McLeod and Chun Y Cheung PROPERTY LOCATION: 605 Sound View Avenue, Mattituck,NY SCTM No. 1000-94-1-4 SEQRA DETERMINATION: The Zoning Board of Appeals has visited the property under consideration in this application and determines that this review falls under the Type II category of the State's List of Actions, without further steps under SEQRA. SUFFOLK COUNTY ADMINISTRATIVE CODE: This application was referred as required under the Suffolk County Administrative Code Sections A 14-14 to 23, and the Suffolk County Department of Planning issued its reply dated May 15, 2019 stating that this application is considered a matter for local determination as there appears to be no significant county-wide or inter-community impact. LWRP DETERMINATION: This application was referred for review under Chapter 268, Waterfront Consistency review of the Town of Southold Town Code and the Local Waterfront Revitalization Program (LWRP) Policy Standards. The LWRP Coordinator issued a recommendation dated August 27, 2019. Determining that the proposed pergola is Exempt from Coastal Consistency Review and the as built fence is INCONSISTENT with the LWRP Policy. However, with the conditions imposed herein, the Board finds the action CONSISTENT with the LWRP. SUFFOLK COUNTY SOIL AND WATER CONSERVATION DISTRICT: This application was referred for an evaluation and recommendation to the Suffolk County SWCD. According to the information provided in a letter from the agency dated August 19, 2019, following an inspection conducted on August 19, 2019, the agency described the yard as well vegetated in turf grasses and generally flat. The face of the bluff is currently stable and several areas of concern were listed including erosion derived from irrigation sprinklers at the top of the bluff. To insure stabilization of the bluff, runoff control measures are recommended to capture and covey all stormwater runoff away from the bluff and discharged/infiltration into the soils to the south of the bluff. Further it is critical that all runoff from the construction phase as well as post construction be diverted away from the bluff and any unstabilized soils. At this time, the fence in question does not pose a major impact, however, as the site changes, the fence may need to be reevaluated. Furthermore, it is recommended that no heavy machinery be driven and stored within 25 feet of the bluff top as extreme weight and vibrations of such equipment may cause instability. PROPERTY FACTS/DESCRIPTION: The subject property is a conforming 40,769 square foot waterfront parcel located in an R-40 Zoning District. The parcel has 25,800 square feet of buildable lot coverage. The parcel runs 110 feet along Sound View Ave, 393.97 feet on the West side and 383.50 feet on the East side. The parcel is improved with an existing two-story frame house and garage under, a pool, a shed, and a garage under construction. All is shown on a survey prepared by John Metzger, LLS, dated June 19, 2018 and last revised November 19, 2018. BASIS OF APPLICATION: Request for Variances from Article XXII, Sections 280-105 and 280-116A(1); and Building Inspector's March 29, 2019 Notice of Disapproval based on an application to construct a pergola addition to an existing single family dwelling and to legalize an "as built" six foot fence at, 1) the pergola is located less than the code required 100 feet from the top of the bluff; 2) the fence is more than the code permitted maximum four(4) feet in height when located in the front yard; located, at 605 Sound View Avenue (Adj. to the Long Island Sound),Mattituck,NY. SCTM No. 1000-94-1-4. RELIEF REQUESTED: The applicant requests a variance to make additions and alterations to build a pergola 84 feet from the top of the bluff where 100 feet is required and to legalize an as built 6 ft. high fence in the front yard where code permits a maximum of 4 feet in height for a fence in a front yard location. ADDITIONAL INFORMATION: The subject property previously received variance relief for additions and alterations t the first and second floor of the existing single-family dwelling with a non-conforming bluff setback of 51.8 feet in ZBA#7230 dated January 17,2019 FINDINGS OF FACT/REASONS FOR BOARD ACTION: The Zoning Board of Appeals held a public hearing on this application on September 12,2019 at which time written and oral evidence were presented. Based upon all testimony, documentation, personal inspection of the property and surrounding neighborhood, and other evidence,the Zoning Board finds the following facts to be true and relevant and makes the following findings: 1. Town Law §267-b(3)(b)(1). Grant of the variance will not produce an undesirable change in the character of the neighborhood or a detriment to nearby properties. The neighborhood consists of single-family waterfront homes. The proposed pergola is landward of the existing home. There is an accessory garage in the front yard of the property which blocks the view of the proposed additions and alterations from the street. The as-built six-foot high fence is covered by vegetation and not visible from the street. In order to remove the fence, the applicant would have to remove some of the vegetative screening which blocks the view of the applicant's pool area. It is in character with the neighborhood for the applicant to maintain the existing vegetative screening and leave the existing fence in place. The applicant may install a code conforming four-foot-high fence once the fence needs to be replaced. 2. Town Law X267-b(3)(b)(2). The benefit sought by the applicant cannot be achieved by some method, feasible for the applicant to pursue, other than an area variance. The existing dwelling was built in 1963 prior to the current zoning regulations. The existing residence has a non-conforming bluff setback and any addition to the existing residence on the seaward side and part of the landward side would require the benefit of an area variance. The benefit sought by the applicant for the non-conforming six-foot high fence in the front yard cannot be achieved without variance relief, although a conforming four-foot-high fence could be installed as a replacement without a variance. However, the removal of the existing fence and/or its replacement with a new conforming fence would require the removal of the applicant's mature vegetative screening which would adversely affect the privacy the dwelling currently enjoys. 3. Town Law 1267-b(3)(b)(3). The variances granted herein are mathematically substantial, representing 16% relief from the code for the bluff setback for the pergola and 50% relief from the code for the fence height. However, the existing residence is 55.8 feet from the bluff and the additional variance relief is requested to i Page 3, September 26,2019 #7230,McLeod SCTM No. 1000-94-1-4 accommodate a pergola that is landward of the residence. The existing as-built six-foot-high fence is buried in mature vegetation and cannot be easily seen from the street or on the subject property. 4. Town Law §267-b(3)(b)(4). No evidence has been submitted to suggest that a variance in this residential community will have an adverse impact on the physical or environmental conditions in the neighborhood. The as built fence and the proposed pergola will cause no storm water management or land disturbance problems. 5. Town Law X267-b(3)(b)(5). The difficulty has been self-created. The applicant purchased the parcel after the Zoning Code was in effect and it is presumed that the applicant had actual or constructive knowledge of the limitations on the use of the parcel under the Zoning Code in effect prior to or at the time of purchase. 6. Town Law §267-b. Grant of the requested relief is the minimum action necessary and to enable the applicant to enjoy the benefit of a second-floor terrace and sunroom addition while preserving and protecting the character of the neighborhood and the health, safety and welfare of the community. RESOLUTION OF THE BOARD: In considering all of the above factors and applying the balancing test under New York Town Law 267-13, motion was offered by Member Dantes, seconded by Member Acampora, and duly carried, to GRANT the variance as applied for, and shown on the Site Plan, dated April 10, 2019 labeled S-1, and the architectural drawings dated January 29, and 30, 2019 labeled Al-A4 all prepared by Mark Schwartz,Architect. SUBJECT TO THE FOLLOWING CONDITIONS: 1. All conditions imposed in ZBA#7230 dated January 17, 2019 remain in full force and effect. 2. If the existing as-built six-foot high fence needs to be replaced in the future, the applicant shall either replace it with a code conforming fence in the front yard area, or re-apply for variance relief. That the above conditions be written into the Building Inspector's Certificate of Occupancy, when issued. Any deviation from the survey, site plan and/or architectural drawings cited in this decision will result in delays and/or a possible denial by the Building Department of a building permit, and may require a new application and public hearing before the Zoning Board of Appeals. Any deviation from the variance(s) granted herein as shown on the architectural drawings, site plan and/or survey cited above, such as alterations, extensions, or demolitions, are not authorized under this application when involving nonconformities under the zoning code. This action does not authorize or condone any current or future use, setback or other feature of the subject property that may violate the Zoning Code, other than such uses, setbacks and other features as are expressly addressed in this action. In the event that an approval is granted subject to conditions, the approval shall not be deemed effective until the required conditions have been met, and failure to comply therewith will render this approval null and void The Board reserves the right to substitute a similar design that is de minimis in nature for an alteration that does not increase the degree of nonconformity. An inventory and evaluation of the site was conducted on August 191h, 2019 with respect tothe proposed property improvements detailed in the Notice of Disapproval letter sent to the applicant on March 291h, 2019.The improvements include add itions/alterations to the existing single-family dwelling including a pergola addition and the legalization of an "as built"fence. The Notice of Disapproval cited the following: Article XX||Section Z8O'116A(1)which states: "All buildings nrstructureslocated onlots upon which there exists a bluff landward of the shore or beach shall be set back notfewer than 100 feetfiromthe top o/such b/uff.^The construction survey notes osetback ofD4feet from the top ofthe bluff, at /tsdosextpoint. Furthermore,the "as built"fence is not permitted pursuant to Article XXII Section 280-105, which states: "Fences, walls orbeams may not 6eerected and maintained, subject to the following height limitations: When located in thefiront yard of residential zones, the same shall not excecdƒourfeet/n6e/ght^ The "as built"fence iosix feet inheight. | observed the site and respectfully submit the following comments: I. The waterfront residential property located at 605 Sound View Avenue Mattituck, NY, is located in a residential area atop a large bluff to the north that leads down to a bullheaded toe along the Long Island Sound's shoreline.The property atop of the bluff is well vegetated with a mix of perennial grasses,trees and shrubs, but also has significant areas under construction that are fallow.The toe of the bluff is supported by a hardened shoreline (bulkhead). During the site visit,the toe of the bluff was not able tobeevaluated due tothe staircase being locked. The bluff face exceeds the RECEIVED 343 AUG S Zoning Board Of Appeals recommended maximum 1:3 ratio, however the bluff is currently stable.The face of the bluff is very steep and consists of several areas with near vertical faces between the top of the bluff and the bulkhead. Although the bluff's face shows an estimated 80%of vegetated cover,there are several areas of concern that should be addressed to ensure the bluff's long-term protection. An existing retaining wall positioned roughly half way up from the toe appears to be in fair condition, but should be monitored. Failing to monitor and manage the angle of repose, runoff and vegetation on the bluff will significantly impact the bluff's long term resilience. As you will see in the photos below, there are several areas of the bluff face that are bare and may contribute to significant soil loss of the bluff, specifically around the staircase and in those unvegetated areas of the bluff's face. In addition,there are number of spots on the bluff that may suffer from erosion derived from runoff from irrigation sprinklers at the top of the bluff. On the east side of the bluff top there are sign of minor gully erosion and lacking vegetation. This erosion may be caused by a sprinkler located in the garden directly atop the bluff.This sprinkler should be removed or changed to a more restrictive emitter as to not discharge any water onto the bluff. Similarly the temporary irrigation measures employed should be carefully monitored as excess irrigation will lead to bluff erosion.To ensure stabilization the bluff, runoff control measures are recommended to capture and covey all stormwater runoff away from the bluff and discharged/infiltrated into the soils to the south of the bluff. It is recommended that the bluff face,top and toe be monitored closely for any changes in the vegetation.Additional stabilization mitigation measures may be required if erosion persists.See attached images. 2. The current structure (single family dwelling)on the property is located close to the top of the bluff and may impact the stabilization and health of the bluff that is adjacent to the structure.These impacts will require periodic monitoring and restoration if deemed necessary by a licensed engineer. See attached images. 3. The proposed improvements to the site include the construction of a pergola attached to the main house and covering the deck between the pool and the primary structure. A pergola is defined as a structure usually consisting of parallel colonnades supporting an open roof of girders and cross rafters. By definition a pergola does not have a solid roof and therefor does not contribute to an increase of the volume of the runoff that is generated from the impervious areas of the property. The drawings supplied by the applicant's architect (Mark Schwartz&Associates)do not indicate the type of roof structure on the pergola or the materials for the sides, if any will be constructed. It is recommended that if side structures or a impervious roof cover are constructed,the runoff generated from these structures be captured and discharged to the south, away from the bluff to minimize the potential impacts from erosion. Even though the proposed construction does not drastically increase the amount of impervious area,special consideration should be taken to ensure that any runoff from these surfaces are collected and discharged in designated areas such as dry wells. It is critical that all runoff from the construction phase as well as post-construction be diverted away from the bluff the structures and any unstabilized soils. Stormwater runoff, stabilization and soil loss is a significant factor when considering the proposed project.See attached images. RECEIVED 73J3 AUG 2 0 2019 ZoningBoard Of Appeals 4. Irrigation use, both temporary and permanent, must be controlled and managed properly to any avoid impacts that they may create.At this site it was observed that both temporary and permanent irrigation was employed at various areas near the top of the bluff. It is recommended that an irrigation professional design a proper irrigation system that ensures minimal irrigation water is used and the direction of the water is away from the top of the bluff. Improper irrigation management can be a significant cause of bluff failure in our region.Spray head location,direction, conveyance seepage and water main leaks are often the catalyst that leads to the degradation of bluffs.See attached images. ' r 5. The March 29, 2019 notice of disapproval from the Town of Southold indicated the"as built"fence was erected outside of the permitted zoning specification.At this time the fence in questions does not pose a major impact, however as the site changes the fence may need to be reevaluated. Removing the existing fence would require the removal of stabilizing vegetation and shrubbery leaving a significant amount of exposed soils that are vulnerable to wind and water erosion and may lead to the degradation of the site. Additional considerations: • All ground disturbance activities have an impact. If soil disturbance is minimized the impacts associated with the activated are significantly decreased. Undisturbed and vegetated areas should be left undisturbed whenever possible. • Protection of existing vegetation is critical to ensuring the long-term stabilization of the property. Protected areas should be clearly identified with,bright colored ribbon and/or fencing prior to the commencement of construction.Additionally,stockpile locations,staging areas and access points must be clearly defined to minimize impacts. • Any improvement that alters the natural course of drainage (ex:structures, impervious surfaces, conveyances,etc.)will increase the impact of stormwater runoff.Consideration should be taken to minimize the impact of runoff during and after construction. Erosion and sediment control measures should be implemented prior to ground disturbing activities. • All efforts should be taken to vegetate and stabilize disturbed soils as soon as possible.See NYS Standards and Specification for Erosion and Sediment Control (`Blue-Book")for additional control measures and considerations. • Construction and the use of heavy equipment may impact the stabilization of soils. Vibrations from machinery as well as soil compaction have adverse impacts. Machinery should not be left to idle and only running when in use.The location and storage of such equipment should be as far away as possible from critical areas such as bluffs and any unstable soils. • It is cautioned that any irrigation should be properly managed to limit the impact and protect the stabilization of the bluff and the surrounding soils. According to the information provided in a letter from the agency dated December 21, 2018, following an inspection conducted on October 26, 2018 with a follow- up visit on November 29, 2018, the agency described the yard as well vegetated in turf grasses and generally flat. Natural slope of the yard does not pose issues for construction in current vegetated state. It was suggested that permeable or semi- permeable pavers for patio be used. Signs of minor erosion were cited on the east side of the bluff top, and the agency suggested that a sprinkler which may have caused the erosion, should be removed. The agency commented that the design shows adequate drainage structures for pool, spa and shower. PROPERTY FACTS/DESCRIPTION: The subject property is a conforming 40,769 square foot waterfront parcel located in an R-40 Zoning District. The parcel has 25,800 square feet of buildable lot coverage. The parcel has 100.72 of bluff frontage along the Long Island Sound. The parcel runs 110 feet along Sound View Ave, 393.97 feet on the West side and 383.50 feet on the East side. The parcel is improved with an existing two story frame house and garage under, a pool, a shed, and a garage under construction. All is shown on a survey prepared by John Metzger,LLS, dated June 19,2018. BASIS OF APPLICATION: Request for a Variance from Article XXII, Section 280-116A(1) and the Building Inspector's August 13,2018,Notice of Disapproval based on an application for a building permit to make additions and alterations to an existing single family dwelling; at; 1) located less than the code required 100 feet from the top of the bluff; at: 605 Sound View Avenue, (Adj. to Long Island Sound),Mattituck,NY. RELIEF REQUESTED: The applicant requests a variance to make additions and alterations to the first and second floor of an existing single family dwelling with a non-conforming bluff setback of 51.8 feet where code requires a 100 foot bluff setback. FINDINGS OF FACT/REASONS FOR BOARD ACTION: The Zoning Board of Appeals held a public hearing on this application on January 3,2018at which time written and oral evidence were presented. Based upon all testimony, documentation,personal inspection of the property and surrounding neighborhood,and other evidence,the Zoning Board finds the following facts to be true and relevant and makes the following findings: 1. Town Law $267-b(3)(b)(1). Grant of the variance will not produce an undesirable change in the character of the neighborhood or a detriment to nearby properties. The neighborhood consists of single family waterfront homes. The proposed additions and alterations are on the North side of the property and away from the public road. There is an accessory garage in the front yard of the property which blocks the view of the proposed additions and alterations from the street. 2. Town Law 4267-b(3)(b)(2). The benefit sought by the applicant cannot be achieved by some method, feasible for the applicant to pursue, other than an area variance. The existing dwelling was built in 1963 prior to the current zoning regulations. The existing residence has a non-conforming bluff setback and any addition to the existing residence on the seaward side would require the benefit of an area variance. 3. Town Law $267-b(3)(b)(3). The variance granted herein is mathematically substantial,representing 49%relief from the code. However, the existing residence is 55.8 feet from the bluff and the additional variance relief is requested to accommodate a small second floor balcony. 'The applicant stated that the proposed balcony will be cantilevered into the'framing of the house; and therefore, will not need any additional excavation or concrete footings disturbing the bluff. 4. Town Law 4267-b(3)(b)(4). No evidence has been submitted to suggest that a variance in this residential community will have an adverse impact on the physical or environmental conditions in the neighborhood. However, the LWRP coordinator recommends that the existing sanitary system be upgraded to an UA OWTS sanitary system, and that a vegetated non-turf buffer be installed along the bluff with planted vegetation native to the area. In addition,the applicant must comply with Chapter 236 of the Town's Storm Water Management Code. The applicant purchased the parcel after the Zoning Code was in effect and it is presumed that the applicant had actual or constructive knowledge of the limitations on the use of the parcel under the Zoning Code in effect prior to or at the time of purchase. 6. Town Law $267-b. Grant of the requested relief is the minimum action necessary and to enable the applicant to enjoy the benefit of a second floor terrace and sunroom addition while preserving and protecting the character of the neighborhood and the health,safety and welfare of the community.
