Goose Creek), Southold SCTM: 1000-70-10-54 SEQRA DETERMINATION: The Zoning Board of Appeals has visited the property under consideration in this application and determines that this review falls under the Type II category of the State's List of Actions, without further steps under SEQRA. SUFFOLK COUNTY ADMINISTRATIVE CODE: This application was referred as required under the Suffolk County Administrative Code Sections A 14-14 to 23, and the Suffolk County Department of Planning issued its reply dated June 17, 2019 stating that this application is considered a matter for local determination as there appears to be no significant county-wide or inter-community impact. LWRP DETERMINATION: This application was referred for review under Chapter 268, Waterfront Consistency review of the Town of Southold Town Code and the Local Waterfront Revitalization Program (LWRP) Policy Standards. The LWRP Coordinator issued a recommendation dated October 9, 2019. Based upon the information provided on the LWRP Consistency Assessment Form submitted to this department, as well as the records available to us, it is our recommendation that the proposed action is EXEMPT from Coastal Consistency Review. PROPERTY FACTS/DESCRIPTION: The subject, non-conforming, 18,922 square feet(17,393.9 buildable land), .434 acre, irregular shaped water front parcel measures 100 feet along a radius on Beachwood Lane then runs south 165.03 feet to Goose Creek, establishing an eastern lot line shared with a private community park, then runs 67.75 feet along the tie line at the high water mark, then continues west 27.75 feet and continues 42.18 feet along the same tie line and returns 177.18 feet, establishing a western lot line shared with a residentially developed lot, back to Beachwood Lane. The site is developed with a one story frame house and attached garage, a waterside wood deck and wood steps, an outside shower, a roof over covered front porch, brick walk, asphalt driveway, a wood dock with attached wood steps and floating wood dock, as shown on the survey prepared by Nathan Taft Corwin, III, Land Surveyor, and dated October 6, 2018. BASIS OF APPLICATION: Request for a Variance from Article XXIII, Section 280-124 and the Building Inspector's May 28, 2019, Notice of Disapproval based on an application for a permit to construct additions and alterations to an existing single family dwelling; at, 1) less than the code required front yard setback of 35 feet; located at 420 Beachwood Lane, (Adj. to Goose Creek) Southold,NY. SCTM No. 1000-70-10-54. Page 2, October 24,2019 #7324,Triolo SCTM No. 1000-70-10-54 RELIEF REQUESTED: The applicant requests a variance for additions and alterations to convert an existing single-story residence to a two-story home, consisting of an expanded kitchen, new front porch and a modified garage for a total of 1,233 square feet with a proposed front yard setback of 25.1 feet where the code requires a minimum front yard setback of 35 feet. ADDITIONAL INFORMATION: No immediate neighbor or member of the public spoke in favor of or against this application. The proposed new lot coverage will be 19.6% of the 17,393.9 buildable square feet where a maximum of 20% is allowed. FINDINGS OF FACT/REASONS FOR BOARD ACTION: The Zoning Board of Appeals held a public hearing on this application on October 10, 2019 at which time written and oral evidence were presented. Based upon all testimony, documentation, personal inspection of the property and surrounding neighborhood, and other evidence,the Zoning Board finds the following facts to be true and relevant and makes the following findings: 1. Town Law X267-b(3)(b)(1). Grant of the variance will not produce an undesirable change in the character of the neighborhood or a detriment to nearby properties. The Southwood's community, where the subject property is located, consists of modest mid-century ranches many of which have been altered and expanded over the past sixty-plus years developed on a network of roadways that meander through the creek front community. Garages, along with covered front porches, are common amenities in this neighborhood. 2. Town Law §267-b(3)(b)(2). The benefit sought by the applicant cannot be achieved by some method, feasible for the applicant to pursue, other than an area variance. In order for the applicant to expand their interior living space, it is necessary to modify the garage plan and encroach on the front yard setback. The existing residence has a front yard setback of 34.3 feet from Beachwood Lane; therefore, almost any expansion of the front fagade of the home will require relief from the code. 3. Town Law X267-b(3)(b)(3). The variance granted herein is mathematically substantial, representing 28.2% relief from the code. However, in order for the applicant to add addition to the front of their home some form of relief will be required. The modification of the garage with a front entry servicing two cars is a common amenity in the community. 4. Town Law §267-b(3)(b)(4). No evidence has been submitted to suggest that a variance in this residential community will have an adverse impact on the physical or environmental conditions in the neighborhood. The applicant must comply with Chapter 236 of the Town's Storm Water Management Code. 5. Town Law §267-b(3)(b)(5). The difficulty has been self-created. The applicant purchased the parcel after the Zoning Code was in effect and it is presumed that the applicant had actual or constructive knowledge of the limitations on the use of the parcel under the Zoning Code in effect prior to or at the time of purchase. 6. Town Law &267-b. Grant of the requested relief is the minimum action necessary and adequate to enable the applicant to enjoy the benefit of additions and alterations to convert an existing single-story residence to a two- story home, consisting of an expanded kitchen, new front porch and a modified garage for a total of 1,233 square feet while preserving and protecting the character of the neighborhood and the health, safety and welfare of the community. RESOLUTION OF THE BOARD: In considering all of the above factors and applying the balancing test under New York Town Law 267-B, motion was offered by Member Planamento, seconded by Member Lehnert, and duly carried, to Page 3,October 24,2019 #7324,Triolo SCTM No. 1000-70-10754 GRANT the variance as applied for, and shown on the site plan prepared by Robert I. Any deviation from the survey, site plan and/or architectural drawings cited in this decision will result in delays and/or a possible denial by the Building Department of a building permit, and may require a new application and public hearing before the Zoning Board of Appeals. Any deviation from the variance(s) granted herein as shown on the architectural drawings, site plan and/or survey cited above, such as alterations, extensions, or demolitions, are not authorized under this application when involving nonconformities under the zoning code, This action does not authorize or condone any current or future use, setback or other feature of the subject property that may violate the Zoning Code, other than such uses, setbacks and other features as are expressly addressed in this action. In the event that an approval is granted subject to conditions, the approval shall not be deemed effective until the required conditions have been met; and failure to comply therewith will render this approval null and void. The Board reserves the right to substitute a similar design that is de minimis in nature for an alteration that does not increase the degree of nonconformity. I was in my ZBA certificate had expired due to there being an original cap of 1yr on the initial approval. I was asked to write a letter to explain the lapse from the original approval date to now. We started this project in 2019 but it took—9months to get final approvals from the DEC, then we were lined up to have our trustees meeting and it was set for the first meeting they cancelled due to covid, once the trustees started taking meetings again (-7months),they required I add an IA system,which caused further delays due to grants approvals from the state and Suffolk county health department,then final installation and remediation of the existing septic.Finally once all was in place, building the project to over 1.5yrs, delays due to material and labor shortages.So, its now the end of 2022 and im trying to put everything together to get the final CO, can you please let me know what I need to do to get the ZBA approval extended?
