SUFFOLK COUNTY ADMINISTRATIVE CODE: This application was not referred to the Suffolk County Department of Planning and is considered a matter for local determination as there appears to be no significant county-wide or inter-community impact. LWRP DETERMINATION: The relief, permit, or interpretation requested in this application is listed under the Minor Actions exempt list and is not subject to review under Chapter 268. PROPERTY FACTS/DESCRIPTION: The subject non-conforming 20,571 square feet, .472 acre rectangular parcel located in the R40 Zoning District measures 100.17 feet along Reeve Road establishing a western lot line, then runs 204.23 feet along a residentially developed lot to the north, then runs south 100.04 feet along a second' residentially developed lot and then runs west 207.21 feet along a third residentially developed lot. The site is improved with a one-story wood frame house with attached garage, a covered front porch, a bluestone driveway, a brick patio at grade, an inground swimming pool with wood deck at grade surrounded by a chain link fence, and 10 feet by 10 feet wood shed as shown on the survey prepared by Nathan Taft Corwin, III, Land Surveyor and dated April 19, 2019. BASIS OF APPLICATION: Request for Variances from Article XXIII, Section 280-124 and the Building Inspector's March 26, 2019, Notice of Disapproval based on an application to construct additions and alteration to an existing single family dwelling; at, 1) less than the code required side yard setback of 15 feet; 2) less than the code required total side yard setback of 35 feet; located, at 3300 Reeve Road, Mattituck, NY. SCTM No. 1000- 100-1-3. RELIEF REQUESTED: The applicant requests variances to add a single car garage to the north side of the existing garage and residence measuring 12 feet by 29.2 feet with a ridge height of 15 feet, for an additional 350 square feet of storage with a proposed single side yard setback of 8 feet where the code requires a minimum setback of 15 feet and a combined side yard setback of 28 feet where the code requires a minimum combined side- yard setback of 35 feet. Page 2, September 26,2019 #7319,Keller SCTM No. 1000-100-1-3 ADDITIONAL INFORMATION: A letter of support was received from the neighbor to the north of the subject parcel. No other neighbor or member of the public spoke in favor of, or against this application. A prior appeal was made under application #1672 granted October 12, 1972 to create the subject lot which is smaller than the 40,000 square feet required by code. The applicant owns and currently stores a classic car in a temporary `tent' garage at the location of the proposed addition. The applicant has stated that they will permanently remove the temporary garage if the applied for relief is granted. FINDINGS OF FACT/REASONS FOR BOARD ACTION: The Zoning Board of Appeals held a public hearing on this application on September 12,2019 at which time written and oral evidence were presented. Based upon all testimony, documentation, personal inspection of the property and surrounding neighborhood, and other evidence,the Zoning Board finds the following facts to be true and relevant and makes the following findings: 1. Town Law §267-b(3)(b)(1). Grant of the variances will not produce an undesirable change in the character of the neighborhood or a detriment to nearby properties. The Saltaire Estates neighborhood consists of homes on comparable size lots and features a variety of housing styles, age and size, the majority of which have two-car garages. The applicant's proposed addition of a second garage bay is in keeping with the character of the community. Currently, the applicant has a temporary `tent' car storage structure located at the proposed site of the addition which is not in keeping with the character of the neighborhood. The removal of this temporary structure, with the granting of relief, will enhance the immediate neighborhood. Additionally, as a result of the natural topography to the north, the proposed low-lying garage addition will be hidden from the neighbor's view. Furthermore, the applicant has a well landscaped property with mature evergreen screening on all neighboring sides for the benefit of the applicant and neighbors alike. 2. Town Law 4267-b(3)(b)(2). The benefit sought by the applicant cannot be achieved by some method, feasible for the applicant to pursue, other than an area variance. The applicant currently has a one-car garage attached to a ranch style house that runs the width of the lot. There is no feasible location, accessed by the existing driveway, for an addition of an enlarged garage, other than on the northside of the residence. An accessory garage cannot be located in a conforming rear yard, due to an existing inground swimming pool. 3. Town Law &267-b(3)(b)(3). The variances granted herein are mathematically substantial, representing 46.6% relief from the code for the single side yard setback and 20% relief from the code for the combined side yard setback. However, there is no accessible location on the property for the applicant to locate an accessory garage in the code conforming rear yard, which is already improved with an in-ground swimming pool, leaving the proposed addition to the existing attached garage as the only feasible way to obtain additional garage space. Furthermore, the subject property is well screened from immediate neighbors. 4. Town Law §267-b(3)(b)(4). No evidence has been submitted to suggest that a variance in this residential community will have an adverse impact on the physical or environmental conditions in the neighborhood. The applicant must comply with Chapter 236 of the Town's Storm Water Management Code. 5. Town Law §267-b(3)(b)(5). The difficulty has been self-created. The applicant purchased the parcel after the Zoning Code was in effect and it is presumed that the applicant had actual or constructive knowledge of the limitations on the use of the parcel under the Zoning Code in effect prior to or at the time of purchase. 6. Town Law §267-b. Grant of the requested relief is the minimum action necessary and adequate to enable the applicant to enjoy the benefit of 12 feet by 29.2 feet accessory garage with a ridge height of 15 feet while preserving and protecting the character of the neighborhood and the health, safety and welfare of the community. Mazzaferro, Licensed Professional Engineer and dated January 2019. SUBJECT TO THE FOLLOWING CONDITIONS: 1. The applicant will permanently remove the `tent' storage unit from the subject property. That the above conditions be written into the Building Inspector's Certificate of Occupancy, when issued. Any deviation from the survey, site plan and/or architectural drawings cited in this decision will result in delays and/or a possible denial by the Building Department of a building permit, and may require a new application and public hearing before the Zoning Board of Appeals. The Board reserves the right to substitute a similar design that is de minimis in nature for an alteration that does not increase the degree of nonconformity. Pursuant to Chapter 280-146(B) of the Code of the Town of Southold any variance granted by the Board of Appeals shall become null and void where a Certificate of Occupancy has not been procured, and/or a subdivision map has not been filed with the Suffolk County Clerk,within three (3) years from the date such variance was granted. Because of this small overage, I am requesting this consideration. #4-This addition to my residence will not have any adverse effect or impact on the physical or environmental conditions in the neighborhood, but will in my opinion enhance the appearance of both my residence and the neighborhood. #5- Over 30 years ago, in 1988, 1 squared off the rear of my house extending into the existing garage to add an additional bathroom and larger dining room and kitchen.This was necessary at that time due to a family of four,three of which were females.The house pre exists today's set back requirements which were adopted one year later in 1989.When I had the house built in 1978, 1 centered it on the property allowing 20ft set back on each sid,e, 10ft more than the required 10ft.
