For purposes of this review the setback was measured from the retaining wall. En-Consultants on behalf of FREDERICK LIGUORI requests a Wetland Permit for the complete reconstruction of a 12'x12' second-story deck, which replaces a previously existing storm damaged deck attached to an existing 634sq.ft., two-story frame building; construct a 12'x12' raised masonry patio beneath reconstructed deck; and maintain an existing outdoor shower, 8'x12' shed with attached 4'x4' access ramp; a 3'x6' storage box, and two sets of steps (4'x8' and 5.2'x8') off existing retaining wall; and a proposed drywell to be installed outside Chapter 275 jurisdiction. Located:. SCTM# 1000-128-2-11 The proposed action has been reviewed to Chapter 268, Waterfront Consistency Review of the Town of Southold Town Code and the Local Waterfront Revitalization Program (LWRP) Policy Standards. Based upon the information provided on the LWRP Consistency Assessment Form submitted to this department, as well as the records available to me, it is my recommendation that the'proposed action is INCONSISTENT with LWRP Policy 6.3 and therefore, INCONSISTENT with the LWRP. 4.1. Minimize losses of human life and structures from flooding and erosion hazards. A. Minimize potential loss and damage by locating development and structures away from flooding and erosion hazards. The garage structure with apartment on the second floor constructed on the non-conforming lot is located within the FEMA Flood Zone AE EI. 6'. These areas are subject to inundation by the 1- percent—annual —chance flood event and may flood during storm events. 6.3 Protect and restore tidal and freshwater wetlands. A. Comply with statutory and regulatory requirements of the Southold Town Board of Trustees laws and regulations for all Andros Patent and other lands under their jurisdiction 1. Comply with Trustee regulations and recommendations as set forth in Trustee permit conditions. A Wetlands Permit pursuant to Chapter 275 Wetlands and Shorelines of the Southold Town Code was not issued for the structure. It is recommended that the applicant identify how wastewater is disposed of. A wastewater system is not shown on the plans. In the event the action is approved the installation of an I/A OWTS is recommended to further this policy. Pursuant to Chapter 268, the Board of Trustees shall consider this recommendation in preparing its written determination regarding the consistency of the proposed action. I also noticed an error on one of the dimensions on the site plan, i.e.,the 97.5'setback to the deck should be labeled "to high water," not "to bulkhead." Thus, our originally submitted project description is incorrect and should be amended/simplified as described below. I will deliver corrected plans ASAP. Sorry about that. Complete the construction of a 12'x 12'second-story deck, which replaces a previously existing, storm-damaged deck attached to an existing 634 sf,two-story frame building; construct a 12' x 12' raised masonry patio beneath reconstructed deck; and maintain an existing outdoor shower, 8'x 12' shed with attached 4'x 4' access ramp, a Tx 6' storage box, and two sets of steps (4'x 8' and 5.2'x 8') off existing retaining wall reconstructed after Hurricane Sandy pursuant to Wetlands Permit 8297, all as depicted on the site plan prepared by Mullman Seidman Architects, last dated September 25, 2019. Specifically, the 97.5' dimension between the corner of the under-construction deck and the high water line should be labeled "to high water line," not"to bulkhead." Therefore, I will be hand-delivering to both of you this afternoon a further revised site plan by Mullman Seidman Architects, last revised September 25, 2019, which depicts both the corrected dimension label and the relocated drywell.
