Tasker. 9:15 'A.M. - Community Development Administrator James McMahon diseussed with the Board the possible donation of the,. hatchery', portion of the Plock property, near Reydon Shores, SOuthold, to the Town. The Board will'meet with Mr. Plock in'the near future to discuss the donation. Mr. McMahon also discussed the draft proposal for the 1987 Community Development budget.---Supervisor Murphy reviewed with the Board the proposed zoning of the Plock property with respect to that of the Dunn property adjoining it. The Board determined that the R-40 designation was only on the Ploci< property and they are unwilling to consider any other changes to the proposed zoning map - hearing to be held on January 22'nd.--T,he Board discussed at length suggestion of Supervisor MUrphy to go ah_e.zad with the Environmental Assessment and then go out for requests for proposals for the Landfill project. Board discussed pros and cons and decided they should meet witl~ the DEC for further direction. Councilman Penny ex- pressed his opinion the Board should wait :for the results from the weighing station before proceeding any further. 10:05 A.M. - Board' met with Val Stype, Jr., Stype Insurance, to discuss.their insurance proposal and review certain options. At the conclusion of the review, Mr. Stype agreed to submit 'a lisl~ of the changes made during this 'meeting and agreed upon by the Board. 11:35 A.M. - Garrett Strand, Architect, met with the Board to discuss the recent problems encountered with respect to the cesspool locations at the Dog Pound kennel construction site. He will' contact the '.contractor Richard Saetta to'prepare a change order in an amount not to exceed $500 (see resolution no. 14). 11:45 A.M. - Board revieWed Regular Meeting r:esolutions, and off agenda items: Deferred Compensation - will seek other proposals; reappointment of William Weiheimer to the Board of Assessment Review (see resolution no. 17)'; letter from Thomas Cramer relative to cost for SEQR review. Board to review further; possibility of meeting with Commissioners of the Fishers Island Garbage & Refuse Distric~ on January 20th - Town to pay travel expense (see resolution no. 19); 12:15 P.M. - Recess for lunch. 1:15 P.M. - Councilmen Schondebare, Cochran, Penny, and Community Development Administrator McMahon met with Diane Carroll and Donald Bracken, contractors for the Coste]lo property at Moore's. Lane and Route 48, Greenport, to diseuss possible federal or state funding, and clarifii:ation of some of the procedures set forth in'-the Affordable Housing Law. 2:15 P.M. - Work Session adjourned. Moving on to the first order of business is a resolution setting the next meeting date for January 20th, ',1987', 7:30 P.M., Southold Town Hail. Moved by Councilwoman Cochran, seconded by Councilman Schondebare, it was RESOLVED that the next regular meeting of the Southold Town Board will' be held at 7:30 P.M., Tuesday, January 20, 1987, at the Southold Town Ha'It, Main Road, Southotd, New York. CouncilmenJs reports. I'd lik~ to ask the Councilmen at this time if anything special to report, starting on my right. George? COUNCILMAN PENNY: [ attended my first committee meeting last night, being the Water Advisory Committ'ee, and I'm-sure the chairman, Paul Stoutenburgh, will be reporting on that. 'Thank you. SUPERVISOR MURPHY: Jay? COUNCILMAN SCHONDEBARE: Nothing, Frank. Thank you. SUPERVISOR M~RPHY: Paul? COUNCILMAN STOUTENBURGH: I will report on that Water Advisory meeting that we both attended. It was kind of revealing because Joe 13aier, who is not a member of that, but part of:our committee in'the sense of bringing in'material' to us, he's sort of our representative that gives us the offici'al standing of the Health Department. He brought in some figures that were rather startling. Seventeen percent of the wells, private wells in our Town, are contaminated with Nitrates. And there are 13% more that have Nitrates in:them, giving almost a total of 30% of our wells having Nitrates in them. Which gives you some idea of the contamination just from Nitrates. Then Aldecarb, which is the Temik problem, 11% of the wells, have to have filters on them. And then there's 12% that there's an additional amount, so we have again almost 25%--another 25% that have Temik in: them. So it ~gives an idea of our real problem of quality, is a real problem in this Town. And the funny part about this thing--it's not funny, I guess, but the odd part about it ~is :that they only used 4 6 7 Temik for three years and then it 'was stopped, and you can see in those three years 25% of the households in this Town have Temik"in'them in just three years. So you can see how we're playing with these things that we're not quite sure of and how they can be a tremendous problem in the future to all of us. There are at least about a thousand filters on the homes in this Town. About a thousand filters are now required on wells just in this 'Town of Southold alone. And they get about between eight and ten filters additional every week. In other words, they find new problems. They're continually testing and they're adding eight to ten every week. The Water Advisory Committee Js working on a Water Management Plan. Hopefully in the future we will have overlays of maps that will give us an idea of where the best water is~"and possibly an area that could be set aside in the future for future water resour~:es. This ~is something We're hoping is~going to be, and this is what they're working on right now. We had assignments for everybody on the committee, but through the holidays, I'm afraid, some of the assignments didn:t get done and so we couldll't do as much as we wanted to, and so we're looking for a much better do their homework kind of thing next time. SUPERVISOR MURPHY: Ray is out in;California; I have nothing further to report. II. PUBLIC NOTICES. SUPERVISOR MURPHY: Moving on to the second item on the agenda, Public'Notices. 1. Designation of a restricted highway on Route 25, between. Aldrich Lane and the Railr~oad Bridge. They're going to do reconstruction, and it 'will~ be restricted unUi =June 30th, 1988, the scheduled completion date. 2. Notice from the Public ~Service Commission on a prehearing conference on the Lighting Company's electric ~ rate increase. There will be one in' New York, and one in'Riverhead on Tuesday, February 10th, Suffolk County Center Board Room, Nugent Drive, Riverhead. Iii. COMMUNICATIONS. SUPERVISOR MURPHY: 1. From Gladys Csajko resigning as. the Director of the Shelter for the North Fork Animal Welfare League. I'm very sorry to see her go. She did a great.service for this community. 2. From a local attorney (Michael J. Hall) expressing thanks to the entire Buildin9 Department for doing a very good iob 'during the year. And it's really nice to hear these and I think it's very important that everybody knows about it. It's a very tough job and they're always under a lot of pressure and it's always good to hear somebody say something nice.. 3. From Richard Saetta who has a contract problems with the excavation at the Dog Pound. Hopefully our architect will be able to resolve this tomorrow. IV. PUBLIC HEARING. SUPERVISOR MURPHY: We have a public'hearing scheduled for tonight at 8:00 o'clock (Zehner, formerly Southport, change of zone hearing). V. RESOLUTIONS. SUPERVISOR MURPHY: We'll move on to Resolutions. The firs't one is an author- ization to go to bid( 1. Moved by Councilman Stoutenburgh, seconded by Councilnian Penny, it was RESOLVED that the Town Board of the Town of Southold hereby authorizes and directs the Town Clerk to advertise'for bid§ for the purchase of six (6) new .1987 Special Police automobiles, with a trade-in of five (5) vehicles, for the Southold Town Police Department. 1.-Vote of the Town Board: Ayes: Councilman Penny, Councilwoman Cochran, Council- man Schondebare, Councilman Stoutenburgh, Supervisor Murphy. This resolution was declared duly ADOPTED. SUPERVISOR MURPHY: Number 2 is to authorize to go to bid for an unmarked' police car. 2. SUPERVISOR MURPHY: Number 3 is to authorize advertisement for the DEC's local Town meeting. 468 JANUARY 6, 1987 Moved by Councilwoman Cochran, seconded by Councilman Stoutenburgh, it was RESOLVED that the Town Board of the Town of Southold hereby authorizes and directs the Town Clerk to place a display ad in'The Long Island Traveler-Watchman and The Suffolk Times advising the public'that members of the New York State Department of Environmental Conservation will'meet at the Southold Town Hall, Main' Road, Southold, New York, on Thursday, January :29, .1987, at 7:00 P.M. to answer questions re~ardin~l local issues. SUPERVISOR MURPHY: I'd like to comment on that. This~is'a new policy of the DEC. I think one trying to clean up their image and get closer to the people. And what it is, this:is the first of the hearings on the 13th towns on Long Island, and they're trying it :out here to see how it ~goes over. Harold Berger, the Regional Director, is expected to be here, as well as various senior staff members in sanitation~ water, wetlands and that. This;resolution was declared duly ADOPTED. SUPERVISOR MURPHY: Number 4 is an urgent action by our Association of Towns on municipal liability. .4. Moved by Councilman Penny, seconded by Councilman Stoutenburgh, WHEREAS, in 1985: the Assembly Standing .Committee on Local Governments issued a report entitled "Deep Pockets- a Study of Munidpal Tort Liability" which concluded that municipal tort liability had entered a crisi's'stage and that insurance was both unavailable and unaffordable to hundreds of New York State local governments, and WHEREAS, in',198'6 the New York State Legislature and' the Governor began to address this problem by enacting laws which' modified the tort system in New York and estab- lished certain insurance reforms, and WHEREAS, despite these new laws, insurance remains unaffordable for our town, and in some instances, unavailable; now, therefore, be it ~ RESOLVED that the .1986 legislation which modified joint and several liability so that~ in the case of non-economic damages, ~f the defendant was found to be less t~an 50~!i.~1 responsible for the tortious act, it ~would pay only its share of the award, b~~' extend~ to totally abolish the joint and several liability doctrine for both economic and non- economic-damages, and be it hereby FURTHER RESOLVED that a limitation of $250,000 be imposed for non-economic damages until such time as a mechanism is established which would provide more uniform standards or schedules for compensation of non-economic damages, and be it hereby FURTHER RESOLVED that the defense of assumption of risk be modified so that an equitable personal responsibility statute for sports and recreatiohal activitie~ be imposed on the basis-that fairness dictates that one who voluntarily/ assumes a known risk and is then injured because of that risk should bear the consequences of one's own behavior, and be it 'hereby FURTHER RESOLVED that a contingency fee schedule similar to that which was included as part of the lg85: medical malpractice legistation be imposed, and be it hereby FURTHER (a) (b) (c) RESOLVED that certain procedural reforms be enacted, including: Requiri'ng plaintiffs and defendants to certify the truthfulness of the allegations contained in their respective pleadings; Changing the process for jury selection to adopt the Federal process; and Requiring all Appellate Divisions of the state to allow bifarcation for personal injury trials, and be it he~reby FURTHER RESOLVED that the present version of court-annexed arbitration be extended so that arbitrators would be permitted to hear cases and make awards up to $25,000, and be it hereby FURTHER RESOLVED that the statute of limitations is not changed in the area of "toxic tort" cases beyond what occurred in"1986; and be it FURTHER RESOLVED that a suitable copy of this 'Resolution be forwarded to the Association of Towns who should be urged to adopt this as part of their resolutions and legislative program at the annual meeting in February, 1987. -Vote of the Town Board: Ayes: Councilman Penny, Councilwoman Cochran, Council- man Stoutenburgh, Supervisor Murphy. Townsend, Jr. a member of the Southold Town Landmark Preservation Commission, effective immedia1~ely, to ~ill~the unexpired term of Louis J. Murphy to execute a contractual agreement between the Town of Southold and Chief of Police Harold D. SUPERVISOR MURPHY: Number 19 is to authorize the transportation for the Board of Commissioners for the Fishers Island Garbage District on January 20th. · 19. Moved by Supervisor Murphy, seconded by Councilman Stoutenburgh, it was RESOLVED that the Town Board of the Town of Southld hereby authorizes payment of the round-trip' transportation cos~ts for the Board of Commissioners of the Fishers Island Garbage and Refuse District to meet with the Town Board on January 20, 1987. 19.-Vote of the Sown Board: Ayes: Councilman Penny, Councilwoman Cochran, Council- man Schondebare, Councilman Stoutenburgh, Supervisor Murphy. This resolution was declared duly ADOPTED. SUPERVISOR MURPHY: Number 20 is to authorize the payment of vouchers for insurance. 20. ED SIEGMANN: I'd just like to ask you a question. Is it~Americ~n built cars that you specify for those Police vehicles, or can it be any vehicle? COUNCILMAN STOUTENBURGH: Can't be done. SUPERVISOR MURPHY: I don't think it can be done. We normally specify the brand that the Police Department is happy with. There's only two or three of the auto dealers that make police car packages, it's a special package that's made. That's why we go to bid early, because they only make a c~i~tain' i-,ur~be~-. COUNCILMAN STOUTENBURGH: Has to have certain'transmissions, certain engines. So there wouldn't be a standard car, you see, and I don't think a foreign car company would make that car anyway. SUPERVISOR MURPHY: Ford, Chevy and Plymouth are the only ones that make them.
