That the said Board of Trustees and the Town of Southold are released from any and all damages, or claims for damages, of suits arising directly or indirectly as a result of any operation performed pursuant to this permit, and the said Permittee will, at his or her own expense, defend any and all such suits initiated by third parties, and the said Permittee assumes full liability with respect thereto, to the complete exclusion of the Board of Trustees of the Town of Southold. 2. That this Permit is valid for a period of 24 months, which is considered to be the estimated time required to complete the work involved, but should'circumstances warrant,request for an extension may be made to the Board at a later date. 3. That this Permit should be retained indefinitely, or as long as the said Permittee wishes to maintain the structure or project involved,to provide evidence to anyone concerned that authorization was originally obtained. 4. That the work involved will be subject to the inspection and approval of the Board or its agents, and non-compliance with the provisions of the originating application may be cause for revocation of this Permit by resolution of the said Board. 5. That there will be no unreasonable interference with navigation as a result of the work herein authorized. 6. That there shall be no interference with the right of the public to pass and repass along the beach between high and low water marks. 7. That if future operations of the Town of Southold require the removal and/or alterations in the location of the work herein authorized, or if, in the opinion of the Board of Trustees, the work shall cause unreasonable obstruction to free navigation,the said Permittee will be required, upon due notice,to remove or alter this work project herein stated without expenses to the Town of Southold. 8. The Permittee is required to provide evidence that a copy of this Trustee permit has been recorded with the Suffolk County Clerk's Office as a notice covenant and deed restriction to the deed of the subject parcel. Such evidence shall be provided within ninety(90)calendar days of issuance of this permit. 9. That the said Board will be notified by the Permittee of the completion of the work authorized. 10. That the Permittee will obtain all other permits and consents that may be required supplemental to this permit, which may be subject to revoke upon failure to obtain same. H. No right to trespass or interfere with riparian rights. This permit does not convey to the permittee any right to trespass upon the lands or interfere with the riparian rights of others in order to perform the permitted work nor does it authorize the impairment of any rights,title, or interest in real or personal property held or vested in a person not a party to the permit. Box 2003 Bridgehampton, NY 11932-2003 RE: WILLIAM & DOLORES'KREITSEK 2455 NEW SUFFOLK AVENUE, MATTITUCK SCTM# 1000-114-9-14.1 Dear Mr. Anderson: The Board of Town Trustees took the following action during its regular meeting held on Wednesday, September 18, 2019 regarding the above matter: WHEREAS, Suffolk Environmental Consulting on behalf of WILLIAM & DOLORES KREITSEK applied to the Southold Town Trustees for a permit under the provisions of Chapter 275 of the Southold Town Code, the Wetland Ordinance of the Town of Southold, application dated June 28, 2019, and, WHEREAS, said application was referred to the Southold Town Conservation Advisory Council and to the Local Waterfront Revitalization Program Coordinator for their findings and recommendations, and, WHEREAS, the LWRP Coordinator recommended that the proposed application be found Inconsistent with the LWRP, and, WHEREAS, the Board of Trustees has furthered Policies of the Local Waterfront Revitalization Program to the greatest extent possible through the imposition of the following Best Management Practice requirements: establish and perpetually maintain a 10' non-disturbance/non-fertilization area; the use of non-treated lumber for entire dock; and WHEREAS, a Public Hearing was held by the Town Trustees with respect to said application on August 14, 2019 and September 18, 2019, at which time all interested persons were given an opportunity to be heard, and, 2 WHEREAS, the Board members have personally viewed and are familiar with the premises in question and the surrounding area, and, WHEREAS, the Board has considered all the testimony and documentation submitted . concerning this application, and, WHEREAS, the structure complies with the standards set forth in Chapter 275 of the Southold Town Code, WHEREAS, the Board has determined that the project as proposed will not affect the health, safety and general welfare of the people of the town, NOW THEREFORE BE IT, RESOLVED, that for the mitigating factors and based upon the Best Management Practice requirement imposed above, the Board of Trustees deems the action to be Consistent with the Local Waterfront Revitalization Program pursuant to Chapter 268-5 of the Southold Town Code, and, RESOLVED, that the Board of Trustees approve the application of WILLIAM & DOLORES KREITSEK to construct a dock assembly consisting of a 3'x80' (240sq.ft.) catwalk; a 3'x10' (30sq.ft.) landward ramp; and access ladder at seaward end with catwalk extending ±14' into Marratooka Lake, the use of non-treated lumber on entire dock; establish and perpetually maintain a 10' non-fertilization/non-disturbance area; and as depicted on the site plan prepared by Suffolk Environmental Consulting, Inc., dated September 10, 2019, and stamped approved on September 18, 2019. Permit to construct and complete project will expire two years from the date the permit is signed. Depths for the dock terminus are within Town Trustees guidelines and there is no recognized navigation channel in the immediate vicinity of the proposed structure. • Scope: The proposed dock is comparable to docks on neighboring properties in an area where docks historically are used for recreational purposes. • Scope in relation to the riparian rights of others: The plan allows a standard fixed catwalk to ladder design that will not impede riparian rights or shoreline access for others. • Scope in relation to view sheds: The lakeside end of the proposed dock will not extend appreciably beyond the shoreline. As such the perspective will not be discernibly different from the existing view. • Environmental upkeep: The dock design projects a usual lifespan of 30 years, with limited pile replacement so as to minimize disturbance of the bottom. THEREFORE, according to the foregoing, the Southold Town Board of Trustees Approve and Authorize the preparation of a Notice of Negative Declaration pursuant to SEQRA for the aforementioned project. Located: 2455 New Suffolk Avenue, Mattituck. SCTM# 1000-114-9-14.1 The proposed action has been reviewed to Chapter 268, Waterfront Consistency Review of the Town of Southold Town Code and the Local Waterfront Revitalization Program (LWRP) Policy Standards. Based upon the information provided on the LWRP Consistency Assessment Form submitted to this department, as well as the records available'to me, it is my recommendation that the proposed action is INCONSISTENT with the LWRP policies and therefore INCONSISTENT with the LWRP. The applicant has not demonstrated that the following dock standards pursuant to § 275- 11. Construction and operation standards have been met. (d) Review and approval of dock applications. Before issuing a permit for a dock structure, the Trustees shall consider whether the dock will have any of the following harmful effects: [11] Whether the cumulative impacts of a residential and commercial dock will change the waterway or the environment and whether alternate design, construction, and location of the dock will minimize cumulative impacts, and The placement of private residential docks within this freshwater wetland system would adversely affect the open space character of the water body and set precedent. k 9.4. There are currently two public access points to the lake: The Marratooka Lake Preserve, Mattituck, New York, was donated to the Town Southold in 1997 by The Nature Conservancy, Long Island Chapter. The approximately 11-acre preserve was originally donated to The Nature Conservancy in 1973 by Mr. & Mrs. Willard J. Heggen. The Marratooka Lake Preserve consists of 10.7 acres on the north shore of Marratooka Lake. Approximately 8 acres, or 80% of the Preserve, is successional shrubland. Most of this area is former pasture, hayfield, and cropland. Parks, Beaches & Open Space Work Plan (1983) identifies the parcel to the east of the subject parcel as Marratooka Lake - South, Mattituck 115-3-23.1 a 1.9-acre waterfront parcel used for fishing access to Marratooka Lake. The public access point located on this property is available to launch non-powered vessels. This ramp is located 480'±from the subject parcel. In the even the action is approved a 20' wide vegetated non-turf buffer along the lake shoreline is recommended. Note the use on non-treated lumber is specified but not indicated on the plans.
