(3) (a),(b),B.(4) (a),(c),(e- partial),(g)and (i), Pursuant to Southold Town Code§280-131 B.(5),the Planning Board has found that waiving the parking requirements on this application by allowing the existing parking area to serve the new barn will not have a detrimental effect on the public health, safety, or general welfare, and will not have the effect of nullifying the intent and provision of the site plan requirements chapter in the Town Code. Upon preliminary review, and following standard procedures, this office referred both applications to the Suffolk County Planning Commission (SCPC), pursuant to Chapter 8 of the Suffolk County Administrative Code. Since the County currently owns the development rights (SC Farm PDR) of both subject parcels, we referred the applications to the Suffolk County Division of Planning and Environment, Open Space and Farmland Unit for their recommendations and advice. On June 5, 2019, we received a response from the Open Space and Farmland Unit advising the Zoning Board of Appeals that since the Deed of Develop Rights restricts the properties exclusively for agricultural production uses and prohibits or restricts the use of the premises for any purpose other than agricultural production, the proposed helicopter landing/take off areas would not be allowed on Suffolk County Farm PDR Land. Furthermore, we received from Sarah Lansdale, Director of Planning of SCPC, a memo dated June 6, 2019 which indicated that the subject applications be a matter for local determination, but acknowledged that the use is not permitted as it relates to the Suffolk County Farmland Purchase of Development Rights properties, and then referenced the Open Space and Farmland Unit's letter of June 5, 2019. On October 7, 2019, John Huber, Esq. telephoned to inform me that the two applications will be withdrawn. He will follow up with a letter.
