A Special Meeting of the SOUTHOLD TOWN ZONING BOARD OF APPEALS was held at the Southold Town Hall Annex, Second Floor Conference Room, 54375 Main Road at Youngs Avenue, Southold on Thursday, September 26, 2019 commencing at 5:00 P.M. Present were: Leslie Kanes Weisman, Chairperson Eric Dantes, Vice Chair Nick Planamento, Member Patricia Acampora, Member Robert Lehnert Kim E. Fuentes, Board Assistant Call to Order at 5:05P.M. by Chairperson Weisman. WORK SESSION: a) Requests from Board Members for future agenda items. b) #7254 & 7256 Beirne—Declaration of Covenants. The Town Attorney will issue a letter to the applicant's representative requesting that the C &R's be rewritten in accordance with the conditions of the ZBA decision, and refiled with the County Clerk. c) Reviewed the DEIS Acceptance Memo from Carrie O'Farrell of Nelson Pope &Voorhis for the Enclaves Hotel and Restaurant and determined that the document is adequate to prepare for distribution and public review. d) Reviewed the Building Department records relating to #7303SE Gorman. e) Letter from Steven Ham, Esq. requesting a thirty (30) day extension (issuance of a certificate of occupancy for an"as built" swimming pool) #7211 Ketner. Page 2—Minutes Special Meeting held September 26,2019 Southold Town Zoning Board of Appeals POSSIBLE RESOLUTION TO CLOSE THE FOLLOWING HEARINGS: KAREN KRAEBEL AHLERS #7314SE—(Adjourned from September 12, 2019) Request for a Special Exception under Article III, Section 280-13B(13). The Applicant is the owners of subject property requesting permission to create an Accessory Apartment in an existing accessory structure, at: 255 Sixth Street, Laurel, NY. SCTM#1000-126-7-2. BOARD RESOLUTION: A motion was offered by Chairperson Weisman, seconded by Member Lehnert to Adjourn the Hearing to October 10 2019. Vote of the Board: Ayes: All. This Resolution was duly adopted (5-0). DELIBERATIONS/POSSIBLE DECISIONS/RESOLUTIONS: The Board continued with agenda items, and commenced deliberations on the following application. The original determinations of each of the following applications as decided are filed with the Southold Town Clerk: GRANT RELIEF AS APPLIED: JAMES KUHLMANN#7310 Vote of the Board: Ayes: Members Weisman Dantes, Acampora, Planamento and Lehnert. Resolutions was duly adopted (5-0). MCLEOD AND CHUN Y CHEUNG#7313 BRAD AND KATHRYN PIECUCH#7288 Vote of the Board: Ayes: Members Weisman, Dantes, Acampora, Planamento and Lehnert. Resolutions was duly adopted (5-0). DECISION TABLED: KAREN KRAEBEL AHLERS (DINIZIO) #7312 KAREN KRAEBEL AHLERS, (DINIZIO) #7314SE Page 3—Minutes Special Meeting held September 26,2019 Southold Town Zoning Board of Appeals Vote of the Board: Ayes: Members Weisman Dantes Acampora, Planamento and Lehnert. Resolutions was duly adopted (5-0). RESOLUTIONS: RESOLUTION ADOPTED: Motion was offered by Chairperson Weisman, seconded by Member Acampora to authorize advertising of hearings for Regular Meeting to be held on October 10, 2019 which Regular Meeting will commence at 8:30 A.M., Town Meeting Hall, 53095 Main Road, Southold. Vote of the Board: Ayes: Members Weisman, Dantes, Planamento Acampora and Lehnert. This Resolution was duly adopted (5-0). RESOLUTION ADOPTED: Motion was offered by Member Weisman, seconded by Member Lehnert to approve minutes from September 12, 2019, Regular Meeting. Vote of the Board: Ayes: Members Weisman, Dantes, Planamento, Acampora and Lehnert. This Resolution was duly adopted (5-0). RESOLUTION ADOPTED: Motion was offered by Member Weisman, seconded by Member Planamento to Grant a Thirty (30) Day Extension for Appeal No. 7211, dated November 15, 2018, D. Scott Ketner. Vote of the Board: Ayes: Members Weisman, Dantes, Planamento, Acampora and Lehnert. This Resolution was duly adopted (5-0). RESOLUTION ADOPTED: Motion was offered by Member Weisman, seconded by Member Planamento to accept the Draft Environmental Impact Statement (DEIS) of The Enclaves Hotel and Restaurant for the Special Exception Proposal as adequate for purposes of public and agency review and comments, subject to the conditions included in the September 26, 2019 Memo to the Zoning Board of Appeals from Nelson Pope &Voorhis, LLC, and furthermore, that the Zoning Board of Appeals sets the date, time and location for a public hearing on the proposals for Thursday, November 7, 2019, at 5:00 PM at the Southold Town Hall Meeting Room, located at 53095 Main Road, Southold,NY 11971. Vote of the Board: Ayes: Members Weisman, Dantes, Planamento, Acampora and Lehnert. This Resolution was duly adopted (5-0). There being no other business properly coming before the Board at this time, Chairperson Weisman declared the meeting adjourned. The meeting was adjourned at 6:30 P.M.
