SUFFOLK COUNTY ADMINISTRATIVE CODE: This application was referred as required under the Suffolk County Administrative Code Sections A 14-14 thru A 14-25, and the Suffolk County Department of Planning issued its reply dated April 10, 2019 stating that this application is considered a matter for local determination as there appears to be no significant county-wide or inter-community impact. LWRP DETERMINATION: The relief, permit, or interpretation requested in this application is listed under the Minor Actions exempt list and is not subject to review under Chapter 268. PROPERTY FACTS/DESCRIPTION: The subject property is a nonconforming 6,677 square foot parcel located in the Residential R-40 Zoning District. The northerly property measures 53.42 feet, the easterly property measures 133.56 feet, the southerly property measures 53.42 feet and is adjacent to Soundview Avenue, and the westerly property measures 133.56 feet. The lot is improved with a single-story wood framed residence with an attached wood deck on the rear property along with a shed located on the northwest side of the rear yard as shown on the survey map prepared by John T.Metzger,LS, dated September 19,2019. BASIS OF APPLICATION: Request for Variances from Article XXIII, Sections 280-124 and the Building Inspector's March 6, 2019, Notice of Disapproval based on an application to demolish an existing dwelling and construct a new single family dwelling; at, 1) located less than the code required minimum front yard setback of 35 feet; 2) located less than the code required rear yard setback of 35 feet; 3) located less than the code required combined side yard setback of 25 feet; 4) more than the code permitted maximum lot coverage of 20%; located at 9955 Soundview Avenue, Southold,NY. SCTM#1000-59-2-5. Page 2, October 10,2019 #7300,Naglieri SCTM No. 1000-59-2-5 RELIEF REQUESTED: The applicant requests variances to demolish and construct a new single-family dwelling at 9955 Soundview Avenue, Southold, NY. SCTM#1000-59-2-5. The proposed construction, on this nonconforming 6,677 square foot lot in the Residential R-40 District is not permitted pursuant to Article XXIII. Section 280-124 which states; lots measuring less than 20,000 square feet in total size require a minimum front yard and rear setback of 35 feet, and a total combined side yard setback of 25 feet. The proposed construction has a front yard setback of 27.5 feet, a rear yard setback of 31.1 feet and total combined side yard setback of 23.5 feet. In addition,the maximum lot coverage permitted is 20%. The proposed lot overage is 26.2%. AMENDED APPLICATION: At the hearing the applicant was asked to bring the plan into more conformity with the code, On September 27, 2019 new plans were submitted with a new survey dated September 19, 2019. The plans for the new house have been revised to eliminate the front yard and lot coverage variances. The front porch and first floor rear yard deck (replaced with an at grade patio) and as built framed shed have been eliminated and the second-floor balcony has been reduced in size thereby reducing the proposed lot coverage from 26.2% to the code conforming maximum of 20%. By eliminating the front porch, the amended application also increases the originally proposed non-conforming front yard setback of 27.5 feet to a conforming 35.1 feet. The second-floor balcony has been reduced in size to 8 ft. by 24.5 feet from 10 ft. by 24,5 feet to increase the rear yard setback from 31.1 feet to 33.3 feet where the code requires a minimum of 35 feet, therefore creating more conformity with the code. Therefore, the amended application still requires variance relief for a rear yard setback of 33.3 feet and a combined side yard setback of 23.5 feet where the code requires a minimum of 25 feet. This amended proposal is significantly more conforming then the variance relief as applied for. ADDITIONAL INFORMATION: The proposed new house will be a modular construction by Modular Steel Systems, Inc. whose drawings were last revised on August 26, 2019 showing a new sanitary system to be installed as approved by the Suffolk County Department of Health. At the hearing an adjacent neighbor spoke in opposition to the application. However, a letter from another adjacent neighbors to the west was received on August 12, 2019 in support of the application, pointing out that the side yard setback of the existing dwelling, to be demolished, is much closer to the shared property line of the objecting neighbor than the new dwelling that the applicant is proposing to build. FINDINGS OF FACT/REASONS FOR BOARD ACTION: The Zoning Board of Appeals held a public hearing on this application on August 1, 2019 at which time written and oral evidence were presented. Based upon all testimony, documentation, personal inspection of the property and surrounding neighborhood, and other evidence,the Zoning Board finds the following facts to be true and relevant and makes the following findings: 1. Town Law §267-b(3)(b)(1). Grant of the variance will not produce an undesirable change in the character of the neighborhood or a detriment to nearby properties. The subject neighborhood has been a longtime beach community with small cottages on small lots. Many of these old cottages have been improved and modernized or replaced with new homes over time. The applicant's amended proposal is in keeping with improvements to other dwellings and properties in this community. 2. Town Law §267-b(3)(b)(2). The benefit sought by the applicant cannot be achieved by some method, feasible for the applicant to pursue, other than area variances. The proposed modular construction has been revised to conform to the code required lot coverage and front yard setback. However, the subject lot is very narrow and the width of the proposed home cannot be feasibly reduced to create a conforming combined side yard setback. The applicant cannot create a conforming rear yard setback because moving the dwelling closer to the road will create a non-confirming front yard setback which would be more visible to the street and reduce the area required for the installation of a new sanitary system. The amended variances as granted herein are not mathematically substantial, representing 4.8%relief from the code for the proposed rear yard setback and 6% relief from the code for the proposed combined side yard setback, as shown on the updated survey prepared by John T. Metzger, LS, last revised September 19, 2019. 4. Town Law §267-b(3)(b)(4). No evidence has been submitted to suggest that a variance in this residential community will have an adverse impact on the physical or environmental conditions in the neighborhood. The applicant must comply with Chapter 236 of the Town's Storm Water Management Code, and plans to install a new sanitary system. 5. Town Law &267-b(3)(b)(5). The difficulty has been self-created. The applicant purchased the parcel after the Zoning Code was in effect and it is presumed that the applicant had actual or constructive knowledge of the limitations on the use of the parcel under the Zoning Code in effect prior to or at the time of purchase. 6. Town Law §267-b. Grant of the requested relief, AS AMENDED, is the minimum action necessary and adequate to enable the applicant to enjoy the benefit of a new home while preserving and protecting the character of the neighborhood and the health, safety and welfare of the community. RESOLUTION OF THE BOARD: In considering all of the above factors and applying the balancing test under New York Town Law 267-13, motion was offered by Member Acampora, seconded by Member Dantes, and duly carried,to GRANT the variances, AS AMENDED, and shown on the survey map prepared by John T. Metzger, LS and last revised September 19, 2019 and the revised modular plans by Modular Steel Systems, Inc. dated August 26,2019. SUBJECT TO THE FOLLOWING CONDITIONS: 1. The "as built" shed shall be removed from the subject property prior to the issuance of a Certificate of Occupancy, as shown on the survey cited above. Any deviation from the survey, site plan and/or architectural drawings cited in this decision will result in delays and/or a possible denial by the Building Department of a building permit, and may require a new application and public hearing before the Zoning Board of Appeals. Any deviation from the variances) granted herein as shown on the architectural drawings, site plan and/or survey cited above, such as alterations, extensions, or demolitions, are not authorized tinder this application when involving nonconformities under the zoning code This action does not authorize or condone any current or future use, setback or other feature of the subject property that may violate the Zoning Code, other than such uses, setbacks and other features as are expressly addressed in this action. In the event that an approval is granted subject to conditions, the approval shall not be deemed effective until the required conditions have been met, and failure to comply therewith will render this approval null and void The Board reserves the right to substitute a similar design that is de minimis in nature for an alteration that does not increase the degree of nonconformity. Enclosed are survey prints and plans for the revised house. The follow changes were made: 1. Eliminated front porch and design an eyebrow window (no lot coverage variance required). Proposed lot coverage (26.2%) has been made conforming (20%). 2. Rear deck on 1st floor eliminated (patio on grade alternative) 3. Rear balcony reduced in size to 8' x 24.5 to conform to 20% lot coverage; however rear yard setback is still required. The proposed rear yard setback for the balcony is 31.1 (when 35 is required). Even though this variance is needed, the proposed is significantly more conforming then the existing nonconforming house and rear deck. After review by the surveyor, we cannot apply the "average front yard setback" of 27.36' because there would not be adequate room for the sanitary system. If we move the house forward to eliminate the rear yard balcony setback (item#3) the sanitary system will not fit. Therefore, in conclusion, the only variance which remains is the rear yard variance. Customized drawings affect the cost to the owner. The standardization of the width and length of the house makes the house affordable to the owner. The house is a rectangle with 1,139.5 foot print. The combined square footage of the front and back porches are a total of 477.5 sq.ft. The front porch is 8' x 26.5' (212 sq.ft.) and the rear 1" floor porch and open deck above is 10' x 26.5' (260 sq.ft.) These are reasonable sized improvements. The proposed house will be in keeping with the character of the surrounding neighborhood. (3) The amount of relief requested is not substantial because: The setbacks are not substantial. The lot coverage is substantial, 6.2 % over the permitted lot coverage. However, the parcel is only 6,677 sq.ft. The house without the porches is 17.8% . Elimination of the porches would impact the look of the house but also the functional use of the house. This is a second home and covered porches and decks are the living area in the spring,summer and fall. We were unable to attend that meeting, and ask that this letter be placed in the file and considered by the Board. We understand that at the public meeting regarding their application, certain objections' were made by Mr. Lee, whose property abuts both our home and the Naglieris. As we understand the proposal, however,the project would move the footprint farther away from the property line that we share with Mr. Lee. In that case, what the Naglieris propose to do would be more in line with current code. We also would like to add that the proposed renovations include a modernized septic system, which is critically important, and in keeping with the new Town comprehensive plan. The Zoning Board of Appeals,should approve the application. One final note. While the Board must comply with the set back and lot coverage laws as written today, the Naglieris' application demonstrates why the code is outdated and counter- productive. There is no reason why residential homes must be set back so far from property lines, or the road, or why lot coverage percentages must be so,limited even on small lots. For that matter, there is no reason why so much of Southold must be R-80 single-family zoned. Given the enormous and growing environmental strain faced by Town, and the utterly short- sighted approvals of recent projects in the vicinity of Kenney's Road, Hashamomuk Pond, and Route 48, and the lack of dense home building in downtown areas, it is time for the Town to - completely re-think its zoning and land usage laws. While we spend time debating whether a given home renovation is 3 or 10 feet from a property line, we continue to allow the physical landscape of the Town to be stripped bare by short-sighted projects, excessive home sizes, and outdated conceptions about whether someone has enough grass between their front door and the road. We cannot afford it anymore.
