and restrictions. !
heard there was a possibility of a decision not being made. I just got off work and
I just typed up a letter agreeing to all those covenants and restrictions that the
Planning Board outlined. Also all those restrictions and covenants were indicated
on the site plan that was presented to the Town Board showing that half that parcel--
more than half the parcel was allocated to AHD and that was in the applicatiot~ too.
That the number of units were going to be equal--84' and 84, and the only other question
that the Planning Board wanted on it,: that if'we built' one.house on the "M" zone prop-
erty that they Would like to see us agree to build one on the affordable. I have an
agreement in' my pocket, absolutely. As a matter of fact you have to build the afford-
able ones because the prices are going, up faster than is 'allowed in: the AHD law. I
have a letter and I'll.give it :to--
SUPERVISOR MURPHY: This is just a legal point.
TOWN ATTORNEY TASKER: John,-your attorney will~have to get together with me.
You're attorney is going to have to draft a document embracing those covenants and
restrictions, adb then they will have to be executed and submitt'ed to us before we
act on the change of zone.
COUNCILMAN SCHONDEBARE: And filed in"the County Clerk's Office in:recordable
form. These are C & R's that everybody does on any subdivision of land that we
have.
MR. COSTELLO:
COUNCILMAN SCHONDEBARE:
MR. COSTELLO: My attorney?
COUNCILMAN SCHONDEBARE:
I would have been glad if:somebody had just requested---
Your attorney.
Yes o
SUPERVISOR MURPHY: You have the commitment from the Town Board on the
property. We're not stopping your progress on your development.
MR. COSTELLO: Well, the Planning Board can't do anything, because I can't address
anything under AHD which I don't have. i'm mean it'~s stopping it 'at that.
SUPERVISOR MURPHY: John, if:you could get them tomorrow, get them recorded,
it would be fine.
MR. COSTELLO: All you need them is recorded?
TOWN ATTORNEY TASKER: You're going to have to have them prepared and submit:
them for our approval, and when they're approved then they will' be ready to be
reco rd ed.
MR.Board'COSTELLO:recommendedThe? only items that you're interested in is the ones that the Planning
COUNCILMAN SCHONDEBARE: Yes, we're not adding anything.
SUPERVISOR MURPHY: We're not asking anything new.
MR. COSTELLO: Just those three items?
SUPERVISOR MURPHY: Yes.
MR. COSTELLO: Because I don't want to start drafting this:up if'it'~ notthe proper
three items. I can agree to it in'a letter.
TOWN ATTORNEY TASKER: You can't do lt.:by letter. You have to do it 'by a ~
dOcument, which has to be in recordable form, which means it 'has to be acknowledge{i! !!~il
L, ke a deed, ano be recorded, and runs with the lai,u, its a ,~tdu bl~ mole ~u,,,,~, ;~.~
than just a letter.
MR. COSTELLO: it has to be recorded. I know. Do I have to record it?
TOWN ATTORNEY TASKER: You have to submit 'it to us and if'you will have your
attorney do it :and submit it I will"get together with him' and go over it."
MR. COSTELLO~~ My question to you is: the covenants and restricl~ions that you're
interested in are itemize~l in a letter, October 7th, that's it?
COUNCILWOMAN COCHRAN: The one with the recommendations from the Planning
Board,
SUPERVISOR MURPHY: I would suggest that you and your attorney sit down with
Mr. Tasker as soon as you can.
,TOWN ATTORNEY TASKER: Basically speaking, as I understand it,' John, and this
comes from a recommendation of the Planning Board, I believe, that what you have--
you have a piece of property, I believe, which was something like 50 acres--
MR.. COSTE1.LO: Forty-eight point---
TOWN ATTORNEY TASKER: Forty-eight point something--let's say for the sake of
discussion you have 50 acres. You could have, under the Affordable Housing, appl~
for the whole 50 acres as affordable housing, in'which event under the Affordable
Housing Law it :provides that one-half of all of the units must be affordable housing.
You propose an alternative to that. To take half.of the property and have 100% .of
those parcels Affordable Housing. Now, since this 'will' be different than the Code,
different than the requirements, we will have to have a covenant whereby you agree
to do this, which will follow the land and run with the land. That's one. The second
one was the idea that the affordable housing section will have to be built and developed
at the same speed as the townhouse section. In other words, you couldn't built all
the townhouses in the western section and then abandon the affordable housing. So
that would have to be a restrictive covenant, and that's kind of outlined in a letter
to you of October 7th of 1986 from the Planning Board. That's where we picked it
up, I think.
MR. COSTELLO: Right.
TOWN ATTORNEY TASKER: Now, we discussed it ;at the Work Session this'afternoon,
and I asked the Town Board if 'there are any other items or matters that should be
addressed in a Declaration of Restrictive Covenants. ! don't know whether the Planning
Board has any. Do you know whether they have required any others ?
MR. COSTELLO: They haven't required of. me, no. Does the Town Board require
any more? I Wasn't at the Work Session. I didn't know it was going to be.
COUNCILMAN SCHONDEBARE: We did:not come up with anything else that was
req u i red.
COUNCILWOMAN COCHRAN: Just the three from the Planning Board.
COUNCILMAN SCHONDEBARE: And we asked were the covenants and restrictions
submitted to us? And we went down to the Planning Board, because we didn't have
them, and the Planning Board said they didn't have them. Nobody had them. You
didn't do it;' but you didn't know you had to do it.
MR. COSTELLO: Every item on there, as you can see ....
COUNCILMAN SCHONDEBARE: It's got to be in legal form.
MR. COSTELLO: You'll have it,' gentlemen.
SUPERVISOR MURPHY: Thank you. Okay, resolution number 3 is to accept a
orooosal,
