Pardee, SCTM# 1000-126-11-3.). Specifically, the Valentes own property located at 6730 Peconic Bay Blvd, Laurel,New York 11948 (the "Adjacent Property"). The Notice stated that a hearing is currently scheduled for August 14, 2019 (the "Hearing"). At the Hearing, Charles G. Pardee's ("Applicant"), who recently purchased property located at 6760 Great Peconic Bay Blvd., Laurel,New York 11948 (the "Applicant Property') will seek several unprecedented variances for certain long-established requirements. As owners of the Valente Property since 11995, the Valentes are committed to upholding the long-standing Town Codes and ensuring consistency with the more recent Local Waterfront Revitalization Program (the "LWRP"). Accordingly, please allow this email to serve as formal notification that based upon review of the permit application, drawings, pertinent Town Codes, LWRP, and past precedent set by the Board, the Valentes object to certain portions of the permit for the following reasons: (i) the proposed structure does not meet setback and other structural and environmental requirements; (ii)the specific placement of the significant structure is not necessary as reasonable alternatives exist; and, (iii) overall, the structure will cause an undesirable change in the character of the neighborhood and a detriment to nearby properties. As a threshold matter, please be advised that the Valentes only oppose the following sections of the permit application: "In addition, applicant also proposes to relocate the existing wooden deck and stair beach access assembly (please see below dimensions of this structure) 20.0'+ or- to the east of its original location (15.0' + or -from eastern property line) and to re-orient the lower stair portion of the assembly to the east side of the deck portion of the assembly " Note, it is unclear why Application is seeking a permit "to construct a 26'x 20' stone patio on the southeastern side of the existing family dwelling" when it appears, based on a site inspection, that Applicant has already completed the patio without said permit. Nonetheless, the Valentes do not object to said patio so long as it meets the side yard setback requirements, to be confirmed by a town property inspection. Further, the Valentes have no issue with the fencing Applicant seeks to install on the western portion of the Applicant Property. Structural Concerns: At the outset,please be advised that there is currently no "existing wooden deck and beach stair beach access assembly" at the Applicant Property. Rather, the wooden deck and beach stair access assembly that previously existed for 24 years in the center of the Applicant Property (i.e., equidistant from both the Valente Property line and the western Applicant Property line) was removed. This is important as the permit application states it seeks to "relocate" the existing wooden deck and beach stair access. In reality, a review of the drawings and the dimensions of the proposed deck, demonstrate that Applicant seeks to construct an entirely new structure with significantly larger dimensions, both in height and depth. First, it appears the drawings do not indicate the width of the proposed deck (the plans only indicate the deck is 10' long). Failure to provide this information prevents the Valentes from assessing the structural, environmental and visual consequences of the deck, including whether the deck meets the requirements of Section 275 - 11(A)(6)(a). Second, based on the drawings, it appears the setback is less than the required bulkhead setback requirement of 75 ft. under Section 275-3 (D), as supplemented by Section 280-116(C), and the 100 ft. setback requirement under Section 280-116 (A)(1)). Third, the 14.5' height of the wooden deck is inconsistent with the requirements of a water adjacent parcel under the Code and is particularly problematic under the LWRP policy standards, including the preservation of the visual impact of waterfront properties. Fourth, the application is vague when it states that the deck will be placed "20.0'+ or- to the east of its original location (15.0'+ or- from eastern property line)."As the Applicant removed the deck and stair assembly that previously existed in the center of Applicant Property, it is difficult to assess its original location. More importantly,the application provides a wide range of potential distance ("15 ft. + or-") from which the deck and stair assembly will be from the eastern property line (i.e., the Valente Property). For example, it is unclear, based on this incomplete information, whether the deck and stairs assembly will be 5 ft. from the Valente Property line or 17 ft. from the Valente Property line. Such information is vital to determine whether the distance of the structure from the eastern property line falls within the Code requirements, as well as what environmental impacts the structure will have on the Valente's berm and bulkhead (see below). Environmental Concerns: As the subject properties are located within the Coastal High Hazard Zone, as indicated by the "Coastal Erosion Hazard Area Map of the Town of Southold," prepared by the NYS Department of Environmental Conservation, the proposed plans must meet the requirements set forth in Section 111 of the Code. Sections 111-4,111-5 and 111-9, require that as part of Southold's Coastal Erosion Management Program, any regulated activity, including the construction of non-movable structures, must be assessed pursuant to the following standards, including whether: (i)the activity is necessary; (ii) reasonable alternatives have been considered; (iii) the activity is likely to cause an increase in erosion; and (v) the activity prevents and/or minimizes adverse effects on natural protective features and their functions and protective values, existing erosion protection structures and natural resources. The proposed location of the deck and the beach stairs access to the eastern side of Applicant's Property (and within approximately 15' of the Valente Property) is unnecessary, as reasonable alternatives exist. For example, Applicant can keep the deck and stairs assembly where it was originally located - in the center of the Applicant Property. Applicant has failed to set forth any reason the deck and stairs assembly must be moved so close to the Valente Property, where it will most certainly threaten the functionality of the Valente Property's berm and bulkhead, cause the removal of soil and affect surface water runoff, as well as affect the overall protective nature of both the Valente's berm and bulkhead. Presumably, Applicant wants the deck and stairs assembly to be moved next to the Valentes Property so that the proposed 14.5'-high deck does not obstruct Applicant's view of the water from his home. However, absent a necessary reason or finding that there are no alternatives (which we know to be untrue), the proposed location of the structure is prohibited under the Code. Architectural Review Standards Under Section 280(134)(A), site plans for a structure to be located on the same street or within 500 ft. of the proposed structure must be reviewed in accordance with the following criteria: (i) substantially identical size 2 and arrangement and location including height, lengths and elements of building design; (ii) minimization of visual discord; (iii)maximizing sensitivity to visual appearance; and (iv)the proximity to open space. The substantial structure Applicant seeks to construct is inconsistent with the heights, sizes, arrangements of the other properties on the shoreline. In addition, the 14.5 height of the proposed deck not only increases visual discord to the shoreline overall, but infringes on the Valentes view of the bay as well as their privacy as the deck will be 14.5 feet above the Valentes bulkhead. Any individual on the proposed deck will be able to look down onto the Valentes bulkhead. Such impairments can easily be eliminated by placing the deck and stairs in the center of the Applicant Property where it was originally located. Additional NYS Permits It is unclear from the application whether Applicant has obtained the proper permits/approvals from the NYS Department of Environmental Conservation. Second Dwelling Lastly, upon receipt of this Notice, it has come to the attention of the Valentes that Applicant may have constructed a second dwelling on the front yard of the Applicant Property, including adding running water and a bathroom to the garage, without the proper permits an in violation of the Code. We would appreciate any further insight the Board has into the status of this structure. For the reasons set forth above, the Valentes object to the construction of the new deck and stair access assembly along the eastern property line. Accordingly, Applicant's permit application must be denied as the proposed deck and stairs will cause undesirable change in the character of the neighborhood and a detriment to nearby properties.
