SOUTHOLD TOWN BOARD

WORK SESSION
Present: Supervisor Francis J. Murphy, Justice Raymond W. Edwards, Coundlman
Paul Stoutenburgh, Councilwoman Jean W. Cochran, Councilman George L. Penny IV,
Town Clerk Judith T. Terry, Town Attorney Robert W. Tasker- (10;20 a.m.).
9:15 A.M. - Community Development Administrator James C. McMahon met with the
Board to discuss recent communication from the NYS-DEC, Division of Marine Re~t;rces~
concerning their:proposed waterfront access plan to meet the needs of the state's
marine recreational fishermen. The Board discussed possible locations within:the
Town which might be approprial~e for cooperative development as a marine recreational
fishing site or small boat launching ramp, as well as existing sites that need enlarge-
ment or rehabilitation which may be considered.---Mr. McMahon also outlined a Youth
Services program being developed for peer counseling at the Mattituck School, and
after development to be in§tituted in'-the other schools within the Town.
9:30 A.M. - Recreation Director Susan Fossett met. with the. Board and along with
Councilwoman Cochran outlined a proposal to develop an Advisory Committee for the
Recreation Programs consisting of one youth and one staff member from each of the
schools within:the Town.--Also discussed was the Friday night Youth Services dance
program at the Senior/Youth Center which seemed to work out quit~ well. The
structured programs seem to be the most successful.
9:45 A.M. - Chris Chardt, representing Clean Air:Filter Smoke Master Electronic
Air;Cleaners met with the Board to discuss the possible installation within the Town
Hall. Since there has been a problem with the quality of the air in the Accounting
and Finance Department, the Board agreed to the immediate installation of one of
the units in that area (see resolution no. 19).
10:05 A.M. - George Desmarais, P.E., Holzmacher, McLendon ~; Murrell, P.C., met
with the Board, and along with Councilman Penny, discussed the proposed reconstructio~
of the discharge ramp at the Scavenger Waste Plant, Greenport. Mr. Desmarais stated
the incline of the ramp is insufficient to fully pump the trucks, and although longer
elimination hoses were tried, the problem could not be solved. H2M then redesigned
the ramp and submitt'ed plans to the Town. It was decided H2M should prepare the
bid package, which they will do at no charge to the Town, and make inspections of
the construction at a nominal charge (see resolution no. 18). Councilman PennydJs~us'se
a recent meeting with Greenport Village Superintendent of Utilities James Monsell (also
in:attendence at this work session) to review the Scavenger Waste Plant site, and at
that time found the cost of certain work being done on the proposed discharge ramp
will:exceed the limitation, thus resulting in the need to go to bid. When the entire
design was reviewed it was found the cost will probably be $17,000. He also related
his meeting with Mr. Monsell and Greenport Village accountant relative to billing
charges. Mr. Monsell will further review the billings and discuss them further with
Councilman Penny;
10:45 A.M. - For discussion items: (1) Southampton Town resolution requesting
legislation limiting municipal liability. This was adopted by the Town Board at their
January 6th meeting. (2) Draft Amendment to the Highway Specifications with
respect to minor subdivisions. This will be reviewed by Town Attorney Tasker.
{3) Amending the term of office for the members of the Board of Assessment Review
(see resolution no. 23). (4) Proposed creation of the 1987 Labor Management
Committee to meet with the CSEA (see resolution no. 20). (5) Possible decision
on the Zehner (formerly Southport) change of zone petition. A letter was received
from Mr. Zehner's attorney Marie'Ongioni requesting the Town Board to defer a
decision in the matter until such time as the proposed Southold Master Plan has been
resolved. Board agreed to hold. (6) Appoints expiring on the Southold Town Farm-
land Committee, and the Board will advertise for resumes (see resolution no. 21).
(7) Discussed SEQR review fees with respect to the fees set forth in the Southold
Town Code and the SEQR Handbook. Board will request Planner David Emilita to

meet with them on February 3rd to discuss this further. (8) Letter from NYS-DEC
with respect to the proposed waterfront access plan for marine recreational fishermen.
This was discussed at 9:15 A.M. with Community Development Administrator James C.
McMahon. (9) Letter from Utica Mutual Insurance Company requesting additional
premium for years 83-84-85. The Director of Credit and Collections will be ask to
meet with the Board'at his:earliest convenience. (10) Letter from the Suffolk County
Department of Civil Service advising there are 31 names on the eligible list for Build-
Inspector, and current provisional Building Inspector Angelo Accardo did not pass the
test and the Town should request an extension of his appointment. Supervisor Murphy
will'make the request. (11) Application of Salvatore Catapano, Sr. for a night watch-
man trailer permit was reviewed (see resolution no. 22). (12) Suffolk County Depart-
ment of Civil Service Certifii:ation of Eligibles for Account Clerk has been received.
The three individuals appearing on the lisl~ will be intervieWed. (13) Request fromr,~
the Board of Appeals for permission for Chairman Goehringer and Secretary Kowalsk!~, !i
to ~_ttend the Associatior~ of Towns meetings or~. Fel~ruary 17th with their :expenses ~il i~1
be paid by the Town (see resolution no. 16-b). (14) Recreation Commitl:ee report '~
was discussed at; 9:30 a.m. with Councilwoman Cochran and Recreation Director Fos~ett.
(15) Letter from the Southold Town Planning Board recommending the refund of
$16,006.00 to the developers of Harbor View at Mattituck, which amount represents
the inspection fee for the water system for the subdivision, which will not be inspect-
ed by the Town Inspector. Supervisor Murphy will discuss this'with the Board of
Health to determine who makes the inspections and what portion would be the Town's
responsi bi lity.
12:30 P.M. - Recess for lunch.
EXECUTIVE SESSION
2:00 P.M. - The Board met with attorney Pierre Lundberg to discuss engaging his
services with respect to closing out the contracts with the DEC for the Scavenger
Waste Plant. , , ,
2:45 P.M. - Councilman Penny reported on the Dog Pound kennel system construction
problems.
2:55 P.M. - Board reviewed regular meeting agenda resolutions,
3:05 P.M. - Phil Obenauer, NYS-DEC Conservation Officer, met with the Board to
discuss enforcement of the rules and regulations with respect to Laurel Lake. Mr.
Obenauer advised the Board that, as the Board knows, the Town and the S~te haw
a Cooperative Agreement for a Laurel Lake Fishing Access site. The T,o~n':l~operty
is totally restricted - no trespassing. The State portion is a trail entry for boat
launching and fishing only. The State annually stocks Laurel Lake with fish and.
cleans the garbage from the area. Officer Obenauer is forced to issue tickets to
individuals swimming, picnicing, loitering. The State law is quite specific'and is
only for boat launching and fishing. The Board found they were not fully aware
of all of the restrictions and thanked Mr. Obenauer to clarifying the law.

SUPERVISOR MURPHY: Okay, at this time I'd like to offer a special resolution
before we go into the regular part of the meeting and l'd like to ask Bob Constanza
to come up and I'd like to read this resolution and then present it to him as one
of the many representatives.
Moved by Supervisor Murphy, seconded by the Entire Town Board,
WHEREAS, parents and community members are concerned about the alarming increase
in drug and a~-cohol use among our youth and social acceptability of this use; and
WHEREAS, young people must be able to feel that it is O.K. not to participate in the
use of drugs or alcohol; and
WHEREAS, it is '-time for parents and community members to take a stand and stop
parties with alcohol and drugs from flourishing in our communities...with and without
adult supervision; and
WHEREAS. it is time that parents and community members join-the SAFE HO~I~S program
homes safe from drugs...safe from alcohol...safe for teenage parties; now, t~erefore,
be it
RESOLVED that it is time for parents and community members to endorse the SAFF
HOMES pro~lram by signing the following pledge:
SAFE HOMES PLEDGE
* I Will'not allow parties or gatherings in my home when l~m not present.
* I will not serve nor will I allow youth under the legal drinking age to consume
alcohol in my home or on my property.
* I will not allow the use of illegal drugs in my home or on my property.
AND BE IT FURTHER RESOLVED that the Town Board of the Town of Southold
wholeheartedly endorses the SAFE HOMES program and urges parents and community
members in the Town of Southold to join the SAFE HOMES program; a program where
parents feel comfortable having their teenagers visit a SAFE HOME for parties and
gatherings; a program where SAFE HOMES parents and participants have access to a
list of other SAFE HOMES parents supporting this :concept; and where SAFE NOMES
parents get the message to children that PARENTS are IN CHARGE and taking the
initiative to deal with the problems of alcohol and drug use by their teens.

M~R. CONSTANZA: Thank you, sir~ Thank you very much. May I just ask to have
the local representatives come forward and have their picture taken? We have every
representative from all the North Fork Schools. It's a total North Fork effort that we
have.
SUPERVISOR MURPHY: Thank you, Bob. Keep up the good work. It's always very
good to see people trying to help other people and I'm sure echoing the sentiments of
the 'entire-Town Board we appreciate it.'

SUPERVISOR MURPHY: Moving on to the first item on the agenda are reports. Th~

8. Councilmen's reports. I would like to ask the Councilmen if they have
anything speda! to report, starting on my right with George Penny.
COUNCILMAN PENNY: Yes, we started off New Years with a bang. We had our
first complaint at 1:30 in'the morning. I got a phone call and we had dogs barking
all night down at the Dog Pound, and what had happened is the police had locked up
and animal there overnight and there was one other dog there that was able to get
out in his run and as many of you may or may not know, we've been working to keep
the animals enclosed in the building. Those two dogs raised such a ruckus ail night
long, and I hate to blame things on the police, but we immediately have worked on
getting a new procedure for animals that get dragged in'after the place is closed.
Everything else seems to be working pretty good down there. On the 12th and then
again on last Friday I was down at the Scavenger Waste Plant that we have in
Greenport, and we are running very well down there. We've had a few problems,
a few complications that you've read about in the papers, but we've ironed out most ~
of our problems and everything seems to be working. We were concerned tha~ there!~.
were originally stories that the ptant was underdesigned and we've got a report now
which shows that we're treating 8500 gallons on a daily average, so it's well-ur~der
the capacity that the plant is designed for and everything is functioning very well.
On the 16th I also met with the Village of Greenport to reconcile some bills for the
Scavenger Waste Plant, and on the 16th again a meeting of the Water Advisory
Committee which i'm sure that Paul will' report on. Thank you.
SUPERVISOR MURPHY: Jay?
COUNCILMAN SCHONDEBARE: Yes, I think George forgot to mention that he also
was with the rest of us, I believe, in doing the interviews for the Accountant that
we plan to hire for downstairs. We need one. As well as he was there along with
the rest of us for doing the interviews for a Town Planner that we plan to hire.
We've sort of narrowed down the Town Planner to three and the Accountant we
narrowed down to one. We had a second meeting with the Accountant and basically
we're waiting for references, resumes and some authorizations for his 'prior employ-
ment records to come through before we can finalize' it, so we've been moving along
in that area, hoping we can get these people on board rather shortly. We did have
a Housinq Committee meeting. Basically we did something different. We've never
done it 'before, I don't believe. Jim McMahon asked us to do it. He gets a lot of
people with proposals for different development projects before him~. He feels that
he's not capable to speak on behalf of the Town Board or the Town Planning Board,
and he asked us that perhaps as a means of streamlining .the procedure, instead of
a developer coming through and going through the whole process of submitting an
application to the Town Board and then submitting an application to the Planning
Board that perhaps if he sits down with members of the Housing Committee, which
consists of Town Board members and a member of the Planning Board, we can give
an indication to that individual as to whether or not the project he proposes is going
to fly, of if 'it'S so far off the wall that it's not going to work. We did this on one
occasion. We met with the developer, he gave his proposal, we discussed it 'for quite
some time and the end result was we recommended to him - don't bother, don't waste
his time. He was very appreciative of the fact that he got some input. He didn't
have a lot of expenses. He didn't go through the whole process and he was able to
go back and rethink his ideas. So perhaps it's something that we're going to consider
for the future to cut down on the paperwork of the Planning Board, cut down on the
paperwork of the Town Board, and cut down the paperwork of the ZBA, which is a
good idea. That's about it, Frank.
SUPERVISOR MURPHY: Thank you, Jay. Paul?

COUNCILMAN STOUTENBURGH: -Ye~,'~F~-an'k, I also was sitting in on these interviews
of the Accountant and the Planner, and Jean and I both visited a pie~:e of property
down in Bay View that is possibly going to be passed on to the Town if we feel it's
worthy of it. This is going to take a little investigating and we're going to pursue
that further tomorrow. We had a Water Advisory Committee in which the members
are working hard towards a Water t~lanagement Plan for this 'Town. We're making
real progress. I think the last meeting was one of our most successful and yet we
have some very difficult decisions to overcome as to how public water is to be used
in our Town, but I think we're all trying desparately to get this thing going. We
have Bob Villa, who is one of the top people in the Health Department, on our
Committee and he is going to try to see if he can get some overlay maps giving the
water contours and water divide lines on our Land Use Map, and hopefully weql have
this for our Planning Department and also the Water Advisory Committee to be used
in the future. That's about it, Frank.
SUPERVISOR MURPHY: Thank you, Paul. Jean?
COUNCILWOMAN COCHRAN: Yes, on Wednesday, January 7th I attended the Landmark
Preservation Committee. One of the things they're beginning to become excited about
is that 1:990 Southold will' be celebrating its 350th year and they have had word from
Sr. Arnold Demontmorency of Southwold, England, who will be visi'ting Southold in the
summer during 1990. In addition plans were made for a work session so they-can
finalize their draft in relation to a Preservation Landmark Ordinance that they will be
presented to the Code Committee, and Jay, I didn't have the opportunity to ask you,
have you received anything from them yet?
COUNCILMAN SCHONDEBARE: No, that's one of the things George has reminded me.
! didn't report on the--just let me get it on the record. The Code Committee supposedly
was going to do the draft of the proposed Landmark Preservation Law and I've been
advised by yourself that the Landmark Preservation Committee is going to draw up their
own draft and then refer it 'to the Code Committ:ee and at the present time the Code
Committee has not receiv;~d anything.
COUNCILWOMAN COCHRAN: All right then I'll check on that. Thank you. ~ haven't
heard any word. I told them that when they finished it to drop it into Judy's office
and then it would be made available to your committee. All right, I'll finalize' on that.
I'll talk to you later on that. Also in attendance was our newly appointed Commissioner
Joseph Townsend, and our newly appointed Town Historiafl Toni Booth, so it gave us
all the opportunity to get to know one another a little better. Also on the 7th during
the day I traveled to Lebanon, Connecticut with Supervisor Murphy and Councilman
Paul Stoutenburgh, myself and Ray Jacobs, Superintendent of Highways, and Vic
Lessard from the Building Department. We had the opportunity to tour the Earth
Glow facility which is :located in Lebanon. It's a composting operation and it~man->,
interesting aspects in addition to seeing composting from beginning to the end and
putting it 'into the bags and shipping it out to market. They have quite a market
with Flowertime and they have entered into some large contracts in building their
facility for composting from different industries. It was interesting to note that the
compost that they send to Long Island, through the bagging it's the same thing in
the bag, but they're labeled differently. Some are labeled topsoil,: some are labeled
manure, and on Long Island the people do not prefer it :labeled manure, so Long Island
gets a label with topsoil on it, which I found interesting. On January 9th I did' attend
a retirement dinner for Joan Richter. As many of you know she has retired from our
staff iN-the Accounting Department, and once again I'd like to wish her health and
happiness in-her retirement. On the 12th the Recreation Committee met and under
disCussion was the development of a Youth Advisory Board to the Recreation Depart-
ment, and it was recommended to the Board today that a student and a staff member
from each school be appointed on this Advisory Board to serve, which will afford us
the opportunity to begin to build better lines of communication and coordination of
recreation between what the Town provides and what the school provides. Also a
program that's being developed under the Recreation Program, which I'm very pleased
about, and I'm sure Councilman Stoutenburgh is also, he's a member of the committee,
is it's a part of the Make a Friend Program, and the one that our Recreation Director
is developing is called Trim and Trot, and this is a physical fitness program for the
developmentally disabled, and Dr. Parnell Searle will be the instructor on the site.
So this is an exciting program for some of our young people. Paul reported on the
meeting which we had in relation to the Plock property, and in between as you've
heard from Councilman Schondebare we've been interviewing Accounts and Town
Planners. That's it. Thank you, Frank.
SUPERVISOR MURPHY: Thank you, Jean. Judge Edwards?
JUSTICE EDWARDS: Well, December 30th was my last meeting in here. I missed
last two weeks ago. On the 31st I flew out for a little vacation out to Los Angeles
way. I saw the Rose Bowl Parade with my daughter and son-in-law and my wife,
It was very, very enjoyable. Beautiful weather, and then three days of rain, and
then it turned into the 70's and stayed there until ] came back to this mess. All
in all it was a nice vacation out there. I've had the opportunity to visit some of

the South Los Angeles ~inerie$. We spent a whole sun'lay touring the area. Some
of them are just starting out as they are here on the North Fork. There's others
that have been in operation for ten years or so. Very, very interesting. Some of
the same concepts that you have here.- Very little commercialism. ! mean there is
no restaurants involved with them. They do have cheese and bread and sausage
and so forth. They have beautifbl picnic areas we can go and look at the mountain
and watch the world go by. And it was very, very nicely presented in the various
wineries that we did~go to. As far as Fishers Island is concerned, I've only been
there a half a day since I got back, so I know it'~ floating, but there's no news
from the Island. Thank you, Frank.
SUPERVISOR MURPHY: Thank you, Ray. I'd just like to add that at the beginning
of the year I spoke representing the Town with the League of Women Voters on cjarb~l

trying to come up with a recycling law also. Unfortunately it's not going [o De lUSt me
efforts of the Town or the County, it's going to have to be the State getting ~nvo~ved
in this most important program to reduce volume. So I'll give this to Judy. ("Petition
For A Recycling Program" on file~ in the Town Clerk's office.) I'd just like to add
what the other members said~ It's been very busy. Last night Paul and 1 attended
a very nice ceremony in honor of the memory of Dr. Martin Luther King at the
Greenport High School. It was very well done and very nice.
II. PUBLIC NOTICES.
SUPERVISOR MURPHY: Moving on to the second item on the agenda is Public Notices.
1. From the New York State Energy office advising of a series of training
seminars to assist the design professions, the building industry and local code officials.
2. State of New York, Public Service Commission on rates, Charges, rules and
regulations of Long Island Lighting Company for electric service. Public statement
hearing February 17, 1987, 2:00 P.M., Suffolk County Center, Riverhead.
3. New York state Department of Environmental Conservation will' be hold a very
important Town meeting at Southold, 7:00 P.M. on January 29th, Suuthold Town Hall.
4. Notice of Public Hearing on a proposed "Local Law to Amend Southofd Town
Code and Zoning Map, as recommended in' the Master Plan"· This is very important
for everybody to come out and let the Town Board know what your opinion of the
Master Plan is and any suggestions. It will be this Thursday, January 22nd, Southold
Town Hall, from 2:00 to 5:00 P.M. and 7:00 to 9:00 P.M. right here. Again, i~s thi~

IIio COMMUNICATIONS.
SUPERVISOR MURPHY: There's one communication from Donald E. FeHer~ recommend-
ing the Town of Southold wait and use the suffolk County Energy Master Plan for their
Power and Energy audit. He's our member on the Suffolk County Solar Energy Commiss-
ion.
IV. PUBLIC HEARING.
SUPERVISOR MURPHY: There is one public hearing scheduled at 8:00 o'clock (petitiOn
of John A. Costello for a change of zone from "M" Light Multiple Residence District ~o
"AHD" Affordable Housing District).
V. RESOLUTIONS.
SUPERVISOR MURPHY: We'll move on to Resolutions. We set a policy several months
ago and anyone is allowed to speak and address the Town Board on any items on the
resolutions. If anyone has any comments, please let us know now. If it's on any other
matter there will be a time set aside after the regular Town Board meeting for the public
to address the Town Board on any matter. So, is there anyone here who would like to
address the Town Board on any of the proposed resolutions that's on your agenda here
