Wilhelm DMW:cd 200 Howell Avenue over ea , New York 11901— (631)727-3 Ext. 260 — Fax (631)208-4034 11.30 10.02.2019 ADOPTED TOWN OF RIVERHEAD Resolution 2019-751 ASSUMES LEAD AGENCY AND ADOPTS A LOCAL LAW TO AMEND CHAPTER 225; ENVIRONMENTAL QUALITY REVIEW OF THE RIVERHEAD TOWN CODE REGARDING THE SEQRA DESIGNATION OF DEVELOPMENT THAT REQUIRE LESS THAN 50 PARKING SPACES Councilwoman Giglio offered the following resolution, - which was seconded by Councilman Hubbard WHEREAS, the Town Clerk was authorized to publish and post a public notice to hear all interested persons to consider a local law to amend Chapter 225 of the Riverhead Town Code entitled, "Environmental Quality Review; " and WHEREAS, by Resolution 2019-529, the Town Board of the Town of Riverhead adopted a resolution on July 2, 2019 classifying the proposed amendment to the Town Code as a Type I action pursuant to SEQRA part 617.4(b)(2) and authorized the Riverhead Planning Department to circulate a request to involved agencies to determine their interest in assuming lead agency; and WHEREAS, the Suffolk County Planning Commission received the SEQRA coordination request on July 5, 2019 and has no objection to the Town of Riverhead assuming lead agency; and WHEREAS, no other involved agency desired to be lead agency; and WHEREAS, a public hearing was held on the 20th day of August 2019 and at Riverhead Town Hall, 200 Howell Avenue, Riverhead, New York, the date, time, and place specified in said public notice, and all persons wishing to be heard were heard; and WHEREAS, the public hearing was closed on the 20th day of August 2019 with a ten (10) written comment period. NOW, THEREFORE, BE IT RESOLVED, the Town of Riverhead Town Board assumes lead agency status pursuant to SEQRA; and be it further RESOLVED, that a local law to consider an amendment to Chapter 225 entitled, "Environmental Quality Review" of the Town Code of the Town of Riverhead is hereby adopted as specified in the attached notice of adoption; and be it further RESOLVED, that the Town Clerk is hereby authorized to publish the attached notice of adoption once in the News-Review Newspaper and to post same on the signboard at Town Hall; and be it further Packet Pg. 130 RESOLVED, that all Town Hall Departments may review and obtain a copy of 11.30 this resolution from the electronic storage device and, if needed, a copy of same may be obtained from the Office of the Town Clerk.
