The proposed construction will result in the as built accessory garage remaining in a non-conforming front yard location instead of the required rear yard. AMENDED APPLICATION: During the hearing, the applicant was asked to bring the plan into more conformity with the code. The applicant on February 10, 2016 submitted a revised survey. The applicant could build the attached garage and workshop as of right. This scales back the size of the project; however it does not bring the plan into more conformity with the code. ADDITIONAL INFORMATION: The subject parcel has a certificate of occupancy for a non-habitable garage and storage building on an existing foundation which was issued in 1986. At some point since then the storage building was converted into a dwelling. The dwelling is approximately 800 square feet in size where town code requires that dwellings contain at least 850 square feet of livable floor area. The Eastern neighbor's agent attended the meeting and voiced opposition to granting the variance. Another neighbor wrote a letter to the ZBA opposing the variance request. FINDINGS OF FACT/REASONS FOR BOARD ACTION: The Zoning Board of Appeals held a public hearing on this application on February 4,2016 at which time written and oral evidence were presented. Based upon all testimony, documentation,personal inspection of the property and surrounding neighborhood, and other evidence,the Zoning Board finds the following facts to be true and relevant and makes the following findings: 1. Town Law X267-b(3)(b)(1). Grant of the variances will produce an undesirable change in the character of the neighborhood or a detriment to nearby properties. The neighborhood consists of larger lots with code conforming single family structures and accessory buildings in code conforming locations. The proposed front yard locations for the pool house and pool are not characteristic of the neighborhood. The existing accessory garage has been in place for almost 30 years and has the benefit of a valid certificate of occupancy. 2. Town Law §267-b(3)(b)(2).The beneft sought by the applicant for the pool and pool house_can be achieved by some method, feasible for the applicant to pursue, other than an area variance. There is enough land for the applicant to build the pool in a conforming rear yard location. The applicant could convert the existing cottage into a legal dwelling therefore bringing the plan into more conformity with the code. The accessory garage is in a non- conforming location and any proposed re-development of the property would require the benefit of an area variance for the accessory garage. 3. Town Law,&267-h(3)(b)(3). The variances proposed herein are mathematically substantial, representing 100% relief from the code for the proposed front yard location for the as built accessory garage. However, the as-built garage has the benefit of a certificate of occupancy in a non-conforming location. The request for the variances for the pool and pool house in a front yard location are mathematically substantial representing 100% relief from the code. 4. Town Law 1267-b(3)(b)(4) No evidence has been submitted to suggest that a variance in this residential community will have an adverse impact on the physical or environmental conditions in the neighborhood. The applicant must comply with Chapter 236 of the Town's Storm Water Management Code. 5. Town Law X267-b(3)(b)(5). The difficulty has been self-created. The applicant purchased the parcel after the Zoning Code was in effect and it is presumed that the applicant had actual or constructive knowledge of the limitations on the use of the parcel under the Zoning Code in effect prior to or at the time of purchase. 6. Town Law 4267-b. Grant of the requested relief for the as-built accessory garage is the minimum action necessary and adequate to enable the applicant to enjoy the benefit of an accessory garage while preserving and protecting the character of the neighborhood and the health, safety and welfare of the community. Grant of the requested relief for the pool and the pool house is not the minimum action necessary and adequate to enable the applicant to build a pool with pool house. WHEREAS, a public hearing was held and concluded in the Matter of the Application for GUY SOBERING on May 2, 1985; and WHEREAS, the board members have personally viewed and are familiar with the premises in question as well as its surrounding area; and WHEREAS, the board has considered all testimony and documentation entered into the record in this matter; and WHEREAS, the board made the following findings of fact: 1 . The property in question is located in an "A-80" Residen- tial and Agricultural Zoning District and is located on the North Side of Sound Avenue, Mattituck, approximately 1474 feet east of Bergen Avenue, and' is identified on the Suffolk County Tax Maps as District 1000, Section 121 , Block 01 , Lot 3.1 ; 2. The subject premises contains a total acreage of 2.911 acres as certified by Howard W.',Young, L.S. by survey most recently dated January 14, 1985; 3. By this application, appellant requests approval : (a) of proposed' Lot #1 of an area of 63,404 sq. ft. with 357.96' frontage along Sound Avenue and which is improved with a single-family, two- story house set back at its nearest point from the front property line 41 .6 feet, and (b) of proposed Lot #2 of an area of 63,405 sq. ft. with 198.84' road frontage and which is improved with a wood-frame structure and concrete foundation, set back 38.6 feet at its nearest point from the front (south) property line. For the record, it is noted that the premises in question was the subject ,of a prior decision rendered by the Board of Appeals on February 27, 1975 under Appeal No. 2003 restricting the premises to contain not less than 40,000 sq. ft. in area (which was the minimum lot area at that time for each lot in a land division). ' 5. It is also noted for the record that the parcel to the east of proposed Lot #2 identified as District 1000, Section 121 ,, Block 01 , Lot 3.2, contains 40,000± sq. ft,. in area with an existing dwelling structure (Building Permit #8083Z dated 7/18/75).
